for the mausoleum wall (south wall) are not procured by the landowner. The applicant also noted in the October
25, 1991 letter that the south wall is to be considered as a part of their overall closure of the site. It has been
represented to the City that the south wall is expected to be a mausoleum. That requires a conditional use permit
rrom the City of Renton. However, the landowner has not yet applied for a Conditional Use permit.)
(5) The applicant shall install impermeable membrane liners in all on -site and off -site conveyance swales in order to
protect the City's sole source aquifer from potential contamination. These liners shall be installed as appropriate
prior to commencement of further grade and fill activities or immediately upon the completion of construction of
Cut -Off Wall 3.
(Note 5a: Swales shall be lined and topsoil and grass seeding shall be installed above the liner.)
(6) The applicant shall, in order to protect the existing trees on the adjacent Mt. Olivet Cemetery site, avoid
construction activity, stockpiling of materials, and/or the use of heavy equipment within the drip line and root zone
area of the group of coniferous trees on the southern boundary of the property throughout the duration of the
project. The applicant shall replace trees damaged or destroyed as a result of the project or project construction
activities, subject to the approval and satisfaction of the City's Development Services Division.
(7) The applicant shall, in order to mitigate stormwater and erosion impacts both on and off -site, submit temporary and
permanent stormwater facility plans and erosion control plans to the City's Development Services Division for the
proposed project activity. The applicant shall also pi ovine the City with a permanent erosion control system and
slope stability analysis for post -closure activities. These plans shall be submitted prior to issuance of the Special
Permit for grade and fill and issuance of the annual Grade and Fill license in order to prevent or diminish potential
erosion, stability or stormwater impacts.
N t 7 : All plans shall be completed in compliance with the 1990 King County Surface Water Design Manual, in
particular, the core requirement for off -site analysis and for an erosion/sedimentation control plan. In addition, a
conceptual drainage plan shall be submitted to the City for approval prior to site plan approval, per City Code 4-22-
5.)
(8) The applicant shall, in order to protect the City's sole source aquifer, pay for professional geotechnical engineering
testing services to be performed by a qualified engineering firm approved by the City of Renton. Approval of the
geotechnical engineers by the City shall occur prior to issuance of the Special Permit for grade and fill and the
annuai license for grade and fill. The aforementioned firm shall conduct and perform water quality/well monitoring,
leachate and sod sampling and testing required under Rea emendations 9 through 11, and report to the City's
Development Services Division on a quarterly basis through the life of the project.
(9) The applicant shall, in order to protect the City's sole source aquifer, ensure that all of the groundwater wells on the
project site ere monitored by the applicant's engineer on a quarterly basis during the project and for one year
following cic:;c. and annually thereafter. The annual monitoring shall be accomplished per requirements of WAC
173-200. Weil ro nitoring shall include, but not be limited to: ammonia, nitrite, nitrate, COD, chloride, tots i coliform
bacteria, conductivity, iron, manganese, zinc, sulfate, TOC, cadmium, chromium, copper, lead, nicked and VOC's
(EPA method 8240).
The applicant's consultant shall submit well logs and results of well groundwater monitoring to the Seattle/King
County Board of Health in a timely manner following quarterly testing. Copies of the reports shall also be submitted
by the applicant's consultants to the City's Development Services Division in a timely manner.
(10) The applicant shall, in order to protect the City's sole source aquifer, ensure that quarterly leachate monitoring is
conducted by the engineering consultant as specified in Recommendatior 8 (above). Leachate monitoring shall
include, but not be limited to: TOC, BTEY., TOX, total colform bacteria, turbidity, specific conductance, nitrate, pH.
VOC, heavy metals, and other probable contaminants. The leachate testing shall be performed quarterly by the
approved consultant and paid for by the applicant. Resuits of testing shall be submitted to the Seattle King Cou1ty
Board of Health, Metro, and the Cays Development Services Division in a timely manner.

(11) The applicant shall, in order to protect the City's sole source aquifer, ensure that all fill material deposited on ,`-
site is certified as 'dean" (i.e., below Model 'roxics Control Act limits) by visually inspecting fit and cap material c
each load delivered to and deposited on project site. This inspection shall be performed by a representative of thi
applicant who is has completed the Solid Waste Association of North America certification course and is certrfiec
by the Washington State Department of Ecology. In addition, off -site sog material delivered to the site must mee
one of the conditions 'A' or 'B' below:
A) The applicant shall submit results of analyses conducted on soils sampled from each off -site area when
material has been collected. Sampling of fill material shall be performed on a random basis by th,
applicant's engineering consultants as specified in Recommendation 8 (above). Only material certified a-
. clean* will be accepted as till for the Mt. Olivet landfill operation.

B) Soils sampling shall take place in areas where off -site soils fill or cap material was placed during tha
quarter. The number of samples and spacing shall be adequate to cover the area filled and to determin.
quality of the fill in that area. Any samples found to exceed the Modei Toxics Control Act (VTCA) limn.
shall be tested again. If the second round of testing for on -site materials shows that the limits are st;
exceeded, then the material shall be removed such that the remaining sod is below stated MiCA limits a
determined by follow-up tests. If unsuitable fill material is found, the applicant shall ensure that the rrateria
is removed and property disposed of at the operator's expense within ten (10) working days of notificatio,
by the City. Soil tests shall include, but not necessarily be limited to: heavy metals, TOC. VOC, TPH, am
other potential contaminants.
(12) The applicant shall, in order to protect the Public health and safety. pay for professional geological engineerin
services to be performed by a qualified firm selected by the applicant and approved by the City's Developmer
Services Section. The aforementioned firm shall conduct and perform tests and calculations as necessary t
determine the stability of slopes both on -site and off -site (directly adjacent to the subject site), and they shall alsi
recommend mitigation measures as necessary for the project site throughout the life of the project.
(13) The applicant shall, in order to mitigate potential impacts to the city's sole source aquifer, agree to meet all state
federal, regional and local requirements ,or the disposal of leachate via connections to sanitary sewer mains. The
applicant shall obtain letters of approval from the City and Metro sanitary sewer utilities for discharging leachate Ic
the sanitary sewer system over the life of the project into each agency's respective conveyance/treatment system
The letters of aoprovat must be submitted to the City's Development Services Division prior to issuance of the
Special Permit for grade and fill and the annual i ;tense for fill and grade.
(14) The applicant shall, in order to mitigate air quality and dust impacts, work with the adjacent and sur, oundinc
property owners/residents to provide for clean-up or other mutually agreed compensating action. If the applican
is unable to work out a mutually agreeable plan with city residents, the City will consider a bond or cash reserve
fund to mitigate air quality/lust impacts to local residents. The applicant shall also agree to require truck operator,
to use effective covers to reduce wind-blown dust and debris throughout construction activities.
(15) The applicant shall, in order to provide for street clean-up as needed during fill operations, provide the City with
letter of credit or other security device approved by the City Attorney, to cover the cost or street cleaning along hay
routes. This security device shall be provided to the City prior to the granting of the Special Permit for grade anc
fall.
(16) The applicant shall, in order to repair wear or damage to roads which can be attributed to the project, provide the
City with a refundable cash deposit, or the City Attorney with a letter of credit or similar g grantee in the amount c
$3,000 for repair or patching of damaged roads. This letter shall be submitted prior to granting of the Sped
Permit for grade and fill.

(171 The applicant shall. in order to assure adequate response to emergency services. agree to maintain, appropriate
emergency access to the project site during arld following construction avivities. The applicant shall meet witt-
representatives of the City s Fire Deparment and obtain a letter of approval to be submitted to the Development
Services Division prior to issuance of the Special Permit for grade and `ill.
(18) The applicant shall, in order to mitigate construction traffic impacts in the area. agree to limit the hours of hauling
and fM delivery to between 8:30 a.m. to 3 30 p.m.. Monday through Friday Hours of on -site Ul operations shall be
limited to 7:00 a.m to 10 00 p.m., Monday through Saturday (per Court Order No. 87-2-03724-0 (July 24, 19871) it
order to diminish construction impacts on the adjacent residential community The agreement shall be submittec
in the form of a letter to the City Development Services Division for approval prior to issuance of the Specia
Permit for grade and fill and the annual grade and fill license.
(19) The applicant shall. in order to diminish construction traffic impacts on surrounding roadways, instruct haulers tc
travel on truck hauling routes approved by the City s Transportation Division during trips to or from the landfill.
ADDITIONAL. NOTES TO APPLICANT
Note 1. The applicant shall provide to the City the results of a survey conducted by a licensed survey engineer
which locates the true center line of Blaine Avenue and identifies the limits of the City's right-of-way in relation to the
proposed cut-off wall. The applicant shall also obtain right-of-way use permits or appropriate street vacation from
the City of Renton as needed, in order to install proposed landscaping buffers along the west side of Cut -Off Wal
#3. This measure is included to assign responsibility for the landscaping to the applicant and to release the Cit•,
from any responsibility for maintenance via ownership.
Note 2. The applicant shall comply with all applicable local, regional. state and federal rules, regulations, laws
ordinances and standards, especially Seattle/King County Board of Health requirements for water quality samplinc
and Department of Ecology requirements for on -site remediation or clean-up in the event of leaks or spills.
Note 3: The applicant shall, in order to mitigate possible Spills or leakages of hazardous substances which coulc
adversely impact the aquifer, agree to comply with King County and the Department of Ecology (DOE
requirements for on -site remediation or clean-up in the event of leakage or spills Letters of agreement shall be
obtained from both King County and the DOE

Review Conunfttee under their authority of Sec'von 4-" Renton Municipai Code (see arached sheet)

This Determination c` Non -Significance - Mitigated (DNS-M) is issued under vVAC 197-11-340(2). Because
mitigation measures have been imposed, the lead agency will not act on this proposal for fifteen (15) days

range from 7 to 12 feet in height_ The applicam proposes installing landscaping at the base of the
proposed cut-off wail in a planting strip that is five feet wide (a portion c4 the proposed panting strip area is
located on Clry-awned road right-of-way). Native ornamental trees. shrubs and groundcover are proposed
for landscaping in this arza. The project would add about 83,000 cubic yards of construction debris fill to
the site. StockpOied site material would be used for the cap. Closure of all six phases of the projec: would
occur under this Grade and Fill permit application. Construction and closure would take approximately six
to twelve months to complete after initiation of project activity.

CONDMONS: The ErrAronmental Review Committee issued a
Determination of Non Significance - Mitigated with the following conditions:
The applicant shall limit the height of the proposed construction debris landfill, including cap and
closure material per the applicant's plan, to a height which does not exceed 335 feet above sea
level. These recommendations are made in order to protect the public health and afety through
timely completion of the landfill operation, while considering economic feasib,ities of the proposed
prom
(Note i3: The applicant shall include ail soils for landscaping purposes (per Recommendation #2.
beiaw) within the 335400t height limitation.)
2. The applicant shall submit landscape plans to the City's Development Services Division for review
and approval of the design, installation and maintenance of landscaping buffers and planting beds.
Plans shall be submitted prior to issuance of the Special Permit for grade and fit. This measure is
imposed in order to mitigate the significant adverse visual impact of the landfill and cut-off wails on
the community. Landscape buffer anus and planting beds shaft be designed by a licensed
Landscape Architect under contract with the applicant The applicant stW be responsible for
financing the design. instaNation and maintenance of the Landscaped areas. Appropriate
installation and maintenance techniques shall be implemented. In addition, the applcant shall
include Landscaped planting beds in front of all cut-off walls, as proposed, and subject to the
review and approval of the City. The following are the minimum buffering requirements:
A) Cut-off Wall No. 3 shah be set back a MN*num of 154eet from the west property line to
allow inclusion of a significantly treed landscape buffer within the setback in Order to
mitigate the significant adverse visual impacts of the landfill and to screen the side slopes
and overall height of the project The applicant shall submit plans for this Landscaped
buffer area to the City's Development Services Division for review and approval prior to
issuance of the Special Permit for grade and fill. i tardy native and ornamental plant
materials suited to the Pacific Northwest region shall be utilized in the landscaped planting

beds and buffer areas. A harry vine plant material shall also be installed, sucbl that the
vine grows to cover the wad in order to s:;r r views of the wall from off -site locations. An
irrigation system sral also be insta8ecl in the butler area to provide water for plant
materials_ Ptarrdng and the insinuation of the irrigation system shall occur immedlate+y
upon completion of consmiction of Cut -tiff Wad 3 and prior to final closure of the iandfil
operation.
B) The applicant strap be resportsNe for essabiistring a landscaped baler strip (minimum
,44M 10 feet) along and belIi Cut-off Walls No. 1 and 2. (as measured from the irtside of
the , -As to the interior of the subject site) and along the north perimeter property lime and
the east perimeter property line (o a point apprmamately 275 feet south of the intersecdon
with the north property line), up to, but not kidttding, the locations capped and dosed by
the previous operator (as indicated on Sheet C-3, ML Olivet Reclamation Site Fnai
Closure, dated 10/18/9o, of the project stc xr&W packet). Hardy native Pacific Northwest
plaint species shall be planted and drfp irrigation shag be irmtaMed in this buffer area within
s xty (60) days of the compie!ion of f rig of each of Phases 4 and 5. The applicant shall
be responsible for the design, irort and maintenance of the landscaped buyer area
Instaflation and maintenance of this buffer strip shall be accompimhed such that the
leachafe collection and treaunent system or the cap and liner are not compromised. A
vlrw plant material shall also be installed alcxtg Cut -Off Wass No. 1 & 2. such that the vine
cove s the wags in order to screen views of the wails from off -site locations.
(Note�: tf the applicant can not meet rile buffer requirements of Recomn►er>dations 2-A) and 2-8)
above. then the appiicar►t shad be responsible for submitting an aftemadve plan to the Clty of
Renton Development Services Division. for the design, iraU taboo and maintenance of alternative
landscaped buffer/setback areas that provide 'as good or better' visual screening potentW for
offsite areas. This submaw must be approved by the City prior to issuance of the Special Permit
for grade and fill and/or the annual fig and grade license. Landscaping plans for buffer/setback
areas must include adequate piannng3 to screer, views of the landffl hDrrt off -site locations.
3. The applicant shall, in order to ensure completion of landscaping requirements and replace plant
materials that do not survive, provide to the Clys Deveiopment Services Division set -aside funds,
lelers of credit, or other security devices equal to 10% of the value of site landscaping as indicated
below in 3.A and 3.8. These security devices shall be submitted to, and be approved by, the City
Attorney prior to the issuance of the Spec!-d Permit for grade and fit.
A) The applicant shall provide to the City a security device to ensure completion of site
landscaping and maintenance as specified unde- Recommendation 2 (above).
B) The applicant shall provide to the C2ty a security device in rrder to replace dead or dying
pont materials in landscaped buffer zones, planting strips and along the top of cuCL-off
wads for a minimum period of three (3) years from the tame of installation.
4. The appilceint shall. in order to mitigate sirdlcant adverse aesthetic impacts of the proposed
project. I" finished slopes to a mmanum slope of 3:1 (horoxIat to vWdcal), except as may be
otherwise allowed by the City along the common bowidary of the subject sate with the Mt. Olivet
Cemetery to the south. The applicant shah agree to round and feather finished slopes into the
natural grade where possible. especially on highly visible slopes, in order to blend the proiject in
with the natural appearance of surrounding lendforms.
CNZ9 The applicant. in his lettt r of October 25. 1391 to the City, has agreed to incorporate a
2.5:1 slope at the south fit of the Tdamation pMpa adjoining the north property line of the
cemetery, in the event that the pemuts for the mausoleum wad (south wall) are not procured oy the
landowner. The applicant also noted in the October 25. 1991 letter that the south wall is to be

considered as a part of their overall closure of the site. It has been represented to the Cty that the
south wall is expected to be a mausoleum. That requires a conditional use permit from the City cf
Renton. However, the landowner has not yet applied for a Ccnditionai Use perms[..)
The applicant shall install impernmde membrane liners in all on -site and off -site conveyance
swaies in order to protect the Ws sole sourc r aquifer from potential contamination. These liners
shad be installed as appropriate prior to commencement of h nher grade and fin activities or
immediatety upon the completion of construction of Cut -Off Wall 3.
(Note 5a: Swales shag be lined and top" and grass seeding shalll be installed above the liner.)
6. The appik2m shall. in order to protect the existing trees on the adjacent Mt Olivet Cemetery site,
avoid consvuctlori activity, wxkD&,g of materials, and/or the use of heavy equipment within the
drip line and root zone area of the group of cor.;ferous trees on the southern boundary of the
property throughout the duration of the project The applicant shaii replace trees damaged or
destroyed as a result of the project or project construction activities, subject to the approval and
satisfaction of the City's Development Services Division.
The applicant shall, in order to mitigate stormwater and erosion impacts both on and off -site,
submit temporary and permanent stormwater facility puns and erosion control plans to the Cty's
Development Services Division for the proposed project activity. The applicant shall also provide
the C:ty with a permanent erosion cxxtrul system and slope s'ab►iity analysis for post-iosure
activities- These plans shall be submitted prior to issuance of the Special Permit for grade and f1r I
and issuance of the annual Grade and iri license in order to prevent or diminish potential erosion,
stability or stormwater impacts.
(Nate 7a: All plans shall be completed in compliance with the 19W Kong County Surface Water
Design Manual, in particular, the core requirement for off -site analysis and for an

inspection shall be performed by a representative of the appik-ant who is has completed the Solid
Waste Association (Y North America certification course and is certified by the Washington State
Department of Ecoii3gy. In addition, off -site soil material delivered to the site must meet one of the
conditions 'A' or '8" bela v:
A) The applicant shall submit results of analyses conducted on sorts sampled from each off -
site area where material has been collected. Sampling of fill rnaterWa shall be performed
on a rar dom basis by the appiicanVs engineering consultants as specified in
Recorr,mcridation 8 (above). Only material certified as 'dean' will be accepted as fill for
the Mt Olivet landfill operation.

B) Sods sampling shall take place in areas where off -site soils frfll or cap material was placed
during that quarter. The number of sarrples and spacing shall be adequate to cover the
area fried and to determine quality of the toll in that area. Any samples found to exceed the
Model Toxx,cs Control Act (MTCA) limits shall be tested again. If the second round cf
testing for on -site matenals shows that the limits are still exceeded, then the material shall
be removed such that the remaining sod is below stated MTCA limits as determined by
follow-up tests If unsuitable fill material is found, the applicant shall ensure that the
material is removed arxi properly disposed of at the operators expense within ten (10)
working days of notification by the City. Sol tests shall include, but not necessarily be
limited to: heavy metals, TOC, VOC, TPH, and other potential contaminants.
12. The applicant snail, in order to protect the public health and safety, pay for professional geological
engineering services to be performed by a qualified firm selected by the applicant and approved by
the Clty's Development Services Section. The aforementioned firm shall conduct and perform
tests and calculations as necessary to determine the smblity of slopes both on -site and off -site
(directty adjacent ':o the subject site), and they shall also recommend mitigation measures as
necessary for the project site throughout the life of the project.
13. The applicant shall, in order to mitigate potential impacts Yo the city's sole source aquifer, agree to
meet all state, federal, regional and local requirements for the dispOaal of leachate via connections
to sanitary sewer mains. The applicant shall obtain letters of approval from the City and Metro
sanitary sewer utMdes for discharging leachate to the sanitary sewer system over the life of the
project into each agency's respec&ie corweyance/treatment system. The letters of approval must
be submitted to the Chys Development Services Division prior to issuance of the Special Permit
for grade and fip arwd the annual license for tilt and grade.
14. The applicant shall', in order to mitigata air quality and dust impact& work with the adjacent and
surrounding property owners/residents to provide for dean -up or other mutually agreed
compensating action. If the applicant is unable to work out a mutually agreeable plan with city
mitmeas2 - 4
residents, the City will consider a bond or cash reserve fund to mitigate air cuaiity/dust impacts to
local residents. The applicant shall also agree to require truck operators to use affective covers to
reduce wind-blown dust and debris throughout construction activities.
is. The applicant shall, in order to provide for street clean-up as needed during fill operations, provide
the City with a letter of credit or other security device approved by the City Attomey, to cover the
cost of street cleaning along haul routes. This security device shall be proMed to the City prior to
the granting of the Special Permit for grade and Mi.
16. The applicant shall. In order to repair wear or damage to roads which can be attributed to the
project, provide the City with a refundable cash deposit, or the City Attorney with a letter of credit
or similar guarantee in the amount of $3,000 for repair or patching of damaged roads. This letter
shall be submitted prior to granting of the Special Permit for grads and rill.
17. The applicant shall, in order to assure adequate response to emergency services, agree to
maintain appropriate emergency access to the project site during and following construction
activities. The applicant shall meet with represerratives of the City's Fire Department ano obtain a
letter of approval to be submitted to the Development Services Division prior to issuance of the
Special Permit for grade and fill.
18. The applicant shall, in order to mitigate construction traffic impacts in the area, agree'o limit the
hours of hauling and MI delivery to between 8:30 am. to 3:30 p.m., Monday through Friday. Hours
of on -site fill operations shalt be limited to 7:00 a.m. to 10:00 p.m., Monday through Saturday (per
Court Order No. 87-2-03724-0 [July 24, 19871) in order to diminish construction impacts on the
adjacent residential community. The agreement shall be submitted in the form of a letter to the
City's Development Services Division for approval prior to issuance of the Special Permit for grade
and fill and the annual grade and MI license.
19. The applicant shall, in order to diminish construction traffic impacts on surrounding roadways,
instruct haulers to travel on truck hauling routes approved by the City's Transportation Division
during trips to or from the landfill.
ADDITIONAL NOTES TO APPLICANT
Note 1: The applicant shall provide to the City the results of a survey conducted by a licensed
survey engineer, which locates the true center line of Blaine Avenue and identifies the limits of the
City's right-f-way in relation to the proposed cut-off wail. The applicant shall also obtain right-of-
way use permit or appropriate street vacation from the City of Renton as needed, in order to
install proposed landscaping buffers along the west side of Cut -Off Wall #3. This measure is
included to assign responsibility for the landscaping to the applicant and to release the City from
any responsibility for maintenance via ownership.
Note 2: The applicant shall comply with all appik.able local, regioral, state and federal rules,
regulations, laws, ordinances and standards, especially Seattle; King County Board of ' lealth
requirements for water quality sampling and Department of Ecology requirements for on -site
remedlatlon or dean -up in tha avent of leaks or spills.

September 19, 1991 to the above referenced site, I must ask
you to change Development services Transportation review
comments from approved to not avpr2Y'ed.
The reason for not approving the wall extension at this time
is that, as proposed, the base of the wall would be at a
much greater elevation than the adjacent roadway. When it
becomes necessary for the adjacent roadway (Blaine Ave NE)
to be widened and improved for development access, beyond
the subject property, the roadway widening would remove the
support for the proposed wall. Therefore, it necessary
that we requirethat the wall be installed at an elevati

elevation of the gall need not change.
in order for the city to evaluate the wall at its submitted
footing elevation, we must make sure that it will interfere
minimum with the development of the public right of way. To
accomplish this a setback from the property line must be
determined by a licensed professional engineers specialized
in geotechniral and structural design.
The set back analysis is to be provided by the Developer.
To make a better assessment of the situation, additional
information will need to be finished by the Developer,
including:
a) A roadway cross section every fifty feet is
to be provided. Show existing elevation for
following:
1) Elevation at base of proposed wall.
2) Elevation at the property line.
3) Elevation at roadway center lire
4) Elevation at 25 feet back of
property line..
b) Note, property line needs to be sho,,.-n on the

After reviewing the application and plans for final closure, I have the following comments
1. The site lies in aquifer protection zone 2.
2. More information is needed to determine and ensure that the leachate conveyance system
does not leak and that the leachate collection system efficiently collects all ieachate.
3. We need more information on the truck wash facility. Is this area contained so that
contaminated water does not fall on the ground? Where does the drainage go? How and
when is this facility cleaned?
4. Drainage facilities should not allow infiltration prior to treatment (e.g. tight lining to the
treatment facility, biofiltration, lined ponds etc.). Stormwater must be treated prior to
infiltration. Please provide details on the treatment method proposed.
5. The City should have the consultant provide quarterly reports (or more frequent depending
on the activity) to include results of site inspections and monitoring to include descriptions of
activity at the truck wash facility, I(:-achate collection and treatment facilities, drainage facilities, J
ground water monitoring results, status of site such as area being worked, fill used etc.
6. Groundwater monitoring should be conducted at all ix o the monitoring wells instead of —L
the four proposed. In addition, it is requested that�J�C be tested on a �I
instead of annual basis and �that heavy metals be added to the parameters to be measuredY44 `f f J

7. The locations of the six monitoring wells are not dear from the figures presented. Please

basis. Site inspections should include walking the entire site. checking status of drainage

existing and proposed)
Applicant does not Indicate where soils exported off site will be disposed. Are there soils
contaminated?
Water Is the Mt. Olivet Pond/Creek under the jurisdiction of the Shoreline Master Program.
Checklist does not address potential leachate contamination of ground water/ City sole
source aquifer.
Plants The checklist indicates no landscaping is proposed. Is this true?
Environmen- Mitigation measures should address leachate and methan.

Land use What Is the ultimate use proposed for the property.
Aesthetics Will the wall be painted. Is it wood grain texture or board texture?
The proposal does not address the visual impact of the existing grading and fil, which is
highly visible from Downtown Renton and Maple Valley
Summary The applicant has attached a letter to the checklist which answers some of the above
questions. The checklist should be revised to reflect this information.
Regarding the attorney letter to Zanetta Fontes, I think we need to talk to the City Attorney
about ERC changing the determination from DNS -Mitigated to DNS. While the proposal
may incorporate mitigation previously required, I am not sure that the actions contained In
this proposal don't require their own mitigation. This letter also refers to expansion of the
vertical boundaries permitted by Renton. I assume this refers to greater height. This is not
mentioned in the checklist, but must be addressed.
GRADE AND FILL PERMIT
The applicant does not address the criteria for issuance of a Special Permit for Grade and Fill.

at the public hearing to be held on the above referenced
application made by Fiorillo Northwest Inc. (John McKenna).
American Memorial is identified as an owner of record on page 2 of
the preliminary report to the hearing examiner for the March 17,
1992 hearing.
In so far as American Memorial can't review or comment on those new
Engineering Plans and or Designs that may be required of Fiorillo
if the Hearing Examiner imposes those conditions required by the
ERC as mitigating measures, until you have actually made your
decision, and the engineering plans if required are produced for
review and approval by the City, the intent of this letter is to
preserve American Memorial services Inc.s' right to appeal if
necessary your decision and further the right's of an owner of
record to appeal if necessary the decisions approving or
disapproving those future Engineering plans which may be required
by your decision in this ongoing approval process.
We note that additional plans and approvals may be required by the
City if the ERC conditions are imposed, reference Para. is (2),
(2) A), (NOTE 2a:), (7), (NOTE 7a:) as described in the report to
the Hearing Examiner.
It appears to American that the City has conducted an exhaustive
environmental review of all aspects of the land reclamation
project, and we are relying on the City and the applicant moving
forward to see this project completed in an environmentally sound

Expansion of the Mt. Olivet Land Reclamation onto the four adjoining residential lots
(to the south and west of the existing landfill) and throughout the remainder of the
project site. The project would construct a third cut-off wall that wouid vary in
height, but which would be up to 12 feet in height. The project would add aoout
83,000 cubic yards of construction debris fill to the site. Closure of all six phases of
the project would occur under this Grade and rill permit application. Construction
and closure would take approximately six to twelve months to complete after
initiation of project activity. The project is located at 2235 N Third Street.

The Environmental Review Committee (ERC) has issued a Detain irsation of Mon -Significance - Mitigated
for the following project(s) under the autrority of the Renton Municipal Code. The following Applicant(s)
have completed a mitigation process:
MT. OLIVET LAND RECLAMATION

rxpansion of the Mt. Olivet Land Reclamation orco the four adjoining residential lots (to
the south and west of the existing larxfflll) and throughout the remainder of the project site.
The project would construct a third curt -off wall that would vary in height, but which would
be up to 12 feet in height. Landscaping would be installed at the base of the wall in
planting strip that is five feet wide (this area is possibly on City -owned land). Native
ornamental trees, shrubs and groundcuver are proposed for landscaping in this area. The
project would add about a3,000 cubic yards of construction debris fill to the site. Closure
of all six phases of the project would occur under this Grade and Fill permit application.
Construction and dosur3 would take approximately sic to tweh•s months to complete after
initiation of project activity. The project is located at 2235 N Third Street.

would construct a third cut-off wall that would vary in height, but which would range from 7 to 12
feet in height. The applicant proposes installing landscaping at the base of the proposed cut-off
mall in a planting strip that is five feet wide (a portion of the proposed planting strip area is
located on City -owned road right-of-way). Native ornamental trees, shrubs and groumcover are
proposed for landscaping in this area. The project would add about 83,000 cubic yards of
construction debris fill to the site. Stockpiled site material wo old he used for the cap. Closure of
all six phases of the project %wld occur uroder this Grade and Fill permit application.
Construction and closure would take 2pproximately six to twelve months to complete after
initiation of project activity. The project is located at 223` 'forth Third Street.
The 15 day comment period for these projects will end on February 11, 1992. Following the end of the
comment period, the City will finalize its Detemunation unless comments received require a reevaluation.

The revised conditions do not constitute a change to the previously issued preliminary threshold Determination of Non -
Significance - Mitigated. Cnly the mitigation measures have changed.
See enclosed Revised Mitigation Measures document.
Because the Environmental Review Committee imr,osed specific mitigation measures rather than issue a C 'mination of
Significance, there is a required 15 day comment period during which comments are soiicited from various agencies,
jurisdictions or individuals (including the applicant) who may have an interest in the Committee's decision. The comment
period will end February 11, 1992. Following the end of the comment period, the City will finalize its Determination unless
comments received require a reevaluation. Following the finalization of the De'ermination, there is a required 14 day appeal
period.
WAC 197-11-660 states that the responsibility for implementation measures may be imposed upon an applicant only to the
extent attributable to the identified adverse impacts of the imposed action Since an environmental impact statement has
not been prepared for this project, any mitigation measure established by the ERC not directly attributable to an identified
adverse impact is deemed to be voluntarily accepted by the applicant.

CONDITIONS: The Environmental Review Committee iFi,;ued a
Determrnatiun of Non-S;gnrficance - Mitigated with the following conditions:
The applicant shall limit the height of the proposed construction debris landfill, including cap and
closure material per the applicant's plan, to a height which does not exceed 335 feet above sea
level. These recommendations are made in order to protect the public health and safety through
timely completion of the landfil! operation, while considering economic feasibilities of the proposed
project.
Note 1a: The applicant shall include all soils for landscaping purposes (per Recommendation #2,
below) within the 335-foot height limitation )
2 The applicant shall submit landscape plans to the City's Development Services Division for review
and approval of the design, installation and maintenance of landscaping buffers and planting beds.
Plans shall be submitted prior to issuance of the Special Permit for grade and fill. This measure is
imposed in order to mitigate the significant adverse visual impact of the landfill and cutoff walls on
the community Landscape buffer areas and planting beds shall be designed by a licensed
Landscape Architect under contract with the applicant The applicant shall be responsible for
financing the design, installation and maintenance of the landscaped areas. Appropriate
instailation and maintenance techniques shall be implemented In addition, the applicant shall
include landscaped planing beds in front of all cut-off walls. as proposed, and subject to the
review and approval of the City The following are the minimum buffering requirements
A) Cut -Off Wall No 3 shall be set back a minimum of 15-feet from the west property line to
allow inclusion of a s!gnificantly treed landscape buffer within the setback in order to
mitigate the significant adverse visual impacts of the Landfill and to screen the side slopes
and overall height of the project The applicant shail submit plans for this landscaped
buffer area to the City's Development Services Divis:on for review and approval prior to
issuance of the Special Permit for grade and fill Hardy rative and ornamental plant
materials suited to the Pacific 'Northwest region shall ce utilized in the landscaped planting
beds and bcrffer areas. A hardy vine plant material shall also be installed such that the
vine grows to cover the wall in order to screen views of the wall from off -site :orations. An
irrigation system shall also be installed in the buffer area to provide water for plant
materials. Planting and the installation of the irrigation system shall occur immediately
upon completion of construction of Cut -Off Wall 3 and prior to final closure of the landfil'
operation
B) The applicant shall be responsible for establishing a landscaped buffer strip (minimum
width 10 feet) along anc oehind Cut-off Walls No. 1 and 2, (as measured from the inside of
the walls to the interior of the subject site) art along the north pe,imeter property line and
the east perimeter property line (to a poink approximately 275 feet south of the intersec'ior+
with the north property line), up to, but not including, the locations capped and closed by
the previous operator (as indicated on Sheet C-3, Mt Olitet Reclamation Site Final
Closure, date• io/18;90. of the p.rr.ect submittal packet). Hard, native Pacrfic Northwest
plant species shalt be planted and rr•;p irrigation shall be installed in this buffer area within
sixty (60) days of the completion of 'filing of each of Phases 4 and 5. The applicant shall
be responsible for the design, insta ation and maintenance of the landscaped ouffer area
Installation and maintenance of t�- s buffer strip shall be accomplished such that the
leachate collection and treatment system or the cap and liner are not compromised A.
vine plant material shall also be insta !ed along Cut -Off Walls No 1 & 2, such that the vine
covers the walls in order to screen Y ews of the walls from off -site locations
(Note 2a. If the applicant can not meet the bjffer requirements of Recommendations 2 A) and 2 B)
above, then the applicant shall be responsible for submitting an alternative plan to the City of
Renton Development Services Division, for tr'e Jesigr., installation and maintenance of alternative
landscaped buffer/setback areas that provide 'as good or better' visual screening potential for
offsite areas. This submittal must be approved by the City prior to issuance of the Special Permit
for grade and fill and/or the annual fill and grade license. Landscaping plans for buffer/setback
areas must include adequate plantings to screen views of the landfill from off -site locations.
3 The applicant shall, it , -ler to ensure completion of landscaping requirements and replace plant
materials that do not . eve, provide to the City's Development Services Division set -aside funds,
letters of credit, or other security devices equal to 10% of the value of site landscaping as indicated
below in 3 A and 3 B These security devices shall be submitted to, and be approved by the City
Attorney prior to the issuance of the Special Permit for grade and fill.

The applicant's consultant shall submrt well logs and results of well groundwater monitoring to the
Seattle/ King County Board of Health in a timely manner following quarterly testing Copies of the

deposited on the site is certified as "clean` (i e., below Model Tcxics Control Act limits) by visually
inspecting fill and cap matenal of each load delivered to and deposited on project site. This
inspection shall he performed by a representative of the applicant who is has completed the Solid
Waste Association of North America certification course and is certified by the Washington State
Department of Ecology. In addition, off -site soil material delivered to the site must meet one of the
cond,tions "A" or "B" below
A) The applicant shall submit results of analyses conducted on soils sampled from each off -
site area where material has been cullectec. Sampling of fill material shall be performed
on a random basis by the applicant's engineering consultants as specified in
Recommendation 8 (above). Only material certified as 'clean" will be accepted as fill for
the Mt Olivet landfill operation.

B) Soils sampling shall take place in areas where off -site soils fill or cap material was placed
during that quarter The number of samples and spacing shall be adequate to cover the
area filled and to determine quality of the fill in that area Any samples found to exceed the
Model Toxics Control Act (MTCA) limits shall be tested again. If the second round of
testing for on -site materials shows that the limits are still exceeded, then the material shall
be removed such that the remaining soil is below stated MTCA limits as determined by
follow-up tests If unsuitable fill material is found, the applicant shall ensure that the
material is removed and properly disposed of at the operator's expense within ten (10)
working days of notification by the City. Soil tests shall include, but not necessarily be
limited to heary metals. TOC, VOC, TPH, and other potential contaminants
t? The applicant shall, in order to protect the public health and safety, pay for professional geological
engineerinq services to be performed by a qualified firm selected by the applicant and approved by
the City's Development Services Section The aforementioned firm shall conduct and perform
tests and calculations as necessary to determine the stability of slopes both on -site and off -site
(directly adjacent to the subject site), and they shall also recommend mitigation measures as
necessaryy for the project site throughout the life of the project
11 The applicant shall, in order to mitigate potential impacts to the city's sole source aquifer, agree to
meet all state, federal, regional and local requirements for the disposal of leachate via connections
to sanitar; sewer mains. The applicant shall obtain letters of approval from the City and Metro
sanitary sewer uAities for discharging leachate to the sanitary sewer system over the life of the
project into each agency's respective conveyance/treatment system The letters of approval must
be submitted to the Cny's Development Services Division prior to issuance of the Special Permit
for grade and fill and the annual license for fill and grade.
14 The applicant shall, in order to mitigate air quality and dust impacts, work pith the adjacent and
surrounding property owners/residents to provide for clein up or other mutually agreed
compensating action If tie applicant is unz o►e to work out a mutually agreeable plan with city
residents, the City will consider a bond or cash reserve fund to mitigate air quali!y/dust impacts to
local residents. The applicant shall also agree to require truck operators to use effective covers to
reduce wind-blown dust and debris throughout construction. activities.
15 The applicant shall, in order to provide for street clean-up as needed during fill operations, provide
the City with a letter of credit or rather security device approved by the City Attorney, to cover the
cost of street cleaning along haul routes. This security device shall be provided to the City prior to
the granting of the Special Permit for grade and fill.
16 The applicant shall, in order to repair wear or damage to roads which can be attributed to the
project, provide the City with a refundable cash deposit, or the City Attorney with a letter of credit
or similar guarantee in the amount of $3,000 for repair or patching of damaged roads This letter
shall be submitted prior to granting of the Special Permit for grade and fill.
17. The applicant shall, in order to assure adequate response to emergency services, agree to
maintair appropriate emergency access to the project site during and following construction
activities. The applicant shall meet with representatives of the City's Fire Department and obtain a
letter of approval to be submitted to the Development Services Division prior to issuance of the
Special Permit for grade and fill.
18 The applicant shall, in order to mitigate construction traffic impacts in the area, agree to limit the
hours of hauling and fill delivery to between 8 30 a.m. to 3:30 p.m , Monday through Friaay. Hours
of on -site fill operations shall be limited to 7.00 a.m. to 10:00 p m., Monday through Saturday (per
Court Order No. 87-2 03724-0 [July 24, 1987j) in order to diminish construction impacts on the
adjacent residential community. The agreement shall be submitted in the form of a letter to the
City's Development Services Division for approval prior to issuance of the Special Permit for grade
and fill and the annual grade and fill license.
19 The applicant shall, in order to diminish construction traffic impacts on surrounding roadways,
instruct haulers to travel on truck h, "--, routes approved by the City's Transportation Division
during trips to or from the landfill.

Note 1. The applicant shall provide to the City the results of a survey conducted by a licensed
survey engineer, which locates the true center line of Blaine Avenue and identifies the limits of the
City's right-of-way in relation to the proposed cut-off wall The applicant shall also obtain right-of-
way use permits or appropriate street vacation from the City of Renton as needed, in order to
install proposed landscaping buffers along the crest side of Cut -Off Wall #3. This measure is

timely completion of the landfill operation, while considering economic feasibilities of the proposed
project.

allow inclusion of a significantly treed landscape buffer within the setback in order to
mitigate the significant adverse visual impacts of the landfill and to screen the side slopes
and overall height of the protect. The applicant shall submit plans for this landscaped
buffer area to the City's Development Services Divis,ort for review and approval prior to

width 10 feet) along and behind Cut-off Walls No. 1 and 2, (as measured from the Inside of
the wags to tho interior of the subject site) and along the north perimeter property dne and
the east peri peter property line (tc a point approximately 275 feet south of the intersection
with the north property line), up to, but not including, the locations capped and dosed by
the previous operator (as indicated on Sheet C-3, ML Olivet Reclamation Site Final
Closure, dated 10/18/90, of the project submittal packet). Hardy native Pacific Northwest
plant species shall be planted and drip irrigation shall be Installed in this buffer area within
sbdy (60) days of the completion of filling of each of Phases 4 and 5. The applicant shall
be responsible for the design, insta►lation and maintenance of the landscaped buffer area.
Installation and maintenance of this buffer strip shall bo accompiished such that the
leaehate collection and treatment system or the cap and liner are not compromised. A
vine plant material shall also be installed along Cut -Off Walls No. 1 & 2, s+ Bch that the vine
covers the walls in order to screen views of the walls from off -site locations.
(fig : If the applicant can not meet the buffer requirements of Recoffirriendations 2.A) and 2.B)
above, then the applicant shall be responsible for submitting an alternative plan to the City of
Renton Development Services Division, for the design, installation and maintenance of alternative
landscaped buffer/setback areas that provide 'as good or better' visual screening potential for
offsfte areas. This submittal must be approved by the City prior to issuance of the Special PrarTnk
for grade c,nd fill and/or the annual fill and grade license. landscaping plans for buffer/setback
areas must include adequate plantings to screen views of the landfill from off -site locations.
The applicant shall, in order to ensure completion of landsaip,ng requirements and replace plant
materials that do not survive, provide to the City's Development Services Divisions set -aside funds,
letters of credit, or other security devices equal to 10% of the value of site landscaping as indicated
below in 3.A and 3.B. These security devices shall be submitted to, and be approved by, the Cory
Attorney prior to the issuance of the Special Permit for grade and fill.
A) The applicant shall provide to the City a security device to ensure completion of site
landscaping and maintenance as specified under Recommendation 2 (above).
B) The applicant shall provide to the ;Ity a security device in order to replace dead or dying
plant materials in landscaped buffer zones, planting strips and along the top of cut -Off
wags for a minimum period of three (3) years from the time of installation.
4 The applicant shall, In order to mitigate significant adverse aesthetic impacts of the proposed
project, limit finished slopes to a maximum slope of 3 : 1 (horizontai to vertical), except as may be
otherwise allowed by the City along the common boundary of the subject site with the Mt. Olivet
Cemetery to the south. The applicant shall agree to round and feather finished slopes into the
natural grade where possible, especially on highly visible slopes, in order to biend the project in
with the natural appearance of surrounding landforms.
(Note 4a The applicant, in his letter of October 25. 1991 to the City, has agreed to incorpLwate a
2.5:1 slope at the south fill of the reclamation projec l adjoining the north property line of the
cemetery, in the event that the permits for the mausoleum wail (south wall) are not procured by the
landowner The applicant also noted in the October 25. 1991 letter that the south wall is to be

south wall Is expected to be a mausoleum. That requires a conditional use permit from the City of

property throughout the duration of the project. The applicant shall replace trees damaged or
destroyed as a result of the protect or project construction activities, - ubject to the approval and
satisfaction of the Chy's Development Services Dfv+sion.
7. The applicant shall, in order to mitigate stomnwater and erosion impacts both on and off -site,
subunit temporary and permanent stomnwater facility plans and erosion control plans to the City's
Developrmem Services Division for the proposed project activity. The applicant shah also provide
the City with a permanent erosion cordrof system and slope stability analysis for post -closure
activities. These plans shag be submitted prior to issuance of the Special Pemnk for grade and fill
and issuance of the annual Grade and Fill license in order to prevent or diminish potential erosion,
stability or stormwater impacts.
(Note 7a: All plans shall be completed in compliance with the 1990 King County Surface Water
Design Manual, in particular, the core requirement for off -site analysis and for an
erosion/sedimentation control plan. In addition, a conceptual drainage pian shall be submitted to
the City for approval prior to site plan approval, per City Code 4-22-5.)
8. The applicant shall, in order to protect the City's sole source aquifer, pay for professional
geotechnical engineering testing services to be performed by z qualified engineering firm
approved by the City of Renton. Approval of the geotechn" engineers by the City stall occur
prior to issuance of the Special Permit for grade and fill and the annual license for grade and fill
The aforementioned firm shall conduct and perform water quality/well monitoring, leachate brn,
soil sampling and testing required under Recommendations 9 through 11, and report to the City s
Oevelopment Services Division on a quarterly basis through the life of the project.
9. Thu applicant shall, in order to protect the City's sole source aquifer. ensure that all of the
groundwater wells on the project site are monitored by the applicant's engineer on a quarterly
basis during the project and for one year following closure, and annually thereafter. T)-e a. ,nual
monitoring shall be accomplished per requirements of WAC 173-200. Weil monitoring shall
include, but not be limited to: ammonia, nitrite, nitrate, COD, chloride. total cdiform bacteria,
conductivity, iron, manganese, zinc, sulfate, TOC, cadmium, chromium, copper, lead, nf�kei and
VOC's (EPA method 8240).
The appicant's consultant shall submit well logs and results of well groundwater monitoring to the
Seattle/King County Board of Health in a timely manner following quarterly testing. Copies of the
reports shalt also be submitted by the applicant's consultants to the City's Development Services
Division in a timely manner

A) The applicant steal, submit results of analyses conducted on sods sampled from each o!f-
site area where material has been collected. Sampling of fdl material shag be perfonrted
on a random basis by the applicant's engineering cansuttartts as specified in
Recomirriendation 8 (above). Only material certified as 'Dean' wdl be accopted as fi for
the Mt. Olivet landfil operation.
B) Sots sampling shall take place in areas where off -site sods fill or cap material was placed
during that quarter. The number of samples and spacing shall be adequate to cover the
area filed and to determine quality of the fig in that area Any samples found to exceed the
Modei Toxie:s Control Act (MTCA) limits shah be tested again. If the second round of
testktg for on -site materials shows that the limits are still exceeded, then time material shall
be removed such ttiat the remaining sod is below stated MTCA limits as determined by
follow-up tests_ If unsuitable fig material is found, the applicant shall ensure that the
material is removed and property disposed of at the operator's expense within ten (10)
working days of notification by the city. Sod tests shag include. but not necessariy be
limited to: heavy metals, TOC. VOC, TPH, and other potential contaminants.
12. The applicant shall, in order to protect the public health and safety, pay for professional geological
engineering services to be performed by a qualified firm selected by the applicant and approved by
the City's Development Services Section. The aforementioned firm shall conduct and perform
tests and calculations as necessary to detemtirm the stability of slopes both on -site and off -site
(directly adjacerr, to the subject site), and they shal also recommend mitigation measiuues as
necessary for the project site throughout the Ige of the project_
13. The applicant shag, in order to mitigate potential impacts to the city's sole source agolfer, agree to
rneet all state, federal, regi inai and local requirements for the disposal of leachate via connections
to sanitary sewer mains. The applicant shag obtain letters of approval from the City and Metro
sanitary sewer utilities for discharging leschate to the sanitary sewer* system over the life of the
project into each agency's respective conveyance/treatment system The letters of approvaJ must
be submitted to the City's Deveiopmertt Services Division prior to issuance of the Special Permit
for grade and fill and the annual license for fill and grade.
14 The applicant shall, in order to rrutigate air quality and dust impacts, work with the adjacent and
surrounding property owners/residents to provide for dean -up or other mutually agreed
compensating action. If the applicant is unable to work out a rnutually agreeable plan with city

survey engineer. which locates the true center line of Eilaume Avenue and identifies the limits of the
