PUBLIC HEARING: After reviewing the Development Services Report,examining available information on file with the application,field checking the property and surrounding area;the Examiner conducted a public hearing on the subject as follows: MINUTES The following minutes are a summary of the November 18, 1997 hearing. The legal record is recorded on tape. The hearing opened on Tuesday,November 18, 1997,at 10:55 a.m. in the Council Chambers on the second floor of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit No. 1: Yellow file containing the original Exhibit No.2: Neighborhood map application,proof of posting,proof of publication and other documentation pertinent to this request. Exhibit No.3: Apron C Exhibit No.4: Apron B Exhibit No. 5: Apron B Exhibit No.6: Elevations The hearing opened with a presentation of the staff report by MARK PYWELL,Project Manager,Development Services,City of Renton,200 Mill Avenue South,Renton,Washington 98055. The applicant requests a Conditional Use Permit(CUP)which is required for the P-1 zone in which this project is located. The applicant currently has a temporary use permit to continue the use of the structures. The original CUP was Paul B. Crane,The Boeing Con;Ya:y Boeing Crew Shelters,Aprons B &C File No.: LUA-97-143,CU-H November 24, 1997 Page 2 submitted in 1990 and the same structures are still in use. The previous permit was for five years,but the applicant is requesting a 10 year permit at this time. An environmental review occurred on October 21, 1997. A Determination of Non-Significance was issued with no mitigation measures required. The applicant uses these crew shelters and the crew support,building for the final construction of the Boeing aircraft on the Renton Municipal Aprons B and C. This project is consistent with the Comprehensive Plan (CP). This is primarily an employment and industrial use area. On the previous review City staff had some concern with the use of temporary buildings and whether or not they would be maintained in a manner conducive to the airport. Airport staff have noted that the structures have been maintained adequately. The property on which these buildings are situated is City-owned and it is leased to Boeing on a contractual agreement.The current lease runs until the year 2015. The proposed location will not result in either a detrimental or over-concentration of a particular use. Boeing needs to use the airport and indeed pays the City for the use of the municipal airport to get its aircraft out to its purchasers. These crew shelters take up a very small portion of the lease area,and certainly the airport area. Landscaping was an issue the last time that this was reviewed,and staff came to the conclusion that there was no potential area for any landscaping, at least out on the airport. The debris from any landscaping and possibly the landscaping itself could interfere with the aircraft using the airport and therefore would be a hazard. The height of the structures as they are located are well within the height limitations established from the airport. Parking on the airport aprons is a continuing area of conflict between the use of vehicles and aircraft;however, the shelters themselves don't directly relate to this. This is something to be worked out between the airport supervisor and Boeing as they work through their lease agreements. These buildings will not generate additional employees or additional traffic beyond what is there now. Although testing of the aircraft can produce high noise levels,these noise levels are within the acceptable range and have been addressed through other permits. As part of the previous permit,testing was conducted and it was proved that it was acceptable for industrial workers' levels. These structures are needed for the employees working on these aprons for such things as tool storage and plan review. Staff recommends approval of the Boeing Crew Shelters Aprons B and C with the condition that it be limited to a maximum of a 10 year period. Paul Crane, Senior Environmental Planner,The Boeing Company,P.O.Box 3707,M.S. 63-01, Seattle, Washington 98124,applicant herein,explained further regarding the noise concerns. These positions along Aprons B and C are not run-up positions--engines are not tested at this location. The positions in which the• engines are tested are on the east side of the airport with the engine facing towards the plant and where there are noise walls and baffles. The type of work that is done on Aprons B and C is mainly avionics works. The aircraft are undergoing testing of electrical systems,navigational systems,pressure tests and load tests which do not generate noise. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 11:12 a.m. FINDINGS,CONCLUSIONS&DECISION Having reviewed the record in this matter,the Examiner now makes and enters the following: Paul B. The applicant, The Boeing Company, filed a request for approval of a Conditional Use Permit to allow crew shelters at the Renton Municipal Airport. 2. The yellow file containing the staff report,the State Environmental Policy Act(SEPA)documentation and other pertinent materials was entered into the record as Exhibit#1. 3. The Environmental Review Committee(ERC),the City's responsible official, issued a Declaration of Non-Significance(DNS)for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is located along the west side of the main runway at the Renton Municipal Airport. The site is below and slightly north of the Renton Chamber of Commerce located along Rainier Avenue above the subject site. 6. The airport is currently zoned P-1 (Public/Quasi-Public uses). While the City is working to eliminate the P-1 zoning and replacing it with other appropriate zoning,the airport has not been rezoned yet. The proposed use at the airport requires a Conditional Use permit. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of employment generating industrial uses,but does not mandate such development without consideration of other policies of the Plan. 8. The specific locations are located on Aprons B and C. 9. The crew shelters are already constructed and have been in operation since 1990. They were approved under an earlier conditional use permit which was limited to five(5)years. This limitation was imposed to make sure that the buildings were properly maintained. The permit has expired and the applicant has been operating under an interim temporary permit. 10. Staff reports that the buildings have been properly maintained. 11. The applicant seeks a permit that would have a duration of ten(10)years under this authorization. 12. The applicant proposes keeping the series of buildings on Aprons B and C located on the west side of the airport. These buildings consist of a series of 20 feet wide by 64 feet long by 14.5 feet high and 12 feet wide by 30 feet long by 11 feet 7 inches high buildings. 13. These facilities permit crews working on airplanes to store tools,eat lunch,and attend meetings closer to the airplanes they are working on. 14. A review of the situation near these facilities has shown that landscaping is not appropriate. 15. Apparently there have been vehicle conflicts in this area and too many vehicles parked around these structures. Paul B. The buildings meet the required setback and height limitation of the airport zone and Federal Aviation Administration(FAA)regulations. 17. Engine "run ups" do not occur at these buildings. CONCLUSIONS: 1. The applicant for a Conditional Use Permit must demonstrate that the use is in the public interest,will not impair the health, safety or welfare of the general public, and is in compliance with the criteria found in Section 4-31-36(C)which provides in part that: a. The proposal generally conforms with the Comprehensive Plan; b. There is a general community need for the proposed use at the proposed location; c. There will be no undue impacts on adjacent property; d. The proposed use is compatible in scale with the adjacent residential uses, if any; e. Parking, unless otherwise permitted,will not occur in the required yards; f. Traffic and pedestrian circulation will be safe and adequate for the proposed project; g. Noise, light and glare will not cause an adverse affect on neighboring property; h. Landscaping shall be sufficient to buffer the use from rights-of-way and neighboring property where appropriate;and i. Adequate public services are available to serve the proposal. The requested conditional use appears justified. Nothing has really changed since the permit was originally issued seven years ago. The utilitarian buildings serve their intended purpose. 2. The proposed use continues to be related to the functioning of the airport, although if final stages of manufacturing were to occur elsewhere there would be more room for general aviation activities. That appears to be also highlighted by the Airport Manager's comments regarding parking at the site. Relocation of such activities could free up valuable and limited aviation space. 3. The buildings, other than their plain exteriors,should not have an adverse impact on adjacent property or the general public welfare. 4. There should be no adverse impact in the areas of noise,light or glare. Engine run-ups will not occur at these locations. The buildings are sized and designed so as not to interfere with aviation safety. 5. Public service support has not changed and is adequate in the areas of water and sewer. Fire protection is provided by both the applicant and the city. 6. In conclusion,the proposed ten year conditional use permit is appropriate. iJ Paul B. The Appearance of Fairness Doctrine provides that no ex parte(private one-on-one)communications may occur concerning pending land use decisions. ENVIRONMENTAL REVIEW Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971 as amended), on October 21, 1997 the Environmental Review Committee issued a Determination of Non-Significance. 3 COMPLIANCE WITH ERC MITIGATION MEASURES No mitigation measures were established under this review. 4. STAFF REVIEW COMMENTS Representatives from various city departments have reviewed the application materials to identify and address site plan issues from the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. CONSISTENCY WITH CONDITIONAL USE CRITERIA Section 4-31-36 lists 11 criteria that the Hearing Examiner is asked to consider, along with all other relevant information, in making a decision on a Conditional Use application. These include the following: (5A) CONSISTENCY WITH THE COMP. PLAN, ZONING CODE& OTHER ORDINANCES: The proposed use shall be compatible with the general purpose, goals, objectives and standard of the Comprehensive Plan, the Zoning Ordinance and any other plan, program, map or ordinance of the City of Renton. (1) COMPREHENSIVE PLAN LAND USE ELEMENT The existing crew shelters and support building are consistent with the Comprehensive Plan designation of Employment Area- Industrial. Policy LU-195: The primary use in the Employment Area - Industrial designation should be industrial. The shelters and support building area accessory uses to the primary use of the construction of airplanes by the Boeing Company. The Boeing Company uses aprons B & C as staging areas for the final steps in the construction of aircraft. The shelters and support building provide the work crews with an area out of the weather to store tools and blueprints used in their work. Policy LU-197: Industrial uses with a synergistic relationship should be encouraged to locate in close proximity to one another. The industrial use of the airport's apron for the construction of aircraft is an industrial use. The completion of construction of the aircraft must occur on or adjacent to an airport out of which the completed plane can be flown. Policy T-49: Use existing airport land primarily for direct aviation related uses. The construction of aircraft can be considered a direct aviation related use. The crew shelters and support building are necessary for the completion of this work. The manufacturing of aircraft is listed as a conditional use. As the shelters and support buildings are part of the Boeing Companies manufacturing of aircraft the conditional use permit is required to retain these structures on the municipal airport. (5B) COMMUNITY NEED: There shall be a community need for the proposed use at the proposed location. In the determination of community need, the Hearing Examiner shall consider the following factors, among all other relevant information: (a) The proposed location shall not result in either the detrimental over concentration of a particular use within the City or within the immediate area of the proposed use. The planned development will the not increase the number of employees or expand the use of the project site. It will provide support facilities for the existing employees in the performance of their work. (2) That the proposed location is suited for the proposed use. The proposed site has been found to be suitable for the final assembly and the testing of aircraft. The proposed sheds are located so as to not interfere with the ongoing use of the airport or with adjacent land use. The proposed buildings are located behind the Building Restriction Line for the airport. (5C) EFFECT ON ADJACENT PROPERTIES: The proposed use at the proposed location shall not result in substantial or undue adverse effects on adjacent property. The following site requirements shall be required: (1) Lot Coverage: Lot coverage shall conform to the requirements of zone in which the proposed use is to be located. There are no lot coverage requirements in the Public Use zone (P-1). In this case where the use is the outdoor testing of aircraft, the only buildings will be the crew support buildings and sheds applied for under this permit. (2) Yards: Yards shall conform to the requirements of the zone in which the proposed use is to be located. Additions to the structure shall not be allowed in any required yard. In this case the "yards" are provided by the landscape buffer area that the airport provides on the vicinity of these two aprons. No further landscape buffering has been required. (3) Height: Building and structure heights shall conform to the requirements of the zone in which the proposed use is to be located. Spires, belltowers, public utility antennas or similar structure may exceed the height requirement upon approval of a variance. Building heights should be related to surrounding used in order to allow optimal sunlight and ventilation, and minimal obstruction of views from adjacent structures. Building heights within the airport are restricted to ensure that they do not interfere with the use of the airport runways and taxiways. This project has been reviewed by the Airport Manager who has found the height of the proposed buildings to be acceptable within the areas that they are located. (Ord 3599, 1-11-82) The proposed units are compatible in use with the existing airport facilities. The buildings are generally aesthetically compatible with other buildings located within the airport area. Based upon concerns about the advisability of permitting modular structures in this area on a permanent basis staff recommended as part of the last conditional use permit that the life of these units be limited to two years with the possibility of the applicant being granted three one- year extensions for a total of five years. The old permit has now expired. At no time in the past did City staff have a problem with the maintenance program that Boeing has established for these units. The structures are still in good shape and are not considered to be a problem. The applicant is now requesting that a ten year permit be granted for these structures. City staff is supportive of this request. If at some time in the future City staff felt that the structures required replacement, there are adequate provisions in the Code to enforce the maintenance of the structures or to revoke the conditional use permit if the structures are not adequately maintained. (5E) PARKING: Parking under the building structure should be encouraged. Lot coverage may be increased to as much as seventy-five percent(75%) of the lot coverage requirement of the zone, in which the proposed use is located, if all parking is provided underground or within the structure. (Ord.3903, 4-22-85) Parking on the airport aprons and the use of vehicles in this area is a continuing area of conflict between vehicles and aircraft using the taxiways. Although not directly tied to the current permit, the vehicle traffic would exist whether or not the shelters are in place, the applicant needs to be aware of the City's concern and expectations for the safe movement of vehicles. This can be more directly addressed when the leases for the aprons are next under review for renewal. No additional parking is requested or granted through this conditional use permit. (5F) TRAFFIC: Traffic and circulation patterns of vehicles and pedestrians relating to the proposed use and surrounding area shall be reviewed for potential effects on, and to ensure safe movement in the surrounding area. These buildings will not generate additional employees or additional traffic. The Transportation Systems Section has indicated that the proposed development should not impact existing traffic circulation. The Airport Supervisor has noted that there is a concern over the movement of vehicles on the aprons and taxiways. These concerns are not directly tied to the current permit but the applicant needs to ensure that their staff follow due diligence in the movement of vehicles and equipment in this area. (5G) NOISE, GLARE: Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the location of on-site parking areas, outdoor recreational areas and refuse storage areas. Although the testing of aircraft can produce high levels of noise, this is not the issue be addressed by this permit. The shelters themselves have not in the past nor is it anticipated that they will produce noise or glare in the future. The Hearing Examiner may require additional landscaping to buffer adjacent properties from potentially adverse effects of the proposed use. No landscaping is required or appropriate on this area of the airport. In this area landscaping material or debris could easily be drawn into the engines of the aircraft so the aprons need to be kept clean of this type of material. (51) ACCESSORY USES: Accessory uses to conditional uses such as day schools, auditoriums used for social and sport activities, health centers, convents, preschool facilities, convalescent homes and others of a similar nature shall be considered to be separate uses and shall be subject to the provisions of the use district in which they are located. All structures located on the airport property are subject to height restrictions that are based upon the distance from the main runway. The intent of the height restriction is to ensure that the structures located on the airport do not interfere with the movement or landing of aircraft. The shelters and support buildings have been located on Aprons B &C for several years. The Airport Supervisor has not noted any problems with the location of these structures. The Boeing Company works closely with the Airport Supervisor to ensure that their activities do not interfere with the operations of the airport or violate their leases. (5J) CONVERSION: No existing building or structure shall be converted to a conditional use unless such building or structure complies, or is brought into compliance, with the provisions of this Chapter. N/A (5K) PUBLIC IMPROVEMENTS: The proposed use and location shall be adequately served by and not impose an undue burden on any public improvements, facilities, utilities, and services. Approval of a conditional use permit may be conditional upon the provision and/or guarantee by the applicant of necessary public improvements, facilities, utilities, and/or services. No new public improvements are required at this time. H. RECOMMENDATION: Staff recommends approval of the Boeing Crew Shelters(Aprons B&C), Project File No. LUA-97- 143,CU-H subject to the following conditions: (1) This conditional use permit(LUA-97-143,CU-H) is approved for a maximum period of ten years. If during that time period the applicant fails to maintain the structures City staff may consider the applicant to be in violation of the permit and recommend the revocation of the permit. HEX.DOC . CITY OF RENTON DETERMINATION OF NON-SIGNIFICANCE APPLICATION NUMBER: LUA-97-143,CU-H,ECF APPLICANT: The Boeing Company/Paul Crane PROJECT NAME: Boeing Crew Shelters&Support Building DESCRIPTION OF PROPOSAL: In 1990 the Boeing Company obtained a conditional use permit (CU-081-90) to locate ten Crew Shelters and a Crew Support Building on Aprons B & C of the Renton Municipal Airport. This permit was given a termination date that has now expired. The Boeing Company is requesting a new permit in order to continue the use of the buildings in their existing locations. A Temporary Use Permit for the buildings was issued to cover the time period until the City can consider the new application. The Crew Shelters and Crew Support Building are used to provide a location for Boeing's employees to read blue prints and store tools while working on the adjacent aircraft. If the conditional use permit is approved there will be no change in the site as the buildings will remain where they are presently located. LOCATION OF PROPOSAL: Renton Municipal Airport - Aprons B&C LEAD AGENCY: City of Renton Department of Planning/Building/Public Works Development Planning Section This Determination of Non-Significance is issued under WAC 197-11-340. Because other agencies of jurisdiction may be involved, the lead agency will not act on this proposal for fifteen(15)days. Comments regarding the environmental determination must be filed in writing on or before 5:00 PM November 10, 1997. Any aggrieved person feeling that the environmental determination of the Environmental Review Committee is based on erroneous procedure, errors of law or fact, error in judgment, or the'discovery of new evidence which could not be reasonably available at the time of the determination may submit written.comments.After review of the comments, if Environmental Review Committee finds there is not sufficient evidence to amend its original determination,then there will be no further extension of the appeal period. Any person wishing to take further action would need to file a formal appeal within the original 15-day timeframe. This has also generated greater support vehicle traffic on the runway side of.. .the stalls, partly due to inadequate access routes to aircraft from the West Perimeter Road. There is a building setback from the airport runway that needs to be followed so as not to cause obstructions for the general aircraft that use the runway. These structures are located on a portion of the apron where the height of the structures does not interfere with the use of the runway. If for any reason Boeing determines that one of the structures needs to be relocated,the applicant will need to ensure that the structure does not intrude into the setback area of the airport. Noise Impacts: When these structures were first proposed City staff was concerned that the noise generated by the planes on the runway and apron could impact the workers using the structures. These shelters and building were previously approved under a Conditional Use Permit (CU-081-90) issued by the City of Renton in 1990. The Conditional Use Permit has expired and the buildings are remaining under a Temporary Permit. The proposed Land Use Action is an application for a Conditional Use Permit that will allow the existing buildings to remain at Apron's B & C. The crew shelters are used in the pre flight preparation of Commercial Jet Aircraft. The "crew" that works on the preparation of each jet liner requires a place, out of the weather, to review plans, meet and store small tool boxes. The location of these crew shelters, on Apron B and C, covers the length of the Western side of the Renton Municipal Airport ( see attached plans). The crew support building at Apron B is approximately 1,280 s.f. , measures 64' X 20' and is 14'- 6" high. Parking is provided in 7 spaces. The crew shelters are located at Aprons B & C and are 12' X 30' and are 11' - 7 1/2" high. In the eight years the crew shelters and crew building have been active they have been regularly painted and maintained. They have not been materially detrimental to the public health, safety or welfare, nor injurious to property or improvements in the vicinity in which they were located. The existing approved parking at the crew building is adequate and is not an impact upon non Boeing, general aviation activities. The buildings have not caused a nuisance or have adversely impacted the surrounding uses. _. I Crane, Boeing Commercial Airplane Group • PROJECT NARRATIVE Apron B & C Crew Shelters The Boeing Company currently has 10 existing crew shelters and 1 existing crew building located on Aprons B & C. These shelters and building were previously approved under a Conditional Use Permit (CU-081-90) issued by the City of Renton in 1990. The Conditional Use Permit has expired and the buildings are remaining under a Temporary Permit. The proposed Land Use Action is an application for a Conditional Use Permit that will allow the existing buildings to remain at Apron's B & C. The crew shelters are used in the pre flight preparation of Commercial Jet Aircraft. The "crew" that works on the preparation of each jet liner requires a place, out of the weather, to review plans, meet and store small tool boxes. The location of these crew shelters, on Apron B and C, covers the length of the Western side of the Renton Municipal Airport ( see attached plans). The crew support building at Apron B is approximately 1,280 s.f. , measures 64' X 20' and is 14'- 6" high. Parking is provided in 7 spaces. The crew shelters are located at Aprons B & C and are 12' X 30' and are 11' - 7 1/2" high. In the eight years the crew shelters and crew building have been active they have been regularly painted and maintained. They have not been materially detrimental to the public health, safety or welfare, nor injurious to property or improvements in the vicinity in which they were located. The existing approved parking at the crew building is adequate and is not an impact upon non Boeing, general aviation activities. The buildings have not caused a nuisance or have adversely impacted the surrounding uses. .kNN1NG oevec ofa .1 PROJECT JUSTIFICATION FOR A CONDITIONAL USE PERMIT The project consists of an application for a Conditional Use Permit for 10 existing crew shelters and 1 existing crew building on Aprons B & C (Please see Project Narrative). These shelters and building were previously approved under a Conditional Use Permit ( CU-081-90). The Conditional Use Permit has expired and the shelters and building are remaining under a Temporary Permit pending the outcome of this application. The following is the Conditional Use Permit justification for these buildings to remain. A. Comprehensive Plan. The City of Renton Comprehensive Plan designation policies for the airport is Employment Area - Industrial. The zoning is P-1- Public Zone. The existing shelters are compatible with the general purpose, goals, objectives and standards of the Comprehensive Plan (Policy - EA-1.1 to EA-1.8, EA-2.3, ). The airport designation as a Public Zone does not match the Comprehensive Plan designation policies for the airport. The proposed existing buildings are not in conflict with any public use of the airport. The existing buildings are compatible with, and support the existing uses operating of the airport. B. Community Need. The community needs are continued jobs and continued revenue from Boeing operations in the City of Renton. The existing location of the existing buildings will not result in the detrimental over-concentration of a particular use within the immediate area of the existing/continued proposed use. The buildings are aviation related crew shelters used to support Boeing Commercial Jet Aircraft at the City of Renton Municipal Airport. C. Effect on Adjacent Properties. The adjacent property surrounding the existing buildings is a municipal airport. The existing buildings and the activity they support will not result in substantial or undue adverse effects on this adjacent property. Property adjacent to the airport are commercial, industrial and residential. These existing crew shelter buildings support work on aircraft that are towed to, and not operational in their respective Apron positions. These aircraft positions on Apron's B & C are not used for engine run ups or and other activity that would generate noise or and other element that would result in substantial or undue adverse effects on the property adjacent to the Renton Municipal Airport property.
