drainage facilities shall be m�intained in campliance with the operation and maintenance
schec�ule incluc�ed anc� attacE�ec� t7erein as Exhibit B�— tJperatians and Maintenance. Drainage
facilities inclucle pipes, channels, ffaw control facilities, water quality facilities, an-site best
management practices (BMPs) ancl ather engineered structures d�signed ta manage and/or

treat stormw�ter on the Property. Qn-site BMPs include dispersion ancl infiltration devices,
bioretention, permeable pavem�nts, rainwater harvesting systems, tree retentian credit,
reduced impervious surface footprint, vegetated roafs and ather measures designed to mimic
pre-developed hydrolagy and minimize stormwater runoff on the Praperty.
2. City of Rentan shall have the ri�ht to ingress and egress aver thase partians af the Property
necessary to perform inspections of the stormwater facilities and BMPs and canduck
maintenance activities specified in this Declaration af Covenant and in accordance with the
Renton Municipal Cade. City af Rentan shafl pravide at least thirty (30) days' written notice to
the Owners that entry an the Property is planned fr�r the inspection of drainage facilities. Afiter
the tP�irty (3Cl) c�ays, tP7e Own�r�s shall allow the City of Renton to enter fc�r the sale purpose of
inspecting drainage facilities. In lieu of inspectic�n by the City, the (Jwners may elect ta er�gage
a licensed ciuil engin�er registered in the state of Washingtan who has expertis� in efrainage to
inspect the drainaga facilities anc! pr�ruidP a written report describing their eoneiition. If the
engineer option is chasen,the Uwners sh�ll praviele written notice ta the City af Renton within
fifteen (15) days of receiving the City's notice of inspection.Within thirty(30) days af giving this
notice,the Owners, or en�ineer an behalf of the t�wners, shall pravide the engineer's report to
the City of Rentan. If the report is not provided in a timely manner as specified above, the City
af R�nton may ins�ect thc�c�rair�a�e facilities without further notice.
3. If City of Renton determines from its inspection, or fre�m an engineer's report prc�vided in
accordance with Paragra�ah 2,that mair-�tenance, re�air, restoratian, and/or mitigatian wark is
required ko be done to any of the drainage facilities, City of R�ntan shall notify the Owners of
th� specific maintenar�ce, repair, restoratian, and/ar mitigation work ("Work"} r�quired
pursuant ta the Rentan Munici�aaa Ce�dp. The City shall also set a reasanable deadline for the
awners to complete the Work, ar ta prauide an en�ineer's repart that verifies completion of
the Work. After the d�ar�lin� has passeci, the C7wr��rs shall allc�w the City access to re-inspect
the drainage facilities unless an engineer's repart has been pravided verifying completion of
the Work. If the Work is nat completec� within the time frame set by the City, the City may
initiate an enfarc�m�nt actic�n anc�/or perfr�rm the Work and hereby is �iven access to th�
F'raperty far such purposes. Written notice will be sent to the Owners sfiating the City's
intention ta perform s�ich Work.This Work will not camrnence until at least seven(7)days after
such natice is mailecl. (f, within the sole disc�etion of the City, there exists an imminent or
present dan�er, th� scven (7j day notice period wilf be waived and Work wili begin
immediately.
4. The Uwners shal[ assume all resporosibility for the cost of any Wark, or any measures tal<en by
th� City to acic[r�ss canditians as descrikaed in Paragraph 3. Such responsibility shall include
reimbursement to the City within thirty(30)clays crf the receipt of the invcrice for any such Work
performed. Overclue paym�nts will require payment of interest at the maximum legal rate
allawecl by RCW 19.52.02Ci(eurrently twelve p�rr.er�t(12°fn)). If the City initiates legal aetian to
enforce this agreem�nt, the prevailing party in such actian is entitled to recover reasanable
litigation costs and at:tc�rney's fees.
5. The Qwn�rs are required ta abtain wriften approval from City of Rentc�n priar to filling, piping,
cutting, ar remc�ving ve�etatian (except in routine landscape maintenance) in apen vegetated
starmwater facilities (such as swales, channels, ditches, ponds, etc.), or perfcarming any
alteratians or rnod�fications to the drainage facilities referenced in this Declaratian of Cavenant.

6. Any notice ar consent required to be given or otherwise pravided for by the provisions of this
Agreemerrt shall be effective upon persanal delivery, or three(3) days after mailing by Certified
Mail, return receipt requested.
7. With regard to the matters addressed herein,this agreement constitutes the entire agreement
between the parties, ancl supersedes all prior discussions, negofiiations, and all agreem�nts
wh�tsoever wheth�r oral or written.

Rerston Sunset Gardens is a faur-story mixed-u�e building located at 29Q0 Northeast 10th Street, Renton,
Washingtan (King County Parcel IC7 7227900C175). The 1.39-acre lot will inctude a surface parking lot,
drive aisle, pedestrian watlkways an�1 amenity areas, and landscaping.
This Operation and Maintenance (O&M} Manual is intended far the project owner ance the prajeck is
cnmplete. Renton Housing Autharity will be#he responsible party for maintenance and op�rakion of all
an-site sformwater facilities per Sectic�n 1.2.6 of fhe 2017 City af Ft�nton Surface Water Design Manual
(CQRSWQM}. This Q�M rr�anual wili be kept at a location that can be made availabie ta the Gity af
Renton for inspectian.
The stormwater facilities located on-site generally consist of catch basins for collection; storm drainage
pipes far cranveyance; infiltrating bioreterr�ion planters far water quality tre�tment; starmwater structures
including manhol�s, cleanouts, a flow splitter, and a pump; permeabl� pavers; grauel filled infiltration
trenches; anci rack splash p�ds far Uutfall protection. Descri�tians for all maintenance tasks are provided
in this O&M manuaL Locations and det�iled drawinc�s of each skormwater facility are provided in khe
Techr�ical Inform�tion Repart.
