We respectfully request approval of this modification to grant an exemption, as noted in Renton Municipal Code (RMC) 4-6-090.D.1, to allow a portion of the site’s existing overhead facilities to remain above ground due to diminished public benefit and prohibitively high costs. Background Our project proposes to perform undergrounding work to overhead utilities on the south side of the subject property (South Lines) only, while leaving the overhead power and communications of SW 12th Street and Seneca Avenue (12th/Seneca Lines) as-is. The South Lines can be undergrounded entirely, which will provide the greatest public benefit due to visibility along Highway 405. On the other hand, the 12th/Seneca Lines (and poles) must remain partially intact due to engineering restrictions and high transmission lines. The frontages of SW 12th Street and Seneca Avenue meet the current City of Renton standard and would otherwise remain largely unaffected by our work. On these frontages, there is negligible benefit achieved by undergrounding a small portion of overhead lines and eliminating a marginal number of poles when compared to the high cost of construction and the impacts to neighboring properties. RMC 4-6-090 C. Applicability 2. Existing overhead power and utility facilities abutting a development or redevelopment site triggering street frontage improvements under RMC 4-6-060 shall be required to be relocated underground, pursuant to the standards of this Section. RMC 4-6-090 D. Exemptions 1.a. Overhead power and utility facilities adjacent to a redevelopment site where a street modification under RMC 4-9-250D is granted to keep the existing overhead power and/or utility facilities above ground. 1.i. Installations where the Administrator determines: ii. The cost of undergrounding such a facility outweighs the general welfare consideration implicit in underground installation. City of Renton March 25, 2025 2240819.10 Page 2 of 3 Work Summary Below is a summary of the impacts associated with the City’s underground request. Refer to Exhibit A for limits of the overhead to underground conversion impacts based on our initial coordination efforts with Puget Sound Energy (PSE). 1. The existing overhead power along SW 12th Street supports high transmission power lines and cannot be underground. Removing the low voltage lines under the high transmission power lines will require setting additional infrastructure on neighboring private properties to maintain or restore service. We are swapping a few overhead lines for different infrastructure, and many overhead poles and lines must remain; therefore, it will not provide a noticeable benefit to the surrounding businesses or community. 2. Work that is required at the major ground vault at the corner of SW 12th Street and Seneca Avenue will require two or three major outages that affect 45+ service connections for businesses in this area. 3. Work on SW 12th Street and Seneca Avenue will require long-term disruption to at least seven businesses directly adjacent to the road and utility work. 4. The underground conversion work triggers relocating services and adding transformers and/or utility poles to adjacent businesses. New easements and occupancy of their property is required to establish these new underground services. Requiring the subject property owner to obtain offsite utility easements and take neighbors usable property is not a legal requirement that the City can make. 5. Based on our preliminary and feasibility efforts, which have expended over $30,000 in preliminary engineering with PSE, we have determined that a net benefit of two utility poles will be removed for a direct total cost of nearly $2 million and 18 months of planning/engineering/permitting, along with real tangible impacts to the local business district and impacts to our environment with unnecessary removal and replacement of functioning infrastructure. Modification Request Justification Justification No. 1 – Undergrounding 12th/Seneca Lines destroys mature frontages in compliance with City standards that are not proposed to be improved in any other manner. We have reviewed RMC 4-6-060 to determine if this project requires frontage improvements. This section of code specifies minimum design standards, including pavement widths, travel lanes, curbs, sidewalks, planter strips, and street lighting. In our pre-application notes (PRE24-00382), SW 12th Street and Seneca Avenue SW are noted as being within the Auto Mall Improvement Plan. The pre-application notes clarify that the existing curb and sidewalk may remain, provided they comply with the minimum sections above and meet current City and ADA standards. In general, the existing frontage of Seneca Avenue SW and SW 12th Street are following City standards for the Auto Mall improvement plan; therefore, frontage improvements are not technically triggered. Refer to attached Exhibit B showing existing curb, planter, and mature street trees along the project frontage. Because the existing frontages are built to City standards, we believe we are substantially compliant with the City’s policies and the project does not warrant removal of existing frontage improvements, including mature street trees, to accommodate the existing overhead power and communications utilities underground. We believe this will create an undue burden on this development by creating unneeded environmental impacts related to the removal of mature street trees, degrading the quality of the existing mature streetscape, and increasing disruption to Subaru and neighboring businesses. City of Renton March 25, 2025 2240819.10 Page 3 of 3 Justification No. 2 – The cost of the undergrounding work is not only high, but it is so high that it will likely make the project impractical and may require relocation of the Walker Subaru Service Center to an alternative site outside of the City of Renton. Refer to attached Exhibit C summarizing costs. The existing overhead power along Seneca Avenue SW supports power that runs along connecting streets and alleys. Because these offsite lines are not within our frontages, the poles, guy wires, and anchors must remain. Nowhere in the code does it state a property should be responsible for providing frontage improvements beyond their frontage. Requiring undergrounding beyond our frontage does not meet proportionality requirements, and it is not feasible to limit undergrounding to our frontage due to the location of existing utility poles and neighboring services. Justification No. 3 – Undergrounding 12th/Seneca Lines provides little benefit to surrounding properties and/or the general public. The existing overhead power and utility facilities serve several neighboring businesses. Based on our coordination with PSE, these adjacent businesses will be directly impacted by this request to underground our frontage utilities. The addition of more utility poles and infrastructure on adjoining businesses’ properties will offset any benefit of removing the limited overhead lines. After careful review with PSE and the contractor, we do not believe it is practical to implement the provisions of this Title. Many overhead lines and cables will remain to support offsite power infrastructure, and many new poles will be set on adjoining properties or public right-of-way to offset the removal of a few overhead lines. The cost of this work will be substantial, and I do not believe any businesses in this corridor with see a benefit. We believe the frontages that currently exist are safe, functional, and maintainable. Adding more infrastructure not only adds costs during construction, but increases costs for future maintenance and increases the likelihood for conflicts with future business operations. Undergrounding utilities will provide more impact to adjoining businesses during and after construction than leaving the overhead utilities in place. Please grant this modification request because the frontages are substantially in conformance with City standards for paving, curbs, sidewalks, street trees, and lighting. Removing established frontages and mature street trees to underground these utilities will have an immediate negative impact on our environment. Thank you for considering and reviewing my request. CLEARANCES: Transformers require a minimum of 6 feet from fire fighting equipment, 10 feet from combustible walls, overhangs, doors, and windows, and a minimum of 5 feet from the back of curb (or guard posts will be required per PSE standards). All conduits and vaults are to be at least 5 feet away from water, storm and sewer lines when paralleling them in the right of way, and at least 1 foot when crossing them. All work is to be done in accordance with local municipal and county permit requirements as applicable.
