I arrived at approximately 1623 hours. UNIT 1: HONDA CR-V Upon arrival I located a green 2002 Honda CR-V(WA/952YLZ, Unit 1) in the parking lot of 20 SW 7th Street. Unit 1 had been moved from its point of rest prior to my arrival. Unit 1 was not damaged from the collision. UNIT 2: KIA FORTE I located a black 2021 Kia Forte (WA/CNZ3022, Unit 2) in the parking lot of 20 SW 7th Street. Unit 2 had been moved from its point of rest prior to my arrival. Unit 2 was not damaged from the collision. Unit 2 had minor damage to the rear bumper. I saw fresh collision damage in the form of dents and cracks to the rear bumper. DRIVER 1:TOLEDO,TAYDEN M. I contacted Tayden M. Toledo (DOB: 06/06/2002) near Unit 1. 1 identified Toledo by his valid Washington Driver License and established him as the driver of Unit 1 by his admission. Toledo was not injured from the collision. This incident occurred in the sCity of Renton,King County,Washington State. !declare underpenalty of perjury under the laws of the State of Washington that the foregoing is true and correct. Monasterio (DOB: 09/29/1989) near Unit 2. 1 identified Monasterio by his valid Washington Driver License and established him as the driver of Unit 2 by his admission. Monasterio said his neck was stiff from the stress of dealing with the collision, not the collision itself. Monasterio refused medical treatment. Monasterio admitted he did not have insurance for Unit 2. STATEMENT:TOLEDO TAYDEN M. I spoke with Toledo about the collision. The following is a summary of our conversation: Toledo drover Unit 1 west on SW 7th Street toward Hardie Avenue SW in the number one (closest to curb) lane. A bus merged from the number one to the number two lane as Toledo approached. As the bus cleared the number one lane,Toledo saw Unit 2 stopped in the westbound number one lane of SW 7th Street at the intersection of Hardie Avenue SW.The traffic signal was green for westbound SW 7th Street and Toledo didn't see anything preventing Unit 2 from driving, so he maintained Unit 1's speed. Unit 2 did not move, and Unit 1's front bumper collided with Unit 2's rear bumper. This concluded my conversation with Toledo. STATEMENT: MONASTERIO, GABRIEL E. I spoke with Monasterio about the collision with the assistance of a Language Line Spanish interpreter. The following is a summary of our conversation: This incident occurred in the sCity of Renton,King County,Washington State. !declare underpenalty of perjury under the laws of the State of Washington that the foregoing is true and correct. Monasterio intended to turn right (north) onto Hardie Avenue SW. Monasterio stopped Unit 2 at the intersection for a pedestrian crossing west/east across Hardie Avenue SW along the north curbline prolongation of SW 7th Street in the marked crosswalk. Unit 1 suddenly rear-ended Unit 2 while Unit 2 was stopped for the pedestrian. This concluded my conversation with Monasterio. PROXIMATE CAUSE The proximate cause of the collision was determined by statements from both drivers and damage observed to Unit 2. The proximate cause of the collision was Toledo's violation of RCW 46.61.400(1),which states: No person shall drive a vehicle on a highway at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing. In every event speed shall be so controlled as may be necessary to avoid colliding with any person, vehicle or other conveyance on or entering the highway in compliance with legal requirements and the duty of all persons to use due care. Toledo drove Unit 1 at a speed greater than was reasonable and prudent under the condition and having regard to the actual hazard existing, namely Unit 2 legally standing on the roadway to allow a pedestrian to cross the road. CITATIONS I issued Toledo a citation for a violation of RCW 46.61.400(1) (Citation #5A0249328). I issued Monasterio a citation for a violation of RCW 46.30.020(1)(a).
