The owner indicates that the tree has major decay and falling limbs have damaged neighboring property in a recent windstorm. Photo evidence provided by the applicant includes fallen tree limbs crushing the neighboring property’s fence, as well as visible decay of the trunk (Attachments A & B). The subject property is approximately 21,795 square feet (0.50 acres) in area and is situated within the Residential-8 (R-8) zone and within the Kennydale Community Planning Area. The applicant is proposing to remove the failing maple tree, aiming to mitigate additional risk of damage to the neighboring property. According to City of Renton (COR) maps, there is a Category II wetland, as well as moderate landslide hazards, regulated slopes >15% & <=40%, and high erosion hazards on the subject property. CRITICAL AREA: A Category II wetland, as well as moderate landslide hazards, regulated slopes >15% & <=40% EXEMPTION JUSTIFICATION: Renton Municipal Code, Section 4-3-050C.3.c.iii Dangerous Trees: Docusign Envelope ID: 3E91F74B-3E27-4ECF-B328-CD19C3382C4C City of Renton Department of Community & Economic Development Routine Vegetation Management Permit Bogdan Tree Removal LUA25-000027, RVMP, CAE Permit Date: March 13, 2025 Page 2 of 6 Routine Vegetation Management Permit and Critical Areas Exemption Removal of non-native invasive ground cover or weeds listed by King County Noxious Weed Board or other government agency or dangerous trees, as defined in Chapter 4-11 RMC which have been approved by the City and certified dangerous by a licensed landscape architect, or certified arborist, selection of whom to be approved by the City based on the type of information required. Limited to cutting of dangerous trees; such hazardous trees shall be retained as large woody debris in critical areas and/or associated buffers, where feasible. RMC 4-3-050C.3.c.iii EXEMPT, PROHIBITED AND NONCONFORMING ACTIVITIES: Activities taking place in critical areas and their associated buffers and listed in the “Exempt Activities – Permitted Within Critical Areas and Associated Buffers” table are exempt from the applicable provisions of Section 4-3-050, provided this letter of exemption has been issued. ROUTINE VEGETATION MANAGEMENT REVIEW CRITERIA 4-9-195D.4: YES 1. The lot shall comply with minimum tree density requirements pursuant to RMC 4-4-130, Tree Retention and Land Clearing Regulations. Staff Comments: In accordance with RMC 4-4-130H, compliance with tree credit requirements necessitates a minimum of 30 tree credits per net acre. The subject property, which is approximately 21,795 square feet (0.50 acres). Based on the property size, fifteen (15) trees are required to meet the minimum tree density requirement (30 tree credits/acre × 0.2 acres = 15 credits). The applicant’s description of the trees on site (Attachment A), and the Tree Retention and Credit Worksheet created by staff based on the applicant’s information (Attachment C) indicate that there is one (1) failing maple tree of landmark or significant size, on the periphery of the site’s wetland buffer within the Native Growth Protection Easement and is proposing removal. Forty-two (42) trees are proposed to remain. Landmark trees are classified as trees with a caliper of twenty-four inches (24”) or greater, except for big leaf maples, black cottonwoods, and red alder trees, which qualify as landmark trees with a caliper of thirty inches (30”) or greater. The tree is a thirty foot (30’) tall maple tree, however, the applicant has not provided an arborist report specifying the exact type of maple, or it’s circumference. Given this limited information, staff is reviewing the application as if it holds a landmark tree status. According to the applicant’s estimation, there are approximately forty-two (42) trees on the property ranging from significant to landmark size. These include one (1) deciduous tree measuring twenty feet (20') in height; twenty (20) evergreen trees at twenty feet (20') in height each; seven (7) evergreen trees at thirty feet (30') in height each; one (1) maple tree at fifteen feet (15') in height; two (2) deciduous trees at ten feet (10') in height each; five (5) deciduous trees at thirty feet (30') in height each; and six (6) maple trees ranging in height from forty to fifty feet (40–50'). The retention of the remaining forty-two (42) trees on the property would maintain the minimum tree density for the subject property. YES 2. The land clearing and tree removal shall be consistent with restrictions for critical areas, pursuant to RMC 4-4-130, Tree Retention and Land Clearing Regulations, and RMC 4-3-050, Critical Areas Regulations. Docusign Envelope ID: 3E91F74B-3E27-4ECF-B328-CD19C3382C4C City of Renton Department of Community & Economic Development Routine Vegetation Management Permit Bogdan Tree Removal LUA25-000027, RVMP, CAE Permit Date: March 13, 2025 Page 3 of 6 Routine Vegetation Management Permit and Critical Areas Exemption Staff Comments: City of Renton (COR) maps has identified a Category II wetland, as well as moderate landslide hazards, regulated slopes >15% & <=40% onsite. A critical areas exemption certificate is a component of this decision due to the presence of a category II wetland on site. The category II wetland designation is based on the historical record on file with the City, in which a wetland assessment was provided with the establishment of The Marshall Short Plat (LUA99-039) (Attachment D). Staff does not anticipate that the proposed removal would have any negative environmental impact on the wetland or wetland buffer. Additionally, moderate landslide hazards, regulated slopes >15% & <=40% do not fall within the threshold of critical area regulation. However, due to the presence of the wetland, as a condition of approval, staff would require the applicant to leave a ten foot (10)tall wildlife snag to mitigate the risk posed by the failing tree. The remaining tree debris would remain on site to provide habitat to the wetland area. Refer to the Critical Area Exemption Findings below for additional exemption information. Removal of the tree aligns with the restrictions for critical areas, as outlined in RMC 4-4-130, Tree Retention and Land Clearing Regulations and RMC 4-3-050, Critical Area Regulations. YES 3. Removal of a landmark tree shall meet the review criteria for removal off landmark tree, pursuant to RMC 4-4-130, Tree Retention and Land Clearing Regulations. i. The tree is determined to be a high-risk tree; or ii. The tree is causing obvious physical damage to buildings (over two hundred (200) square feet), driveways, parking lots, or utilities, and it can be demonstrated to the Administrator’s satisfaction that no reasonable alternatives to tree removal exist, including tree root pruning, tree root barriers, tree cabling, or preventive maintenance, such as cleaning leaf debris, deadwood removal, or directional/clearance pruning; or iii. Removal of tree(s) to provide solar access to buildings incorporating active solar devices. Windows are solar devices only when they are south-facing and include special storage elements to distribute heat energy; or iv. The Administrator determines the removal is necessary to achieve a specific and articulable purpose or goal of this Title. Staff Comments: According to RMC 4-4-130F.2.c.i, a landmark tree may be removed if it is determined to be high risk. In RMC 4-11-200, a high-risk tree is classified as such if it has a probable or imminent likelihood of failure; and a medium or high likelihood of impact; and the consequences of failure for the tree are significant or severe. There was no ISA Tree Risk Assessment Qualification form provided, thus the following information is based on the supplemental information submitted by the owner. According to the property owner, a large branch of the maple broke off and crushed a fence on the neighbor’s property to the north (3783 Monterey CT NE, APN 5592150050) during a storm in November of 2024. In addition, the photos further demonstrate that the majority of the tree’s trunk structure is dead or dying by the amount of decay visible on the tree’s structure (Attachment B). Since the tree demonstrated the severe consequences of impact and imminent likelihood of failure, staff concurs that the tree should be removed due to criteria i in RMC 4-4-130F.2.c being satisfied. N/A 4. Street frontage and parking lot trees and landscaping shall be preserved unless otherwise approved by the Administrator. Staff Comments: Not applicable. The subject tree is not a street frontage tree nor a parking lot tree. Neither street frontage nor parking landscaping is proposed to be removed. N/A 5. The land clearing and tree removal shall not remove any landscaping or protected trees required as part of a land development permit. Staff Comments: Not Applicable. The tree was not required as part of a land development permit for landscaping or tree requirements. Neither street frontage nor parking landscaping is proposed to be removed. YES 6. The land clearing and tree removal shall maintain visual screening and buffering between land uses of differing intensity, consistent with applicable landscaping and setback provisions. Staff Comments: The high-risk tree proposed for removal is adjacent to lots with detached dwellings. Removal of this tree would not remove any required visual screening and/or buffering between land uses of equal intensity. YES 7. The land clearing and tree removal shall not create or contribute to a hazardous condition, such as increased potential for blowdown, pest infestation, disease, or other problems that may result from selectively removing trees and other vegetation from a lot. Staff Comments: Submitted documentation did not indicate that the removal of the tree would create or contribute to a hazardous condition, rather the documentation indicated that it could cause greater damage to safety, and infrastructure in the future if retained. N/A 8. The land clearing and tree removal shall be consistent with the requirements of the Shoreline Master Program, pursuant to RMC 4-3-090F1, Vegetation Conservation, and RMC 4-4-130, Tree Retention and Land Clearing Regulations. Staff Comments: Not applicable. The property is not located within shoreline jurisdiction. The activity is not prohibited by this or any other provision of the Renton Municipal Code or State or Federal law or regulation; Staff Comments: Removal of this tree is not prohibited by this or any other provision of the Renton Municipal Code or State or Federal law or regulations. Approval of this exemption would act as written permission to allow the removal of the maple tree. YES ii. The activity will be conducted using best management practices as specified by industry standards or applicable Federal agencies or scientific principles; Staff Comments: The removal process of the remaining portions of the tree being snagged at a height of eight to ten feet (8-10’) tall is aimed at minimizing impacts on the surrounding wildlife, neighboring structures, and residents, with a specific focus on removing only the tree determined to be failing. The applicant did not identify how the disturbed wetland buffer areas were going to be restored after tree removal. Therefore, staff recommends as a condition of approval, that the applicant reduce the height of the remaining portion of the high-risk maple tree, located within the subject property, to a safe height (approximately eight to ten feet (8- 10’) tall and the failing tree shall be left as an environmental habitat snag as determined by the Current Planning Project Manager. No additional vegetation removal is proposed. YES iii. Impacts are minimized and, where applicable, disturbed areas are immediately restored; Staff Comments: The removal process is aimed at minimizing potential damage to people and structures while maintaining the slope and wetland buffer habitat. This is accomplished through the measures written in FOF ii above. YES iv. Where water body or buffer disturbance has occurred in accordance with an exemption during construction or other activities, revegetation with native vegetation shall be required; Staff Comments: The removal of the tree to a ten foot (10’) tall wildlife snag would not require additional planting as it is not a full removal of the tree. See FOF ii above, for staff’s recommended condition of approval to protect the existing wetland habitat and surrounding improvements. N/A v. If a hazardous material, activity, and/or facility that is exempt pursuant to this Section has a significant or substantial potential to degrade groundwater quality, then the Administrator may require compliance with the Wellhead Protection Area requirements of this Section otherwise relevant to that hazardous material, activity, and/or facility. Such determinations will be based upon site and/or chemical-specific data. Staff Comments: Not applicable. The proposal does not include a significant or substantial potential to degrade groundwater quality. DECISION: The Bogdan Tree Removal Routine Vegetation Management Permit and Critical Areas Exemption, LUA25-000027, RVMP, CAE is Approved with Conditions*. The approval body may modify his decision if material evidence not readily discoverable prior the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on March 27, 2025. An appeal of the decision must be filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted electronically. I heard a lot of loud noises during the windstorm and the morning after I could see that part of the 30ft Maple Tree fell down. Furthermore, my neighbor shared pictures from his property of how this tree broke his fence, crashed into his roof and created a hole all the way down to the second floor of his house. You can see the damage to the tree, condition of tree and damage it caused to my neighbor’s house in the images and videos I provided. Please see originally provided narrative below. • I am requesting approval to remove the remaining elements of a Maple Tree that fell on my neighbor's house during the recent windstorm. There are dead and dying trunks/branches coming out of the same tree base that collapsed onto my neighbor's house - breaking his fence and causing damage to his roof. The neighbor flagged that he is concerned about the remaining tree falling onto his property and asked if I can have it removed (his email request in the attached PDF as well). Given the damage this tree has already caused and the dead/dying remaining elements of this tree, I believe this is a high-risk tree that poses an imminent threat to my neighbor's house and property and I do not want to be found liable for damages if it comes down in an upcoming storm. Therefore, I am requesting the city's permission for me to remove the tree. 2) Describe how the tree will be removed from the site and any mitigation expected for removal. • Tree will be cut down by a professional company.
