As I understand your response, this is intended to be a Hearing on the merits of the appeal. I can make 5/27 or 6/24 work for a virtual Hearing on the merits. I cannot make 5/20 work. I am on a plane back from the Upper Peninsula of Michigan (with my 90 year old father), on that day. And as noted in my prior email, I also cannot make 6/17 work for a Hearing on the merits. I think this appeal would probably benefit from a Pre-Hearing conference. That would likely help make this a more efficient Hearing. I suspect that there are a good number of undisputed facts, and document submissions, that could be stipulated to. I think it would also help the Hearings Examiner to know whether the applicant will be participating, and if so presenting witnesses or exhibits - or not. Karl G. Is the proposed 6/17 Hearing a scheduling matter, to set the process and date for a Merits Hearing, or is it intended to be a Hearing on the merits of the appeal? I ask because I am scheduled to be on a long planned family vacation from 6/1-23. I can almost certainly find a way to appear for a brief scheduling Hearing on 6/17 despite being out of town. However, it would be an extreme hardship for me to prepare for and participate in a merits Hearing that week. Since this is the first notice I have had of a proposed date, I also do not know the availability of my client representative for that week.
