RMC 4-5-050/4-5-060 No Building Permit
April 16th 2024: The City Renton received an phone call/ verbal complaint about a structure
that was built at: 1137 Harrington Ave NE, Renton WA 98056. Per my research on CorMaps and
Energov, I did not observe any recent building permits on file.
At 10:00 am I left City Hall and conducted inspections. At 10:36 I arrived at the property. I took a
photo with my Code Enforcement issued camera, of the new structure that was attached to the
north side of the home. (Exhibit 1) It is yellow in color and appears to have a large door, near
the drive way.
April 17th 2024: I sent a the first Warning of Violation to Mark St Peter at the mailing address:
407 Lyons Ave NE Renton, WA 98059 (CODE24-000225). (Exhibit 2)
May 21st 2024: I checked Energov to see if there was any new building permits listed and did not
observe any on file. I proceeded to send the second Warning of Violation to Mark St Peter at the
mailing address: 407 Lyons Ave NE Renton, WA 98059 (CODE24-000225). (Exhibit 3)
July 10th 2024: I checked Energov to see if there was any new permits listed. I did not observe
any, therefore I sent a the first Notice of Violation to Mark St Peter at the mailing address: 407
Lyons Ave NE Renton, WA 98059 (CODE24-000225). I included a $100 fine due to the amount of
time given and lack of communication with code enforcement. (Exhibit 4)
July 30th 2024: I received an email from the Finance Division stating that payment has been
received and Finance was asking for an invoice number to complete the transaction. I
immediately invoiced the $100 fine and updated Finance. (Exhibit 7)
August 29th 2024: Mark St. Peter applied for a building permit - B24004399. I made note of that
and was cc’ed on the email by Adrian Alexander, a permit specialist with the City of Renton.

August 30th 2024: Email from Mark To Adrian – stating: “This invoice is for almost $2,900.00”

September 6th 2024: Email from Adrian to Mark. – stating “The fee includes your plan review
fees, the Code Enforcement Investigation Fees and the Permit Fees. The permit total is
$4063.89, the $2872.37 is a portion of that total. It covers the plan review fees and Code
Enforcement Investigation Fees. The remaining balance would be due at issuance. Inspections

September 9th 2024: Email from Mark to Adrian – Stating: “enclosure cost is only around $2500.
Is there a way to reduce some of these fees?” (Exhibit 6- Full Email Chain)

September 19th 2024: Email from Mark to Adrian- Stating “Is there a payment plan available for
this. $4K is a large expenditure…” Adrian replied stating there is no payment plan available.

September 20th 2024: Email from Melissa Kamphaus stated- “Attached is invoice 00145814 for
the submittal fees on permit B24004399.The invoice includes information on how to pay by
cash/check or credit card (Visa/Mastercard only).”

construction consultant to update the construction plan. Do you have a list of providers or

“As the City we are not able to provide any contractors. However I am able to push back
the dates for compliance. I can start with 1/1/2025.
If you are unable to complete the project by that time frame, please contact me directly
and let me know. I am more than happy to work with you.”
February 6th 2025: I sent a the second Notice of Violation to Mark St Peter at the mailing
address: 407 Lyons Ave NE Renton, WA 98059 (CODE24-000225). (Exhibit 5)
Mr. St Peters was made aware of the no building permit violation and paid the initial
$100.00 code enforcement fine. Mr. St peters has been working with the city to obtain a
permit by submitting building plans for review and approval.
Mr. St Peters is required to re-submit plans that meet the City’s minimum construction
requirements and continue his efforts with the permit specialists. As of todays date –
02/20/2025, a permit has not been accepted for review and approval.
I, as code enforcement inspector, my main goal is to identify the violation, notify the
home owner and follow through and monitor the permitting process, to ensure that a
final inspection is completed.

The City has elected to establish a non-judicial hearing and determination system to enforce Renton Municipal Codes (RMC)
civil code violations. Therefore a code violation penalty, consistent with RMC 1~3~2.P is imposed, not including any costs,
fees or assessments. You may respond in the following manner:
I deny creating, permitting to exist, maintaining or failing to eliminate the violation(s) and I am requesting a hearing to
contest this Notice of Violation. Appeal requests must be received by the Renton City Clerk’s office within 15 days of the
date of this Notice of Violation. Please send me a hearing date. I promise to appear on that date. The administrator must
prove by a preponderance of the evidence that I committed the violation. I understand that under RMC 1-3-2.G that the
administrator shall decide whether the opportunity to be heard will be only in writing or in person, or both. The city is not
required to call witnesses to testify at the hearing. Pursuant to RMC 1-3-2.K, failure to attend the scheduled hearing
makes the Notice of Violation final, and I may be subject to additional costs if I fail to withdraw or resolve my appeal prior

leave the date stamp, permit number and version intact on all those sheets.
3. Flatten the newly revised plan set and submit it as your revision.

We do not have a payment plan. These investigation fees will need to be paid. For now, and in order to keep this moving, I will remove the Code Case Fees from this invoice (00145814) so you will at least pay the required
plan review fees. Plan review was completed so once paid; I can share the plan review comments with you. The Code Enforcement fees will be due prior to permit issuance. You are welcome to discuss them with the Building
Official.

Unfortunately, no. I will try and breakdown how we come up with the fees if that helps.
We charge $165.67 per square foot. Your enclosure is 158 sq ft. 165.67 x 158= $26,175.86 valuation. When you plug that into the formula located on our Fee schedule it breaks down like this:

On top of the usual plan review, permit and technology fee, we charged a code case investigation fee of 2x the permit fee for construction without the benefit of a permit. The invoiced amount is due at intake and the
remainder at issuance. You are welcome to appeal to the Building Official who I have CC’d.

The fee includes your plan review fees, the Code Enforcement Investigation Fees and the Permit Fees. The permit total is $4063.89, the $2872.37 is a portion of that total. It covers the plan review fees and Code
Enforcement Investigation Fees. The remaining balance would be due at issuance. Inspections are included with the permit fees.

The City has elected to establish a non-judicial hearing and determination system to enforce Renton Municipal Codes (RMC)
civil code violations. Therefore a code violation penalty, consistent with RMC 1-3-2.P is imposed, not including any costs,

I deny creating, permitting to exist, maintaining or failing to eliminate the violation(s)and I am requesting a hearing to
contest this Notice of Violation.Appeal requests must be received by the Renton City Clerk's office within 15 days of the
date of this Notice of Violation. Please send me a hearing date. I promise to appear on that date. The administrator must
prove by a preponderance of the evidence that I committed the violation. I understand that under RMC 1-3-2.G that the
administrator shall decide whether the opportunity to be heard will be only in writing or in person, or both. The city is not
required to call witnesses to testify at the hearing. Pursuant to RMC 1-3-2.K,failure to attend the scheduled hearing
makes the Notice of Violation final, and I may be subject to additional costs if I fail to withdraw or resolve my appeal prior
to the hearing date. I also understand that the city has not waived any rights or remedies under the law.
