Renton Municipal Code Section 4-5-130 Adopts the International Property
Maintenance Code
International Property Maintenance Code Section 302.9 Defacement of Property: No
person shall willfully or wantonly damage, mutilate or deface any exterior surface of any
structure or building on any private or public property by placing thereon any marking,
carving or graffiti.
B. AMENDMENTS:
The following amendments to the Code are hereby adopted:
1. Section 301.2, Responsibility, of the 2018 Edition of the IPMC, is amended to read as
follows:
Responsibility: The owner of the premises shall maintain the structures and exterior
property in compliance with these requirements, except as otherwise provided for in
this code. A person shall not occupy as owner -occupant or permit another person to
occupy premises which are not in a sanitary and safe condition and which do not comply
with the requirements of this section.

August 13, 2024: While driving on NE 24th Street, I observed graffiti on a corner fence at
2315 Blaine Ave NE.
At 11:13 am I attempted to make in person contact. Left my business card on the front
door of the residence as nobody answered the door.
August 14, 2024: A Warning of Violation was sent to Mr. Kazem asking that the graffiti
be removed from the fence by August 24, 2024.The Warning of Violation was sent US
Postal Service Certified #7020 2450 00013898 6236 and regular mail.
September 16, 2024: US Postal Service Certified #7020 2450 0001 3898 6236 was
returned Unclaimed.

October 1, 2024: Site reinspection noted the graffiti remains on the fence.
October 3, 2024: A Warning of Violation Second Notice was sent US Postal Service
Certified #9589 0710 5270 21589592 37 and regular mail.
The Warning of Violation Second Notice was sent to Mr. Kazem asking that the graffiti
be removed from the fence by October 17, 2024.
October 7, 2024: Warning of Violation Second Notice US Postal Service Certified #9589
0710 5270 21589592 37 was returned to the city signed by Brian Kazem.

January 2, 2025: A site reinspection on noted the graffiti remains on the fence.
An email with photos was sent to Mr. Kazem asking him to remove the graffiti from his
fence. No response was received.

February 11, 2025: A site reinspection on noted the graffiti remains on the fence.
February 12, 2025: A Notice of Violation and Order to Correct was sent was sent US
Postal Service Certified #9589 0710 5270 2158 9573 87 and regular mail.
The Notice of Violation and Order to Correct was sent to Mr. Kazem asking that the
graffiti be removed from the fence by February 27, 2025.

February 26, 2025: Mr. Kazem and I had a phone conversation about removing the
graffiti. He did not agree with me that he had to remove the graffiti. I suggested he
appeal the February 12, 2025, Notice of Violation and Order to Correct and emailed him
the appeal form.
Received the appeal form for the February 12, 2025, Notice of Violation and Order to
Correct via email.

Code Text: RMC 4-5-130; IMPC Section 302.9 Defacement of Property. No person shall willfully or
wantonly damage, mutilate or deface any exterior surface of any structure or building on any
private or public property by placing thereon any marking, carving or graffiti.
It shall be the responsibility of the owner to restore said surface to an approved state of
maintenance and repair.
Corrective Action: While we sympathize that you as a business/property owner are a victim of this vandalism, you
have the responsibility to correct the problem by removing or painting over the graffiti as soon
as it appears on your property.
Many cities have discovered that a quick response in removing graffiti often discourages the
vandals from "tagging" the property again. In many instances when the graffiti is removed,
retagging reoccurs. Graffiti removal may be ongoing until the vandals give up, because of your
efforts.
We are requesting that you remove all graffiti from your fence.
The City and your neighbors thank you for your cooperation in this matter.

Compliance Inspector revealed violation(s) of the City of Renton Municipal Code and Ordinances listed below.
Compliance or corrective action must be completed by 2/27/2025.
The violation(s) listed below are deemed a Class 1 Civil Infraction pursuant to Chapter 7.80 RCW, and any such

dollars ($500), the second criminal violation shall have a mandatory minimum sentence of fifteen (15) days in jail
without the option of electronic home detention, and the minimum penalty for the second violation shall be six
hundred twenty five dollars ($625), the third criminal violation for any individual shall have a mandatory minimum
sentence of thirty (30) days in jail without the option of electronic home detention, and the minimum penalty for
the third violation shall be seven hundred fifty dollars ($750) [RMC 1 -1 0-7.A.2].

NOTICE OF RENTON MUNICIPAL CODE VIOLATION
Date: 2/12/2025
The City has elected to establish a non -judicial hearing and determination system to enforce Renton Municipal Codes (RMC)
civil code violations. Therefore a code violation penalty, consistent with RMC 1-3-2.P is imposed, not including any costs,
fees or assessments. You may respond in the following manner:
❑ I deny creating, permitting to exist, maintaining or failing to eliminate the violation(s) and I am requesting a hearing to
contest this Notice of Violation. Appeal requests must be received by the Renton City Clerk's office within 15 days of the
date of this Notice of Violation. Please send me a hearing date. I promise to appear on that date. The administrator must
prove by a preponderance of the evidence that I committed the violation. I understand that under RMC 1-3-2.G that the
administrator shall decide whether the opportunity to be heard will be only in writing or in person, or both. The city is not
required to call witnesses to testify at the hearing. Pursuant to RMC 1-3-2.K, failure to attend the scheduled hearing
makes the Notice of Violation final, and I may be subject to additional costs if I fail to withdraw or resolve my appeal prior
to the hearing date. I also understand that the city has not waived any rights or remedies under the law.

NOTICE OF RENTON MUNICIPAL CODE VIOLATION
The City has elected to establish a non -judicial hearing and determination system to enforce Renton Municipal Codes (RMC)
civil code violations Therefore a code violation penalty consistent with RMC 1-3-2.P is imposed, not including any costs
fees or assessments You may respond in the following manner
I deny creating permitting to exist maintaining or fading to eliminate the violation(s) and I am requesting a hearing to
ontest this Notice of Violation. Appeal requests must be received by the Renton City Clerks office within 15 days of the
date of this Notice of Violation. Please send me a hearing date I promise to appear on that date The administrator must
prove by a preponderance of the evidence that I committed the violation I understand that under RMC 1-3-2 G that the
administrator shall decide whether the opportunity to be heard will be only in writing or in person or both. The city is not
required to call witnesses to testify at the hearing Pursuant to RMC 1-3-2.K, failure to attend the scheduled hearing
makes the Notice of Violation final and I may be subject to additional costs if I fad to withdraw or resolve my appeal prior
to the hearing date I also understand that the city has not waived any rights or remedies under the law
