HomeMy WebLinkAboutC_2nd Extension Request_Solera_2025040.pdf April 9, 2025 Phil Olbrechts City of Renton Hearing Examiner olbrechtslaw@gmail.com Subject: Solera Master Plan and Preliminary Plat / LUA18-000490 and LUA20-000305 1-year Extension Request Dear Mr. Olbrechts: The Planning Division of the City of Renton received a one (1) year extension request for the Solera Master Plan and Preliminary Plat (LUA18-000490 and LUA20-000305) on December 14, 2025 (attached). The Master Plan and Preliminary Plat applications for the Solera project were initially approved on January 30, 2019, and a major modification of the proposal was approved on March 14, 2021. On April 20, 2020, the Renton City Council adopted an ordinance (Ordinance No. 5968) that temporarily extended the validity of certain permits by a period of six (6) months due to on-going construction challenges created by the COVID-19 pandemic. Preliminary Plats are valid for five (5) years and due to the COVID extension, the approval would have expired on July 30, 2024, or five years and six months following the initial preliminary plat approval. Pursuant to Renton Municipal Code (RMC) 4-7-080L.2, a single extension of one (1) year was granted to the applicant on January 30, 2024, extending the approval until July 30, 2025 (attached). Pursuant to RMC 4-7-080L.3, one additional one-year extension beyond the administrative one-year extension may be granted by the Hearing Examiner if the applicant shows need caused by unusual circumstances or situations that occurred during the prior extension period, which make it unduly burdensome to file the final plat. Staff concurs that the request meets requirements of the extension criteria and qualifies for a second extension of one (1) year until July 30th, 2026, as as an extension request was submitted more than 30 days prior to the expiration of the preliminary plat approval and the applicant provided adequate documentation outlining the need for an extension. LUA18-000490 and LU20- 000305) for a period of one (1) year. The Master Plan and Preliminary Plat applications for the Solera project were initially approved on January 30, 2019, and a major modification of the proposal was approved on March 14, 2021. Pursuant to Renton Municipal Code (RMC) 4-7-080L.2, a single extension of up to one (1) year may be granted to an applicant who files a written request with the Administrator at least 30 days before the expiration of preliminary plat approval, provided the Administrator finds that the applicant has obtained issuance of a construction permit and has made sustained progress towards final construction, engineering, and surveying necessary to record a final plat. Your request meets requirements of the extension criteria and qualifies for a one-time extension of one (1) year, as an extension request was submitted more than 30 days prior to the expiration of the preliminary plat approval, the Construction Permit has been issued and the applicant has made sustained progress towards final construction necessary for the recording of the final plat. Therefore, your one (1) year extension request is approved. The one (1) year extension shall be measured using the expiration date of the Preliminary Plat approval after issuance of the temporary six (6)-month extension (July 30, 2024) in order to ensure consistency with the extensions granted to other projects under the emergency ordinance. Please note that all construction must be completed or deferred, and the final plat recorded in accordance with City Code prior to the last day of the extension of July 30, 2025. Pursuant to RMC 4-7-080L.3, one additional one-year extension beyond the one-year extension may be granted by the Hearing Examiner if the applicant shows need caused by unusual circumstances or situations that occurred during the prior extension period, which make it unduly burdensome to file the final plat. The applicant must file a written request with the Hearing Examiner and the Administrator for this additional extension; this request must be filed at least 30 days prior to the plat expiration date. Said request must include all necessary documentation as to the need for the additional extension.
