CORRESPONDENCE Letter from City Attorney Warren requested Council comments prior to Annexation: Liberty public hearing on the Liberty View/Conner plat to be held by the King View/Conner County Hearing Examiner on 12/8/87, to assure that City of Renton development standards are met before the area annexes to Renton. The site is located in King County south of the existing Renton corporate limits between State Highway 167 and State Route 515. A second letter addressed issues on which City representatives and the developer have reached agreement pertaining to traffic, walkways, parking, street widths, curbs, storm water retention, parks, lot size, emergency access, fire flow, sewers, and future rights to build. Still to be resolved is the question of applicability of Renton's setback regulations on the ultimate development if the property is annexed after being platted in King County. Police: Jail Contract Form Police Department requested approval of jail contract form with other Revision jurisdictions which increases daily fee from $25 to $35 for prisoners. OLD BUSINESS Community Services Committee Chairman Mathews presented a report Community Services recommending that Building Department permit fees for the Community Committee ' Center be waived, less the amounts actually paid by the Building Department Parks: Community Center I to other non-city agencies (i.e. outside government agencies and contractors providing plan check services.) The amount of the fees waived will not exceed $25,000. , The Committee further recommended that the use of Park Department property for well sites and water and storm drainage lines be considered as adequate compensation for the various utility fees. The relative value for use of Park Department property and service received from the Park Department will be determined by the method prescribed by the Finance Department. CAG: 87-072, Community Services Committee Chairman Mathews presented a report Community Center recommending acceptance of the low bid from Levernier Construction for the Renton Community Center in the amount of $3,545,000 (including all additive alternates). The Park Board concurs in the recommendation. The Committee further recommended that Council authorize the Mayor and City Clerk to execute the contract with the low bidder. King County: Solid Waste Councilwoman Keolker reported that only one person testified for the Interlocal Agreement environmental community at the King County Council hearing on solid waste interlocal agreement held on 11/30/87. The matter has been referred to Committee for action on 12/21/87, and it is probable that the 12/31/87 deadline for cities to sign the agreement will be extended. Warren, City Attorney RE: Fees for Community Center Dear Jim: The Community Services Committee asked for my opinion concerning waiver of the utilities fees in exchange for the use by the utility of park property for well sites, pipe lines and similar uses. I have previously given an opinion that such a trade-off is acceptable as long as the City can justify that the amounts are approximately equal. If the value of an easement, well site, etc. is greater or equal to the amount of the fees to be charged to connect to the water and sewer, then there is no exchange of money necessary. However , the method of calculation and the assumptions need to be reduced to writing so that the City can memorialize how the exchange took place. BUILDING & ZONING The Building & Zoning Department Report was received DEPARTMENT REPORT: by the Examiner on August 11, 1987 PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the' application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: MINUTES The hearing was opened on August 18, 1987 at 9:45 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow File containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit #2 - Master Site Plan. Exhibit #3 - Site Plan for Phase I. The hearing opened with a presentation of the staff report by the Zoning Administrator, Don Erickson. Erickson pointed out the City would like to develop a community center on this property; the site is 18.5 acres in size, the proposed facility would be 36,000 square feet and will be a multi-use center. It is the intent of the City to try to bring people to the site without creating additional traffic; access is from Maple Valley Highway and Houser Way; there are sufficient utilities available to the site; transit service is available, and this proposal will tie into the park and trail system for the City. Mr. Erickson stated the ERC reviewed the project and had concerns regarding traffic noting the new building will be located in a very high traffic density area; the applicant was asked to participate in a greater regional traffic study for the area, and is requested to provide traffic counts and volumes generated by this site; and questions were raised regarding drainage from the site to the aquifer due to City wells located in the area. A review was given of the criteria to be considered when considering a Site Approval request noting the proposal is in compliance with the Comprehensive Plan, and complies with the Cedar River Strategy Plan. Mr. Erickson advised certain rooms within the building will be terraced toward the river; the center will be located in an area that will depend heavily on automobile access and staff feels it necessary to explore other methods to improve pedestrian access. By the time the community center is completed it was pointed out the I-405 S-curve improvements may be in effect; this site will enhance property values and set a direction for future development in the area; and Mr. Erickson reviewed the ERC mitigation measures requested for the site and aquifer such as the provision of a delineated pedestrian/vehicle linkage between Liberty Park and Cedar River Park under the freeway which would extend the trail system and provide a link from this site to the Civic Center and downtown portion of the City. It was also a condition of the ERC that a system of stop signs be placed along the circulation corridors of the site; a more extensively bermed, landscape buffer be provided along the eastern portion of the site; more extensive landscaping to the west edge of the site to buffer I-405;.a pedestrian activated crossing between the site and the median in the middle of SR-169 to provide safe crossing • �� CITY OF RENTON PARKS AND RECREATION DEPARTMENT SA-049-87, V-050-87 August 27, 1987 Page 2 between the site and the industrial/commercial uses to the north; and the possible creation of a right turn-in lane eastbound and a left turn-in westbound for traffic entering the site from SR-169. Continuing, the Zoning Administrator said the site is setback from 1-405 by more than 100 ft.; air quality/dust may be a problem because of activities on the adjoining site and the freeway but it is felt extensive landscaping will help filter out some of the dust, noise and odors from those activities. In reviewing the request for a Variance for fewer parking stalls at the recreation center, Erickson stated the matter was reviewed with the applicant and there will be approximately 584 parking stalls needed with the applicant having proposed 367; it is not felt the applicant will suffer any undue hardship more than any other business in the area requiring the same type of parking requirements; suggested other remedies available to the applicant as mentioned in Section 4.22.28.12 which could approve the installation or delay of up to 50% of the minimum number of parking stalls required if the applicant proves the need for reduced parking and reserves an area for that parking at a future date. With all of the above information staff recommended approval of the Site Approval request with the conditions set out in their report, and denial of the requested parking Variance. Calling for testimony in support of this proposal from the applicant or their representative, responding for the applicant was John Weblev, Director, Parks and Recreation Department, City of Renton. Mr. Webley noted for the record that he was in agreement with the recommendations by staff and added explanation to some of the findings contained within the staff report. He stated regarding pedestrian access, currently there is a Master Trail Plan within the City that would include looking at the plateau to the north of the site and a means of accessing Maple Valley Highway to get to the park, as well as looking at the 1-405 S-Curve Plan and the Cedar River Trail Natural Zone Plan that will ultimately effect this property; the Department of Transportation has agreed to include the linkage between Liberty Park and the Civic Center to Cedar River Park on the north side and to the Cedar River Trail System on the south. He stated with that in mind they had decided to wait for those actions to take place as well as a railroad abandonment which is being pursued by the DOT which will impact the trail on the south side of the Cedar River. The DOT is proposing to provide access trail systems from both sides of the river from Liberty Park to the proposed site. Referring to landscaping, Mr. Webley stated since the I-405 project is being considered and a small portion of the park will be taken, DOT has been requested by the City to buffer this site from that action; a landscape buffer on the eastern boundary will be aesthetically more appealing than the adjoining use at Stoneway Concrete, and will be located on City property; well field protection concerns will be worked out with the Utilities Department and DOE to design a system that is satisfactory and he noted they have made design changes to move drainage away from the well fields and the building itself. Webley stated the final design should prove to be satisfactory; a left turn pocket coming from the east and right hand turn lane to be provided will be worked out with Traffic Engineering and must be approved by the State, and access to the park will be designed so it can accommodate desirable emergency vehicles within the park as well as speed bumps or stop signs to slow traffic within the park. Referring to the Variance from specific parking requirements, Mr. Webley stated the Variance was sought as it was recommended by the Building and Zoning Department because the Parking Ordinance did not cover this type of facility, and the facilities used for the parking requirements were based on a City Hall-type complex which he stated really does not meet proper criteria for this proposal. He agreed parking requirements as suggested by staff are acceptable to his Department. Speaking to this matter was Helen Klann, 1901 N.E. Third, #402, Renton, Washington who expressed concern over the pedestrian crossing between the north part of the park and Maple Valley Highway. She asked for clarification of the proposed access. She noted pedestrians come from north to south to the area, and after development of the new facility, more pedestrian traffic will be created thereby causing concern for their safety to and from the new facility. She also questioned if the park would be more pedestrian or vehicle access and was advised it would more than likely be a combination of both, but due to the proximity of the new facility it is considered more of a drive-to site. However, due to its location on the river the City is trying to enhance through the trail system the access and improve the development to further encourage pedestrian/bike access. Ms. Klann noted her favorable impression of the new Renton.Community Center plan. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 10:25 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, the City of Renton Parks and Recreation Department, filed a request for approval of a site plan for a multiple use indoor recreation facility, together with a request for a variance from the provisions of the Parking and Loading Ordinance. CITY OF RENTON PARKS AND RECREATION DEPARTMENT • SA-049-87, V-050-87 August 27, 1987 Page 3 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit #1. 3. The Environmental Review Committee (ERC), the City's responsible official issued a Declaration of Non-Significance (DNS) for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. There was no opposition from the public regarding the subject proposal. 6. The subject site is located in the Cedar River Park, just west of the Carco Theater, at 1717,, Maple Valley Highway. The site is immediately east of I-405, south of the Maple Valley Highway and north of the Cedar River. 7. The site is part of the original townsite of the City of Renton. It was originally zoned, and remains zoned, P-1 (Public/Quasi-Public). 8. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of recreation uses, but does not mandate such development without consideration of other policies of the Plan. 9. A variety of zoning districts surround the subject site. •An R-1 (Single Family Residential) district is located southwest of the subject site. South and east of the site is an H-1 (Heavy Industry) district. North of the Maple Valley Highway is a B-1 (Business/Commercial) district. 10. The City of Renton has approved a bond issue to construct an indoor community recreation complex at the Carco/Cedar River Park site. The complex will contain approximately 36,000 sq. ft.. It will consist of recreational components including a gym, racquetball courts and fitness center, meeting rooms including a banquet/dance area and arts and crafts areas, and administrative space. 11. The facility was conceived as a "drive to" facility fairly centrally located with access via Maple Valley Highway and an underpass under I-405. The facility was envisioned as a City-wide community complex rather than a neighborhood park or recreation building. The nearest residential communities are Renton Hill south of the site across the Cedar River, Monterey Terrace north of the site across the Maple Valley Highway, and the downtown North and South Renton residential communities. 12. Topography generally separates most of the residential population from the location with steep hillsides, generally making pedestrian access a secondary consideration. Staff has suggested that pedestrian and possibly bicycle access could be bolstered by providing a protected, or at least signed crossing at the Maple Valley Highway. The Trails Master Plan also suggests access via a trail which would parallel the Cedar River. The State, in reviewing the widening of I-405, has included a pedestrian link of some kind on the east side of the freeway which would cross the River providing a link with Renton Hill. 13. The complex will be one story high over its 36,000 sq. ft. footprint. The building will be approximately 100 feet from I-405, approximately 250 feet from the Cedar River (observing the shoreline setback of the Shoreline Master Program), 300 feet from its easterly property line, and 600 feet from the Maple Valley Highway. Windows are oriented away from I-405, oriented instead toward the river view. The complex will have masonry exterior walls to reduce noise impacts on persons inside the building. Architectural variety is exemplified by the mix of modulated facades, gable and hip roofs, and the masonry exterior which will provide additional texture. 14. Uses surrounding the site, as opposed to the zoning districts, are the two highways, I-405 and Maple Valley Highway to the west and north, the Cedar River and railroad right-of-way to the south, and Stoneway Concrete, a heavy industrial use to the east. 15. Staff was particularly concerned with the eastern neighbor, the concrete plant. It is conceived as less than an aesthetic neighbor both visually and acoustically. In addition, the operation produces dust which could impact air quality, although air quality was not specifically analyzed. 16. Staff recommended additional landscaping be planted along the eastern property line to buffer the entire park site, not only the new complex, from the concrete plant. Landscaping would screen the complex from the visual,acoustic, and to some extent the dust impacts of the concrete plant. • 17. The complex has been designed to allow expansion in the future when demand rises. 18. Parking variances were sought based upon initial estimates that approximately 1100 parking spaces were -required. Staff indicates that the applicant misinterpreted, on the conservative side, CITY OF RENTON PARKS AND RECREATION DEPARTMENT SA-049-87, V-050-87 August 27, 1987 Page 4 the requirements for the baseball field and assembly areas. With future expansion, parking for approximately 584 vehicles would be required. The applicant now proposes 367 parking stalls which staff contends is sufficient when coupled with provisions of the parking and loading Ordinance which permit delay and future review of up to 50% of the required parking, as long as sufficient space is reserved for the parking. Staff has indicated no physical hardships would justify a grant of a Variance. CONCLUSIONS Site Plan 1. The Site Plan Ordinance provides a number of specific criteria generally represented in part by the following enumeration: a. Conformance with the Comprehensive Plan; b. Conformance with the Building and Zoning Codes; c. Mitigation of impacts on surrounding properties and uses; d. Mitigation of the impacts of the proposal on the subject site itself; e. Conservation of property values; f. Provision for safe and efficient vehicle and pedestrian circulation; g. Provision of adequate light and air; h. Adequacy of public services to accommodate the proposed use; The proposed use satisfies these and other particulars of the ordinance. 2. There can be no question regarding compatibility with the Comprehensive Plan. The site is designated for recreational uses in the Plan, and the community recreation complex proposed obviously complies with that designation. It also obviously complies with the Park and Recreation Plan in that it will create and add to an already vital system of high quality community parks. 3. Staff's major concern regarding the site plan actually revolves around the site not the plan. The site, while centrally located, is not easily accessible due to its proximity to the I-405/Maple Valley Highway interchange. Staff has suggested that the City work with the State to provide a safer means of crossing the Maple Valley Highway north of the site to allow pedestrian/bike traffic to reach the center, with less problems than now would exist. A protected crossing and signal have been suggested. Access via an I-405 related underpass and bridge has been contemplated, and staff suggested the underpass which now exists should be upgraded for pedestrian passage, a passage now shared nervously with vehicles. 4. The facility is designed to take advantage of its water's edge location. Windows have been directed toward the river. Both for aesthetic reasons and for acoustics, windows have been directed away from I-405. Maple Valley Highway is sufficiently north of the site, 600 or so feet, that no particular problems exist. 5. The complex should not have an adverse impact upon adjacent facilities either public or private. Although the location of the recreation center could require additional screening of industrial uses near the site. Staff and the applicant have indicated that the City will plant additional landscape materials along the eastern edge of the site to minimize both the visual and dust impacts created by the concrete plant next door. The complex should not have an adverse impact upon the Carco Theater, and is setback more than the required 200 feet from the shoreline. 6. One potential impact considered by the ERC is the city's water well system. Conditions for protection and monitoring were required by the ERC and the impacts should be minimal. 7. The one story, masonry building will not be visually intrusive and should blend with the area and the existing theater. There appear to be no adverse impacts upon adjacent property. There also would appear to be no impacts upon property values, although the closer residences on Renton Hill would appear to benefit by the shorter distances to the complex. 8. As has been indicated, staff has suggested better accommodations for pedestrian and bicycle patronage by providing,some form of protected route across the Maple Valley Highway and a • separate pedestrian entry under I-405 to separate cars and pedestrians more efficiently. Eventually the city's trail system will provide an additional means of getting to the complex. It • CITY OF RENTON PARKS AND RECREATION DEPARTMENT SA-049-87, V-050-87 August 27, 1987 Page 5 is expected to run westerly at least from the vicinity of the Maple Valley Golf Course to the site and connect in some fashion to Liberty Park and the central city west of I-405. The interconnection of these various facilities will also create a large multifaceted park system for residents of the community. 9. In addition, the underpass has unfortunately become a bypass route to avoid the signal at I-405, Bronson and the Maple Valley intersection. The Parks Department has recognized this and has implemented a series of measures to minimize pass through traffic attempting to avoid the signal. The measures include stop signs, less direct through access, and could involve speed bumps if necessary. 10. The building is adequately set back from any other structure and is assured of adequate light and air. The landscape buffer is also intended to assist in cleansing the air of dust generated by the concrete factory. Apparently similar conditions are being contemplated for some proposed work on that site. 11. While two transit lines pass by and serve the site, access to the site is generally anticipated to be by passenger car. The transit is there and available for those who desire it. The site is adequately served by utilities and should not tax the existing infrastructure. 12. The site is well landscaped, with the building oriented to take advantage of the river and to avoid adverse impacts from I-405. Landscaping, as has been emphasized, will screen the easterly concrete plant. Additional plantings are also intended to soften the affects of any I-405 retaining wall created when 405 is realigned. Parking areas are also landscaped, with the ball fields presenting a large, practical expanse of lawn to the north, toward the Maple Valley Highway. Variance 13. While it would be unfortunate, if not shameful to eliminate landscaping, lawn area or other recreational open space to provide additional parking, there is no evident hardship which would justify granting a variance. Simply, the City is placing a lot of emphasis on this one parcel and the parking demand for each of the uses will eventually compromise parking standards. It does not appear apparent that a variance is in order especially when staff has pointed out other avenues. 14. Provisions of the permit could defer an ultimate decision on the parking load for at least up to 50 percent of the requirement until after occupancy. This provision in, and of itself, negates any justification for a variance at this time. Since other remedies may be available, approval of a variance is not an appropriate response. .The variance therefore should be denied. 15. In conclusion, the total scope of the project and its impacts appears to be positive. It will provide the long sought after goal of providing a varied and well designed community recreation facility. DECISION The Site Plan is approved subject to the following conditions: 1. The City work with the State on both the I-405 and Maple Valley Highway access and crossing points to assure safe efficient vehicular and pedestrian access to the Cedar River Park complex. 2. The City provide a safe means of utilizing the I-405 underpass by both pedestrians and vehicles. 3. The City develop a 'detour' system to discourage through traffic between Houser Way and SR-169. 4. The installation of screening landscaping along the I-405 and eastern property line to soften or screen out the visual impacts along both those respective property lines. The Variance is denied. As we read the City of Renton's Shorelines Master Program, this project does "fit" in this location. The environmental designation is urban for which the objective is to " . . . ensure optimum utilization of the shorelines within urbanized areas by providing for public use, especially access to and along the water's edge and by managing development so that it embraces and maintains shorelines for a multiplicity of viable and necessary urban uses" . (See p. 22 of City of Renton Shoreline Master Program. ) This section goes further to state "In this Master Program, priority is also given to planning for visual and physical access to water in the urban environment" . (See Section 5. 04. 01(D) , p. 22 of City of Renton Shoreline Master Program. ) Thus, in looking at this project which is set back over 200 feet from the water's edge, it is our opinion that this project "fits" the proposed location. The project will enhance public's use and enjoyment of the river area. The Park's Department has provided plans to enhance the area within 200 feet of the water's edge with landscaping and trails. The proect will move parking areas farther from the river's edge and attempts to tie the building and river activities together with the banquet/dance area located on the south side of the building. The City of Renton Parks and Recreation Department has applied for site plan approval, a variance and shoreline permit for construction of the Renton Community Center, a 36, 000 sq. ft. multiple use indoor recreation facility. 2 . The Environmental Review Committee issued a Determination of Non-significance - Mitigated on June 29, 1987, with the following conditions: a. That traffic mitigation measures for the project be drafted and included with the record. b. That the issue of drainage and protection of the City's aquifer be mitigated to the satisfaction of the Department of Ecology and the Public Works Department. BUILDING AND ZONING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING CITY OF RENTON PARKS AND RECREATION DEPT. PAGE 3 SITE APPROVAL REQUEST 3 . Section 4-738 (D, 1) lists ten criteria that the Hearing Examiner is asked to consider along with all other relevant information in making a decision on a Site Approval application. These include the following: General Criteria: a. Conformance with the Comprehensive Plan, its elements and policies; The Comprehensive Plan designates the subject site as "Recreation" to which the project fully complies. In terms of the Cedar River Corridor. Strategy, the project will certainly enhance the stated objective of focusing on the Cedar River as a unique community asset since the proposed Community Center is oriented towards the river and will increase the public's awareness of it. Whereas the Strategy calls for the extension of the Cedar River trail system farther east up the river, one might have expected to see the trail system extended along the subject property at this time. That is not the case. Apparently the City is awaiting the recommendations of the Master Trails Plan. In terms of the Community Facilities Goals, Objectives, and Policies of the Plan, the subject proposal is in general compliance in terms of maximizing use by encouraging a variety of uses (the facility includes a gym, racquetball courts, a banquet/dance area, fitness center, game rooms, arts and crafts rooms as well as a pre-school facility) . In regards to Policy 3 . on siting the facility so as to be convenient and safe with access to an arterial, the project would appear to comply again, although access off of SR-169 may be difficult at certain times of the day. Since the proposed facility has been designed to allow for future expansion, presumably Policy 4. has been adequately addressed. Since the proposed facility is set back 220 feet from the Cedar River, it is not anticipated to have an adverse effect on the river or its immediate environs. Since the structure is single story, it is not expected to pose any access problems for the handicapped other than those already discussed above, which apply to all of the users groups. In terms of Policy 8. , the proposed facility would appear to be compatible with the Carco Theatre next door as well as the existing ball field facilities already on the site. In terms of the City's Comprehensive Park and Recreation Plan, the subject proposal appears to be in general compliance. The proposed new Community Center will help create a system of high quality community .parks as well as conserve, enhance and improve recreational and cultural opportunities for the public. As noted above, the area of greatest weakness probably relates to Goal 3 . , having to do with maximizing public access to and involvement in recreational opportunities. Staff believe that the subject site, whereas centrally sited in terms of the community, is nonetheless severely impaired in terms of ease of access•. The intersection of I-405 and SR-169 already has considerable delays associated with it much of the time, and there is virtually no pedestrian access to the site now for pedestrians in the Highlands. The BUILDING AND ZONING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING CITY OF RENTON PARKS AND RECREATION DEPT. PAGE 4 straightening out of the "S" curves on SR-405 is also apt to exacerbate access to this site, not improve it, since vertical clearances will be reduced under SR-405. The proposal also complies with the Plan by being a high priority on the list of Community Park Development Priorities. b. Conformance with existing land use regulations; The subject site is currently zoned P-1, Public Zone. This zone requires the reviewing body to ascertain and determine that "the general design and development conform with the adjacent surroundings, meet applicable building and zoning code requirements, comply with the Comprehensive Plan, and has adequate and safe traffic circulation and access. " The use. itself is a principal use. c. Mitigation of impacts to surrounding properties and uses; The subject proposal, because of its unique location between a major freeway on one side and sand and gravel operation on the other, is not anticipated to adversely impact its neighbors. Rather, it must do a lot to protect itself from these adjacent uses in terms of noise, dust, etc. The greatest potential impacts this project could have in Staff's estimate are to the City's aquifer and well system, which it is nearly immediately over, and the nearby Cedar River. The City's well system, if it remains at its present location immediately west of the site across I-405 in Liberty Park, could be possibly impacted by construction activities such as spills of fluids that might leach down to the aquifer. Potential oil/gas spills, sanitary sewer leaks and leachate from fire fighting are all potential threats to the City's well system that should be foreseen over the reasonable life of the project. (Note: If the City's well system is eventually located east to the Maplewood Golf Course site, many of these potential impacts would be mitigated. ) d. Mitigation of impacts of the proposed site plan to the site; There are a number of improvements which Staff believes could be made to the site or its immediate environs that should be considered as mitigation measures to the site, the adjacent aquifer, and policies of the Parks and Recreation Plan where this proposal is currently the weakest. These include: 1) That a clearly delineated vehicle separated pedestrian linkage be created between Liberty Park to the west and Cedar River Park under I-405, extending the City's trail system and linking this site to the City's civic center complex and downtown; 2) That a clearly delineated vehicle separated pedestrian route be provided between the proposed new community center and SR-169 along the north edge of the site to eventually link up with pedestrian access from the emerging residential areas to the northeast; 3) That a system of vehicle "STOP" signs be placed strategically along the vehicular BUILDING AND ZONING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING CITY OF RENTON PARKS AND RECREATION DEPT. PAGE 5 circulation corridors to discourage the existing eastbound, through traffic between Houser Way and SR-169. 4) The provision of a more extensive, possibly bermed, landscape buffer along the eastern boundary of the site to create a visual and psychological buffer between the site and the heavy industrial use next door. 5) The provision of more extensive landscaping along the west edge of the site to also create a visual and psychological buffer between the proposed and adjacent I-405 freeway. 6) The provision of a pedestrian activated pedestrian crossing between the site and the median in the middle of SR-169 to create a signalized crossing for pedestrians between the subject site and the industrial/commercial uses to the north. (Note: An existing traffic signal exists along the north side of this median that presumably could be signalized with a crosswalk here for pedestrians. It might be possible to create an L.I.D. between this site and the owners of the proposed new development to the north to implement these improvements. ) 7) That consideration should be given (if Traffic Engineering concurs) to creating a right- turn in lane (westbound) and a left-turn in (eastbound) for traffic accessing the site from SR-169. e. Conservation of area-wide property values; The subject development is expected to have a positive impact on surrounding property values because • of its relative low site coverage, extensive landscaping, and a distinctive architectural appearance using both brick veneer, metal gable roofs, and the appearance of an exterior framing system to add visual interest to the large building. f. Safety and efficiency of vehicle and pedestrian circulation; If items 1) , 2) , 3) , and 6) above under Item d. are implemented, staff believe Item F. will be adequately satisfied. g. Provision of adequate light and air; Because of the proposed new center's fairly substantial setbacks from side property lines (100 ' from the I-405 right-of-way, and 250 ' from the Cedar River, more than 300' from the east property line, and approximately 600 ' from Maple Valley Highway) , the site is assured of good light and air exposure. Air quality, however, has not been looked at. h. Mitigation of noise, odors, and other harmful or 4. unhealty conditions; The proposed community center has been designed so that no windows, other than a narrow clerestory window at the end of the game room and an east facing lobby entrance face towards I-405. This, and the use of masonry exterior veneers will help reduce noise intrusion into the building. Extensive landscaping BUILDING AND ZONING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING CITY OF RENTON PARKS AND RECREATION DEPT. PAGE 6 along the site's east property line could help reduce dust coming off the adjacent Stoneway Concrete site to the east. The introduction of "STOP" signs and possibly speed bumps throughout the vehicle circulation areas should reduce unhealty conditions resulting from fast moving vehicles "short cutting" through the site. 1. Availability of public services and facilities to accommodate the proposed use; As noted above in Section D. Public Services, the site is served by a 8 inch sanitary sewer and a 24 water line. In addition, Metro's transit lines 143 and 912 which run along Maple Valley Highway serve the site. The site is also served by police and fire from the nearby municipal complex on Mill Avenue South. j . Prevention of neighborhood deterioration and blight; The subject development, because of its large site, architectural refinement (modulated facades, gable and hip style roofs, masonry veneer exterior, and extensive landscaping) should enhance surrounding property values and help upgrade the surrounding area. VARANCE REQUEST 4. The applicant, the Renton Parks and Recreation Department, is requesting a variance to allow a reduction in the number of required parking stalls for the construction of the Renton Community Center. The Hearing Examiner has the authority to grant a variance upon making a determination in writing that the conditions specified below have been found to exist: (a) That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other owners in the vicinity and under identical zone classification. Staff's review does not support the argument that the applicant suffers undue hardship based upon site constraints of any kind other than possibly size - the site could not physically accommodate all the parking required at grade and continue to provide substantial areas of landscaped open space. Rather, the hardship here is that the City's Zoning Code, in terms of required parking, is excessive for multi-use, multi- purpose facilities such as the current park and proposed community recreation center, where events and activities are often discontinuous throughout the day so that the likelihood of all events or activities allowed occurring at one time is very slim. Section 4-2228. 12 does authorize the Building Official to approve a delay in the installation of up to fifty (50) percent of the minimum number of parking spaces otherwise required if the applicant substantiates the reduced need for parking and the space normally required for this parking is reserved. BUILDING AND ZONING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING CITY OF RENTON PARKS AND RECREATION DEPT. PAGE 7 Staff believe that this is another alternative the applicant may wish to explore. Also, Staff believe the applicant has overestimated the amount of parking actually needed on this site. For their existing Ball Field, they have estimated one space for each 100 sq. ft. of the whole playing area rather than one space per place of assembly, not containing fixed seats as spelled out in Section 4-2208.4 Recreation-Amusement a Activities. Rather than needing 600 spaces for the existing Ball Field, Staff estimate that only 100 spaces could be needed here at the most, assuming a maximum viewing (assembly area) of 10, 000 sq. ft. Using this revised number, the total facility need, including Carco Theatre and future expansion, would be approximately 584 spaces rather than the applicant's estimated 1084 spaces. Since 154 of these 584 spaces are for future expansion, it would appear that the applicant could satisfy their parking requirements with 430 spaces now. The applicant proposed to provide 343 spaces now and 450 spaces later on after they complete their expansion. Since other avenues appear to exist that have not been fully explored by the applicant, including deferral of parking and a possible amendment to the parking provisions (Section 4-2208) prior to the future phase, and because no unique hardship attributable to the site exists, Staff recommend that this variance request be denied. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, Staff believes that: 1. First, let me point out that the building in question as originally proposed, was 200+ feet from the river but we felt that the facility was close enough and significant enough to merit looking at its impact, if any, on the shoreline. The shoreline, in this case, is a concrete vertical wall caused by past industrial use except where we have created an amphitheater allowing for a more natural relation- ship between the river and its uplands. The building's role in our overall recreational scheme has two strong ties to the river and its environs. First, we have attempted to pro- vide support facilities for our many river trail and beach front users encouraging them through proximity to utilize the sanitary facilities within instead of the river area. Secondly, we have designed the building so that major pedestrian access ways are east and west limiting their immediate impact on the area and automobiles are pushed further away from the river using the building as a buffer, both visually and acoustically. The building also has strong aesthetic ties to the river as facilities in the southern portion open up the beauty of the river environs for public viewing. While it is questionable as to whether we really need a shoreline permit, we are sensitive to the environmental concerns of our shore- lines. We are, therefore, moving the building an additional twenty feet away from the river and will take every precaution not to nega- tively affect the river environment. LOCATION OF PROPOSAL: Cedar River Park, 1717 Maple Valley Highway ; B. ISSUES: 1. Whether the new center is designed and sited so as to minimize impacts of noise from I-405? Discussion Noise, from the nearby I-405 corridor will project over the site and proposed civic center building. The building materials together with the lack of windows along the west elevation should minimize the noise impacts from the freeway. The new freeway design may help reduce some noise clue to the shifting of trucks through the S-curves. Traffic noise will have the most impact on the banquet/dance area which may be used as a meeting room, especially if doors are open to the terrace area. In addition to traffic noise, the site will be impacted by noise from the Stoneway Concrete facility. Since the craft areas, offices and banquet/dance areas face toward Stoneway, noise from the plant will be a nuisance to center activities. 2. Whether adequate provisions have been made for pedestrian access both to and from the facility from adjacent areas? Discussion Two natural pedestrian linkways exist to the north and to the west. The western linkage would connect the park complex with the Cedar River Trail and park facilities in Liberty Park. People will naturally move from the park grounds to these areas. Steps should be taken to ensure that the existing crosswalk linkage is kept (and possibly upgraded) and that a solution be arrived at to safely get pedestrians back and forth across the Maple Valley Highway. 3. Whether the proposed use is compatible with the adjacent land uses or vice versa. A major conflict arises between the park activities and proposed community center and the Stoneway Concrete property with its concrete mixing facility. Until the Stoneway site is redeveloped, there will be major conflicts, especially with respect to aesthetics, noise, and dust. 4. Whether sufficient information has been provided with 'respect to the traffic impacts of the new facility? Discussion The checklist states that there will be approximately 700 vehicle trips per day generated by the center. The checklist does not provide any measures to mitigate the impact of these trips on the adjacent corridors, especially the Maple Valley Highway. The major access to the park is from this corridor which is moving closer to peak capacity as development occurs east in King County and north/northeast of the park site along the bluff in Renton. Traffic Engineering suggest a measure to direct traffic by providing right and left lanes. 5. Whether sufficient information is provided on the impact of constructing the community center within the most sensitive area of the acquifer recharge area? Discussion The checklist does not address this issue at all. The fact that we are adding more impervious surfaces (including parking lots) over the acquifer raises questions about whether the City should accept additional risk to contaminating the acquifer. If the risks are accepted, then what precautions should be taken to minimize contamination of the acquifer and nearby City wells. Parallel Parking @ roadway (approx.) 70 TOTAL 205 spaces Since the community recreation center will occupy a part of the site, a reduction of this number could be considered for the Carco Theatre and the existing fields parking requirement. The possibility of using a number less than the 205 space as a "grandfather clause" should be considered. The ability to schedule different activities and uses between field use, community recreation center use and theatre use should also allow for a joint use of parking further reducing the parking requirements. The preliminary master plan of the park indicates that the parking capacity of the site would be around 450 spaces. In consideration of the above reasons, the parking could be reduced as follows: Total Proposed Master Plan Parking: Community Recreation Center 208 Future Pool 70 Future Expansion* 37 Carco Theatre 55 Fields 80 TOTAL 450 spaces * The total required for future expansion (84) cannot be accommodated on this site. Total Parking First Phase: Community Recreation Center 208 Carco Theatre 55 Fields 80 TOTAL 343 Both the proposed master-.plan parking and first phase parking includes the following assumptions: a. Joint use of parking can be achieved because of different schedules of activities. Also the staff will be able to pre-schedule major activities such that peak parking demand will be minimized. b. The existing site parking was used for the Carco Theatre and Field parking since the code requirement for field parking is clearly excessive. c. The location of parking will likely to spread around the site to accommodate the different users and for joint use. d. The 70 existing parallel parking spaces were not included since the community center does occupy part of the field area and no reduction was used in the community center parking. e. No reduction in the community center parking requirement was made for "accessory" support areas to the major activities. (locker room, child care, storage, kitchen, etc.) Given the limitations imposed by the site and the ability to schedule activities at alternate times.
