SUMMARY OF ACTION: Development Services Recommendation: Approve with conditions DEVELOPMENT SERVICES REPORT: The Development Services Report was received by the Examiner on August 20,.1996. PUBLIC HEARING: After reviewing the Development Services Report, examining available information on file with the application, field checking the property and surrounding area;the Examiner conducted a public hearing on the subject as follows: MINUTES The following minutes are a summary of the August 27, 1996 hearing. The legal record is recorded on tape. The hearing opened on Tuesday,August 27, 1996, at 9:05 a.m. in the Council Chambers on the second floor of the Renton Municipal Building: Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit No. 1:, Yellow file containing the original Exhibit No.2: Neighborhood map application,proof of posting,proof of publication and other documentation pertinent to this request. The hearing opened with a presentation of the staff report by PETER ROSEN,Project Manager,Development Services, City of Renton,200 Mill Avenue South,Renton, Washington 98055. The applicant requests a conditional approval permit that would allow for the existing nonconforming use and structure on the site to be reestablished or rebuilt in the case that replacement costs due to loss or damage exceed 50%of the most recent assessed or appraised value prior to the loss or damage. The Ordinance for conditional approval permits was N.W. Permit, do Deborah Hart ' Intercity Insurance/U.S. Bank File No.: LUA-096-088,CA September 12, 1996 Page 2 approved by the City Council in February 1996 to provide some relief for property owners that have become nonconforming uses or structures as a result of code amendments that were made in June 1993 with the City- wide rezone. The ordinance only applies to uses that were legally established prior to the rezone. With a conditional approval permit,the building could be reconstructed up to 100%of the appraised value. Without a conditional approval,the reconstruction or re-establishment would be limited to 50%. The conditional approval permit does not convey any further rights for continuance of the nonconforming use. If the use was considered abandoned for a year or more,the nonconforming use may not be resumed. That would be the case with or without the conditional approval permit. The existing building was established over 26 years ago and is approximately 1755 square feet. It has been used as an office continually since that time. The zoning on the site was B-1 prior to the 1993 City-wide rezone that rezoned it to R-10 which does not include office uses, and therefore the office use is nonconforming in the R-10 zone. The reason behind the rezone at that time was largely due to neighborhood input that wanted to see that area transitioned towards residential uses. The Examiner questioned whether this permit would defeat that purpose. Mr. Rosen responded that in a certain sense it would;however,there are quite a range of mixed uses in that area, so there are a number of nonconforming uses that were resulting from the City-wide rezone. There are a number of surrounding single family residences,but directly adjacent to the south of the subject site are two other office buildings. On the corner there is a church and across the street on 2nd and Park there are other office uses. There are some multi-family uses at the corner as well. On Park Avenue there are a number of mixed uses, as well as Park has been widened and is'a.collector street now. In terms of the structure,the existing building has no side yard setbacks. It is built directly to the side property lines and the R-10 zone does specify a 5-foot side yard setback. Additionally,the site is entirely covered with impervious surfaces. The R-10 zone has a development standard of 60%-maximum impervious coverage standard. The subject building is a single story brick and concrete block rectangular structure. Adjacent to the south are two offices that are attached and very similar in character. The alley provides for parking in the back and there is parking in the front. Presently it is unstriped and the applicant has proposed to stripe the parking as a part of this application. - The conditional approval ordinance lists review criteria for both the nonconforming uses and nonconforming structures, and the Hearing Examiner would need to find at least three of the factors in order to grant the permit. The first one regards community need for the proposed use at its present location, and the determination of community need consideration shall be given to the following factors: the continuance of-the nonconforming use should riot result in either the detrimental over-concentration of a particular use within the City or within the area surrounding the site. The immediate area includes a mix of single family residences, low density multi-family uses,-a church, restaurant, and other office uses. The Examiner asked if there is a community need for the proposed use at its present location or would it be better served to be converted to residential as the zoning and Comprehensive Plan(CP)designate the site. Mr.Rosen stated that one of the policy objectives in the CP is to provide a mix of uses that serve a - neighborhood,that residents can walk to. There isn't an over-concentration of small office uses in this area. It does serve a community need in terms of small scale office use to serve local residents. • N.W. Permit, do Deborah Hart -- Intercity Insurance/U.S. Bank File No.: LUA-096-088,CA September 12, 1996 Page 3 The Examiner questioned whether the same could be said of other neighborhoods,that someone could convert a single family home to a small scale office. He pointed out that the trend was to protect residential neighborhoods and to make uses compatible rather than continue and perpetuate nonconformity. Mr. Rosen responded that that is an issue with this application. The fact that the subject site is on Park Avenue which is a collector street,the character of the street and the uses along it are quite a bit different than the other residential streets in the neighborhood where it would be more of a solid single family character. The second criteria under community need is that the existing location is or can be made suitable for the existing use. The fact that it is a four lane collector arterial street with a mix of uses would suggest that the existing location is suitable for the existing use. It provides the local residents with a small scale office use that is in character with the neighborhood. Another review criteria is timeliness with existing plans and programs. The land uses in the neighborhood appear to be stable. There hasn't been much conversion of the existing commercial uses or of the single family residential uses in that zone to the residential uses that are permitted and anticipated in the R-10 zone. It has only been three years since the zoning has been changed,but it doesn't appear that the neighborhood is • changing strongly towards the uses that are anticipated in the R-10 zone. Given the small size of the current lot, it would not seem that the nonconforming use would impede the area from transitioning towards implementation of the CP. In terms of appearance,the residential structures on the street have pitched roofs,have landscaping in the front. The subject use and the other office uses in the area are flat-roofed and there is parking in the front which is not necessarily in keeping with the character of the existing area, but again along Park Avenue there are a number of nonconforming uses that differ from the residential character. In terms of the review criteria for the nonconforming uses, staff would recommend that the subject proposal could comply under community need,under the timeliness with existing plans and programs, and under effect on adjacent property. The fact that the activities associated with the existing office do not appear to adversely impact adjacent properties,the use doesn't generate much customer traffic in that it is a small office use, particularly in comparison to the overall traffic volumes that exist on Park Avenue. There are also review criteria for the nonconforming structure. The first two deal with architectural and historic significance and architectural compatibility with surrounding uses. The fact that the subject building is single story and flat-roofed, it is not particularly significant either architecturally or historically. It is different from the residential buildings on the block,though similar to the office uses to which it is attached. The third review criteria is potential of the site for redevelopment. The existing site is 45 feet wide and redevelopment with a conforming structure having a 5-foot side yard setback would mean a building of 35 feet,which would be appropriate and possible for a building on that site if it was to be redeveloped. The parking requirements for the office use are such that those portions of the site are necessary for parking and so the site could not be redeveloped to provide parking for the office use and meet the impervious covered standard which again was a standard that was anticipated for residential uses.' The building has been well maintained and is not considered to be a threat to public health, safety or welfare. It is attached to two office buildings. If it was reconstructed the building code requirements would require a fire resistant wall in terms of where it is attached to the building on the south. N.W. Permit, do Deborah Hart Intercity Insurance/U.S. Bank File No.: LUA-096-088,CA September 12, 1996 Page 4 • Staff recommends approval of the Intercity/U.S. Bank subject to three conditions: (1) The conditional approval permit shall be valid for a period of 10 years from the date of issuance. This condition would allow some time to evaluate if uses in the immediate area are converting towards the residential uses that are anticipated with the R-10 zone. (2) A covenant be filed by the applicant with King County Assessor's office in order to notify future purchasers or tenants of the property of the existence of the conditional approval permit. That verification of this filing shall be submitted to Development Services Division prior to this permit being issued. (3) The parking areas in the front and rear of the building be striped in conformance with parking code standards. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 9:35 a.m. FINDINGS, CONCLUSIONS &DECISION Having reviewed the record in this matter,the Examiner now makes and enters the following: FINDINGS: 1. The applicant,N.W. Permit, filed a request for approval of a Conditional Approval of a nonconforming use and structure. 2. The yellow file containing the staff report,the State Environmental Policy Act(SEPA)documentation • and other pertinent materials was entered into the record as Exhibit#1. 3. The Environmental Review Committee(ERC),the City's responsible official,determined that the proposal is exempt from an environmental assessment. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is located at 216 Park Avenue North. 6. The subject site is 45 feet wide(north to south)by 95 feet deep. The lot is level. A ten foot wide alley runs along the rear of the parcel. 7. An existing building spans the entire width of the lot. The building is 45 feet wide and 39 feet deep or 1,755 square feet. There is an approximately 26 foot deep parking lot in front of the building and a 30 foot deep parking lot in the rear serviced by the alley. 8. As noted,the building runs from its north property line to its south property line and is joined on the south to another building. This neighboring building itself again abuts another building. The arrangement is of three attached, one-story buildings. 9. South of this attached complex is another office building. 10. North of the subject site is a single family home, and additional residential buildings are located north of this. N.W. Single family homes are also located east of the site and single and multiple family homes are west of the site, across Park Avenue. 12. The building has been used for business purposes for more than 26 years. The use was legally established according to the record. 13. The site's B-1 (Business/Commercial)Zoning was changed to R-10(Residential/10 dwelling units per acre)Zoning which no longer allows the uses which were permitted in the B-1 zone. In addition,the current zoning requires minimum side yards of five(5)feet and permits only 60% impermeable surface, whereas the building and paved parking areas cover most of the site. 14. Under current code provisions if the existing building were to be were damaged more than 50%or destroyed it could not be repaired or replaced. 15. The applicant has applied for a Conditional Approval which allows restoration of a building or re- establishment of a use even if the 50%threshold for restoration has been exceeded. 16. The record is not clear but it does not appear that the adjoining buildings which share common property lines, if not necessarily one common wall, have applied for or been granted this relief. It is therefore unknown what would happen if the entire complex were destroyed. In other words,would this building be permitted to rebuild to its property lines while the linked buildings would have to be used for residential purposes and meet all standards of the R-10 residential zone. Would it make sense to allow one building in this block front to be used as a commercial office building and cover 100 percent of the property from lot line to lot line with impermeable surface and a building immediately touching its two side property lines. CONCLUSIONS: • 1. The general criteria for issuing a Conditional Approval are as follows: a. The continuance of such use or structure is in the public interest; b. It would be compatible with other existing or potential uses or structures in the general area; and c. It can be made compatible with the application of appropriate conditions. The more specific criteria for non-conforming uses require: a. Community Need: There shall be a community need for the proposed use at its present location. In the determination of community need, consideration shall be given to the following factors, among all other relevant information: (1) The continuance of the nonconforming use should not result in either the detrimental over-concentration of a particular use within the City or within the area surrounding the site. Effect on Adjacent Property: The existing nonconforming use has not resulted in undue adverse effects on adjacent properties from noise,traffic, glare,vibration, etc., (i.e. does not exceed normal levels in these areas emanating from surrounding permitted uses). • c. Historic Significance: The existing use was associated with a historical event or activity in the community and as a result has historical significance. d. Economic Significance: The existing use provides substantial benefit to the community because of either the employment of a large number of people in the community,the generation of considerable retail and/or business/occupation tax revenues to the City, or it provides needed affordable housing. e. Timeliness with existing Plans and Programs: Because of the anticipated market timing for permitted uses in the zone,retention of the existing nonconforming use would not impede or delay the implementation of the City's Comprehensive Plan. 2. The specific criteria for nonconforming structures are: - Conditional Approval Permit Review Criteria for Nonconforming Structures: The Planning/Building/Public Works Administrator or his or her designee shall consider the following factors, among all other relevant information,when considering a request for a conditional approval permit for a nonconforming structure. In order to grant the permit, he/she shall find that at least three(3)of the following criteria have been satisfied: a. Architectural and/or Historic Significance: The damaged structure represents a unique regional or national architectural style or an innovation in architecture because of its style,use of materials, or functional arrangement and is one of the few remaining examples of this. b. Architectural Compatibility with Surrounding Uses: The nonconforming building or structure was part of a unified streetscape of similar structures that is unlikely to be replicated unless the subject structure is rebuilt per, or similar to, its original plan. c. Potential of Site for Redevelopment: Redevelopment of the site with a conforming structure is unlikely either because the size of the existing lot'may be too small to be economical, or because the characteristics of adjacent permitted uses(that might normally be expected to expand to such a site)currently might preclude their expansion. Typically, economic hardship would not be considered for a variance,but is a consideration here. d. Condition of Building/Structure: If nonconforming as to provisions of the City's Building Code,the building or structure and surrounding premises have generally been well maintained and is not considered to be a threat to the public health,welfare, or safety, or it could be retrofitted so as not to pose such a threat. e. ' Departure from Zoning Code: If nonconforming with the provisions of the City's development regulations,the building or structure does not pose a threat to the public health,welfare or safety, or could be modified so as not to pose such a threat. As noted above,there are some complex issues with regard to reviewing this permit,particularly since this building is attached to two other nonconforming structures which also contain nonconforming uses. 4. In any event, it would appear that the permit should be approved,but subject to conditions that require it to meet the side yard requirements of the existing zoning if replacement were to occur. While staff has suggested that a time limit be placed on the operation, it does not appear that a building would be reasonably amortized in a ten year period. At least, no facts were presented on this issue. As a matter of fact it would seem illogical to allow a building to be reconstructed and then removed in 10 years or less. 5., Allowing existing businesses to keep operating is generally in the public interest, particularly if there are no adverse impacts associated with such uses. Clearly, attempting to bring uses and structures into conformity with both the Comprehensive Plan and the Zoning Code are also in the public use and interest. 6. The existing building which has a wall on the property line abutting a single family residence is not compatible with either this neighboring single family use or the current residential zoning. Clearly, if the building were substantially damaged,reconstruction should respect the zoning code regarding side yard setbacks at a minimum. 7. The building is an ordinary one-story,flat-roofed, concrete block structure without any known historic importance. It creates employment opportunities although the numbers do not appear large. 8. If all three linked buildings were destroyed,but the subject site were redeveloped in a nonconforming manner while the abutting buildings complied with the code, it could impede implementation of the Comprehensive Plan. 9. The size of the lot is definitely one militating factor. The lot is quite small or, at least, narrow. Clearly, it could be used for conforming residential purposes but it would make more sense to develop it along with its current abutting structures in one unified fashion. 10. It would appear that the building and its associates are reasonably maintained but as staff noted the parking lot should be striped. 11. The building and use do not appear to present any threats to the public health, safety or welfare. 12. In conclusion,the proposed permit appears generally reasonable, although it clearly is not an easy one to approve given the juxtaposition of a single family house immediately on one side and its attached neighbors on the other. DECISION: The Conditional Approval is granted subject to the following conditions: 1. If all three attached structures are damaged or destroyed more than 50%,then the subject site shall provide the required side yards. The existing building is built to the side property lines with no side yard setbacks and therefore it does not conform to the 5 foot side yard setback requirement of the R-10 zone. The site is entirely covered with impervious surfacing (the building and parking area) and therefore exceeds the 60% maximum impervious coverage standard of the R-10 zone. It should be noted that the R-10 development standards are intended for residential uses developing in the zone. For example, the side yard setback requirement is specifically referenced for detached single family structures in the R-10 zone. The subject building is a single story, brick and concrete block, rectilinear, flat-roofed office. Parking is located in the front along the street and an alley provides access to parking in the rear of the building. The building is attached to two other office buildings of similar character located directly south of the subject site. 2. ENVIRONMENTAL REVIEW Because the proposal does not entail a change of use or modification of the existing structure, it was determined that the application is not subject to SEPA environmental review requirements. 3. STAFF REVIEW COMMENTS Representatives from various city departments have reviewed the application materials to identify and address issues from the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the Departmental Recommendation at the end of the report. REVIEW CRITERIA FOR NONCONFORMING USES Section 4-31-19.J.5 lists criteria that the Hearing Examiner and/or City Council is asked to consider, along with all other relevant information, in making a decision when considering a request for a Conditional Approval Permit for a nonconforming use. In order to grant the permit, at least three (3) of these factors shall be complied with: a. Community Need: There shall be a community need for the proposed use at its present location. In the determination of community need, consideration shall be given to the following factors, among all other relevant information: (1) The continuance of the nonconforming use should not result in either the detrimental overconcentration of a particular use within the City or within the area surrounding the site. The immediate area surrounding the subject site includes a mix of single family residences, low density multifamily uses, a church, restaurant, and office uses. There are two office buildings (with a dentist and chiropractor) which are attached to the subject building. The continuance of the office use on the subject site would perpetuate the nonconforming office uses in the area; however it would not necessarily result in an overconcentration of offices within the immediate neighborhood or City. The office use appears to serve local residents and it may be in the community's interest to retain small scale office uses that serve the North Renton area residential population. (2) That the existing location is or can be made suitable for the existing use. The existing location is suitable for the office use in that it is in a mixed use area of smaller scale businesses and residential uses and it is located along a collector/arterial street which provides good access for an office use. The office is also adjacent to two other office buildings so office uses appear to be established at this location. The applicant has proposed striping the parking stalls which would make the location more suitable for customer parking to support the use at this location. b. Effect on Adjacent Property: The existing nonconforming use has not resulted in undue adverse effects on adjacent properties from noise, traffic, glare, vibration, etc., (i.e. does not exceed normal levels in these areas emanating from surrounding permitted uses). Activities associated with the existing office use do not appear to adversely impact adjacent properties. The use generates some customer traffic; however, the small size of the office use (1,755 square feet) generates little traffic compared to overall traffic volumes existing on Park Avenue N. c. Historic Significance: The existing use was associated with a historical event or activity in the community and as a result has historical significance. The existing office use is not associated with a particular historical event or activity. d. Economic Significance: The existing use provides substantial benefit to the community because of either the employment of a large number of people in the community, the generation of considerable retail and/or business/occupation tax revenues to the City, or it provides needed affordable housing. The existing office use employs several people and the office serves the local neighborhood. 'However, the existing office use is not economically significant to the community in terms of tax revenues or providing an employment base. e. Timeliness with Existing Plans and Programs: Because of the anticipated market timing for permitted uses in the zone, retention of the existing nonconforming use would not impede or delay the implementation of the City's Comprehensive Plan. Land uses in the neighborhood seem to be stable and there does not appear to be a conversion of commercial uses toward the residential uses permitted in the R-10 zone. The existing office building would not be conducive to residential use. However, it would support continuation of a nonconforming office use in a residential designation. 5. CONDITIONAL APPROVAL PERMIT REVIEW CRITERIA FOR NONCONFORMING STRUCTURES: The Planning/Building/Public Works Administrator or his or her designee shall consider the following factors, among all other relevant information, when considering a request for a conditional approval permit for a nonconforming structure. In order to grant the permit, he/she shall find that at least three (3) of the following criteria have been satisfied: a. Architectural and/or Historic Significance: The damaged structure represents a unique regional or national architectural style or an innovation in architecture because of its style, use of materials, or functional arrangement, and is one of the few remaining examples of this. The existing structure is not damaged. The architectural style is a typical single story, 1950's-1960's office and it is not considered significant or unique architecturally. b. Architectural Compatibility with Surrounding Uses: The nonconforming building or structure was part of a unified streetscape of similar structures that is unlikely to be replicated unless the subject structure is rebuilt per, or similar to, its original plan. The subject building is a single story, brick and concrete block, rectilinear, flat-roofed office with parking in the front and rear of the building. While the bulk and scale of the building is similar to surrounding residences and buildings, it is architecturally different from most residential buildings on the block. The subject building is similar to the office buildings adjacent to the south of the subject site. c. Potential of Site for Redevelopment: Redevelopment of the site with a conforming structure is unlikely either because of the size of the existing lot may be too small to be economical, or because the characteristics of adjacent permitted uses (that might normally be expected to expand to such a site) currently might preclude their expansion. Typically, economic hardship would not be considered for a variance, but is a consideration here. The existing building is not setback from the side property lines. The R-10 zone requires side yard setbacks of 5 feet. This standard is specific to detached single family residential uses. The subject site is 45 feet wide and therefore redevelopment with a conforming structure would necessitate a maximum building width of 35 feet. This would not render the existing lot too small for economical redevelopment in compliance with the code. The site is entirely covered with impervious surfacing (the building and parking area) and therefore exceeds the 60% maximum impervious coverage standard of the R-10 zone. Most of the impervious area is devoted to parking. The site could not be redeveloped to meet the impervious coverage standard as well as the parking requirements for an office use. There is not presently a trend toward redevelopment in the area, and therefore it is unlikely that adjacent uses would choose to expand to the subject site. d. Condition of Building/Structure: If nonconforming as to the provisions of the City's Building Code, the building or structure and surrounding premises have generally been well maintained and is not considered to be a threat to the public health, welfare, or safety, or it could be retrofitted so as not to pose such a threat. The building has been generally well maintained and it is not considered to be a threat to the public health, welfare or safety. The subject building is attached to two office buildings directly south. Building code regulations would require a fire-resistant wall if the subject building was reconstructed to the same configuration, maintaining the nonconforming standard of no side yard setback. e. Departure from Zoning Code: If nonconforming with the provisions of the City's development regulations, the building or structure does not pose a threat to the public health, welfare or safety, or could be modified so as not to pose such a threat.
