I have reviewed the proposed Interpretation/Policy decision regarding the segregation of SDC
fees. Let me start by stating that the Utility Systems Division administers this section of the code
and, as such. any interpretation of this section of code needs to be done through this division.
Therefore. we do not feel that it is appropriate for Development Services to render a decision
through the format proposed.
As far as the information contained within the proposal. Utilities does feel that it was the intent of
the code at the time it was developed to require partially developed sites to be responsible for
greater than their direct area of the site. That is why the formula is in place. If, at this time.
Administration does not feel that this should still be the methodology used. then we need to
change the code. Currently, the Utility Systems Division has proposed revisions to this section
that would allow for a property in [his situation to segregate at straight fee as long as it is a
minimum of two acres and leaves a minimum of two acres. It should also be noted that the
Surface Water section of the SDC Code does allow for this methodology with 5-acre
requirements.
It would, therefore, be Utility System Division's recommendation that this instance be handled
one of two ways. The preferred way would be for us to process our code revisions, thus
eliminating the concern directl%- If timing does not allow for this, then I would prefer that
Utilities make a determination that although the five -acre allowance is not in the water or sewer
section. that its exclusion was accidental due to the reformatting that occurred during the move of
sections from Title 8 to Title 4. Thus it was the intent to continue to have this option available for
all SDC fees. This will allow the other method to stay in place where it is applicable. while
allowing the Frye development the option it needs to proceed with its plans.
