I was traveling eastbound on S Grady Way, in the City of Renton, County of King, and State of Washington. While driving in my patrol vehicle, I observe a male driving next to me and waving his arm out the window. He made it seem as though he wanted me to follow him. Once traffic slowed, I was able to drive up next to him and he told me "That guy just hit me" while pointing at another vehicle a few vehicles in front of him. I was unsure which vehicle he was referring to. The male, later identified as Kesean Garrett, yelled "follow me". I aired this information and began to merge over in an attempt to catch up to the vehicles. Once I turned right to go southbound on Talbot Rd S, I saw Kesean following an unknown white sedan very closely. The vehicles were a couple of blocks ahead of me. 1 activated my lights and siren in an attempt to catch up to the vehicles. Once I passed S Renton Village PI, I observed that both vehicles had decided to turn westbound onto S 15th St and pull over. Officer Nugent arrived on scene shortly thereafter. I asked him to contact the driver of the fleeing vehicle (Unit#1) and obtain his information. Officer Nugent advised me of the following information: The driver of Unit#1 was identified via WAID as Mario R Davila Guerrero (DOB 03/12/1999). He did not have a valid driver's license out of the United States of America but did provide his Venezuelan Driver's License, which I can only assume is valid. Mario also advised that he did not have insurance. Mario was read his Miranda Rights which he stated he understood and was willing to speak to Officer Nugent. According to Mario, he was coming from work when the collision occurred. He advised that he is a Door Dash driver and was picking up an order at McDonald's, which is located at 401 S. Grady Way. When he was leaving, the other involved vehicle (Unit#2) came into his lane. The vehicles collided into each other and then he immediately gave chase to Unit#2. 1 asked Officer Nugent to clarify, through language line, that Mario is claiming that he was "chasing" after the other driver, Kesean. I told Officer Nugent to advise that I witnessed the after math of the collision and clearly saw Mario driving away and Kesean following him. I told Officer Nugent to advise that it is a crime to provide false statements to a public servant. While Officer Nugent was speaking to Mario, I began speaking to Kesean. Kesean advised me of the following information: He was driving on S Grady Way and had just turned southbound to head towards the mini mall. While in the parking lot, he made a left hand turn to go down one of the parking lot aisles. He advised that the driver of Unit#1, Mario, was turning out of McDonalds and must not have seen him because he collided with the side of the vehicle he was driving. Kesean stated that Mario then took off and fled the scene. Kesean began to follow Mario and he saw me on S Grady Way. That is when he flagged me down. He then continued to follow Mario until I was able to catch up to the vehicles. I observed damaged on the passengers side door on Unit#2. Unit# 1 had damage to the front of his vehicle. This damage is consistant with Kesean's version of events. However, I can not determine by the damage, and with both vehicles turning at the same time, who is the proxiamte cause for the collision. Photos were not taken of the vehicles at the time. I thought I had asked another Officer to take photos but did not so no photos were taken. Based on the actions that I witnessed, it was clear to me that the driver of Unit#1, Mario, was fleeing the scene and was not planning on stopping. I believe that the only reason that Mario stopped was because he observed my emergency lights behind him. Mario had driven a couple of blocks away from the scene of the collision, at a high rate of speed, and did not stop until I was behind him, visible with my lights and siren. Based on the facts and circumstances listed above, I could not determine who was the proximate cause for the collision. However due to the actions that occurred after the collision there is probable cause that the driver of Unit#1, Mario R. Davila Guerrero (DOB 03/12/1999), committed the crime of `Hit-and-Run—Attended' by being involved in an accident with another vehicle and failing to stop and remain at the scene until fulfilling all statutory duties listed in the RCW (provide name, address, insurance company, policy, vehicle license, driver's license and render reasonable assistance to any This incident occurred in the sCity of Renton,King County,Washington State. !declare underpenalty of perjury under the laws of the State of Washington that the foregoing is true and correct. Based on the facts and circumstances listed above, there is probable cause that the driver of Unit#1, Mario R Davila Guerrero (DOB 03/12/1999), committed the crime of'Making a false or misleading statement to a public servant' by knowingly making a false or misleading material statement to a Police Officer. Mario also violated RCW 46.30.020— Liability Insurance. This is due to the fact that no person may operate a motor vehicle unless the person is insured under a motor vehicle liability policy with liability limits of at least the amounts provided in RCW 46.29.090. Proof of financial responsibility for motor vehicle operation must be provided on the request of a law enforcement officer in the format specified under RCW 46.30.030. 1 cited Mario via complaint for Hit and Run -Attended.
