facilities, Grantee rr�ay from time to time canstruet such additional facilities as it rnay require or
desire. Tk7is easement is granted subject ta tf�e foCiawin�terms and conditiaris:
1. The Gr�ntee shall, uporr corrrpletion af any work within tt�e property covered by the easemenk,
restore the su�face a�the easernent, and any private imprnvements disturbed ar destrayed during
execution of the work, as nearGy as practicabPe to the canc(itio� they wera in ummeciiately before
commencement caf the work ar er�try by the Gr�ntee.
2. Grantor shalk retain the rfgh� tc� use the surface of the easement as iang as such use daes not
interfere with khe easem�nt ri�hts grantec� to the Grantee. Grar�tor shall nat, hcawev�r, h�ve the ri�ht tr�:
n. Erect ear rrcaintain any build�ngs ar structures within the easement;or
b. PCant trees, shrubs or v��etation havin� deep roat patt�rns which may cause damage ta or
interfere with the utilities to be�laced within the easement by the Grantee;or
c. Develop, IancPsca�a�, or beautify the e�semer�t area ir� any way which wcauld unr�asonably
increase the costs ta the Grantee af restcrring the easement are� and any private
improvern�nts Yherein;car

of Grantor in con��ection with this cas�ment. Th� oblig�tian to pratect, save and hald harmless, and cie(end
shall not include such claims, actic,ns, casts,damages, or expens�s which may be e�usecl by the sole negli�ene�
ofi Grantee or its tenant(s),or their successars ar�assigns; Provided that if the clairns actians, costs, d�mages, or
expenses are c�usecl by r�r result frc�m concurrent negli�ence of(a} Grankee ar its tenant(s7, oi�their successors
or assi�ns and (bj Grantor, its agents, ccantractors or assigras, �nd invc�lv�s thcrse actians cavered by RCW
4.24.�.15,this inctemnity provisipn shall be vafid and enforce�bfe anly to the extenC af the negligence of Grantor,
