b.Theon-rampfromNEParkDr.to1—405SBandtheoff-rampfrom1—405SBtoNE30thStreetwillberepaved.C.TrafficcontrolwillstartatMP4.00at3rdAvewithincityofRentonlimits.Table1below,detailsthenumberofnightsperconstructionactivitythatitwillberequiredthroughthelifeoftheproject.Table1:Projectitemsofwork,totalnumberofnightseuual30non-consecutivenightsItemofworkNumberofnightsIPavementrepair,cracksealingandshoulder_asphaltpaving---RampPavingRoadway4--—Trafficloops6PavementMarking6Total30Theprojectwillincludenighttimeworkwherethezoningvanesfromresidential,hotels,commercial,andlightindustrialzoningdesignation.TrafficLimitationsTheprimaryreasonforconductingnighttimeworkistodecreasethealreadycongesteddaydaytimetrafficcongestionalongthe1-405corridor.Daytimefullandpartialclosuresalongthiswell-traveledrouteareexpectedtocausedisruptionintheurbancirculationaswellasincreasedtraveltimesforthecitizensofRenton.Partialclosuresmayimpactcommercialandbusinesstrafficduringbusinesshoursaswellasdelaystoschoolroutesandnormalroadusers.Furthermore,datashowsthatdaytimeclosurescouldincreasetrafficaccidentsandcompromisethesafetyofworkersandthetravelingpublicwithintheconstructionzones.Attachment2liststheproposedlaneclosuresforI-405highwayandRampsConstructionEquipmentandpredictednoiseimpactsduringnighttimeoperationsTheconstructionequipmentisdescribedinTable2includedinAttachment3alongwiththeestimatednoiselevelpredictiontonearbyreceiversapproximately50feetawayaswellasproposedmitigationmeasures.ProposedNighttimeNoiseMitigationWSDOTwillrequirethecontractortoadheretothefollowingnoisereductionmeasures:1.TheContractorshallusebackupwarningdevices,exceptpuretonebackupalarms,onallvehicles.TheContractormayuseback-upobserversinlieuofback-upwarningdevicesforallequipmentexceptdumptrucksincompliancewithWACChapter296-155-610and296-155-615.TheContractorshalluseback-upobserversandback-upwarningdevicesfordumptrucksincompliancewithWACChapter296-155-610.

JustificationfortheNoiseVarianceRequest.TheApplicantsufferspracticaldifficultiesandunnecessaryhardshipandthevarianceisnecessarybecauseofspecialcircumstances.WSDOTisrequestingthisvariancetoworkatnightbasedonthefactthatthisportionofthe1-405corridorcarries142,000vehiclesperdayandtheexistingsouthboundpavementisshowingsignificantfailure.AlsoatthetworampstoSR900/ParkWayand30thStreetwithinthecityofRentonthepavementhasreachedtheendofitslifecycle.1-405servesasakeyconnectorforcommercial,freightandmotoristuses,andmasstransitwithinthePugetSoundarea;soitspreservationisaddressedintheongoingWSDOThighwaypreservationbudget.Daytimeclosuresfullorpartialtoperformthisworkwould,havethepotentialtospikecongestiononthisnorth-southcorridornegativelyandwouldaffectthecityofRentonarterialsandlocalstreets;consequently,workingatnightwillallowresidents,businessesanddriverstobeabletomaintaintraveltimewhileusingthiscorridor.Thecontractoronthisprojectwillberequiredtoprovideasafeandefficientmovementofpeople,goods,andservicesthroughandaroundtheproject,whileminimizingnegativeimpactstoresidents,commuters,andbusinesses.Inordertomeettheserequirements,itisnecessarythattheworkforthisprojectbedoneatnight.Workingatnightisthebestwaytominimizenegativeeffectsasaresultofconstructionwhichwouldonlyexacerbatetheexistingtrafficconditionsmentionedabove..Thegrantingofthevariancewillnotbemateriallydetrimentaltothepublichealth,welfareorsafety,orundulyinjurioustothepropertyorimprovementsinthevicinityofthelocationforwhichthisvarianceissought.TemporarynighttimeconstructionisoneofthefewtoolsthatWSDOTimpliestolessentrafficcongestionanddisruptiontohighwayuserswhileimprovingtheroadway.Alongthe1-405pavementrepairprojectwithinthecityofRenton,therearenoisesensitivereceiverseastandwestof1-405.However,themajorityofsensitivereceiversareprotectedbyexistingnoisewallsthatwouldhelptomaintainsoundlevelswithsomenoisepeaksovertheexisting1-405nighttimetrafficbackgroundnoise.Thenoiselevelscomingfromconstructionequipmentwilldiminishwithdistance.A6-dBAnoiseleveldecreasewilloccurwiththedoublingofdistancefromastationarynoisesource.Forexample,anoiselevelof70dBAmeasuredat50feetwouldbe64dBAat100feet,58cIBAat200feetand52cIBAat400feet.Noisealsodecreasesifanobjectinterfereswiththereceiver’slineofsighttothenoisesource.Forresidentswithinthecitylimits,thisattenuationdependsontherelativeelevationofthesourceandthereceiver,andtheheightandlocationoftheinterveningobject.Noiselevelsprojectedforthisprojecthavebeenestimatedthatsomeactivitiesmaygeneratepeaknoiselevelsof64to85dBAheardat50feet.Backgroundtrafficnoiselevelson1-405reachapproximateaveragepeaklevelsupto65dBAatnightat50feetfromthetravellane.Whendistanceisincorporatedintotheassessmentaswellastopographyandtheproposedmitigationmeasures,weestimatethatthenearestresidenceswouldstillnoticethenighttimeworkbutwouldnotbeassevereaswithoutallthelistedmitigation.Citizenswillbeimpactedtotheminimumextentandthereisnopossibilitythatthepublichealthorsafetywillbediminished.Ifanynoiserelatedcomplaintsarereceived,thecontractoralongwiththeagencywillworkonalternativemitigationmeasurestostopthedisruption.
.Thevariancesoughtistheminimumvariancewhichwillaccomplishthedesiredpurpose.Therequestednon-consecutivedaysaretheminimumnumberofnightsrequiredtocompletethisworkandwilladdressthenighttimeworkatdifferentlocationsalong1-405withinthecityofRentonasshownontheprovidedmaps..Thatthevariancecontainssuchconditionsdeemedtobenecessarytolimittheimpactofthevarianceontheresidenceorpropertyownersimpactedbythevariance.Thevarianceapprovalmaybesubjecttoconditions..TheContractorshallusebackupwarningdevices,exceptpuretonebackupalarms,onallvehicles.TheContractormayuseback-upobserversinlieuofback-upwarningdevicesforallequipmentexceptdumptrucksincompliancewithWACChapter296-155-610and296-155-615.TheContractorshalluseback-upobserversandback-upwarningdevicesfordumptrucksincompliancewithWACChapter296-155-610..Trucktailgatebangingisprohibited.Alltrucksshallbesecuredtopreventexcessivenoisefrombanging..AlltrucksperformingexporthaulshallhavewellmaintainedbedlinersasinspectedandapprovedbytheEngineer..Acopyofnoisevarianceshallbekeptontheprojectsiteatalltimes..ProvideaWSDOTcomplaintnumberaswellasalistofdesignatedcontactpersonsforthepurposeofforwardingcomplaints;.TheContractornotifiesresidents,within500feetoftheprojectcorridor,ofnighttimeworkactivitiesatleast14calendardaysinadvanceoftheproposednighttimeconstructionwork..Theimportanceoftheservicesprovidedbythefacilitycreatingthenoiseandtheotherimpactscausedtothepublicsafety,healthandwelfarebalancedagainsttheharmtobesufferedbyresidentsorpropertyownersreceivingtheincreasednoisepermittedunderthisvariance.The1-405existingpavementlifecyclehasreachedthepointthatitneedstoberepairedbythenextconstructionseasonanddelayingtherepairandresurfacingtheexistingpavementwouldcreateafurtherfailingroadwaystructure.Theresurfacingandrepairofthisportionofthehighwaywouldgiveriders,residentsandusersawellmaintainedandsafehighway.ConstructionnoisemitigationmeasuresareabletoaddressorminimizeanyinconveniencetothenearbyresidentssograntingthisvariancewouldnotcauseWSDOTtoadverselyaffectthegeneralpolicyandpurposeoftheordinance..Theavailabilityofpracticablealternativelocationsormethodsfortheproposedusewhichwillgeneratethenoise.
Thenatureofthe1-405asamaincorridorforhighvolumesofusersandinterstatehighwaylimitsalternativelocationsforprojectwork.Anypavementrehabilitationworkmustbecompletedatthelocationofthehighway.WSDOThasworkedtoutilizebestpracticesfornoisereductionintheirmethodologyduringnighttimeworkbyusingtheabovenoisemitigationmeasures.Ifanynoiserelatedcomplaintsarereceived,thecontractoralongwiththeagencywillworkonalternativemitigationmeasurestostopthedisruption..Theextentbywhichtheprescribednoiselimitationswifibeexceededbythevarianceandtheextentanddurationofthevariance.Peaknoiselevelsproducedbyconstructionequipmentisexpectedtorangefrom64to85decibelsatadistanceof50feetfromthesourceofthenoise.Thesesoundlevelsareexpectedtodiminishtoarangefrom56to79decibelsatadistanceof200feetfromthesourceofthenoise.Therequestedvarianceisforatotalof30non-consecutivenights.However,thiswillbeamobileconstructionoperation,meaningthatnoisesourcesandconstructionequipmentwillbeoperatingatdifferentlocationsalongtheprojectareaduringthe30workingnights.Thismobileoperationwillmeanthateachindividualresidentwillonlybeimpactedforafewnights,notall30workingnights.
