CALL TO ORDER: The meeting was called to order at 8:35 a.m. by Chairman Jim Hanson. 2. APPROVAL OF MINUTES: Moved by Dennis Gerber, seconded by Jim Chandler to approve the meeting minutes dated March 5, 1997. MOTION CARRIED. 3. REQUESTED ACTION: • ON/OFF-SITE DEFERRAL, Ticon Short Plat,LUA 96-090, 420 South Tobin Street - applicant requests a deferral for the installation of curb, gutters, sidewalks, and driveway approach. Discussion: Upon questioning from the Board about the necessity of this deferral, staff mentioned that the requested items for deferral were at one time installed, but a condition of those items was questionable. It was discussed that Arneta, Board Coordinator, would make a site visit and determine the validity of this request. If it is determined that a deferral is needed for this applicant, staff will bring the item back to the Board for review. MOTION CARRIED. 4. Summary of Action: The purpose of this dedication is to widen the existing alley right-of-way to current City Standards. The alley runs east and west from Shattuck Ave S to Logan Ave S. That portion of the alley that lies adjacent to and north of 420 S Tobin St (the.address of the short plat) is currently only 10 feet in width. The intent of the dedication is to bring the alley right-of-way up to current City standards which is a 16 foot wide alley right-of- way. The dedication is a code requirement of the Ticon Short Plat, LUA 96-090, and needs to be completed prior to the recording of the short plat. The intent of the dedication is to bring the alley right-of-way up to current City standards which is a 16 foot wide alley right-of- way. The dedication is a code requirement of the Ticon Short Plat, LUA 96-090, and needs to be completed prior to the recording of the short plat. STAFF RECOMMENDATION: Staff recommends that Council authorize the Mayor and City Clerk to execute the Deed of Dedication. There are two existing sheds on the west side of the property. Both of these sheds will be removed in order to allow for the construction of a private drive on this side of the property. The private drive will provide access to the back two proposed lots. The lot facing onto Tobin Street will retain the existing driveway. 2. Environmental Review In accordance with the State Environmental Policy Act (SEPA), Chapter 43.21 C RCW, and the City's Environmental Review Ordinance, Short Plats are exempt from environmental review. 3. Compliance with ERC Mitigation Measures N/A 4. Staff.Review Comments Representatives from various city departments have reviewed the application materials to identify and address issues raised by.the proposed,development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. • 5. Consistency Short Plat Criteria Approval of a plat is based upon several factors. The following short plat criteria have been established to assiist'decision makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation The subject property is designated as Residential Single Family on the.LandWse Element Map of the Comprehensive Plan. The Residential Single Family designation allows for the construction of single family homes on a minimum lot size of 4,500 sf. The proposed short plat will allow for the construction of two new single family homes on lots that are over 4,500 sf in area. The subject property is less than a half acre in size. This zone allows for the construction of single family homes at a maximum density of 9.7 du/acre and a minimum density of 5 du/acre. The proposed short plat is consistent with the density requirements in that it provides a density of approximately 7.5 dwelling units per acre: This density falls within the acceptable range of 5 to 8 dwelling units per acre. c) Compliance with Subdivision Regulations Streets: No new streets are proposed as part of this subdivision. Lot 1 gains access directly from South Tobin Street. Lots 2 and 3 will gain,access from a private drive that will connect to both South Tobin Street and the alley located at the north end of the subject property. The applicant will need to record access-agreements on each of the lots that allow for the use of the private drive as it crosses each.of the lots. Blocks: No new blocks will be created as part of this subdivision. Lots: Lots 2 and 3 are approximately 65' X 75' and Lot 1 is 102' by 75'. These lot dimensions exceed the minimum lot width and lot depth required by code. d) Reasonableness of Proposed Boundaries, . Access:. As noted above, access,to the subject property is provided from South Tobin Street and an alley on the north side of the property. Mutual access easements will need to be recorded on each of the lots by the applicant. These easements will need to be recorded prior to or at the time of the recording of the short plat. Topography: Topography of the site is virtually level. The northern portion of the lot is slightly higher southern portion of the lot. Relationship to Existing Uses: This area of Renton has developed as"a mix of residential and commercial land uses. Also, the,airport is located just north of the subject property and the Renton High School is located just south of the subject property. The proposed short plat is compatible with the adjacent single family residential area. Lots in this area range from approximately 5,000 sf to over 17,000 sf. The proposed lots range in size from 4,912 sf to 7,715 sf. The proposed lots are.similar in area to the existing residential lots in this area. The planes approaching and leaving the airport do not normally fly directly over the subject property. However, the future residents in these proposed homes will be aware of the activity associated with the airport and the level of noise associated with these activities. Staff recommends that the homes be required to have double pain windows installed as this is one means of lowering the noise levels in the interior of the proposed homes. One letter in opposition to the short plat was received from a restaurant located just to the north of the subject property. The owner of the restaurant notes that area residents already complain about the noise from his establishment and from the trucks that are servicing the restaurant. The use of double-pained windows should help to reduce the impacts of the restaurant on the occupants of the homes on the subject property. shpltrpt.doc . Fire Prevention Bureau staff note that a Fire Mitigation Fee of $.488 will be assessed each of the new homes. The mitigation fee must be provided prior to the recording of the short plat. Recreation: The' proposed project will allow for two new residents. It is anticipated that the residents of these homes will use the existing recreational facilities and programs offered by the City of Renton. The applicant will need to provide a mitigation fee of $530.76 for each new lot. The applicant will need to provide•the mitigation fee prior to the recording of the short plat. Schools: It is anticipated that the two new homes will generate approximately one new school age child. This will not have a significant impact on the Renton.School District.- Storm Water. At the present time storm water sheet flows into Tobin Street from the subject property. It is anticipated that the storm water will continue to sheet flow into Tobin Street after buildout of the short plat. The City will be installing a new 24"storm water main in Tobin Street to replace the existing 12" storm water main. This project will not extend to the property that is the subject of this short plat. Although no significant drainage issues are anticipated the applicant will need to provide a Level 1 downstream analysis. Water and-Sanitary Sewer Utilities: Adequate water and sanitary sewer mains are located in SE Tobin Street to serve the proposed development. New sewer extensions will be•required. Transportation: The proposed subdivision will generate approximately 20 new vehicle trips per day. The City has adopted a City-wide transportation mitigation fee of $75.00 per vehicle trip: The applicant will need to provide a mitigation fee of $1,500 (20 vehicle trips X $75.00 = $1,500.00). The mitigation fee will need to be submitted prior to the recording of the short plat. This area is not within the Airport's Runway Protection Zone. However, it is recommended that since the area is subject to noise generated on the airport and by low flying aircraft, that the owners install adequate insulation and double paned windows. The applicant should record a note on the face of the plat that there is a municipal airport is located in the area and homes. should be constructed with adequate insulation and double paned windows. Since the area is zoned for residential housing, the proposed housing should not violate the height limitations. 'This residential area is the closest residential area to the airport. As mitigation for increasing the number of housing units, insulation to HUD or Renton standards, whichever is most stringent, is requested, with double pane windows required as a minimum. 2. The'landowner is requested to inform purchasers/renters of the new housing/lots that the houses/lots are located next door to an active airport with low flying aircraft at very low levels. Also, that other aircraft operations are also located in this area both on the, ground and in the air occur at all times of the day and night. If possible, .a disclosure requirement, wherein the property owner notifies the purchaser/renter of these facts, would assist with informing the occupants prior to purchasing/renting that airport and aircraft noise will occur 24-hours per day. 3. Project Description/Background The applicants seek approval of a short plat application in order to subdivide an existing 17,540 sf lot into three lots. The size of the proposed lots will be: Lot 1 - 7,715 sf, Lot 2 - 4,912 sf, and Lot 3 - 4,916 sf. The existing single-family home and a garage will be retained and will be located on proposed Lot 1. There are two existing sheds on the west side of the property. Both of these sheds will be removed in order to allow for the construction of a private drive on this side of the property. The private drive will provide access to the back two proposed lots. The lot facing onto Tobin Street will retain the existing driveway. 2. Environmental Review In accordance with the State Environmental Policy Act (SEPA), Chapter 43.21C RCW, and the City's Environmental Review Ordinance, Short Plats are exempt from environmental review. 3. Compliance with ERC Mitigation Measures N/A 4. Staff Review Comments Representatives from various city departments have reviewed the application materials to identify and address issues raised by the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. Consistency Short Plat Criteria Approval of a plat is based upon several factors. The following short plat criteria have been established to assist decision makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation The subject property is designated as Residential Single Family on the Land Use Element Map of the Comprehensive Plan. The Residential Single Family designation allows for the construction of single family•homes on a minimum lot size of 4,500 sf. The proposed short plat will allow for the construction of two new single family homes-on lots that are over 4,500 sf in area. Therefore, the proposed short plat is consistent with the Comprehensive Plan designation. The subject property is less than a half acre in size. This zone allows for the construction of single family homes at a maximum density of 9.7 du/acre and a minimum density of 5 du/acre. • The proposed,short plat is consistent with the density requirements in that it provides a density of approximately 7.5 dwelling units per acre. This density falls within the acceptable range of 5 to 8 dwelling units per acre. c) Compliance with Subdivision Regulations Streets: No new streets are proposed as part of this subdivision. Lot 1 gains access directly from South Tobin Street. Lots 2 and 3 will gain access from a private drive that will connect to both South Tobin Street and the alley located at the north end of the subject property. The applicant will need to record access agreements on each of the lots that allow for the use of the private drive as it crosses each of the lots. Blocks: No new blocks will be'created as part of this subdivision. Lots: Lots 2 and 3 are approximately 65' X 75' and Lot 1, is 102' by 75'. These lot dimensions exceed the minimum lot width and lot depth required by code. d) Reasonableness of Proposed Boundaries Access: As noted above, access to the subject property is provided from South Tobin Street and an alley on the north side of the property. Mutual access easements will need-to be recorded on each of the lots by the applicant. These easements will need tote recorded prior to or at the time of the recording of the short plat. Topography: Topography of the site is virtually level. The northern portion of the lot is slightly higher southern portion of the lot. Relationship to Existing Uses: This area of Renton has developed as a mix of residential and commercial land uses. Also, the airport is located just north of'the subject property and the Renton High School is located just south of the subject property. The proposed short plat is compatible with the adjacent single family residential area. Lots in this area range from approximately 5,000 sf to over 17,000 sf. The proposed lots range in size from 4,912 sf to 7,715 sf. The proposed lots are similar in area to the existing residential lots in this area. The planes approaching and leaving the airport do not normally fly directly over the subject property. However, the future residents in these proposed homes will be aware of the activity associated with the airport and the level of noise associated with these activities. • Staff - recommends that the homes be required to have double pain windows installed as this is one means of lowering the noise levels in the interior of the proposed homes. One letter in opposition to the short plat was received from a restaurant located just to the north of the subject property. The owner of the restaurant notes that area residents already complain about the noise from his establishment and from the trucks that are servicing the restaurant. The use of double-pained windows should help to reduce the impacts of the restaurant on the occupants of the homes on the subject property. Fire Prevention Bureau staff note that a Fire Mitigation Fee of $488 will be assessed each of the new homes. The mitigation fee must•be provided prior to the recording of the short plat. Recreation: The proposed project will allow for two new residents. It is anticipated that the residents of these homes will use the existing recreational facilities and programs offered by the City of Renton. The applicant will need to provide a mitigation fee of $530.76 for each ,new lot. The applicant will need to provide the mitigation fee prior to the recording of the short plat. Schools: It is anticipated that the two new homes will generate approximately one new school age child. This will not have a significant impact on the Renton School District. Storm Water. At the present time storm water sheet flows into Tobin Street from the subject property. It is anticipated that the storm water will continue to sheet flow into Tobin Street after buildout of the short plat. The City will be installing a new 24" storm water main in Tobin Street to replace the existing 12" storm water main. This project will not extend to the property that is the subject of this short plat. Although no significant drainage issues are anticipated the applicant will need to provide a Level 1 downstream analysis. Water and Sanitary Sewer Utilities: Adequate water and sanitary sewer mains are located in SE Tobin Street to serve the proposed development. New sewer extensions will be'required. Transportation: The proposed subdivision will generate approximately 20 new vehicle trips per day. The, City has adopted a City-wide transportation mitigation fee of $75.00 per vehicle trip. The applicant will need to provide a mitigation fee ,of $1,500 (20 vehicle trips X $75.00 = $1,500.00). The mitigation fee will need to be submitted prior to the,recording of the short plat. This area is not within the Airport's Runway Protection Zone. However, it is recommended that since the area is subject to noise generated on the airport and by low flying aircraft, that the owners install adequate insulation and double paned windows. The applicant should record a note on the face of the plat that there is a municipal airport is located in the area and homes should be constructed with adequate insulation and double panedwindows. H. DECISION: The Short Plat, File No. LUA-96-090,SHPL, is approved subject to the following conditions: 1. Prior to recording the short plat, the applicant shall remove the two existing sheds located within the proposed access roadway. 2. Prior to or with the recording of the short plat, the applicant shall record access covenants across each of the three lots for-use of the proposed access roadway. 3. Any new construction must have a fire hydrant capable of delivering a minimum of 1,000 GPM fire and shall be located within 300 feet of the structure. This distance is measured along a travel route. The private access easement shall be a minimum of 20 feet in width, with a minimum of a twelve foot paved driveway. 2. The code requires the installation of curb, gutter and sidewalks along the full frontage of the parcel being developed. 3. S Tobin St. has been identified for a street overlay for this Autumn. 4. An additional six feet of right-of-way (as shown on the submittal) along the alley shall be deeded to the City prior to the recording of this short plat. The recording number of the dedication shall be shown on the face of the plat prior to recording. GENERAL PLAN REVIEW COMMENTS: 1. Submit a conceptual utility plan with the formal application. All required utility, drainage and street improvements will require separate plan submittals prepared according to City of Renton drafting standards by a licensed Civil Engineer. 3. Permit application must include an itemized cost estimate for these improvements. The fee for review and inspection of these improvement is 5% of the first $100,000 of the estimated construction costs; 4% of anything over$100,000 but less than $200,000, and 3% of anything over$200,000. Half of the fee must be paid upon application for building and construction permits, and the remainder when the permits are issued. There may be additional fees for water service related expenses. See Drafting Standards. AIRPORT MANAGER 1. The proposed short plat lots are not within the Airport's Runway Protection Zone (RPZ) -or the 7:1 sloe are adjacent to the RPZ. Since the area is zoned for residential housing, the proposed housing should not violate the height limitations. This residential area is the closest residential area to the airport. As mitigation for increasing the number of housing units, insulation to HUD or Renton standards, whichever is most stringent, is requested, with double pane windows required as a minimum. 2. The landowner is requested to inform purchasers/renters of the new housing/lots that the houses/lots are located next door to an active airport with low flying aircraft at very low levels. Also, that other aircraft operations are also located in this area both on the ground and in the air occur at all times of the day and night. If possible, a disclosure requirement, wherein the property owner notifies the purchaser/renter of these facts, would assist with informing the occupants prior to purchasing/renting that airport and aircraft noise will occur 24-hours per day. 3. A Notice of proposed construction will be required to be submitted to the FAA for review prior to issuance of a Building Permit. 4. Airport Zoning Codes apply to the area for building height restrictions and other restrictions such as glare, lighting, height of trees, Etc. POLICE DEPARTMENT 1. It is anticipated that the new development will generate 2.22 calls or police service annually. Tobin, Renton To whom it may concern, I, Don Schumsky would like to go on record to oppose the short plat and sub- division of the above listed property. Locating single family housing next to a commercial parking lot would be a big mistake. This property is used all hours of the day and the back alley of the restaurant, Schumsky's All City Diner is used for deliveries, garbage truck noise, use of the parking lot, customer noice etc... at least 16- 18 hours every day. Our property has been a restaurant for the past 40 years or more. The City of Renton and I have had several complaints from residents of Logan street regarding the noise, use of the alley for delivery trucks and the outside lighting being intrusive. The last resident of the house at this site on Tobin had many complaints about the use of the alley and the noise. They called the Renton Police Department and expressed a complaint of which there is a record This short plat is not condusive to the quality family living that we want in Renton. The person trying to develop this property is here only for the fast buck that can be made and not the long term effect that it will have on this property. This site should be left as is or zoned for commercial use. There is common knowledge of drug homes and sales in the area. We do not need more of this next to the High School.
