EE89714 CASE# 24-6414 OF COLLISION 06/18/24 16:38 OF CbLLI510N NARRATIVE blk suv back from 2wcltl me rear CC Within the city limits of Renton/King/WA I responded to a car v motorcycle near the 16900 block of 116th Ave SE. When I arrived I located a Subaru partially blocking south bound 116th Ave SE and a motorcycle facing northbound laying on its side on the west side of 116th Ave SE. I contacted the operator of the motorcycle/unit 2. He was crying and standing in one spot leaned over. I called for Renton Fire to respond and check him. He told me he had just pulled out of a business parking lot just about 200 feet away. He told me he made a left onto 116th Ave SE and told me he was going about 25 mph when unit 1 suddenly crossed over his lane. Unit 2 was slightly confused about how unit 1 was in his lane but told me he did not see a turn signal. Unit 2 told me he braked both front and rear with so much front braking force he could feel the back of his motorcycle starting to serpentine, which is common with weight transfer. He told me he made contact with the back of unit 1, ejected over his motorcycle, flew over the top of the car and landed passed the front of unit 1 landing on the west sidewalk on his back. Renton Fire checked him on scene and released him with advisement to seek additional medical attention if when his adrenaline wears off he discovers he has any additional injury. His motorcycle required a tow truck but he decided to make arraignments to have it removed on his own. I contacted the driver of unit 1 ID'd by his matching picture WADL. He told me he was stopped in the 2WCLTL. He told me his intention was to back across south lane 116th Ave SE into his driveway. Although there is room to pull in and 3 point turn around. He told me it was clear to proceed with his backing into his driveway. Unit 1 told me he did not see the motorcycle and also said the motorcycle was going very fast. I asked him if he did not see the motorcycle then how does he know it was going too fast. He pointed to the motorcycle and told me by looking at the bike it had to have been going fast. He was insistent that because he had backed into his driveway in the past he was not in the wrong for backing. He continued to argue that he would have seen a pedestrian but did not see the motorcycle, but also the motorcycle was speeding. Based on the damage to the back of unit 1 and the fact it appeared to only be cosmetic damage to the bike. Meaning it did not appear the triple clamp, forks or frame were bent as a result of the collision it did not appear to be a "high speed" collision. The trajectory of unit 2 was consistent with the backing position of unit 1 and contact alignment between unit 1 and unit 2. 1 cited unit 1 Ref RCW 46.61.6045 improper/prohibited backing and ref RCW 46.61.525 negligent driving second degree via complaint. Unit 1 did commit improper backing and negligent driving as the operator or a motor vehicle SHALL not back until it is clear to do so and he was backing from the center left turn lane across the south travel lane which he operates a motor vehicle in a manner that is both negligent and endangers or is likely to endanger any person or property. He caused an unnecessary motorcycle injury collision based on a dangerous practice of backing when he could 3 point turn around in his driveway and deflected any responsibility of this crash based on a clear bias towards motorcycles and their operators.
