TREE REPLACEMENT JUSTIFICATION
Replacement may be authorized as an alternative to 30% retention provided the removal is the minimum necessary to
accomplish the desired purpose and provided the proposal meets one of the following options:
a. There are special circumstances related to the size, shape, topography, location, or surroundings of the subject
property; or
b. The strict application of the code would prevent reasonable use of property; or
c. The strict application of the code would prevent compliance with minimum density requirements of the zone; or
d. The project is a short plat with four (4) or fewer lots.
Please attach a written justification demonstrating compliance with the requirements and criteria as descripted above.
TREE REPLACEMENT QUANTITY
Tree replacement quantity is determined based on the credit value of the trees proposed for removal. Larger, higher
priority trees shall be used for calculation of tree replacement. Identify the quantity of each tree requested to be removed
in lieu of 30% retention, based on tree size. List the identification number of each tree, as indicated in the arborist report.

RE: Tree Retention Justification Memo
Windsor Court Subdivision
To Whom it May Concern:
Please accept this memo as justification for alternative tree replacement in lieu of retaining
30% of existing trees for Windsor Court, a proposed 20-lot subdivision. Of the 57 healthy
existing trees at the subject property, three (3) are proposed for retention. Three retained
trees amount to just over 5% retention, which is less than the 30% required by code.
Factors leading to shortfall in tree retention are as follows:
Healthy trees/root systems will be encroached by the required stormwater facility
located at the low point of the site
Healthy trees/root systems will be encroached by the required 3’ dedication and
right-of-way improvements along 108th Ave S, including the likely removal of an
existing rockery that abuts a cluster of healthy conifers (City of Kent)
Healthy trees/root systems will be encroached by 53’ of required right-of-way with
a 20’ emergency vehicle access (EVA) tract
Healthy trees/root systems will be encroached by the single-family residences and
driveways
o Maximum density is 14 DU/acre; proposed density is 11.4 DU/acre
o Minimum lot size in R-14 is 3,000 ft2; average lot size is 3,238 ft2 and 12 of
the 20 proposed lots are 3,007 ft2 or less
While the subject property fronts two roads, access is limited to 108th Ave S because 107th
Ave S is privately owned. R-14 is a mixed residential zone that supports multifamily
developments. The intensity of development in higher density residential zones can
conflict with tree retention strategies on infill sites like the subject property.
Tree credits required to both meet minimum tree density and mitigate for insufficient
retention amount to 184 credits total. While replacement plantings are proposed, there is
insufficient space on site for all required plantings. Therefore, fee-in-lieu of $375 per
replacement tree is proposed for a 93.75 credit shortfall.
