We understand cuts of approximately four to six feet will be required to construct portions of the proposed access road. At the time of our site visit, near vertical cuts of approximately three to four feet in height were present along the west side of the access road. The soil conditions observed along the cut face consisted of dense poorly graded sand and poorly graded sand with silt. Pocket penetrometer readings were taken at several locations along the cut face. These readings indicate unconfined compressive strengths in excess of four tons per square foot. In our opinion, the observed cut should remain stable provided the face of the cut is protected from weathering. We understand the current proposal is to protect the face these cuts with ecology blocks. The height of the proposed cut and ecology-block facing will range between approximately four to six feet. Based on the soil conditions observed during our site visit, ecology blocks will provide adequate protection to the face of the proposed cut. The ecologyblocks should be placed on a 6:1 batter, and backfilled with free-draining gravel. A four-inch diameter perforated drain pipe should also be placed along the base of the ecology blocks, between the cut and the blocks. The drain pipe should be directed to an approved discharge point. We hope this information meets your current needs. If y.ou have any questions or if additional information is required, please call. This discrepancy was isolated to trees within the east 50 feet of the overall Site. This discrepancy.in no way effects the•area in or around the.GTE facility. After a field check, we determined that the discrepancy.arose from our instrument mistakenly being switched to angle left mode while occupying one of our control points. The net effect was that 11 trees were shown in a mirrored fashion. Two additional tree were'determined to be,within the 150 foot limit. We have corrected that occurrence and re-issued the enclosed drawing (C1, 10/21/96). We have enclosed 4 copies for your use. ILLEGAL LAND CLEARING AND TREE REMOVAL IN VIOLATION OF RENTON MUNICIPAL CODE SECTION 4-9-5. 2. ILLEGAL GRADING ACTIVITIES IN VIOLATION OF RENTON MUNICIPAL CODE SECTION 4-10-15. SUBJECT SITE ADDRESS: 1616 NE 30TH STREET RENTON, WA. As a result of our telephone conversation on August 28, 1996, the following is a chronological account of the investigation conducted regarding the above-subject allegations. On July 26, 1996, and again on August I, 1996, you completed a grading license application and submitted`thein for review to the City of Renton Development Services Division. I received the application, I B960524, and reviewed it on August 5, 1996. This application was not approved (August 6, • 1996) with the following comments: 1. Applicant to provide a topographic, scaled diagram of area to he improved. 2. Applicant to provide a valid tree survey of area to he cleared. 3. Applicant to complete a routine vegetation management permit application. 4. Applicant to show on plan that ecology blocks will be installed a minimum of tive(5') from west property line. 5. Application is not to he tied to One-Com/GTE building permit B960514. 6. Applicant to show which trees will he removed. Additionally, Neil Watts commented that you must submit a set of your plans for review, These comments were FAXED to you on August 12, 1996, by Jan Conklin, Development Services Representative. 200 Mill Avenue South - Renton, Washington 98055 ® This paper contains 50"0 recycled material,20""post consumer On August 22, 1996, you re-submitted your plans with revisions so noted for Departmental Review. I received the revised plans on August 27th. Before I could begin review of these plans, I received a complaint from City of Renton Senior Planner, Jennifer Henning, advising me that illegal grading and clearing activity had been conducted on your site on August 27th. I visited the above-subject address on the morning of August 28, 1996, and confirmed that illegal grading, land clearing, and tree removal had occurred in the area surrounding the proposed ARCO remodel. site and the proposed Monopole site. Photographic evidence was obtained and the site was posted with a stop work order. After discovering this violation of the Ordinances, I telephoned you and inquired why you had authorized work on the site without the necessary permits being issued. Your response to me was that you had made a mistake in allowing the grading and clearing to begin prior to approval of the permit application. I then advised you of the stop work order that had been • posted on the site and that Civil Infraction Citations would be issued when an investigation was completed. You were additionally advised that this stop work order was area specific and was not intended to affect the Monopole constniction which is allowed under City of Renton building permit#B960514 nor the ARCO station remodel allowed under City of Renton building permit#B960169. Additional evidence obtained during my investigation also showed the following: 1. Substantial areas of your property, that had not been mentioned in the permit application, had been illegally cleared and graded. One of the areas of concern lies directly east of the ARCO site and lies directly west of the east property line. Measurements of the affected area, excluding the slope at the eastern edge of your property, has been calculated to he approximately 5,500 square feet. An additional area, that was not included in your application, lies directly behind the proposed ARCO building. This illegally cleared and graded area amounts to approximately 1,300 square feet. 2. Three trees which had been slated for retention on the eastern portion of your property had been illegally removed. Photographic evidence including a tree survey submitted by DCI, Duncanson Company, Inc., dated May 16, 1996, shows that the three trees, a 20" Douglas Fir, a 24" Cedar and a 28" Maple, were present. My investigation on August 28, 1996, showed that these three trees were no longer there. 3. The area at the western edge of your property had been illegally graded including an area that involved a six foot (6') vertical cut. From plans submitted with your application, the affected slope grade calculates to be approximately 53%. Your plans stated that you would not be doing any work over the hillside or near the steep slope area. Although the affected area with the 53% slope is not extensive, it is still protected by the Ordinances. Specifically Section 4-9-10C (enclosed) states, "For all properties, no land clearing, tree cutting, or ground cover management activities except enhancement activities are permitted in areas with slopes over forty percent(40%)." 4. The illegal cut, grading and clearing, conducted at the western side of your property, also resulted in the following: a. The root systems of the two (2) six inch 6" deciduous trees slated for retention, sustained extensive damage with numerous root extensions exposed. These two trees have essentially been destroyed. b. The root systems of the three smaller trees just south of the two (2) 6" deciduous trees suffered extensive root damage. One of these smaller trees is a double-trunked deciduous tree and would qualify as a tree to he retained. This tree has also been soseverely damaged that it will not live. c. The six inch (6') deciduous tree at the southwest corner of the Monopole site suffered extensive root damage. It also shows signs of distress and probably will not live. d. The six inch (6") deciduous tree at the west edge of the Monopole site was illegally removed. e. Approximately one-hundred sixty feet(160') north of the south property line, illegal grading was conducted around a twenty inch (20") deciduous tree. The grading was very invasive to the root system of the tree and lowered the ground level immediately around the base of the tree approximately three feet (3'). With this much damage to the root system the tree will probably die. The illegal grading around this tree is a violation of the tree cutting ordinance, specifically Section 4-9-13I(1). Your initial application, as well as the required revised application, was not factual. Your narrative in attachment#1 stated, "The area to he cleared is in green on the plan labeled attachment #1." The area cleared was considerably more than indicated. You also did not include the area to the east of the ARCO site. The second statement, "The ground cover is only blackberries 100% coverage of area in green." The area cleared was considerably more than indicated. Your narrative also stated "We will not be doing any work over the hillside or near the steep slope area:" Several rubble piles were stacked right at the edge of the steep slope. There was also evidence that illegal clearing and grading had been accomplished right up to the edge of the slope. You were specifically advised, by my Comment #5,.submitted to you August 12, 1996, that your application was not to be tied to the One-Com/GTE building permit #B960514. Your Routine Vegetation Management Permit Application did just that in the description of specific work to he accomplished (enclosed). REQUIRED COMPLIANCE PROCEDURE Within ten (10) days receipt of this certified Notice Of Violation you will be required to submit to the Development Services Division of the City of Renton, the following: • I. A revised, factual, Routine Vegetation Management Permit Application. The permit application will show a scaled diagram indicating all of the areas that you illegally cleared and graded. Included with the application will he an accurate topographical representation of the site to he cleared. The application will be subject to site inspection and verification prior to Departmental approval. 2. A plan, designed by a Soils or Structural Engineer, shall be submitted showing the installation of a retaining wall at the area illegally cut at the western edge of your property. This plan shall be submitted to the satisfaction of the Development Services Division of the City of Renton and shall be subject to Structural Observation. 3. Your actions resulted in the illegal removal of four(4) trees, one(1) on the western portion of your property and three(3) on the eastern edge of your property. Additionally, your actions resulted in severe, terminal damage to four(4) other trees. Renton Municipal Code, Section 4-9-16 (enclosed), requires certain action by you. Specifically, in Subsection C, you are required to replace these illegally cut/damaged trees on a ratio of three-to-one, (3 to I). Therefore, you shall he required to submit a landscape plan showing a minimum of twenty-four(24) replacement trees of the same species, each tree having a minimum of three inches (3") in caliper. These trees shall also he planted in the immediate vicinity of the tree(s) illegally removed. 4. Regarding the twenty inch (20") deciduous tree. The illegal lowering of the grade surrounding the tree within the drip line has, more than likely, terminated the life of this tree. Consulting arborists have placed a value of approximately $3,000.00 on a tree of this type. You shall, therefore, he required to submit one of the following: 1. A stand-by letter of credit, 2. A set- aside letter or 3. Cash in an amount equal to 150% ($4,500.00) of the assessed value of the tree. This letter or credit, set-aside letter or cash shall be deposited with the City for a period of not less than three years. 5. You shall submit a plan tbr the immediate removal of all debris accumulated as a result of the illegal clearing and grading. Under no circumstance shall any of this debris be pushed over the edge of the slope. 6. You shall submit a plan tbr the restoration/replacement of all improperly removed ground cover in compliance with Section 4-9-16B of the Code (enclosed) 7. Your plan shall also include installation and maintenance of interim and emergency erosion control measures in compliance with Section 4-9-I6D of the Code (enclosed). • Accordingly, you are being issued Civil Infraction Citations for violations of the following Codes: I. Section 4-9-15B Illegal removal/destruction of trees 2. Section 4-9-10A • Permit required for Routine Vegetation Management 3. Section 4-9-131(5) Lowering ground level around tree to be retained 4. Section 4-10-15B Illegal cut (vertical) These citations will he issued to you through the Municipal Court. The Court will advise you of the procedures you must tallow for proper adjudication of the charges. Also, please be aware that, according to Section 4-9-16E of the Code (enclosed), the stop work order, which is exclusive to your site, is still in effect. No activity, whatsoever, will be allowed on your site until you have been issued the required permits. Be advised, you will be required to complete items one through seven (I through 7) mentioned under REQUIRED COMPLIANCE PROCEDURES, within sixty days (60) issuance of permits. Any person who performs routine vegetation management on undeveloped property in the City must obtain a routine vegetation management permit prior to performing such work. 4-9-5F. Any person who uses mechanical equipment for routine vegetation management, land clearing, tree cutting, landscaping, or gardening on developed, partially developed or undeveloped property must obtain a routine vegetation management permit prior to performing such work. 4-9-10A. Any routine vegetation management on undeveloped property requires a permit pursuant to this Chapter. Permitted activities may include the use of mechanized equipment except as provided in 4-9-10C and 4-9-10D below. 4-9-10C. For all properties, no land clearing, tree cutting, or ground cover management activities except enhancement activities are permitted in areas with slopes over forty percent (40%); slopes over twenty five percent (25%) with class II or class III landslide hazards, and• slopes over twenty five percent (25%) with class II or class III erosion hazards, as identified by the King County Soils Survey, King County Sensitive Areas Map Folio or the City Environmentally Sensitive Areas Maps. 4-9-13I1. The applicant may not fill, excavate, stack or store any equipment, or compact the earth in any way within the area defined by the drip line of any tree to be retained. 4-9-1315. The grade level around any tree to be retained may not be lowered within the greater of the following areas: 1) the area defined by the drip line of the tree, or 2) an area around the tree equal to one foot (1') in diameter for each one inch (1") of tree caliper. 4-9-16B. Restoration shall include the replacement of all improperly removed ground cover with species similar to those which were removed or other approved species such that the biological and habitat values will be replaced; and 4-9-16C. For each tree which was improperly cut and/or removed, replacement planting of a tree of equal size, quality and species or up to three (3) trees of the same species in the immediate vicinity of the tree(s) which was removed. The replacement trees will be of sufficient caliper to adequately replace the lost tree(s) or a minimum of three inches (3") in caliper. 4-9-16D. Restoration shall include installation and maintenance of interim and emergency erosion control measures until such time as the restored ground cover and trees reach sufficient maturation to function in compliance with the performance standards identified in 4-9-6. 4-9-16E. For any parcel on which trees and/or ground cover are improperly removed and subject to penalties under this Chapter, the City shall stop work on any existing permits and halt the issuance of any or all future permits or approvals until the property is fully restored in compliance with this Chapter and all penalties are paid. (Ord. 4219, 6-5-89) 4-10-156- Slope: The slope of cut surfaces shall be no steeper than is safe for the intended use.
