HomeMy WebLinkAboutAddendum - 3AMENDMENT NO. 3 TO AGREEMENT FOR 116TH AVE SE SIDEWALK PROJECT CAG-23-387 THIS AMENDMENT, dated for reference purposes only as February 10, 2025, is by and between the City of Renton (the “City”), a Washington municipal corporation, and Shea Carr and Jewell, Inc (dba SCJ Alliance) (“Consultant”), a Washington Corporation. The City and the Consultant are referred to collectively in this Amendment as the “Parties.” Once fully executed by the Parties, this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Consultant under Agreement CAG-23-387, dated November 9, 2023, to provide necessary services for the 116 th Ave SE Sidewalk Project (referred to herein as the “Agreement”); Whereas, the Parties wish to amend the Agreement to change the scope of work, and change the compensation in order to complete storm water drainage report, updated construction cost estimate, and collect additional survey. NOW THEREFORE, It is mutually agreed upon that CAG-23-387 is amended as follows: 1. Scope of Work: Section 1, Scope of Work, is amended to add work as specified in Exhibit A-3, which is attached and incorporated herein. 2.Time of Performance: Section 3, Time of Performance, is amended pursuant to the schedule(s) set forth in Exhibit A-3. All Work shall be performed by no later than December 31, 2025. 3.Compensation: Section 4, Compensation, is amended so that the maximum amount of compensation payable to Consultant is increased by $25,375.95 from $241,128.35 to $266,504.30, including any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actually performed according to the rate(s) or amounts specified in Exhibit A-3, which is attached and incorporated herein. 4.All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. This amendment (Amendment #3) covers added design efforts associated with the following design changes: i Added utility coordination effort i Addressing additional City comments on the final Drainage Report submitted in November 2024 i Addition of Cultural Resources documentation i Addition of geotechnical investigation to provide pavement design Assumptions The following assumptions were made to establish the scope and budget for this project. Changes to these assumptions may require an amendment to this scope of work. i The scope and fee estimate in this Amendment #3 assumes the project will go out to advertise before June 2025. i The contract duration has been extended through December 31, 2025. i All assumptions and work in the original project contract, Amendment #1 and Amendment #2 still apply, unless otherwise noted in this amendment. Phase 1 Management/Coordination/Administration (Modified) The level of effort included in the fee estimate covers the additional effort to manage the project due to the scope change, including contract and subconsultant administration. This work is to assist Soos Creek Water and Sewer District with their relocation of the hydrants. Please see the attached scope of work prepared by MTN2Coast. Phase 3 Conceptual Design No changes. Phase 4 Utility Coordination (Modified) Task 1 Utility Coordination (Modified) The level of effort included in the fee estimate covers the additional effort associated with added utility coordination due to complexity of coordination with regards to Soos Creek Water and Sewer District. Phase 5 60% Design No changes. Phase 6 SEPA Checklist No changes. Phase 7 100% Design Task 1 100% Design Plans The level of effort included in the fee estimate covers the additional effort to revise the design plans for the revisions to the pavement section as recommended by the geotechnical engineer. Task 2 100% Project Manual The level of effort included in the fee estimate covers the additional effort to revise the project manual for the revisions to the pavement section as recommended by the geotechnical engineer. Task 3 100% Design Cost Estimate The level of effort included in the fee estimate covers the additional effort to revise the design cost estimate for the revisions to the pavement section as recommended by the geotechnical engineer. Task 4 Full Drainage Report (Modified) The level of effort included in the fee estimate covers the additional effort to address the City’s additional comments from the final Drainage Report submitted with the 60% resubmittal. Addressing additional revisions resulting from City comments on the Final report will require an additional amendment. Phase 8 Bid Documents No changes. Phase 9 Management Reserve Part of the funding for this request will be sourced from the Management Reserve Fund. Phase 10 Cultural Resources (New) Task 1 Cultural Resources (New) Task 1.1 Background Research and Records Review: The consultant will conduct a review of soils and geomorphological information, development history of the project area, County Assessor’s records, DAHP’s Washington Information System for Architectural and Archaeological Records Data (WISAARD) database for previous sites and surveys within one mile of the project alignment, EPA’s NEPAssist Data, and other pertinent environmental and historical sources. Task 1. 2 Reporting and Deliverables: the consultant will prepare the DAHP EZ/Project Form in compliance with GEO 21-02. The form will contain information gathered in the background research and records review, along with project specific information about the proposed action. The consultant will submit a draft EZ form to the City for review. Any comments will be addressed and a revised form will be provided to the City for final submittal to DAHP and any concerned Tribes. Assumptions i Project plans, detailed project description, shapefiles, and previous communication with agencies and Tribes will be provided by the City. i The City of Renton will conduct formal consultation with DAHP and the Tribes. i If DAHP determines that an archaeological survey or history property inventory forms are required, an amendment to this scope of work may be required.
