In no case shall the percentage of a partial payment for SDC fee be greater than 100% of the
percentage of the area of the site being developed. When a clearly definable portion of the site is
being used for development, with coverage exceeding 80%, then the percentage for the partial
payment of the SDC fees shall be equal to the percentage of developed site which could be
segregated via a short plat. If the site is later platted with the subject development parcel in
excess of the area used for the fee segregation, the SDC fees for the additional area will be due
prior to recording of the short plat. This condition shall be included in the restrictive covenant
recorded against the parcel for the partial SDC payment fee.
