EF18322 CASE# 24-9981 OF COLLISION 09/23/24 15:03 OF CbLLI510N NARRATIVE 24-9981 On 09/23/2024 at approximately 1504 hours, I was dispatched to a motor vehicle versus pedestrian injury collision at the intersection of Duvall Ave NE and NE 10th Street, within the city limits of Renton, County of King, Washington. While en route, dispatch advised that one pedestrian was struck by a single vehicle and that both parties were still on scene on Duvall Ave NE. At 1505 hours, I arrived on scene and contacted the involved parties. The pedestrian was sitting on the sidewalk with visible injuries to the back of his head, left arm, and left leg. These injuries consisted of large scrapes which were actively bleeding. The Renton Regional Fire Authority (RRFA) later arrived on scene and treated the pedestrian, later identified by DOL photo as AISPURO, KADEN L (DOB 02/07/2008). AISPURO was visibly upset, crying, and clearly in pain. I contacted the driver of the only involved vehicle, and positively identified her via pictured WADL as RASMUSSEN, PENNY M (DOB 04/29/1943). Her vehicle, a maroon 2020 Subaru Ascent (WA Lic# BRW1834), had no visible damage. RASMUSSEN the following: RASMUSSEN was the sole occupant of her vehicle and was traveling westbound on NE 10th ST when she reached the intersection of Duvall Ave NE and stopped at the traffic light-controlled intersection. After RASMUSSEN received a green light, she proceeded out into the intersection with the intent to make a left (southbound) turn onto Duvall Ave NE. RASMUSSEN stated she did not see AISPURO in the crosswalk. RASMUSSEN later made a statement that she was not sure "why he kept walking" in reference to AISPURO crossing. Unit#1 struck AISPURO in the crosswalk. RASMUSSEN claimed that she never saw AISPURO. AISPURO relayed the following: AISPURO was walking eastbound on NE 10th ST on the south sidewalk. AISPURO reached the intersection at Duvall Ave NE and prepared to cross the roadway via the marked crosswalk. AISPURO stated he received the walk sign and began to cross the roadway. Upon reaching near middle of the crosswalk, AISPURO was struck by Unit#1. An independent witness, identified as Bui, Chris R (DOB 10/05/2009), stated that AISPURO had an active walk sign for his direction of travel and believed he had right of way to cross the roadway at that time. Based on the above statements, I determined RASMUSSEN was the proximate cause for the collision based on the failure to yield the right of way to a pedestrian, which is a violation of RCW 46.61.235 -Stop for pedestrians in crosswalks or unmarked intersections. Per RCW 46.61.235, the operator of a motor vehicle shall stop and remain stopped to allow a pedestrian to cross the roadway upon which the vehicle is traveling. Based on the pedestrian being in a clearly marked crosswalk in daylight hours, I will be submitting a driver's license retest of RASMUSSEN through the Washington State Department of Licensing (DOL).
