While on scene, I collected each of the involved party's driving information and their independent recollection of the events leading up to the collision. The driver of Unit#1, identified as Kim Martin, stated he was stopped facing eastbound on N 3rd St at the controlled intersection of Sunset Blvd N. Kim stated he was stopped hoping to make a left turn to travel northbound on Sunset Blvd N in first left turn lane. Once the traffic signal became green, Kim proceeded through the intersection. As he approached the center of the roadway, Unit#2 struck the right side of his vehicle, causing moderate damage to his vehicle's passenger side fender. Kim stated that Unit#2 came out of nowhere and was unable to avoid the collision. spoke with the driver of Unit#2, Celina Lam, and she reported a similar story as Kim. Celina stated she was in the first left turn lane, hoping to travel northbound on Sunset Blvd N from N 3rd St. Celina stated Unit#1 struck her driver's side doors while making her left turn. Both drivers had a similar story, so Detective K. Lane was contacted to review the cameras at the intersection. Detective lane contacted the on-duty supervisor who then told me that Celina Lam was in lane 2 of 2. He also said Kim was in the first turn lane. When the traffic signal turned green, Celina proceeded forward and made an improper lane change while turning left striking Unit# 1 on his passenger side fender. Detective Lane stated he would create a copy of the video and attach it to this case report. Based on the above statements, I determined that the Driver of Unit #2 (Celina) is the proximate cause for the collision due to not granting the right of way during a left turn causing a collision. The driver of Unit#1 violated RCW 46.61.185(1) by being the driver of a vehicle intending to turn to the left within an intersection and not yielding the right-of-way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate hazard. The driver of Unit#1 (Smith) did not grant the right of way to Unit#2 traveling in the roadway which had the right of way and was already underway. An exchange of information was provided to all involved parties. Celina will receive a Sector infraction via mail.
