I don't find wiggle room in the Code that would allow this criterion to be ignored - Unfortunately, I think that the right way to approach this is to bring a Code revision proposal before Council (would have to cover water, sewer, storm). I would support a provision allowing commercial property coverage up to 1000/a to be used for dense developments in which no undeveloped property was identified and no setback or other deductions are proposed for the segregated area- Another possible approach would be to ask Council for an interpretation for this particular project ernly.
