Nelson, Director February 15, 1988 Mr. Michael McLendon, Assistant Manager McLendon Hardware 710 South Second Street Renton, WA 98055 Subject: Fencing Requirement for New Storage Building Dear Mr. McLendon: This letter is written as a follow-up to our telephone conversation of February 12 , 1988, regarding fencing requirements for the new metal storage building constructed north of your retail store. . As was mentioned, when the building was originally reviewed by city staff for site plan approval, (file SA-045-87) and environmental review (file ECF-045-87) , a determination of non-significance was issued with a mitigating measure. That condition was: "That the wood fencing and landscaping surrounding the sales yard area be maintained for screening - purposes and that no alley access for the new storage shed be permitted. " This condition was imposed for aesthetic reasons, to protect the existing single family homes along the alley from urban blight, and to protect the surface siding of the storage shed wall itself. During a visit to the storage shed on February 12, 1988, I noted that along the alley the metal wall is showing some damage in that there is some indentation, perhaps from a truck. Additionally, the northeast corner has a mud-like substance on it, and graffiti was noted in several locations. The fence that was previously in that location is now stockpiled in a parking lot south of Tobin Street. 200 Mill Avenue South - Renton, Washington 98055 - (206) 235-2540 Mr. Michael McLendon February 15, 1988 Page Two This project had gone through two 14-day appeal periods in which the requirement of the decision to keep the fence could have been reconsidered or appealed. As neither were done within the time limits established, McLendon's Hardware is required to maintain the fencing along the sides of the storage building. This can be done by fastening the fence directly onto the metal sides of the building as G. W. Construction Corporation agreed to with the City's site plan approval committee. The City would like to see this fence reinstalled at McLendon's earliest convenience in order to meet the requirements of the site plan approval. For your information, a copy of the report and decision of the site plan review committee, and a copy of the environmental determination which requires the subject fence are attached. I would like to- correct an apparent misunderstanding referred to in your Conclusions, paragraph 5(c) . In my letter of July 10, 1987, I have no objection to any of the • parking stalls in the McLendon parking lot. I am indicating only that parking on Burnett Street, immediately south of where the alley exits onto Burnett Avenue S. , should be eliminated. The sight distance problem is because of the on street parking at that particular location. There is no sight distance problem created by parking stalls within the McLendon parking lot area. Construction Corporation LOCATION: 710 South Second Street SUMMARY OF REQUEST: Application for site plan review to allow the construction of a pre-engineered storage shed containing approximately 5,760 sq. ft. Structure to be located in an existing sales yard. COMMITTEE REVIEW: The review was conducted at 10: 00 a.m. on July 8, 1987, in the third floor conference room of the Renton Municipal Building. The Committee review was conducted after receiving written comment from all divisions of the Public Works Department, both divisions of the Building and Zoning Department, and the Fire, Police, Parks and Policy Development Departments. , The following exhibits were entered into the record: Exhibit No. 1 Yellow file containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit No. 2 Site plan (received May 6, 1987) . FINDINGS, CONCLUSIONS AND DECISION Having reviewed the written record in the matter, and conducted individual on-site inspections by each member of the Site Plan Review Committee, the Site Plan Review Committee now makes and enters the following: Findings: 1. The applicant, G.W. Construction Corporation for McLendon Hardware, has requested site plan approval to allow the construction of a pre-engineered storage shed containing approximately 5,760 sq. ft. in an existing sales •yard. 2 . The applicant's file containing the application, the state Environmental Policy Act (SEPA) documentation, the comments from various City departments, the public notices requesting citizen comment, and other pertinent documents was entered as Exhibit No. 1. 3 . Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43 .21C 1971 as amended) , a Determination of Non- Significance-Mitigated has been issued for the • subject proposal by the Environmental Review Committee, the responsible official subject to the following condition: a. That the wood fencing and landscaping surrounding the sales yard be maintained for screening purposes and that no access for the new storage shed be permitted from the alley. `>Sie Plan Review Committee City of Renton Report and Decision G.W. Construction Corporation Page 2 4 . Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject proposal is consistent with the Comprehensive Plan designation of Commercial for the subject site as well as the existing zoning designation of B-1, Business Use. 6. The site plan as presented provides sufficient parking to comply with the Parking and Loading Ordinance of the City of Renton. The site is within the area of the downtown which is exempt from complying with the City's parking requirements (see Section 4-715, Off-Street Parking (B-P) ) . Conclusions: 1. Proposal is a development consistent with policies, specifications, and codes of the City of Renton. 2 . Specific issues raised by various City departments focused on: a. The aesthetic impacts of the storage shed on the surrounding neighborhood; and b. Whether construction of the storage shed would eliminate required parking. 3 . The aesthetic impacts of the proposed application upon the surrounding properties in the neighborhood were of concern to the Environmental Review Committee. Currently, the outside storage area within which the proposed storage shed will be located is entirely screened with wood fencing. Landscaped areas are located on the north and west sides of the storage yard. The Environmental Review Committee as a mitigating measure imposed a condition to retain the existing wood fencing and landscaping areas in order to maintain screening purposes. In addition, there is to be no access from the alley to the proposed storage shed. ' • 4 . The second issue dealt with the potential loss of parking spaces as a result of the construction of the storage building. No parking stalls will be eliminated as a result of constructing the new storage shed. Nor will the project result in increased traffic. The area is already used for storage. The applicant is merely enclosing within a building products stored already within the area. Thus, on-site circulation, both vehicular and pedestrian should not be affected. 5. A near-by property owner in a letter dated July 10, 1987, while not objecting to the project, did provide comments to the City on the proposal. The individual was concerned about the following matters: a. That the existing fencing buffer remain between the building and the alley. This has been addressed by the Environmental Review Committee's mitigating measure. b. That the fire lane shown on the site plans is actually a public alley. As noted in the adjacent property owner's letter, the fire lane shown on plans is actually' a public right-of-way. In 1978 where a portion of the alley is between Burnett and Williams Ave. S. at S. 2nd Street, Council approved a westerly connection from the sewer main or the north property line to be place to provide access for the attorney and heating oil companies and also to provide access for the fire department (Ref. : Ord. 3272 for VAC-4-78 together with quit claim deed with recording number of 7811200482) . -"bite Plan Review Committee - City of Renton Report and Decision G.W. That, the parking space immediately south of the alley as it enters McClendon's property poses a site distance problem from persons exiting through the alley onto Burnett Ave. South. The Traffic Engineering Division did not identify a a site distance problem as identified by the adjacent property owner, nor has it been brought to their attention. However, after discussing the matter with the Traffic Engineer, he felt there may be a site distance problem and could put up a no parking sign. Traffic Engineering needs to visit the site and confirm that this situation exits. Should the stall (s) in question be eliminated, the property owner would not be required to replace the stall since the property falls within the area of downtown which does not need to comply with off-street parking requirements per Section 4-715. Decision: The site plan for G.W. Construction (for McClendon Hardware) , file SA-045-87, is subject to the following conditions: 1. The mitigating measure imposed by the Environmental Review Committee as part of the Determination of Non-Significance issued for the subject property. 2. That site plan should show the dedicated right-of-way running east and west from the alley. 3 . That the applicant/property owner work with the Ci.ty's Traffic Engineer to determine whether the parking stall(s) immediately south of the westerly right-of-way is creating a site distance problem. If a problem exists, then the property owner will be asked to remove the parking stall(s) . 4. That the above conditions be met before issuance of a final occupancy permit for the project. For the purpose of these decisions, the term "should" and "shall" are to be considered mandatory and the term "may" is considered discretionary. Any aggrieved person feeling that the decision of the Site Plan Review Committee is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request to the Zoning Administrator for review by the Site Plan Committee within fourteen (14) days of this decision. This request shall set forth the specific errors relied upon by such appellant, and the Committee may, after review of the record, take further action as it deems proper. AN APPEAL TO THE HEARING EXAMINER is governed by Title IV, Section 3011(B) (1) , which requires that such appeals be filed directly with the Hearing Examiner. Appeals must be made in writing before 5 p.m. on September 7, 1987. All communications after the decision date must be made in writing through the Zoning Administrator. All communications are public record and this permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence in writing. Erickson: • I am in receipt of the above site plan approval submitted by McLendon' s Hardware. As you will note, I am one of the adjacent property owners . The applicant is a good neighbor and I have no particular objection to the proposed use, however , I have the following comments : 1 . The existing fencing buffer should remain between the proposed building and the alley. 2 . The site plan is inaccurate in that it does not reflect that the North/South 10 foot improved alley makes a 90 degree turn at the back of our building and runs East/West exiting onto Burnett Avenue South. The site plan references a fire lane, however , this in fact is a public alley that should be identified as such. 3 . The parking space on Burnett immediately south of the alley exiting onto Burnett Avenue South should have a "no parking this space" sign. I have personally witnessed two quite severe accidents by reason of no line of sight when people exit onto Burnett from the alley. I consider this particular exit to be extremely dangerous to the public and have previously made a request for a no parking sign for this particular space, however , my concerns have brought no results . I believe the reference on the site plan map for a fire lane should actually refer to a public alley that runs eastbound from Burnett until it intersects with the north/south alley from South Tobin . The alley right of way should be marked by appropriate lane striping. I am enclosing a photocopy of the information I received in the mail and have noted in yellow the portion of the site plan that should be indicated as an alley, and I have also indicated where there is a need for the no parking sign.
