Due to the bulkhead's size (under 4 feet in height)a building permit was not required. Therefore, SEPA review was not conducted by the City. • Subsequently,the applicant proposed to construct a dock on the shoreline of the subject property. SEPA review is required for the dock alone and is also necessary for the bulkhead when viewed as a combined project. • SEPA Environmental Review for both aspects of the project,the dock and the bulkhead,will be conducted under the land use application for the dock. The dock application will also be coming in the next two weeks. As far as the bulkhead is concerned we are attempting to get information from Larry Fisher with the Department of Fish and Wildlife. It was very useful to see the site and to receive,revised site plans. As long as the proposed rock "seawall" is constructed no further waterward than the existing bulkhead, with the exception of the area required to go around the tree (as shown on the attached draft site plan), this project would meet the exemption criteria.under WAC 173-27-040(2)(c) for a normal protective bulkhead. The applicant will need to submit revised site plans, including a cross- section which clearly indicate the location of the ordinary high water mark. The ordinary high water mark, in this case, is the line of the existing concrete bulkhead. Additionally, the applicant still needs to demonstrate compliance with SEPA and to obtain an HPA from the Department of Fish - and Wildlife as discussed in my letter of October.10, 1997. 0 0 As we discussed on the 21st, this project could be enhanced by planting suitable.native vegetation on the north and south ends 'of the lots where some native vegetation already exists. Suggested plantings that are tolerant of shallow flooding during the growing`season include Nootka Rose (Rosa . u l October 24, 1997 Lesley Nishihara Page 2 nutkana), Salal (Gaultheria shallon), Oregon Grape (Berberis aquifolium), Snowberry (Symphoricarpos albus), Salmonberry (Rubus spectabilis), Vine maple (Acer circinaturm), Red-Osier dogwood (Cornus stolonifera or Cornus serica), Hooker Willow (Salix hookeriana), Western red cedar (Thuja plicata) and Sitka Spruce (Picea sitchensi). After reviewing the materials, and speaking with you and with Larry Fisher of the Washington Department • of Fish and Wildlife, I have several concerns regarding this project: 1. I question whether the shoreline revetment work, as proposed,meets the exemption criteria for the construction of a normal protective bulkhead common to single-family residences under WAC 173-27-040(2)(c). The materials submitted do not provide enough information to draw that conclusion. • 2. I am not aware that the State Environmental Policy Act(SEPA)process has been initiated for this project. 3. If the applicant's are proposing to build a new pier, as you mentioned, and are planning to tie it into the new revetment,the two projects must be considered together for the purposes of both SEPA and the Shoreline Management Act in order to avoid piecemeal development. 4. Resource and habitat issues related to this proposal have not been adequately addressed. According to Larry Fisher,this area of Lake Washington is considered an Index Area for beach spawning sockeye. It is not clear that the site has been adequately evaluated and whether alternative solutions have been identified which would have less potential impact than the installation of this type of structure: An Hydraulic Project Approval(HPA)will be required for both the bulkhead and the pier. To Mr. Fisher's knowledge,the applicants have not yet contacted Fish and Wildlife regarding an HPA for these projects. Lit October 10, 1997 Lynn Nishihara Page 2 5. The site plans must locate the ordinary high water mark(OWHM)relative to both the existing bulkhead and the proposed revetment. I found it difficult to discern the location of the OHWM on the materials I reviewed. I would like to set up a site visit as soon as possible with you,the applicant's or their representative and with Larry Fisher from the Washington Department of Fish and Wildlife to view the site and discuss possible options.
