LO \J14) CLD CD WHEREAS, the District requires an easement for a sanitary sewer water C:fines across Grantors' property at a location more specifically described Mbreinbelow; CD (:) NOW, THEREFORE, in consideration of —O — N-- and other good cNand valuable consideration in hand paid, receipt of which is hereby acknowledged, nd in consideration of the performance by the District of the covenants, terms nd conditions hereinafter set forth, Grantors hereby grant, convey and quit- (NI laim to the District the following easement: SEE ATTACHED EXHIBIT "B". Said easement is for the purpose of installing, constructing, operating, main- -,taining, removing, repairing, replacing and using sanitary sewer and/or water lines and appurtenances thereto, as designated above, together with the non- exclusive right to ingress to and egress from said portion of Grantors' property for the foregoing purposes. This easement is granted subject to and conditioned upon the following terms, conditions and covenants which'the parties hereby promise to faithfully and fully observe and perform: 1. USE OF PROPERTY BY GRANTORS. The Grantors shall retain the right to use the surface of the easement if such use does not interfere with installa- tion of the sanitary sewer and/or water lines. The Grantors shall not erect buildings or structures of a permanent nature on the easement during the existence of said easement. 2. THE DISTRICT'S USE AND ACTIVITIES. The District shall exercise its rights under this Agreement so as to minimize and avoid, insofar as possible, damage to any private improvements on the easement herein. If any such damage occurs, the District shall repair and/or replace said improvements. 3. RESTORATION. The District will restore Grantor's property to a condi- tion as good as or better than the premises were prior to entry by the District. Photographs will be taken prior to construction on said property to assure the „completeness of restoration. Final restoration will include, but shall not be limited to, sod replacement in existing lawns, hydroseeding in unimproved areas, Mreplanting of existing shrubs and bushes or replacement of same. Large trees LO which exist within the permanent easement may be removed during construction c--)unless otherwise noted in this easement document. Fences, rockeries and con- ocrete, asphalt and/or gravel driveways, etc. will be repaired or replaced. C:D 4. CONSIDERATION. The Grantors acknowledge that part of the above-men- tioned consideration being paid by the District is compensation for any and 1/4-d all damage resulting to, or resulting hereafter from the possible interference CD of the natural flow of surface waters, subsurface waters and/or groundwaters by the District's digging on the easement. Said digging may disturb the soil CN composition within said easement. CD CD 5. ATTORNEY'S FEES. In case suit or action is commenced against the Grantors or the successors, heirs or assigns of said Grantors, for removal of an encroachment from this easement, the Grantors hereby promise to pay, in addition to costs provided by statute, such sum as the court may adjudge reasonable as attorney's fees therein. 6. EASEMENT TO BIND SUCCESSORS. This easement, during its existence, shall be a covenant running with the land and shall be binding on the successors, heirs and assigns of both of the parties hereto.
