HomeMy WebLinkAbout02-05-2025 - Citys Witness and Exhibit List CODE23-000293 February 4, 2025 Dear Mr. Hearing Examiner and Mr. Carner, In the absence of a formal pre-hearing order, the City considers the Hearing Examiner’s email of December 29, 2024 as establishing due dates for filing and notice between the parties. That email set 5:00 pm on January 10, 2025 as a deadline for requesting accommodation for disabilities; the City has not received any such requests and therefore has not provided accommodation. The December 28, 2024 HEX Email also noted that “the parties will have the option of written or verbal closings.” The City will exercise its option to have a written closing statement. In his December 13, 2024 email, the Hearing Examiner noted he would accept a response from the City in response to Mr. Carner’s November 8 (“Defense”) email filings “when a due date is set”. With setting a hearing to allow the City to cross examine and provide closing statements, the City will reserve its response to the sufficiency of evidence presented for its closing brief. In its closing brief, the City will also provide the Hearing Examiner with the clarification requested in his 12/13/2024 HEX Email. Specifically, the City will clarify its position on (a) the burden of proof for affirmative defenses presented by Mr. Carner, and (b) occupancy of the travel trailer as regulation of Mr. Carner’s residential use of the property. The December 28 HEX Email set out that Witness and Exhibits Lists are due one week before the hearing.
