• The 10th Annual Renton Career Fair will be held Wednesday, May 14 and Thursday,
May 15 from 3-6 p.m. at Renton Technical College (3000 NE 4th Street; Renton).
Wednesday will feature all industries except healthcare and Thursday’s event will
focus only on careers in the healthcare field. For more information and to register
visit www.rentonwa.gov/Events-Meetings/All-City-Events-Meetings-
Calendar/Tenth-Annual-Renton-Career-Fair.
• The Organizational Development and Performance Division of the Executive
Services Department, in collaboration with ReconMR, is currently finalizing the
2025 Community Survey in preparation for distribution. Survey results provide
important feedback that advances the city’s understanding and performance
metrics regarding the residents’ and business community’s experience with city
services. Results also help advise city leaders as they assess future projects and
programs desired by the community. The survey will be available in mid-May and
open for approximately one month.
Once compiled, survey results will be presented to City Council and provided on
the website. For any questions or comments please email
rentonsurvey@rentonwa.gov.
• Information about preventative street maintenance, traffic impact projects, and
road closures happening this week can be found at http://rentonwa.gov/traffic. All
projects are weather permitting and unless otherwise noted, streets will always
remain open.

ADMINISTRATIVE REPORT
CAO Ed VanValey reviewed a written administrative report summarizing the City’s recent
progress towards goals and work programs adopted as part of its business plan for 2023 and
beyond. Items noted were:
• The Renton History Museum will be hosting Congressman Adam Smith’s 2025
Congressional Art Competition Reception, Saturday, May 3 from 11 a.m.-12 p.m. The
Museum is located at 235 Mill Avenue South near Fire Station 11.
• Police Youth Academy applications are now available. The Academy is a
collaborative effort between the Renton Police Department, King County Sheriff’s
Office, Newcastle Police Department and the DEA. The four-day program held
July 14-17 from 9 a.m.-4 p.m. is an opportunity that allows middle school aged
students to explore a variety of topics including law enforcement, firefighting, and
emergency response while developing leadership skills, teamwork, and self-
confidence. Learn more about the program, read about the application process
and register by Friday, May 2 at https://rentonwa.gov/PDYouthAcademy.
• The Renton Police Department is seeking diverse voices to discuss major
incidents, policies, and community policing strategies. Members meet every
other month and gain exclusive behind-the-scenes experiences. Applications
may be found by visiting https://rentonwa.gov/chiefscouncil and are open to
those who live, work, or have a strong connection to Renton (such as through a
school or faith-based organization). Terms are a two-year commitment.
• The city’s Recreation Division is excited to launch the May to August Let’s Go Guide.
Whether you are looking to dive into a new activity, freshen up your fitness goals, or
find engaging youth programs, this guide has something for everyone. For more
information and to register for your summer fun visit www.rentonwa.gov/letsgo.
• The Community and Economic Development Department and Renton Municipal Arts
Commission have kicked off the “Paint with a Purpose” program. Artists interested in
being part of the program and public agencies, businesses, and property owners
located within the city limits are encouraged to apply. For more information and
applications visit www.rentonwa.gov/publicart.
• Compost and Amendments the Natural Way, the first of three free gardening classes,
will be held Wednesday, May 7 at the Renton Community Center (1715 Maple Valley
Hwy.) from 6-7:30 p.m. Explore how to best use compost, amendments, and so-
called garden “waste” to meet the nutritional needs of your soil and plants. Classes
are sponsored by a partnership between the Public Works Department, Parks &
Recreation Department, and Saving Water Partnership. To register visit

• Preventative street maintenance will continue to impact traffic and result in
occasional street closures.
AUDIENCE COMMENTS
• Sharon Bolstad, Renton, voiced concern about an issue of not televising a sign held by
Matt Hanbey at the April 14, 2025, Council meeting and that no one had responded
to her about this issue yet. Council President Alberson noted that an email with an
explanation had been sent to her earlier in the day.

• Sheryl Friez, Renton, voiced opposition to the Logan 6 development, and noted that
while out picketing the project she witnessed numerous traffic violations in the area.

measure at intersections.

budget to increase revenues by $56,072,799 for an amended total revenue of
$701,143,703 over the biennium, and increase expenditures by $167,033,277, for an
amended total expenditure of $815,422,398 over the biennium.
2. Approve the resolution amending the 2025-2026 Fee Schedule.

There would be no impacts to the city budget for this rezone as no development is associated with the
requested rezone.
SUMMARY OF ACTION:
The applicant, William Millhollin, Northwest Permits, is requesting a site specific rezone not requiring a
comprehensive plan amendment to change the existing zoning from Commercial Office (CO) to Commercial
Arterial (CA).
On March 18, 2025, the Hearing Examiner held a public hearing and issued a recommendation to approve the
rezone, File No. LUA24-000281, on April 9, 2025, which is being forwarded to City Council for a final
decision.
The CA zone provides for a wide variety of retail sales, services, and other commercial activities along high-
volume traffic corridors.
The requested rezone is intended to accommodate expanded retail use types to align with the current use
demand of the neighborhood.

RECOMMENDATION:
The Hearing Examiner recommends that Council authorize the Mayor and City Clerk
to approve the rezone of the property located at 101 SW 41st St, Renton, WA 98057
(APN 3926800040) from Commercial Office (CO) to Commercial Arterial (CA).
BACKGROUND:
The applicant, William Millhollin, Northwest Permits, is requesting a site specific
rezone not requiring a comprehensive plan amendment to change the existing zoning
from Commercial Office (CO) to Commercial Arterial (CA). The Hearing Examiner
held a public hearing on March 18, 2025 to consider the matter and issued a
recommendation to approve the rezone, File No. LUA24-000281, on April 9, 2025,
which is being forwarded to City Council for a final decision. The purpose of the
Commercial Arterial zone (CA) is to evolve from “strip commercial” linear business
districts to business areas characterized by enhanced site planning and pedestrian
orientation, incorporating efficient parking lot design, coordinated access, amenities
and boulevard treatment with greater densities. The CA zone provides for a wide
variety of retail sales, services, and other commercial activities along high-volume
traffic corridors. Residential uses may be integrated into the zone through mixed-use
buildings. The requested rezone is intended to accommodate expanded retail use
types to align with the current use demand of the neighborhood. The proposed rezone

H. FINDINGS OF FACT (FOF):
1. The Planning Division of the City of Renton accepted the above master application for review on
December 19, 2024 and determined the application complete on January 15, 2025. The project
complies with the 170-day review period for a Type IV permit.
2. The project site is located at 101 SW 41st St, Renton, WA 98057 (APN 3926800040).
3. The project site is currently developed with an existing 15,104 square foot multi-tenant retail
building.
4. Access to the site would remain in its current configuration. There is currently one curb cut off of SW
41st St and one curb cut off of East Valley Rd.
5. The property is located within the Employment Area (EA) Comprehensive Plan land use designation.
6. The site is located within the Commercial Office (CO) zoning classification.
7. The site is mapped within a high seismic hazard area.
8. Staff received one (1) agency comment email from the Duwamish Tribe (Exhibit 6) after the
completion of the 14-day public comment period. Staff responded to the Duwamish Tribe’s
comment in Exhibit 7.
9. No other public or agency comments were received.
10. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971 as
amended), on February 10, 2025 the Environmental Review Committee issued a Determination of
Non-Significance (DNS) for the SW 41st St Rezone (Exhibit 5). A 14-day appeal period commenced on
February 10, 2025 and ended on February 24, 2025. No appeals of the threshold determination have
been filed.
11. Representatives from various city departments have reviewed the application materials to identify
and address issues raised by the proposed rezone. These comments are contained in the official file,
and the essence of the comments has been incorporated into the appropriate sections of this report
and the Departmental Recommendation at the end of this report.
12. Comprehensive Plan Compliance: The site is designated Employment Area (EA) on the City’s
Comprehensive Plan Map. Employment Areas provide a significant economic development and
employment base for the City. Maintain a variety and balance of uses through zoning that promotes
the gradual transition of uses on sites with good access and visibility to more intensive comm ercial
and office uses. The proposal is compliant with the following development standards if all conditions
of approval are met:

13. Rezone Criteria: The applicant is requesting a rezone to change the existing zoning from
Commercial Office (CO) to Commercial Arterial (CA). Pursuant to RMC 4-9-180D, site specific
rezone requests no requiring an amendment to the Renton Comprehensive Plan shall be reviewed in
an open public hearing held before the Hearing Examiner. Following the close of the public hearing,
the Hearing Examiner provides a written recommendation to the City Council for final approval. The
CA zone provides for a wide variety of retail sales, services, and other commercial activities along
high-volume traffic corridors. The requested rezone is intended to accommodate expanded retail
use types to align with the current use demand of the neighborhood. The proposed rezone is not
associated with a proposed development at this time. The rezone property is located within the
Employment Area (EA) Comprehensive Plan land use designation, which is implemented by the CO
and CA zones. The proposal is compliant with the following rezone criteria, pursuant to RMC 4-9-
180F.2, if all conditions of approval are met:

a. The rezone has merit and value for the community, and will not adversely
affect public health, safety, and welfare.
Staff Comment: The applicant contends that the proposed rezone would have
merit and value for the community, and would not adversely affect public health,
safety, and welfare by providing broader retail opportunities than presently exist
under the current CO zoning (Exhibit 8). Additionally, appropriate zoning
designations are intended to protect the welfare, safety, and health of the public,
as well as, allowing for uses that result in an appropriate and best use of the land.
On the subject property, the applicant contends that the best use would be retail.
Further, retail businesses contribute to the City’s tax base and increase resources
of public services and infrastructure.
Staff concurs that the requested rezone has merit and would provide value for the
community without adversely impacting the public health, safety, and welfare. The
proposed rezone from CO to CA would be appropriate for the project site as the
project site is currently developed with an existing multi-tenant retail building and
is not developed with offices. The requested rezone would allow for a broader
range of retail uses on the project site that are currently permitted under the CO
zone. There are adequate public services and facilities available to accommodate
any increased demands created by the proposed rezone.

b. The rezone will not be materially detrimental to the uses or properties
located in the immediate vicinity thereof.
Staff Comment: The applicant contends that the proposed rezone would not be
materially detrimental to the uses of properties in the immediate vicinity thereof.
Moreover, many of the neighboring properties are already zoned CA, which is
compatible with the remaining CO zoned parcels.
Staff concurs, that the requested rezone would not be materially detrimental to the
uses or properties located within the immediate vicinity. The adjacent properties
to the north and east are currently zoned CA and the existing building located on
the project site is currently occupied with a multi-tenant retail building. There are
no stand-alone office uses located on the site that would warrant the existing CO
zoning designation.
Furthermore, the rezone is anticipated to increase traffic, as retail use generally
generates more traffic than office use. However, it is not anticipated that the

proposed rezone would create any level of service problems or exceed public
service and infrastructure capacity within the immediate vicinity.

c. Since the original zoning or most recent rezone of the subject property,
conditions affecting the subject property have substantially changed as a
result of, but not limited to, public improvements or permitted private
development.
Staff Comment: The applicant contends that since the CO zone was established
for the subject property, conditions affecting the subject property have
substantially changed due to the dramatic reduction in demand for o ffice space
since the pandemic, especially office space in retail strip mall.
Staff concurs that the conditions have changed since the original zoning of the
subject property to CO. The project site is currently developed with a multi-tenant
retail building, the CA zoning designation would allow for a broader range of retail
uses within the existing retail building than the current CO zoning designation
would allow.

d. The property subject to rezone was not specifically considered for a rezone
at the time of the last area land use analysis and area zoning.
Staff Comment: The subject property was not considered for a rezone at the time
of the last area land use analysis and area rezoning, and specifically was not
considered with its neighboring parcels in Ordinance 5832.

e. The characteristics of development upon the land subject to the rezone
application are compatible with the purpose and intent of the proposed zone
as well as the zone-specific policy of the proposed zone, as provided by the

WHEREAS, the Council has heretofore adopted and filed Development Regulations and

Jill Ding, senior planner, summarized the staff report. William Millhollin, Applicant representative,
noted that the purpose of the rezone was to expand the range of authorized retail uses.
Exhibits

were admitted into evidence.
FINDINGS OF FACT
Procedural:
1. Applicant. William Millhollin, Northwest Permit, 1026 SW 151st St, Burien, WA 98166.
2. Hearing. A virtual hearing was held on the application at 11:00 am on March 18, 2025 in the
City of Renton Council Chambers.
3. Project Description. Kana Properties LLC seeks approval of rezone from Commercial Office
CO) to Commercial Arterial (CA) for 1.36 acres located at the southwest corner of the intersection of
SW 41st St. and East Valley Road. The requested rezone is intended to accommodate expanded retail
use types to align with the current use demand of the neighborhood. The proposed rezone is not
associated with a proposed development at this time. The project site is currently developed with an
existing 15,104 square foot multi-tenant retail building.
4. Surrounding Uses. The project site is surrounded by office and retail use. Properties to the
north and east are zoned CA and to the south and west are zoned CO.
5. Adverse Impacts. There are no significant adverse impacts associated with the proposal. On
February 10, 2025 the Environmental Review Committee issued a Determination of Non-
Significance (DNS) for the rezone (Exhibit 5). The proposed rezone will enable a wider range of
retail uses, which in turn could increase trip generation. The proposal fronts two collector arterials --
SW 41st St along the north property line and East Valley Road along the east property line. As such,
it is will located for enhanced retail use. As outlined in the staff report, the project site is fully served
by all necessary utilities, including water, sewer and stormwater. The project site is mapped within a
seismic hazard area. The City’s critical area regulations will mitigate against any impacts arising
from the hazard area for any proposed redevelopment. The property is also surrounded on two sides
by properties zoned with the requested CA zoning designation and so is compatible with surrounding
development.
6. Changed Circumstances. Conditions have substantially changed since the property was zoned
CO. The applicant notes that there has been a dramatic reduction in demand for office space since
the pandemic, especially office space in retail strip mall. The project site is currently developed with a

multi-tenant retail building. The CA zoning designation would allow for a broader range of retail
uses within the existing retail building than the current CO zoning designation would allow.
Conclusions of Law
1. Authority. The hearing examiner is required to hold a hearing and issue a recommendation to
the City Council on site specific rezones.
RMC 4-8-080(G) classifies site specific rezones not necessitating a comprehensive plan amendments
as a Type IV application. Type IV applications require a hearing and recommendation from the
hearing examiner with final approval by the City Council.
2. Zoning/Comprehensive Plan. The site is designated Employment Area (EA) on the City’s
Comprehensive Plan Map. It’s zoning is CO.
3. Review Criteria. Rezone criteria are set by RMC 4-9-180F.2. Those criteria are quoted
below in italics and applied via corresponding conclusions of law.
RMC 4-9-180F.2a. The rezone has merit and value for the community, and will not adversely affect
public health, safety, and welfare;
4. Criterion met. The rezone will serve to expand the range of retail uses authorized at a
location that is suited for the proposal. In this regard it adds value to the community. As determined
in Finding of Fact No. 5 it also creates no significant adverse impacts and so will not adversely affect
public health, safety and welfare.
RMC 4-9-180F.2b. The rezone will not be materially detrimental to the uses or properties located in
the immediate vicinity thereof;
5. Criterion met. As determined in Finding of Fact No. 5 the proposal creates no significant
adverse impacts and so will not be materially detrimental to the uses and properties located in the
immediate vicinity.
RMC 4-9-180F.2c. Since the original zoning or most recent rezone of the subject property,
conditions affecting the subject property have substantially changed as a result of, but not limited to,
public improvements or permitted private development;
6. Criterion met. The criterion is met for the reasons identified in Finding of Fact 6.
RMC 4-9-180F.2d. The property subject to rezone was not specifically considered for a rezone at
the time of the last area land use analysis and area zoning;

7. Criterion met. The criterion is met. The subject property was not considered for a rezone at
the time of the last area land use analysis and area rezoning, and specifically was not considered with
its neighboring parcels in Ordinance 5832.
RMC 4-9-180F.2e. The characteristics of development upon the land subject to the rezone
application are compatible with the purpose and intent of the proposed zone as well as the zone-
specific policy of the proposed zone, as provided by the Comprehensive Plan; and
8. Criterion met. The criterion is met. The proposed CA zone, like the current CO zone, is an
implementing zone of the underlying Employment Area comprehensive plan land use map
designation per pages 12 and 13 of the Comprehensive Plan. One of the purposes of the CA zone is
to provide for “a wide variety of retail sales, services, and other commercial activities along high-
volume traffic corridors” per RMC 4-2-020N. The existing multi-tenant building at the rezone site,
bordered by two primary arterials, is well suited to accommodate this type of use.
RMC 4-9-180F.2f. The rezone does not conflict with the governing Community Plan, if one was
adopted for the Community Planning Area in which the property subject to the rezone is located.
9. Criterion met. The subject property is located in the Valley Community Plan area and no
governing Community Plan has been adopted. Therefore, the rezone does not conflict with any
governing Community Plan.
RECOMMENDATION
It is recommended that the City Council approve Rezone File No. PR24-000002 for the reasons
identified in the conclusions of law above.

SUMMARY OF ACTION:
The Parks and Recreation Department submits CAG-22-013, Kiwanis Park Improvements for final acceptance
and release of a retainage bond. The project commenced on October 10, 2022, was completed on January 25,
2025, and the work was accepted on March 18, 2025. The Contractor, Terra Dynamics Inc., met the terms of
the contract for the park improvement project.

Dear Mr. Emerson:
The above referenced project has been reviewed and found to have reached Final Acceptance by the City of
Renton on March 13, 2025, at 12:19 pm PDT. The items identified in the Final Completion Punch List of August 8,
2023, are found to be satisfactorily completed for conformance with the Contract Documents.
Please commence the preparation of the following documents, refer to General Conditions 6.9:
1.Affidavits that payrolls, bills for materials and equipment, and other indebtedness connected with the
Work, for which the Owner or Owner’s property might be responsible or encumbered have been paid
or otherwise satisfied.
2.Certificate evidencing that insurance required by the Contract Documents to remain in force after final
payment is currently in force after final payment is currently in effect and will not be canceled or
allowed to expire until at least 30 days’ prior written notice has been given to the Owner.
3.Consent of surety to final payment.
4.Certificate of Release of Liens.
5.Additional documentation as required by the City of Renton.
Upon receipt of the above documentation, we will proceed with Council approval for Final Acceptance and
Release of Bonds and the required release from state agencies for project completion. Thank you for your effort,
dedication, and commitment to the Kiwanis Park renovation project. It has been a pleasure working with you

FISCAL IMPACT SUMMARY:
Funding for this agreement in the amount not to exceed $275,000.00 is available from the PW/ Facilities
Budget 108 fund contracted services, GL 108.220046.015.518.31.41.003. Current Funding for this contract is
budgeted for $255,000.00. In addition, the Public Works Facilities Division is requesting an additional
$20,000.00 in appropriations to be requested with a second quarter budget adjustment to GL
108.220046.015.518.31.41.003 from fund balance, to fully fund this agreement.
SUMMARY OF ACTION:
In May of 2022 it was determined that the Renton Downtown parking garage was in need of security
services to help provide improved public safety and reduce illegal activity in and around the facility.
Utilizing the MRSC small works roster DWR Security (DBA Pono Security) was selected to provide
security services. After several years of utilizing Pono Security there have been several unreported
significant security eventsincludingfailure to respond or report an arson event, and anincident
involving suicide.There have been incidents of security officers using unmarked personal vehicles for
security patrols and inappropriate attire worn while on duty. For these reasons, PW/ Facilities isseeking
a new and more professional security contractor.
Using the MRSC small works roster PW/Facilities received several qualified bids ranging in price from
$771,120.00, $321,521.00, and $246,052.00. Pacific Security was selected as the lowest qualified
bidder at $263,868.62.Pacific Security providescompany owned professional marked patrol vehicles,
hourly patrols with scannable check points to ensure proper documented patrolling, professional
security uniforms worn by all on-duty security guards, and real time situational and daily reporting to
designated city employees. This new one-year contract will provide full building security inside and
outside of the parking garage with coverage from:Sunday thru Thursday 5:00 AM to 11:00 PM, Friday
and Saturday 5:00 AM to 1:00 AM.

AGREEMENT FOR SECURITY SERVICES
THIS AGREEMENT, dated for reference purposes only as Month XX, XXXX, is by and between the
City of Renton (the “City”), a Washington municipal corporation, and Parker Corporate Services
Inc. DBA Action Cleaning Services, Pacific Security a division of Parker Corporate Services Inc a
Washington Corporation. UBI 602 040 772 (“Consultant”), Pacific Security. The City and the
Consultant are referred to collectively in this Agreement as the “Parties.” Once fully executed by
the Parties, this Agreement is effective as of the last date signed by both parties.
1. Scope of Work: Consultant agrees to provide Security Servivces as specified in Exhibit A,
which is attached and incorporated herein and may hereinafter be referred to as the
“Work.”
2. Changes in Scope of Work: The City, without invalidating this Agreement, may order
changes to the Work consisting of additions, deletions or modifications. Any such changes
to the Work shall be ordered by the City in writing and the Compensation shall be
equitably adjusted consistent with the rates set forth in Exhibit A or as otherwise mutually
agreed by the Parties.
3. Time of Performance: Consultant shall commence performance of the Agreement
pursuant to the schedule(s) set forth in Exhibit May 5, 2025. All Work shall be performed
by no later than May 5, 2026.
4. Compensation:
A. Amount. Total compensation to Consultant for Work provided pursuant to this
Agreement shall not exceed $275,000.00, plus any applicable state and local sales
taxes. Compensation shall be paid as a flat rate fixed sum based upon Work actually
performed according to the rate(s) or amounts specified in Exhibit A. The Consultant
agrees that any hourly or flat rate charged by it for its Work shall remain locked at the
negotiated rate(s) unless otherwise agreed to in writing or provided in Exhibit A.
Except as specifically provided herein, the Consultant shall be solely responsible for
payment of any taxes imposed as a result of the performance and payment of this
Agreement.
B. Method of Payment. On a monthly or no less than quarterly basis during any quarter
in which Work is performed, the Consultant shall submit a voucher or invoice in a form
specified by the City, including a description of what Work has been performed, the

name of the personnel performing such Work, and any hourly labor charge rate for
such personnel. The Consultant shall also submit a final bill upon completion of all
Work. Payment shall be made by the City for Work performed within thirty (30)
calendar days after receipt and approval by the appropriate City representative of the
voucher or invoice. If the Consultant’s performance does not meet the requirements
of this Agreement, the Consultant will correct or modify its performance to comply
with the Agreement. The City may withhold payment for work that does not meet the
requirements of this Agreement.
C. Effect of Payment. Payment for any part of the Work shall not constitute a waiver by
the City of any remedies it may have against the Consultant for failure of the
Consultant to perform the Work or for any breach of this Agreement by the
Consultant.
D. Non-Appropriation of Funds. If sufficient funds are not appropriated or allocated for
payment under this Agreement for any future fiscal period, the City shall not be
obligated to make payments for Work or amounts incurred after the end of the
current fiscal period, and this Agreement will terminate upon the completion of all
remaining Work for which funds are allocated. No penalty or expense shall accrue to
the City in the event this provision applies.
5. Termination:
A. The City reserves the right to terminate this Agreement at any time, with or w ithout
cause by giving ten (10) calendar days’ notice to the Consultant in writing. In the event
of such termination or suspension, all finished or unfinished documents, data, studies,
worksheets, models and reports, or other material prepared by the Consultant
pursuant to this Agreement shall be submitted to the City, if any are required as part
of the Work.
B. In the event this Agreement is terminated by the City, the Consultant shall be entitled
to payment for all hours worked to the effective date of termination, less all payments
previously made. If the Agreement is terminated by the City after partial performance
of Work for which the agreed compensation is a fixed fee, the City shall pay the
Consultant an equitable share of the fixed fee. This provision shall not prevent the
City from seeking any legal remedies it may have for the violation or nonperformance
of any of the provisions of this Agreement and such charges due to the City shall be
deducted from the final payment due the Consultant. No payment shall be made by
the City for any expenses incurred or work done following the effective date of
termination unless authorized in advance in writing by the City.
6. Warranties And Right To Use Work Product: Consultant represents and warrants that
Consultant will perform all Work identified in this Agreement in a professional and

workmanlike manner and in accordance with all reasonable and professional standards
and laws. Compliance with professional standards includes, as applicable, performing the
Work in compliance with applicable City standards or guidelines (e.g. design criteria and
Standard Plans for Road, Bridge and Municipal Construction). Professional engineers shall
certify engineering plans, specifications, plats, and reports, as applicable, pursuant to
RCW 18.43.070. Consultant further represents and warrants that all final work product
created for and delivered to the City pursuant to this Agreement shall be the original work
of the Consultant and free from any intellectual property encumbrance which would
restrict the City from using the work product. Consultant grants to the City a non-
exclusive, perpetual right and license to use, reproduce, distribute, adapt, modify, and
display all final work product produced pursuant to this Agreement. The City’s or other’s
adaptation, modification or use of the final work products other than for the purposes of
this Agreement shall be without liability to the Consultant. The provisions of this section
shall survive the expiration or termination of this Agreement.
7. Record Maintenance: The Consultant shall maintain accounts and records, which
properly reflect all direct and indirect costs expended and Work provided in the
performance of this Agreement and retain such records for as long as may be required by
applicable Washington State records retention laws, but in any event no less than six
years after the termination of this Agreement. The Consultant agrees to provide access
to and copies of any records related to this Agreement as required by the City to audit
expenditures and charges and/or to comply with the Washington State Public Records Act
(Chapter 42.56 RCW). The provisions of this section shall survive the expiration or
termination of this Agreement.
8. Public Records Compliance: To the full extent the City determines necessary to comply
with the Washington State Public Records Act, Consultant shall make a due diligent search
of all records in its possession or control relating to this Agreement and the Work,
including, but not limited to, e-mail, correspondence, notes, saved telephone messages,
recordings, photos, or drawings and provide them to the City for production. In the event
Consultant believes said records need to be protected from disclosure, it may, at
Consultant’s own expense, seek judicial protection. Consultant shall indemnify, defend,
and hold harmless the City for all costs, including attorneys’ fees, attendant to any claim
or litigation related to a Public Records Act request for which Consultant has responsive
records and for which Consultant has withheld records or information contained therein,
or not provided them to the City in a timely manner. Consultant shall produce for
distribution any and all records responsive to the Public Records Act request in a timely
manner, unless those records are protected by court order. The provisions of this section
shall survive the expiration or termination of this Agreement.
9. Independent Contractor Relationship:

A. The Consultant is retained by the City only for the purposes and to the extent set forth
in this Agreement. The nature of the relationship between the Consultant and the City
during the period of the Work shall be that of an independent contractor, not
employee. The Consultant, not the City, shall have the power to control and direct the
details, manner or means of Work. Specifically, but not by means of limitation, the
Consultant shall have no obligation to work any particular hours or particular
schedule, unless otherwise indicated in the Scope of Work or where scheduling of
attendance or performance is mutually arranged due to the nature of the Work.
Consultant shall retain the right to designate the means of performing the Work
covered by this agreement, and the Consultant shall be entitled to employ other
workers at such compensation and such other conditions as it may deem proper,
provided, however, that any contract so made by the Consultant is to be paid by it
alone, and that employing such workers, it is acting individually and not as an agent
for the City.
B. The City shall not be responsible for withholding or otherwise deducting federal
income tax or Social Security or contributing to the State Industrial Insurance
Program, or otherwise assuming the duties of an employer with respect to Consultant
or any employee of the Consultant.
C. If the Consultant is a sole proprietorship or if this Agreement is with an individual, the
Consultant agrees to notify the City and complete any required form if the Consultant
retired under a State of Washington retirement system and agrees to indemnify a ny
losses the City may sustain through the Consultant’s failure to do so.
10. Hold Harmless: The Consultant agrees to release, indemnify, defend, and hold harmless
the City, elected officials, employees, officers, representatives, and volunteers from any
and all claims, demands, actions, suits, causes of action, arbitrations, mediations,
proceedings, judgments, awards, injuries, damages, liabilities, taxes, losses, fines, fees,
penalties, expenses, attorney’s or attorneys’ fees, costs, and/or litigation expenses to or
by any and all persons or entities, arising from, resulting from, or related to the negligent
acts, errors or omissions of the Consultant in its performance of this Agreement or a
breach of this Agreement by Consultant , except for that portion of the claims caused by
the City’s sole negligence.
Should a court of competent jurisdiction determine that this agreement is subject to RCW
4.24.115, (Validity of agreement to indemnify against liability for negligence relative to
construction, alteration, improvement, etc., of structure or improvement attached to real
estate…) then, in the event of liability for damages arising out of bodily injury to persons
or damages to property caused by or resulting from the concurrent negligence of the
Consultant and the City, its officers, officials, employees and volunteers, Consultant’s
liability shall be only to the extent of Consultant’s negligence.

It is further specifically and expressly understood that the indemnification provided in
this Agreement constitute Consultant’s waiver of immunity under the Industrial
Insurance Act, RCW Title 51, solely for the purposes of this indemnification. The Partie s
have mutually negotiated and agreed to this waiver. The provisions of this section shall
survive the expiration or termination of this Agreement.
11. Gifts and Conflicts: The City’s Code of Ethics and Washington State law prohibit City
employees from soliciting, accepting, or receiving any gift, gratuity or favor from any
person, firm or corporation involved in a contract or transaction. To ensure compliance
with the City’s Code of Ethics and state law, the Consultant shall not give a gift of any kind
to City employees or officials. Consultant also confirms that Consultant does not have a
business interest or a close family relationship with any City officer or employee who was,
is, or will be involved in selecting the Consultant, negotiating or administering this
Agreement, or evaluating the Consultant’s performance of the Work.
12. City of Renton Business License: Unless exempted by the Renton Municipal Code,
Consultant shall obtain a City of Renton Business License prior to performing any Work
and maintain the business license in good standing throughout the term of this
agreement with the City.

13. Insurance: Consultant shall secure and maintain:
A. Commercial general liability insurance in the minimum amounts of $1,000,000 for
each occurrence/$2,000,000 aggregate for the Term of this Agreement.
B. In the event that Work delivered pursuant to this Agreement either directly or
indirectly involve or require Professional Services, Professional Liability, Errors and
Omissions coverage shall be provided with minimum limits of $1,000,000 per
occurrence. "Professional Services", for the purpose of this section, shall mean any
Work provided by a licensed professional or Work that requires a professional
standard of care.
C. Workers’ compensation coverage, as required by the Industrial Insurance laws of the
State of Washington, shall also be secured.

D. Commercial Automobile Liability for owned, leased, hired or non-owned, leased, hired
or non-owned, with minimum limits of $1,000,000 per occurrence combined single
limit, if there will be any use of Consultant’s vehicles on the City’s Premises by or on
behalf of the City, beyond normal commutes.
E. Consultant shall name the City as an Additional Insured on its commercial general
liability policy on a non-contributory primary basis. The City’s insurance policies shall
not be a source for payment of any Consultant liability, nor shall the maintenance of
any insurance required by this Agreement be construed to limit the liability of
Consultant to the coverage provided by such insurance or otherwise limit the City’s
recourse to any remedy available at law or in equity.
F. Subject to the City’s review and acceptance, a certificate of insurance showing the
proper endorsements, shall be delivered to the City before performing the Work.
G. Consultant shall provide the City with written notice of any policy cancellation, within
two (2) business days of their receipt of such notice.
14. Delays: Consultant is not responsible for delays caused by factors beyond the
Consultant’s reasonable control. When such delays beyond the Consultant’s reasonable
control occur, the City agrees the Consultant is not responsible for damages, nor shall the
Consultant be deemed to be in default of the Agreement.
15. Successors and Assigns: Neither the City nor the Consultant shall assign, transfer or
encumber any rights, duties or interests accruing from this Agreement without the
written consent of the other.
16. Notices: Any notice required under this Agreement will be in writing, addressed to the
appropriate party at the address which appears below (as modified in writing from time
to time by such party), and given personally, by registered or certified mail, return recei pt
requested, by facsimile or by nationally recognized overnight courier service. Time period
for notices shall be deemed to have commenced upon the date of receipt, EXCEPT
facsimile delivery will be deemed to have commenced on the first business day following
transmission. Email and telephone may be used for purposes of administering the
Agreement, but should not be used to give any formal notice required by the Agreement.

17. Discrimination Prohibited: Except to the extent permitted by a bona fide occupational
qualification, the Consultant agrees as follows:
A. Consultant, and Consultant’s agents, employees, representatives, and volunteers
with regard to the Work performed or to be performed under this Agreement, shall
not discriminate on the basis of race, color, sex, religion, nationality, creed, marital
status, sexual orientation or preference, age (except minimum age and retirement
provisions), honorably discharged veteran or military status, or the presence of any
sensory, mental or physical handicap, unless based upon a bona fide occupational
qualification in relationship to hiring and employment, in employment or application
for employment, the administration of the delivery of Work or any other benefits
under this Agreement, or procurement of materials or supplies.
B. The Consultant will take affirmative action to insure that applicants are employed and
that employees are treated during employment without regard to their race, creed,
color, national origin, sex, age, sexual orientation, physical, sensory or mental
handicaps, or marital status. Such action shall include, but not be limited to the
following employment, upgrading, demotion or transfer, recruitment or recruitment
advertising, layoff or termination, rates of pay or other forms of compensation and
selection for training.
C. If the Consultant fails to comply with any of this Agreement’s non -discrimination
provisions, the City shall have the right, at its option, to cancel the Agreement in
whole or in part.
D. The Consultant is responsible to be aware of and in compliance with all federal, state
and local laws and regulations that may affect the satisfactory completion of the
project, which includes but is not limited to fair labor laws, worker's compensation,
and Title VI of the Federal Civil Rights Act of 1964, and will comply with City of Renton
Council Resolution Number 4085.
18. Miscellaneous: The parties hereby acknowledge:
A. The City is not responsible to train or provide training for Consultant.
B. Consultant will not be reimbursed for job related expenses except to the extent
specifically agreed within the attached exhibits.
C. Consultant shall furnish all tools and/or materials necessary to perform the Work
except to the extent specifically agreed within the attached exhibits.

D. In the event special training, licensing, or certification is required for Consultant to
provide Work he/she will acquire or maintain such at his/her own expense and, if
Consultant employs, sub-contracts, or otherwise assigns the responsibility to perform
the Work, said employee/sub-contractor/assignee will acquire and or maintain such
training, licensing, or certification.
E. This is a non-exclusive agreement and Consultant is free to provide his/her Work to
other entities, so long as there is no interruption or interference with the provision of
Work called for in this Agreement.
F. Consultant is responsible for his/her own insurance, including, but not limited to
health insurance.
G. Consultant is responsible for his/her own Worker’s Compensation coverage as well as
that for any persons employed by the Consultant.
19. Other Provisions:
A. Approval Authority. Each individual executing this Agreement on behalf of the City
and Consultant represents and warrants that such individuals are duly authorized to
execute and deliver this Agreement on behalf of the City or Consultant.
B. General Administration and Management. The City’s project manager is Brian
Hammon. In providing Work, Consultant shall coordinate with the City’s contract
manager or his/her designee.
C. Amendment and Modification. This Agreement may be amended only by an
instrument in writing, duly executed by both Parties.
D. Conflicts. In the event of any inconsistencies between Consultant proposals and this
Agreement, the terms of this Agreement shall prevail. Any exhibits/attachments to
this Agreement are incorporated by reference only to the extent of the purpose for
which they are referenced within this Agreement. To the extent a Consultant
prepared exhibit conflicts with the terms in the body of this Agreement or contains
terms that are extraneous to the purpose for which it is referenced, the terms in the
body of this Agreement shall prevail and the extraneous terms shall not be
incorporated herein.
E. Governing Law. This Agreement shall be made in and shall be governed by and
interpreted in accordance with the laws of the State of Washington and the City of
Renton. Consultant and all of the Consultant’s employees shall perform the Work in
accordance with all applicable federal, state, county and city laws, codes and
ordinances.

F. Joint Drafting Effort. This Agreement shall be considered for all purposes as prepared
by the joint efforts of the Parties and shall not be construed against one party or the
other as a result of the preparation, substitution, submission or other event of
negotiation, drafting or execution.
G. Jurisdiction and Venue. Any lawsuit or legal action brought by any party to enforce or
interpret this Agreement or any of its terms or covenants shall be brought in the King
County Superior Court for the State of Washington at the Maleng Regional Justice
Center in Kent, King County, Washington, or its replacement or successor. Consultant
hereby expressly consents to the personal and exclusive jurisdiction and venue of
such court even if Consultant is a foreign corporation not registered with the State of
Washington.
H. Severability. A court of competent jurisdiction’s determination that any provision or
part of this Agreement is illegal or unenforceable shall not cancel or invalidate the
remainder of this Agreement, which shall remain in full force and effect.
I. Sole and Entire Agreement. This Agreement contains the entire agreement of the
Parties and any representations or understandings, whether oral or written, not
incorporated are excluded.
J. Time is of the Essence. Time is of the essence of this Agreement and each and all of
its provisions in which performance is a factor. Adherence to completion dates set
forth in the description of the Work is essential to the Consultant’s performance of
this Agreement.
K. Third-Party Beneficiaries. Nothing in this Agreement is intended to, nor shall be
construed to give any rights or benefits in the Agreement to anyone other than the
Parties, and all duties and responsibilities undertaken pursuant to this Agreement will
be for the sole and exclusive benefit of the Parties and no one else.
L. Binding Effect. The Parties each bind themselves, their partners, successors, assigns,
and legal representatives to the other party to this Agreement, and to the partners,
successors, assigns, and legal representatives of such other party with respect to all
covenants of the Agreement.
M. Waivers. All waivers shall be in writing and signed by the waiving party. Either party’s
failure to enforce any provision of this Agreement shall not be a waiver and shall not
prevent either the City or Consultant from enforcing that provision or any other
provision of this Agreement in the future. Waiver of breach of any provision of this
Agreement shall not be deemed to be a waiver of any prior or subsequent breach
unless it is expressly waived in writing.

Work Schedule:
•Sunday through Thursday 5:00 AM to 12:00 AM 19 hours total security coverage
•Friday and Saturday 5:00 AM to 2:00 AM 21 hours total security coverage
Security needs and expectations:
•Submit daily reports to appointed city representatives.
•Clearly identified Professional attire will be worn by all on duty security officers while on
site
•All Security Vehicles will be clearly Identified as a professional security vehicle along
with company name and contact. Vehicle signage shall be located on at least the driver
and passenger sides of the vehicle along with amber strobe lights on top of or in the
front and rear of vehicle.
•Observe and report on all Illegal activity in accordance with Renton Municipal Code
6-31.(ordinance 5598 signage for these rules is posted inside the parking garage)
•Patrol all areas of the parking garage inside and outside. Including physically inspecting
both elevators and stairwells utilizing foot patrol and vehicle patrol.
•Ensure all unauthorized person(s) are not inside of the parking garage during closed
hours
•Ensure all entryways and exits are secured outside of normal operating hours.
•Ensure all doors and gates to secure areas inside of the parking garage are locked and
secure.
•Will remain professional and courteous during all contacts with the general public and
city personnel
•Report to the City of Renton about any safety deficiency that would affect security
personnel from adequately securing the parking garage.
•Contracted security guards are not special commissioned police officers, security guards
will be unarmed (pepper spray canisters can be carried, projectile weapons shall
not be carried or onsite, knives or blunt weapons shall not be carried or onsite).
Security guards shall not issue citations, make arrests or hold violators.

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING THE CITY
OF RENTON FISCAL YEARS 2025/2026 BIENNIAL BUDGET AS ADOPTED BY
ORDINANCE NO. 6147, BY INCREASING THE BUDGETED REVENUES AND
EXPENDITURES BY $56,072,799 AND $167,033,277 RESPECTIVELY; AMENDING
THE 2025 CITY OF RENTON SALARY TABLE AS LAST AMENDED BY ORDINANCE
NO. 6156; PROVIDING FOR SEVERABILITY, AND ESTABLISHING AN EFFECTIVE
DATE.
WHEREAS, on November 18, 2024, the City Council adopted Ordinance No. 6147 adopting
the City of Renton’s 2025/2026 Biennial Budget and incorporating therein the job classifications
and pay ranges for City employees set forth in the 2025 City of Renton Salary Table and updated
such table in Ordinance No. 6156; and
WHEREAS, funds appropriated in 2024, but not expended in 2024 due to capital project
interruptions and delays in invoice payments, need to be carried forward and appropriated for
expenditure in 2025 requiring an adjustment to the 2025/2026 Biennial Budget; and
WHEREAS, minor corrections and the recognition of grants, contributions and associated
costs, and new cost items not previously included in the budget require additional adjustments
to the 2025/2026 Biennial Budget; and
WHEREAS, the City Council desires to amend the 2025 City of Renton Salary Table to:
make minor corrections and clarifications; reflect the wages approved as part of the 2025-2027
collective bargaining agreement with the American Federation of State, County and Municipal
Employees (AFSCME) bargaining group; update the cost-of-living increase for non-represented
employees from 3.5% to 3.8%, add a revised longevity amount for AFSCME and non-represented
employees; reflect the new position titles that were previously added to the biennium budget;

eliminate position titles that were eliminated in the biennium budget; recognize the revised titles
of Finance Director (m41), Communications and Engagement Director (m38), Parks Planning &
Trails Manager (m32), Comms & Community Engagement Manager (PD) (m30), Network &
Security Engineer 2 (a29) and Network & Security Engineer 1 (a25); and reflect salary grade
changes pursuant to the AFSCME collective bargaining agreement and the salary grade change
from m28 to m36 of the non-represented position Financial Operations Manager; and to reflect
the addition of a Financial Operations Supervisor position at m27.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION I. The City of Renton’s 2025/2026 Biennial Budget, originally adopted by
Ordinance No. 6147 is hereby amended to increase revenues by $56,072,799 for an amended
total revenues of $701,143,702 over the biennium, and increase expenditures by $167,033,277
for an amended total expenditures of $815,422,397 over the biennium.
SECTION II. The City Council hereby adopts the amended 2025/2026 Biennial Budget. The
2025 Carry Forward/1st Quarter Budget Adjustment Summary by Fund is attached as Exhibit A
and the 2026 Adjusted Budget Summary by Fund is attached as Exhibit B. Detailed lists of
adjustments are available for public review in the Office of the City Clerk, Renton City Hall.
SECTION III. The 2025 City of Renton Salary Table as last set forth in Ordinance No. 6156
is hereby repealed in its entirety and replaced with the 2025 City of Renton Salary Table, attached
hereto as Exhibit C.The Amended Salary Table is intended to be consistent with all applicable
collective bargaining agreements. In the event of conflicts, applicable collective bargaining
agreements control.

SECTION IV. The Amended Salary Table shall be effective on May 16, 2025, except the
changes to the wages of the employees of the AFSCME bargaining group shall be retroactive
starting on January 1, 2025, pursuant to their 2025-2027 collective bargaining agreement.
SECTION V. If any section, subsection, sentence, clause, phrase, or word of this ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality thereof shall not affect the constitutionality of any other section,
subsection, sentence, clause, phrase, or word of this ordinance.
SECTION VI. This ordinance shall be in full force and effect five (5) days after publication
of a summary of this ordinance in the City's official newspaper. The summary shall consist of this
ordinance's title.
