PROJECT DESCRIPTION: The applicant is requesting a Tier 1 Temporary Use Permit (TUP) for the installation of
barbed wire on top of existing six-foot (6’) construction fencing. The maximum height of the fence to the top of
the barbed wire would be eight feet (8') and the fence would be installed around the perimeter of the two (2)
buildings at 500 and 535 Park Ave N, as well as the on-site structured parking garage (APN 756460055)
(Attachment A). The fencing is located within the front yard and secondary front yard setbacks along portions
of the north, west, and east property lines. The proposed temporary fencing is intended to secure the site and
ensure no unauthorized entry into the site, which contain structures that are proposed to be demolished under
separate permits. According to the applicant, the proposed barbed wire to be added to the top of the fencing
will enhance security on the site and provide an additional deterrent to potential trespassers. The project site
is located within the Urban Center - 2 (UC - 2) zone. Fences located within the front yard and secondary front
yard setbacks are limited to a maximum height of 48 inches (48") and barbed wire is permitted with an
administrative fence permit. As the fence location and barbed wire will be in place to temporarily secure the
site, a Tier 1 temporary use permit is appropriate. The project site is mapped within a seismic hazard area and
a zone 1 wellhead protection area. There would be some vegetation and tree trimming and removal to
accommodate the temporary fencing. The applicant submitted an abatement agreement with the application
(Attachment B).
Pursuant to RMC 4-9-240J, the Administrator may approve, deny, modify, or condition an application for a
temporary use permit, based on consideration of the following factors:
1. The temporary use will not be materially detrimental to the public health, safety, or welfare, nor
injurious to property or improvements in the vicinity of the temporary use; and

2. Adequate parking facilities and vehicle ingress and egress are provided to serve the temporary use
and any existing uses on the site; and
3. Hours of operation of the temporary use are specified, and would not adversely impact surrounding
uses; and
4. The temporary use will not cause nuisance factors such as noise, light, or glare which adversely
impact surrounding uses; and
5. If applicable, the applicant has obtained the required right-of-way use permit.
Staff Comment: There is currently temporary construction fencing already installed on-site and within the right-
of-way intended to secure the vacant buildings awaiting demolition. The applicant is requesting approval to
replace, relocate onsite, and add barbed wire to the top of this fencing to further enhance site security and deter
unauthorized entry. Based on the temporary nature of the fencing and the proposed barbed wire addition, staff
finds that the temporary use will not be materially detrimental to the public health, safety, or welfare, nor
injurious to property or improvements in the vicinity.
The addition of barbed wire will not reduce on-site parking or alter vehicle ingress or egress. Furthermore, the
fencing and barbed wire will not create nuisance factors such as noise, light, or glare that could adversely impact
surrounding uses. The replacement fencing and the proposed barbed wire would be located entirely on private
property within the project site. Staff is recommending three (3) conditions of approval as noted below.
The Temporary Use Permit is hereby Approved with Conditions* and subject to the following conditions::
*CONDITION OF APPROVAL:
1. The security fencing shall be removed on or before July 9, 2026, or when demolition is complete,
whichever is first.
2. The removal of the fence shall be left free of debris, litter, or other evidence of the fence upon
completion of removal of the use, or when the operation of the fence ceases to exist.
3. The areas occupied by the temporary fence shall be restored to the original condition when the use
ceases to exist including restoration of site elements such as, but not limited to, landscaping
vegetation and holes/ground disturbance. Trees that are removed to accommodate the temporary
fence shall be calculated and replaced as part of the redevelopment of the site.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened
by the approval body. The approval body may modify his decision if material evidence not readily discoverable
prior to the original decision is found or if he finds there was misrepresentation or fact. After review of the

Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there
will be no further extension of the appeal period. Any person wishing to take further action must file a formal
appeal within the 14-day appeal time frame.
APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on July 23, 2025. Appeals
must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor
Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be
collected at a future date if your appeal is submitted electronically. The appeal submitted in person may be
paid on the first floor in our Finance Department. Appeals to the Hearing Examiner are governed by RMC 4-8-
110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office,
cityclerk@rentonwa.gov.
EXPIRATION: A Temporary Use Permit is valid for up to one (1) year from the effective date of the permit, unless
the Community & Economic Development Administrator or designee establishes a shorter time frame or an
applicant can request that a permit be valid beyond the one-year expiration, for up to five years at the time of
application or prior to permit expiration.
EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to permit
expiration to the Department of Community & Economic Development Administrator.
