Pywell, AICP • City of Renton RECEIVED Department of Planning/Building/Public Works Development Planning Section 200 Mill Avenue South Renton, Washington 98055 RE: MDNS ISSUED FOR MENDENHALL PIER REPLACEMENT (LUA-96- 093,SM,SMV,ECF1 Dear Mr. Pywell: • The Environmental Division of the Muckleshoot Indian Tribe has reviewed the MDNS issued for a proposal to replace an existing 225 foot pier with another 225 foot pier, though of slightly smaller overwater coverage. The applicant is to be commended for using wood mooring piles rather than using fingers as in the old structure. However, the application does justify the requested variance for a 225 foot long pier in an area where 80 feet is the maximum • authorized length and which is extensively used by juvenile salmon. The request for variance states that proposed pier length is consistent with other piers in the neighborhood, though the pier to the immediate south of the proposed pier is less than 100 feet long. The variance request claims that 12 feet of water depth is necessary for safe moorage, though the letter does not state specifically why such a depth is required for safe • moorage. The nearshore environment of Lake Washington in this reach of the lake (lake miles 39-40) has been largely bulkheaded, and to a considerable extent occupied by piers and associated structures. For example, in 1989 this lake reach contained approximately 32 piers. Both piers and bulkheads are considered to have adverse impacts upon the nearshore environment used by juvenile salmon. Though the applicant believes that the requested variance will cause no hardship or inconvenience to the public welfare, granting the proposed variance will perpetuate a situation that has altered the nearshore habitat of the lake that is extensively utilized by juvenile salmon, a public resource. Furthermore, the City of Renton should consider the continuation of existing impacts upon aquatic resources and declining salmon stocks when piers are replaced. It is anticipated that the State Department of Fish & Wildlife, will establish a specific period in which the proposed construction may occur. This will replace an existing pier the same length but 8 feet wide. The existing pier serves a single family residence..The Environmental Review Committee(ERC)issued a Determination of Non-Significance-Mitigated(DNS-M)on August 20, 1996. The applicant will need to comply with the mitigation measures during the construction of the pier. This is a shoreline variance and there are some established criteria that the staff has reviewed. In reviewing the criteria the first is that the exceptional or extraordinary circumstances or conditions apply to the subject property or the intended use thereof, and do not apply generally to the other properties in the same vicinity. As can be seen on Exhibit 2,the shoreline itself as it extends out remains very shallow and to get to the 12 foot depth it is necessary to have the pier 225 feet in length. The shoreline ordinance would normally'limit a pier to 80 feet in length and 12 feet in depth. The 80 feet in length would leave this pier in about 3-1/2 to 4 feet of water at the mean high water mark,which means during the summer when the pier would get its most significant use the water would be shallower than that. The variance permit is necessary for the preservation and enjoyment of substantial property rights,of the applicant possessed by owners of other properties on shorelines in the same vicinity. Again, staff would note that the length is necessary to make the 12 feet of depth which is generally the depth that most piers in the vicinity are stopped at, and again,the length is justifiable due to the fact that this area of the lake has a very shallow shoreline. The applicant does own a boat that will be moored here and that does require the greater depth. The variance permit will not be materially detrimental to the public welfare or injurious to property on the shoreline in the same vicinity. This pier will actually be smaller than the existing pier, and a different mooring system will be used which will not have the finger piers but will just be pole moored. Staff is not aware of any complaints the City has received on the existing pier or any problems associated with it. The variance granted will be in harmony with the general purpose and intent of the master program which is to limit piers to the minimum length that will allow them to be useful to the owners, and staff believes in this case the applicant has met that requirement. The granting of the variance will not cause harm to the general area and will allow the applicant to continue the use of its property in a manner similar to its neighbors that do not have the extended shallow water area as part of the lake frontage. Therefore, staff would recommend approval of the Mendenhall pier replacement variance subject to the condition that the applicant comply with the ERC mitigation measures. A letter was received from the Muckleshoot Indian Tribe, and they did not express significant issues on their rights, but asked that the City ensure that the length of the pier was justifiable. Staff has talked with the applicant's representative and feels assured that due to the boats that the applicant owns and will be mooring here and that traditionally have come to this pier,that the depth and the length is justifiable. The Muckleshoots did indicate that they are also appreciative of the fact that the applicant has made an effort to reduce the size of the pier and the method of construction. M. W. FREE, 1100 N.W. Leary Way, Seattle, Washington 98107, applicant herein, explained that typically the pilings are cut off,they are not pulled out. Under-water air saws are used to cut them off at the mud line so that reduces the turbidity. The estimated length of time for the project to be completed would be ten days. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 9:20 a.m. FINDINGS,CONCLUSIONS &RECOMMENDATION • M. W. Free Sea& Shore Construction,Inc. _ Mendenhall Pier Replacement File No.: LUA-96-093,SM,SMV October 10, 1996 Page 3 FINDINGS, CONCLUSIONS &RECOMMENDATION Having reviewed the record in this matter,the Examiner now makes and enters the following: FINDINGS: 1. The applicant,M.W. Free, for Besse Mendenhall, filed a request for approval of a Shoreline Substantial Development Permit and a Variance from the Shoreline Management Act to construct a 225 foot long pier into Lake Washington. 2. The yellow file containing the staff report,the State Environmental Policy Act(SEPA)documentation and other pertinent materials was entered into the record as Exhibit#1. 3. The Environmental Review Committee(ERC),the City's responsible official, issued a Determination of Non-Significance-Mitigated(DNS-M)for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is located 3007 Mountain View Avenue North. 6. The subject site is located on the shoreline of Lake Washington. The site is located west of Lake Washington Boulevard and north of NE 30th Street(as extended). 7. A large majority of the subject site is submerged below the surface of the.lake. An existing home is located on the site. The site is already served by an older pier which would be replaced if this permit is approved. The existing pier is also 225 feet long but is 8(eight)feet wide. The proposed pier would be only 6 feet wide. . 8. The existing pier is old and will be replaced by a new pier with new piling,framing and decking. The existing pier has finger piers where the boat is moored. These finger piers are perpendicular projections , of the pier structure. This creates additional overwater structures. The new pier will use pilings, a more open arrangement,to secure moored boats. 9. The construction will be monitored and the appropriate construction windows will be used to ensure that activity does not interfere with migrating salmon. 10. The water depth in this shoreline area is very shallow. In order to achieve a'navigable water depth of 12 feet,the pier would be extended out as far as the existing pier. 11. An existing pier to the south is approximately 100 feet long. - CONCLUSIONS: • 1. The Variance provisions of the Shoreline Master Program permit a variance in certain circumstances. Mendenhall Pier Replacement File No.: LUA-96-093,SM,SMV October 10, 1996 Page 4 Upon proper application, a substantial development permit may be granted which is at variance with the criteria established in the Renton Master Program where, owing to special conditions pertaining to the specific piece of property,the literal interpretation and strict application of the criteria established in the Renton Master Program would cause undue and unnecessary hardship or practical difficulties. The fact that the applicant might make a greater profit by using his property in a manner contrary to the intent of the Master Program is not by itself sufficient reason for a variance. The Land Use Hearing Examiner must find each of the following: a. Exceptional or extraordinary circumstances or conditions applying to the subject property, or to the intended use thereof,that do not apply generally to other properties on the shoreline in the same vicinity. b. The variance permit is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by the owners of other properties on shorelines in the same vicinity. c. The variance permit will not be materially detrimental to the public welfare or injurious to. property on the shorelines in the same vicinity. d. The variance granted will be in harmony with the general purpose and intent of this Master Program. e. The public welfare and interest will be preserved; if more harm will be done to the area by granting the variance than would be done to the applicant by denying it,the variance will be denied,but each property owner shall be entitled to the reasonable use and development of his lands as long as such use and development'is in harmony with the general purpose and intent of the Shoreline Management Act of 1971, and the provisions of this Master Program. 2'. Lake Washington's rather shallow depth waterward from the shoreline makes it hard to dock and utilize all but very shallow draft and therefore small boats. Eighty feet from shore the water only reaches a . water depth of four feet when the water level is high. During summer or dry periods the water depth is even lower and sometimes the bottom is exposed. This would preclude use of all but small boats and in some cases, leave boats high and dry. This is a unique aspect of the area in which the subject site lies. 3. In order to make use of the water-side nature of the site and to allow use of even a moderate sized boat, a variance that permits a pier of greater than the usual 80 foot length is necessary. A longer pier is necessary in order to reach water that is 12 feet in depth. The fact that an existing pier already exceeds the 80 feet shows that historically this site needs a longer pier to achieve a reasonable water depth. 4. Since this pier'replaces one of equal length but provides a narrower width and eliminates the additional finger pier protrusions and similar longer piers already serve portions of the lake, approval will not be unnecessarily detrimental to either the public welfare or other properties in this area. ' 5. The Master Program has already made allowances for single family homes along the lakeshore. Piers have been considered normal accessory uses. The pier is in harmony with the purposes of the program. 6. The replacement of the wider pier by this one will actually reduce the impact and reduce the harm. It should be approved. M. W. The applicant is to be commended for using wood mooring piles rather than using fingers as in the old structure. However, the application does justify the requested variance for a 225 foot long pier in an area where 80 feet is the maximum authorized length and which is extensively used by juvenile salmon. The request for variance states that proposed pier length is consistent with other piers in the neighborhood, though the pier to the immediate south of, the proposed pier is less than 100 feet long. The variance request claims that 12 feet of water depth is necessary for safe moorage, though the letter.does not state specifically why such a depth is required for safe moorage. The nearshore environment of Lake Washington in this reach of the lake (lake miles 39-40) has been largely bulkheaded, and to a considerable extent occupied by piers and associated structures. For example, in 1989 this lake reach contained approximately 32 piers. Both piers and bulkheads are considered to have adverse impacts upon the nearshore environment used by juvenile salmon. Though the applicant believes that the requested variance will cause no hardship or inconvenience to the public welfare, granting the proposed variance will perpetuate a situation that has altered the nearshore habitat of the lake that is extensively utilized by juvenile salmon, a public resource. Furthermore, the City of Renton should consider the continuation of existing impacts upon aquatic resources and declining salmon stocks when piers are replaced. DEPARTMENT ANALYSIS: 1. PROJECT DESCRIPTION/BACKGROUND The applicant seeks a Shoreline Substantial Development Permit and a Variance from the Shoreline Master Program in order to remove an existing eight-foot wide by 225-foot,long private pier and construct a six-foot wide by 225-long private pier. The Shoreline Substantial Development Permit will be issued separately once the Hearing Examiner has issued a determination on the variance. As noted above, there is an existing pier on the subject property. This pier extends out to an area where the water is 12 feet in depth. This allows for sailboats and the larger motorboats to be moored at the pier without the fear of scraping the lake bottom during the drier months. The depth also limits the disturbance of the lake bottom each time a boat is brought into or leaves the pier. 2. ENVIRONMENTAL REVIEW The Environmental Review Committee (ERC)"issued a Determination of Non- Significance -Mitigated on August 20, 1996. 3 COMPLIANCE WITH ERC MITIGATION MEASURES The applicant shall ensure that all construction debris and litter is properly disposed of away from the shoreline area. In order to further protect the water, all equipment shall be fueled away from the shoreline area. The applicant will need to comply with this mitigation measure during the construction phase of the project. During the removal of the existing pilings and the installation of the new pilings the applicant shall ensure that a visual as well as physical measurement of turbidity and dissolved oxygen is maintained to assure that water quality is not adversely impacted beyond the anticipated minor and short-term periods. CONSISTENCY WITH VARIANCE CRITERIA Upon proper application, a substantial development permit may be granted which is at variance with the criteria established in the Renton Master Program where, owing to special conditions pertaining to the specific piece of property, the literal interpretation and strict application of the criteria established in the Renton Master Program would cause undue an unnecessary hardship or practical difficulties. The fact that the applicant might make a greater profit by using his property in a manner contrary to the intent of the Master Program is not, by itself, sufficient reason for a variance. The Land Use Hearing Examiner must find each of the following: a. Exceptional or extraordinary circumstances or conditions applying to the subject property, or to the intended use thereof, that do not apply, generally to other properties on the shoreline in the same vicinity. The applicant believes that extrodinary conditions apply to this property. It is located in an area of shallow water. An eighty foot long pier from the high water mark of the lake would only reach a water depth of four feet during the high water period of the lake. During the low water period of the lake the water depth would even be less. A small beach usually forms along this section of the lake during the drier months. b. The variance permit is necessary is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by the owners of other properties on shorelines in the same vicinity. Other private piers along the lake frontage reach water depths of 12 feet within the prescribed limit of 80 feet. The depth of 12 feet is necessary for those who desire to moor boats larger than the typical runabout at their pier. c. The variance permit will not be materially detrimental to the public welfare or injurious to property on the shorelines in the same vicinity. The variance will not be materially detrimental to the public. The adjacent pier is also extended to the same area in order to provide an adequate water depth at the end of the pier. d. The variance granted will be in harmony with the general purpose and intent of this Master Program. The variance, if granted, will be in harmony with the intent of the Master program. Although the length of the pier is longer than would normally be allowed, it is necessary in order to reach beyond the very shallow water area that extends out more than 80 feet from the upland section of the applicants property. The proposed pier will replace an existing 8 foot wide by 225 foot long pier(approx. 1662 sf). Both the existing pier and the proposed pier serve a single family residence on Lake Washington. The existing pier will be removed and new piling, framing, and decking will be installed for the new pier. This pier will be two feet above the ordinary high water mark of the lake. The construction of this project will take ten,days and will occur when all applicable permits have been issued. During the removal of the existing pilings and the installation of the new pilings the applicant shall ensure that a • visual as well as physical measurement of turbidity and dissolved oxygen is maintained to assure that water quality is not adversely impacted beyond the anticipated minor and short-term periods. Advisory Notes to Applicant: The following notes are supplemental information provided in conjunction with the environmental determination. Because these notes are provided as information only, they are not subject to the appeal process for environmental determinations. 1. The applicant shall comply with all applicable City, state, county, federal and other jurisdictional regulations, codes and policies governing the project and obtain all necessary permits. 2. The applicant shall comply with all applicable City Regulations including, but no limited to,the City's Noise Ordinance restricting noise levels and hours of operation. 3. An architect will need to conduct structural observation on the pile driving. The connections are deemed to be structural. After completion of the pier the architect will write a letter to the building official certifying that the constructions meets the approved plans. The architect will conduct a final inspection with the City building inspector. 4. Untreated piling are to be used, unless treatment is approved by the building official. ENVIRONMENTAL IMPACTS Whether the applicant has adequately identified and addressed environmental impacts anticipated to occur • in conjunction with the proposed development? 1. Earth Impacts: The applicant will be removing an existing pier,with approximately 48 piles, and two mooring piles. Then the applicant will be installing 38 piles for the new pier and two new piles. The removal of the 50 existing piles and the installation of forty new piles has the potential to cause a significant amount of disturbance of the bottom sediment. This turbidity in the water could affect the spawning of fish species that breed in the shallow water areas of the lake. The sediment could also adversely impact the plant life that fish depend on in this area. State Fisheries staff establish windows during which construction activities can occur in Lake Washington. The permits allowing construction limit construction activities to those months in which the Lake is at its' lowest levels. This limits the amount of work that needs to be conducted under the water and also limits the area disturbed by the sediment as it settles back onto the lake bottom. The applicant will still need to have the construction work monitored to ensure that the turbidity caused by the construction does not become excessive. Mitigation Measures: During the removal of the existing pilings and the installation of the new pilings the applicant shall ensure that a visual as well as physical measurement of turbidity and dissolved oxygen is maintained to assure that water quality is not adversely impacted beyond the anticipated minor and short-term periods. Nexus: Environmental Ordinance (SEPA) Section 4-6, Shoreline Master Program 2. Noise Impacts: Demolition and construction activities, especially the pile driver, could result in noise impacts during the length of time in which the construction will occur. The applicant has stated that the proposed construction will take ten days. As the construction will occur for only a limited duration, it is not considered to be a significant adverse impact. The applicant will need to comply with the City's Code-requirements. Mitigation Measures: No further mitigation measures are required. Nexus: N/A 3. Water Impacts: The applicant is proposing to use untreated pilings. The chemicals used to treat pilings, if used, can leach out into the lake. If the applicant desires to use a treated piling, the type of treatment used will need to be approved by the Building Official. Construction activities can cause adverse impact if debris and litter is allowed to enter Lake Washington. The applicant will need to ensure that debris and litter is not allowed to enter into the lake. Therefore,the applicant will need to ensure that all litter and debris are properly contained within the work area and that adequate storage facilities are maintained away from the shoreline. Mitigation Measures: The applicant shall ensure that all construction debris and litter is properly disposed of away from the shoreline area. Renton, WA 98055 re: Request for Variance, Mendenhall Pier - Sirs: We are requesting a variance for the Mendenhall pier project at 3007 Mountain View Ave N, Renton, WA 98055. We are requesting that a variance be issued to allow a pier length of 225 feet from ordinary high water, the purpose of extending the pier to this length is to attain sufficient water depth for the safe moorage of boats. The City of Renton Shoreline Master Program Section 7.12.05 Design Criteria for Single-Family Docks and Piers specifies a maximum length of eighty (80) feet or a depth of 12 feet, whichever is reached first. The water depth of the subject property at 80 feet from ordinary high water is 4 feet, to attain 12 feet of water depth it is necessary to extend the pier to 225 feet from ordinary high water. The requested pier length is consistent with other piers in the neighborhood and as such does not entitle the owner to a special privilege not accorded other homeowners in the vicinity. The requested variance causes no hardship or inconvenience to the public welfare or • other properties in the vicinity and is the minimum needed to provide safe moorage. July 23, 1996 re: Mendenhall Pier Project Narrative The project site is a single family residence on Lake Washington. The existing shoreline is low bank with an existing rock bulkhead. There is a small beach exposed at low lake levels composed of gravel and rock. The existing house is located approximately 30 feet from the street ( Mountain View Ave N) and approximately 175 feet from the shoreline. The proposed project will obstruct no views. The proposed pier is to be 6 feet wide by 225 feet long (approx. 1350 sf), constructed with new piling, framing and decking, it's height above ordinary high water is 2 feet, 2 mooring piles are to be placed 20 feet north of the pier and will be cut to an elevation of 5 feet above ordinary high water. The existing remnant pier and piling (approx. 225 feet long and 1662 sf) is to be removed and recycled. The construction cost of this project is $20,000.00 and the construction will take approximately 10 days and will occur when all applicable permits have been issued and during a period specified by the Dept. of Fish and Wildlife on the hydraulic permit.
