Pre-Collision Driver 2 stated that he was traveling North on Jericho Ave NE at the intersection of NE 4th St performing a lefthand turn to proceed West on NE 4th St. Driver 1 stated that he was traveling East on NE 4th St in the #1 lane approaching the intersection of Jericho Ave NE. Collision Driver 2 stated that as he was performing his lefthand turn through the green light, Unit 1 entered the intersection against a red light and the front bumper of Unit 1 collided with the rear drivers side wheel and quarter panel of Unit 2, causing significant damage. Driver 1 stated that he was having difficulty seeing the traffic light due to the sun being in his eyes. Driver 1 stated that as he entered the intersection, he did not have time to stop and the front bumper of Unit 1 collided with the rear drivers side wheel and quarter panel of Unit 2. Based on the cycle of the light, Driver 1 would have had a red light. Driver 1 was unable to provide me with a valid license and upon a check of his driving status, he returned as "Not licensed-Eligible". Driver 1 was unable to provide me with insurance for his vehicle. Injuries No injuries reported. Vehicle Disposition Unit 2 was inoperable and was towed from the scene. Proximate Cause I determined that Driver 1 is the proximate cause of this collision because vehicle operators facing a steady circular red signal alone shall stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection control area and shall remain standing until an indication to proceed is shown. However, the vehicle operators facing a steady circular red signal may, after stopping proceed to make a right turn from a one-way or two-way street into a two-way street or into a one-way street carrying traffic in the direction of the right turn; or a left turn from a one-way or two-way street into a one-way street carrying traffic in the direction of the left turn; unless a sign posted by competent authority prohibits such movement. Vehicle operators planning to make such turns shall remain stopped to allow other vehicles lawfully within or approaching the intersection control area to complete their movements. Vehicle operators planning to make such turns shall also remain stopped for pedestrians who or personal delivery devices that are lawfully within the intersection control area as required by RCW 46.61.235(1).
