materials. The Contractor may need to excavate additional test pits during the course of
work to assess tainted soils which would need to be exported. This Change establishes pay
items for the work to excavate test pits for the evaluation of tainted soils.
Because petroleum tainted material cannot be accepted at standard export sites or
disposed of under the original unit prices in the proposal, a new unit price has been
established to cover the costs associated with the disposal of petroleum-tainted soils.
Equitable Adjustment:
This Change Order does include an equitable adjustment per Section 1-09.4 of the 2022
WSDOT/APWA Standard Specifications. See attached.

36-A202 -Excavation of Test Pits for Tainted Soils and Water for Storm Sewer
An independent estimate was prepared for the cost to excavate test pits to identify the
extent of tainted soils and water for storm sewer. This cost was calculated to be
$21,657.60. The Contractor's quote of $40,000.00 is rejected because of overestimated
quantity. The estimated cost of excavation of test pits for tainted soils and water for
storm sewer is $22,000.00.
36-A203 -Disposal of Petroleum Tainted Materials Incl. Haul for Storm Sewer
An independent estimate was prepared for the cost to dispose of tainted soils and water
for storm sewer. This cost was calculated to be $34,245.69. The Contractor's quote of
$63.46 per ton is accepted, and the estimated cost to dispose of tainted soils and water
for storm sewer is $25,384.00.
36-B43 -Excavation of Test Pits for Tainted Soils and Water for Water
An independent estimate was prepared for the cost to excavate test pits to identify the
extent of tainted soils and water for water. This cost was calculated to be $3,248.64.
The Contractor's quote of $5,000.00 is rejected because of overestimated quantity. The
estimated cost of excavation of test pits for tainted soils and water for water is
$3,000.00.
36-B44 -Disposal of Petroleum Tainted Materials Incl. Haul for Water
An independent estimate was prepared for the cost to dispose of tainted soils and water
for water. This cost was calculated to be $4,236.62. The Contractor's quote of $63.46

2.Measurement:
SP 8-35.4 Measurement is supplemented as follows:
No specific unit of measurement shall apply to the force account item of
"Excavation of Test Pits for Tainted Soils and Water for Joint Utility Trench".
3.Payment:
SP 8-35.5 Payment is supplemented as follows:
"Excavation of Test Pits for Tainted Soils and Water for Joint Utility Trench", by
force account as provided in Section 1-09.6.
4.Reason for Change: The Contractor encountered tainted soils while excavating
for the joint utility trench. Disposing of contaminated soils exceeding the MTCA
Method A Soil Cleanup Levels for Unrestricted Land Uses is relatively more
expensive than that for tainted soils. To minimize the quantity of soils disposed
as contaminated soils and therefore save project funds, a series of five test pit
sites was identified, excavated, and tested.

8.Equitable Adjustment: This Change Order includes an equitable adjustment per

this entire Change Order is included in section H. of this Change Order.
