PROJECT DESCRIPTION: The applicant, Flatiron-Lane Joint Venture (FLJV), is requesting a one-year
Tier II Temporary Use Permit (TUP) to continue the temporary use of temporary field office trailers and
laydown area at 4350 Lake Washington Blvd N (APN 3224059049) to support the completion of the
WSDOT I-405 Renton to Bellevue Widening and Express Toll Lanes Project. On April 24, 2020, the
applicant received approval for a five-year Tier II TUP and SEPA Environmental Review for the
implementation of the temporary field office trailers, a laydown yard and a staging area for construction
equipment and materials (LUA19-000318, ECF, TP). The original 2020 Tier II TUP is not eligible for any
extensions as the maximum permitted time was granted under the permit. FLJV’s use of the property was
authorized by the property owner through a lease agreement until the WSDOT I-405 widening project is
completed or until such date that the owner chooses to terminate its lease with FLJV.
The 7.18-acre parcel has a Comprehensive Plan Land Use Designation of Commercial-Office-Residential
(COR), is zoned Commercial Office Residential (COR), and is in the Urban Design Overlay District C. The
site is mostly impervious surfaces with limited vegetation along the periphery. The site includes six (6)
existing structures, two (2) permanent structures and four (4) temporary structures, along with a
stormwater pond at the southwestern corner of the site to collect and treat stormwater runoff. In February

2025, the applicant was issued a building permit (B25000369) to demolish one (1) of the remaining
existing structures, a 33,500 square-foot building on the westside of the property. The applicant is
requesting to retain the existing temporary office trailers and restrooms (approx. 7,780 square feet) and
add less than 4,000 square feet of additional temporary office space toward the south end of the existing
temporary office trailers, although it is not anticipated at this time. There are approximately 150 temporary
parking spaces available to support the 150 employees that visit the site during various work shifts.
Location of the parking stalls would be adjusted if additional temporary office space is constructed.
Access to the site is from the north end of the property from Lake Washington Blvd N. The applicant does
not indicate any tree removal onsite. The City’s mapping system, COR Maps, indicates that the subject
property is within the Shoreline High-Intensity May Creek (Reach B) Designation, Flood Hazard Area (FEMA
Zone – AE), and Seismic Hazard Area. However, a Letter of Map Amendment (LOMA) Determination
Document (Removal) was issued by the Federal Emergency Management Agency on May 22, 2012 that
removed the project site from the special flood hazard area. The existing onsite critical area of May Creek,
along the southern portion of the property, would be protected from the proposed temporary uses at all
times through erosion control measures and appropriate on-site BMPs to meet the City requirements. The
applicant submitted a Geotechnical Engineering Design Study, a Preliminary Technical Information
Report, and an Existing Conditions Report with the application.
The Temporary Use Permit is hereby approved for the term of one (1) year and subject to the following
conditions:
*CONDITIONS OF APPROVAL:
1. The applicant shall maintain a minimum 20-foot (20’) emergency access lane clear for the
duration of the temporary use.
2. All future siting of temporary office trailer space and parking space layout shall be located at least
five feet (5’) from the parcel boundaries and the May Creek shoreline buffer.
3. The site occupied by the temporary use shall be left free of all debris, litter, or all other evidence
of the temporary use upon completion of removal of the Temporary Field Office Trailers and
Laydown Area (FLJV) or when the operation of the use ceases to exist.
4. Should the Administrator determine that information provided to the City is found to be false,
incomplete, or the temporary use actually being used is different than or greater than that applied
for, then the Administrator may revoke the temporary use permit upon thirty (30) days of written
notice to the applicant, unless an emergency exists, in which case the Administrator may declare
such as an emergency and immediately suspend or revoke the temporary use permit until the
emergency is abated.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not
readily discoverable prior to the original decision is found or if he finds there was misrepresentation or
fact. After review of the Reconsideration request, if the approval body finds sufficient evidence to amend
the original decision, there will be no further extension of the appeal period. Any person wishing to take
further action must file a formal appeal within the 14-day appeal time frame.
APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on April 25, 2025.
Appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City
Hall 1st floor Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is
submitted, will be collected at a future date if your appeal is submitted electronically. The appeal
submitted in person may be paid on the first floor in our Finance Department. Appeals to the Hearing
Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process may be
obtained from the City Clerk’s Office, cityclerk@rentonwa.gov.
EXPIRATION: A Temporary Use Permit is valid for up to one (1) year from the effective date of the permit,
unless the Community & Economic Development Administrator or designee establishes a shorter time
frame or an applicant can request that a permit be valid beyond the one year expiration, for up to five years
at the time of application or prior to permit expiration.
EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to
permit expiration to the Department of Community & Economic Development Administrator.
