The condition reads "If the FAA requires the installation of lighting or other safety features shall be the applicant's..." (please refer to copy of Report&Decision dated August 20, 1996). Sprint Spectrum has recently been notified by the FAA that the Sprint Facility on.Houser/SAS Fluid Power is not identified as an obstruction under any standards of FAA, Part 77, Subpart C, but would not be a hazard to navigation. Thus, obstruction marking and lighting are not necessary. Please see attached FAA determination. This determination should exempt Sprint Spectrum from satisfying any part of Condition No. 3 of the Conditional Use Permit. The existing pole is approximately 60' above ground elevation, while the proposed tower is between 72'and 84' in • elevation. It is difficult to determine, from the applicant's statement,what the total height (tower plus antennas)will be. The proposed tower is on the west side of I-405, and will extend above 1-405 but most likely will not be above the hill to the immediate east of 1-405. 2. The proposed tower is within 20,000 feet of the Renton Airport Runway, and exceeds the height established by a slope of 100:1 from the runway. A Notice of Proposed Construction is to be submitted to the FAA, and should be submitted to and a decision received from the FAA prior to a City building permit being issued. Although the tower is private property, it is of a height that would require the City to employ special procedures to maintain obstruction lighting if it were a City project. Staff reviewers have identified that the proposal is likely to have the following probable impacts: 1) Earth Impacts The project should not have a significant impact on the soil or geology of the subject property. The area where the proposed tower will be located is already a paved portion of an industrial site. There is a potential for erosion impacts, both wind and water, during the construction phase of the project. However, these adverse impacts will be mitigated by the Code-required temporary erosion control measures. Mitigation Measures No further mitigation.is required for the proposed project. The adjoining area is also zoned IH. Although the proposed facility will only serve a portion of the City, it contribute to a major communications network. The applicant states that PCS is the most advanced wireless service and will provide a modern communications system throughout the City of Renton and the region. Findings 1) CONSISTENCY WITH CONDITIONAL USE CRITERIA Section 4-31-36 lists 11 criteria that the Hearing Examiner is asked to consider, along with all other relevant information, in making a decision on a Conditional Use application. These include the following: A. CONSISTENCY WITH THE COMP.PLAN,ZONING CODE&OTHER ORDINANCES: The proposed use shall be compatible with the general purpose, goals, objectives and standard of the Comprehensive Plan, the Zoning Ordinance and any other plan, program, map or ordinance of the City of Renton. (1) COMPREHENSIVE PLAN, ITS ELEMENTS AND POLICIES The proposed tower is consistent with the Comprehensive Plan. Policy LU- 200 states that secondary uses should be limited so that they do not reduce the amount of land area available for industrial uses. The proposed communication tower will not limit the amount of area available for industrial use. It is being located on a small unused portion of an existing industrial site. The land owner does not feel that the tower will interfere with his operation or he would not have agreed to the towers location. Objective U-J: Promote the timely and orderly expansion of all forms of telecommunications services within the City and the remainder of the planning area. The applicant states that the tower is necessary for them to provide service to this area of the City of Renton. Although there is another tower in the area it is operated by a rival company and this new tower will allow the all cellular users to operate in this area. The Comprehensive Plan anticipates that monopolies for cellular telephone use will be between 60 and 150 feet in height. The proposed pole will be approximately 70 feet of height and is well within the range anticipated by the Comprehensive Plan. (2) ZONING CODE The subject site is zoned Heavy Industrial (IH). Cellular sites are permitted providing that an Administrative Conditional Use Permit is approved. There are no height limits established within the IH zone. Thus, the height of the tower is acceptable in the IH zone. However, as noted by the Airport Manager, the height of the proposed tower does require approval of a Notice of Proposed Construction from the FAA. COMMUNITY NEED: There shall be a community need for the proposed use at the proposed location. In the determination of community need, the Hearing Examiner shall consider the following factors, among all other relevant information: (1) The proposed location shall not result in either the detrimental over concentration of a particular use within the City or within the immediate area of the proposed use. Although there will be two cellular towers located on adjacent properties, this will not result in a detrimental overconcentration of cellular towers in this area or within the City of Renton. The use of cellular phones is growing rapidly and a number of companies are now competing for service areas. These towers are operated by different cellular service providers and this competition is considered to be a benefit to the cellular phone users in this area. (2) That the proposed location is suited for the proposed use. The proposed location is well suited for the cellular tower. It will allow Sprint to provide uninterrupted service in this area.' C. EFFECT ON ADJACENT PROPERTIES: The proposed use at the proposed location shall not result in substantial-or undue adverse effects on adjacent property. The following site requirements shall be required: (1) LOT COVERAGE Lot coverage shall conform to the requirements of zone in which the proposed use is to be located. • The proposed tower will only cover approximately 110 square feet of 620 square feet dedicated to the tower and base station. The base station includes some cabinets located at the base of the tower. The cabinets are approximately five feet in height. (2) Yards: Yards shall conform to the requirements of the zone in which the proposed use is to be located. Additions to the structure shall not be allowed in any required yard. Only a front yard of fifteen feet is required in the IH zone. There are no requirements for side or rear yard setbacks. The project site is located on the rear property line of the subject property. This leaves a front yard setback of approximately 200 feet. 3) Height: Building and structure heights shall conform to the requirements of the zone in which the proposed use is to be located. Spires, belltowers, public utility antennas or similar structure may exceed the height requirement upon approval of a variance. Building heights should be related to surrounding used in order to allow optimal sunlight and ventilation, and minimal obstruction of views from adjacent structures. There is no height limit in the IH zone. The applicant is proposing to construct a 72-foot tall tower. There is an existing 60-foot tall cellular phone tower on the adjacent property to the north. The two towers will be the tallest structures in this area. Sprint has stated that the proposed tower needs to be 72-feet in height since it uses a lower wattage technology than the U.S. West tower on the adjacent property. COMPATIBILITY: The proposed use shall be compatible with the residential scale and character of the neighborhood. (Ord 3599, 1-11-82) The proposed cellular tower will be compatible with the adjacent industrial area. The tower will be the tallest man-made structure in the immediate area. The hill on the opposite side of 1-405 is taller. The subject property is located with 20,000 feet of the airport. The applicant will need to file a Notice of Proposed Construction with the FAA. It is likely that the applicant will be required to install safety lighting in accordance with FAA regulations. The applicant will be responsible for the installation and maintenance of this lighting. The City will need to have an access agreement and a bond or other form of security to ensure that if the owner fails to maintain the lighting or other FAA-required security features, that the City may access the facility and have a funding source to pay for the required maintenance. E. PARKING: Parking under the building structure should be encouraged. Lot coverage may be increased to as much as seventy-five percent(75%)of the lot coverage requirement of the zone, in which the proposed use is located, if all parking is provided underground or within the structure. (Ord.3903, 4-22-85) Parking for cellular base stations is not directly addressed by the Parking and Loading Ordinance. Once the tower is constructed it will not generate a significant amount of traffic. Typically, these base stations have one or two personnel visit the site once a month to perform routine maintenance. The base site will be located on an industrial site. • Presumably, the applicant's staff will be able to use the existing parking while they perform any maintenance required on the tower or base station equipment. The applicant will need to provide a letter of agreement from the land owner stating that they may use the existing on-site parking spaces. F. TRAFFIC: Traffic and circulation patterns of vehicles and pedestrians relating to the proposed use and surrounding area shall be reviewed for potential effects on, and to ensure safe movement in the surrounding area. The construction of these towers is a relatively quick process and does not require a significant number of sub-contractors to be on-site. After construction, the project will only generate one vehicle trip per month. City staff believe that the existing roadways will be able to accept the traffic generated by this proposal. The proposed tower will not have a significant impact on the adjacent roadways. G. NOISE, GLARE: Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the location of on-site parking areas, outdoor recreational areas and refuse storage areas. Noise and glare impacts may be generated during the construction phase of the proposed project. However, these impacts are short term and should be insignificant in this heavy industrial area. The applicant will need to ensure that any required lighting for the project does not cause glare on the adjacent roadway or freeway. Once completed it is not anticipated that the proposed base station would generate significant levels of noise or glare in the surrounding area. LANDSCAPING: Landscaping shall be provided in all areas not occupied by building or paving. The Hearing Examiner may require additional landscaping to buffer adjacent properties from potentially adverse effects of the proposed use.. The proposed project is located on the paved rear portion of a heavy industrial lot. Existing on-site facilities are located between the proposed tower location and the existing street. No additional landscaping around the base of the tower would be visible from the street. Staff does not recommend the addition of landscaping around the proposed structure. I. ACCESSORY USES: Accessory uses to conditional uses such as day schools, auditoriums used for social and sport activities, health centers, convents, preschool facilities, convalescent homes and others of a similar nature shall be considered to be separate uses and shall be subject to the provisions of the use district in which they are located. CONVERSION: No existing building or structure shall be converted to a conditional use unless such building or structure complies, or is brought into compliance, with the provisions of this Chapter. Not applicable. K. PUBLIC IMPROVEMENTS: The proposed use and location shall be adequately served by and not impose an undue burden on any public improvements, facilities, utilities, and services. Approval of a conditional use permit may be conditional upon the provision and/or guarantee by the applicant of necessary public improvements, facilities, utilities, and/or services. Utility lines are available in the adjacent public right-of-way. However, this facility will not require a connection with the utilities. 2) Request: The Applicant, Sprint, has requested approval for Administrative Conditional Use Permit for a wireless base station, that includes some equipment cabinets and a 72'tall tower. 3) Administrative Conditional Use: The applicant's administrative conditional use application complies with the requirements for information for conditional use. The applicant's site plan and other project drawings are entered as Exhibits No. 2 thru 4. 4) • Comprehensive Plan: The subject proposal is consistent with the Comprehensive Plan designation of Employment Area - Industrial. 5) Zoning: The Conditional Use as presented, complies with the zoning requirements . and development standards of the Heavy Industrial Zone. 6) Existing Land Use: Land uses surrounding the subject site include: North: heavy industrial; East: Heavy industrial; South: heavy industrial; and West: heavy industrial. H. Conclusions 1) The subject proposal complies with the policies and codes of the City of Renton. 2) The proposal complies with the Comprehensive Plan designation of Employment Area - Industrial; and the Zoning designation of Industrial Zone. The details of Sprint Spectrum's request are fully set forth in the attached applications and drawings. This letter offers a brief summary, an explanation of Sprint Spectrum's wireless system,and the necessity for the S.A.S.Fluid Power PCS site. Proposal: Sprint Spectrum proposes to construct a Personal communication Services (PCS) base station for wireless telecommunication service on the S.A.S. Fluid Power, Inc. Code Compliance: Sprint Spectrum's proposal is consistent with the City of Renton's Zoning Ordinances as provided in Chapter 4-31-16 which allows Medium Utility Facilities as an Administrative Conditional Use. The proposal is in keeping with the Goals and Policies for Utilities as stated in City of Renton Comprehensive Plan. Justification for the Conditional Use Permit Request: The proposed project is consistent with the Comprehensive Plan Land Use Element, in the particular following and Policies found in the Utilities Element: a) Policy U-1--.The PCS system will provide wireless communication service to all present and future uses in city and the growing region. Residential,commercial, light industrial,retail, public services, entertainment,recreation and youth services can all benefit from the convenience of high quality mobile communications. Wireless communications also attract businesses and will facilitate local and regional growth. b) Policy U-4--The radio signals emitted from the PCS antennas do not contain any known health risk to the public. The facility does not emit harmful rays, noxious odors, heat, excessive noise or pollutants. The facility will operate at extremely low power levels, only a small fraction of the power used by television and radio broadcasters. Sprint Spectrum's proposed facility will provide significant benefits to the public at large. People rely and depend on advanced communications services to meet their communications needs,particularly in emergency situations. c) Policy U-6-- S.A.S Fluid Power, Inc. site selection provides the City with excellent wireless coverage and minimizes the impact on adjacent land uses. The monopole is to be located in a Heavy Industrial zone. The surrounding land uses are industrial. Industrial land uses typically involve the widest allowed environmental impacts, including noise, dust, and the operation of heavy equipment. The proposed use has none of these characteristic industrial impacts. The proposed use is unmanned, and uses no vehicles and will produce minimum noise. In addition, there is an existing monopole on the property directly to the north of the site. The proposed project is consistent with the Comprehensive Plan Land Use Element, in particular Objective 4.0 and its relative Policies found in the Residential Element: a) Policy R-4.2--The proposed communications facility would minimally impact, and would not interfere with surrounding properties or their uses. PCS facilities operate at an extremely low power, and the levels of radio-frequency energy which will be emitted by the proposed facility are very low. It is unlikely that electromagnetic interference will occur to consumer electronic equipment, including radios, / televisions, and telephone transmissions. Radios transmissions are strictly controlled the Federal Communications Commission, preventing occurrences of interference. Further, the proposed facility is of minimal size and constitutes a passive use with regard to traffic,noise, and emissions. The adjacent properties to the proposed facility on all four sides are Industrial. The adjacent office buildings are situated in a manner that provides minimal view of the proposed facility site and only from a relatively small number of other buildings. The project is located in an appropriate land use designation and its communications activity supports the public health and welfare by enhancing communications • networks that provide service to emergency services such as police, fire, and paramedics. The proposed use is a specially classified use recommended, provided, and allowed for by the Federal Communications Commission. The proposed location is suited for the proposed use due to the fact that it lies immediately adjacent to the I- 405 corridor. Sprint Spectrum: Sprint Spectrum is a partnership of Sprint Corporation, Telecommunications Inc. (TCI), Cox Communications and Comcast Corporation. It was formed in 1994 to develop and provide nationwide Personal Communications Services(PCS)over a wireless network. In March, 1995, Sprint Spectrum obtained licenses from the Federal Communications Commission for the Seattle Major Trading Area and 28 other markets throughout the United States to develop this network. The Seattle Major Trading Area includes the western two-thirds of the State of Washington. The Service: PCS is an abbreviation for "Personal Communications Services", the newest innovation in wireless communications technology. PCS offers a unique combination of telecommunications services including small compact wireless phones,pagers, caller ID,notepad size computers with wireless moderns,fax machines and an array of other customized mobile equipment. PCS services differs from existing cellular services in a number of ways. PCS systems are smaller, lighter, transmit at higher frequencies with-less power than cellular. PCS utilizes 100% digital technology that produces a higher quality transfer of voice and data than the older analog/digital hybrid systems currently being used by cellular companies. PCS offers a new service in a competitive marketplace with security, excellent voice quality and low subscriber rates. The Sprint Spectrum network has been specifically designed for people - for the convenience of everyday use anywhere,anytime. The System: Similar to cellular systems,PCS consists of a network of base station sites located throughout the intended service area which transmit and receive radio signals. These base stations each transmit the radio signals in the frequency bands between 1850 and 1970 MHz at a very low power (less than 200 watts total).As a customer moves throughout the system using his or her equipment, the /call is passed from one base station to another. Each base station site will have self-contained cabinets of radio equipment and antenna arrays. The radio cabinet dimensions are approximately 6 feet in height, and 30 inches square. Fluid Power/City of Renton 7/9/96/RENT-006-07 Public Benefits: Wireless communications services are being utilized throughout the country by emergency service providers, public utilities and maintenance companies, and mobile commercial purposes. A growing number of people are discovering the convenience and safety of utilizing wireless phones and pagers. Sprint Spectrum's PCS system combines paging and short messaging with a portable phone. Wireless services are valued in emergency situations. For example, in the recent regional windstorm, with many phone and power lines down, wireless services provided communication links to ensure safety and assistance where needed. In addition, wireless subscribers have reported countless auto accidents and disabled vehicles, emergency conditions, crime or drunk driving. Site Selection: The need for a new base station sites is dictated by capacity and coverage requirements. Once the need for a new PCS site in a particular service area has been established, Sprint Spectrum's engineers identify a target district in which to locate the facility. Within the target district, the selection of a specific PCS site location is determined by local topographic and geographic factors, mitigation of the facility's visual impact, compatibility with existing land use and the ability to negotiate a contract with a willing landlord. The height of the antenna array is determined by local topographical factors such as ground elevation, tree canopy, buildings within the area, and mountains. A radio signal must travel unobstructed to be effective. The customer's handset needs to "see" an antenna. The more directly the antenna"sees"the user,the clearer the signal. Environmental Impact: • Typical communications facilities consist of computerized radio equipment. These facilities are unmanned and inaccessible to the public. PCS facilities operate at a high frequency with very low power. Radio frequency energy has existed since the beginning of time. The sun emits energy that registers on the frequency spectrum, warm bodies emit energy, and energy is used as electricity. In fact,an environment free of radio frequency energy would be dark,cold and silent. The American National Standards Institute (ANSI) has established a standard for safe levels of radio frequency energy. These standards are designed for 24-hour-per-day, lifetime exposure from conception on.Thus,they are designed to apply to all: the unborn,young,old,sick,well. The world's body of scientific literature is considered in the development of the safety standards. Currently, there are over 10,000 such reports. There are over 100 experts working on the committees continuing to evaluate the biological effects of radio frequency energy and electromagnetic fields. Interference: Communications facilities have been designed to meet the fullest FCC standards. The FCC issues operating licenses in separate frequency bands to prevent interference. Sprint Spectrum is authorized to use the PCS Block,an allocation with handsets transmitting in the 1850-1865 MHz range and base stations transmitting in the 1930-1970 MHz range. Below is an example of the types of frequency spectrum users. AM Radio: 540-1600 kHz FM Radio: 88-108 MHz TV Stations: 54-806 MHz Cellular and ESMR: 800-900 MHz Cable TV: 50-500 MHz PCS: .1850-1970 MHz Transmitting and receiving equipment of all kinds is manufactured according to the assigned FCC frequencies. As a result, Sprint Spectrum is not allowed to transmit a signal that could be received by a radio or television set,or other electronic equipment. PCS base stations operate at very low power levels (200 watts or less). In contrast, other broadcast stations, such as AM/FM radio or TV,operate at up to 5 million watts. Most electronic equipment is designed with electronic shielding to prevent undesirable radio signals from being picked up by other electronic circuitry. There should'not be any problem of interference from properly shielded, maintained and operated equipment. The proposed development generates no noise other than the sound from fans and/or • heat exchanging equipment mounted inside the equipment cabinets. This noise is equivalent to the sound of a domestic fan at the nearest property line. Proposed measures to reduce or control noise impacts, if any: No measures are needed to reduce or control noise as there is no adverse noise impact associated with this project. 8. There are no displacement impacts associated with this project. 1) Proposed measures to ensure the proposal is compatible with existing and projected land use and plans, if any. The proposed project is compatible with existing and projected land uses and plans. The site is currently zoned IH--Industrial Heavy. The proposed use is permitted with a Conditional Use Permit, Variance, and Environmental Checklist. The small scale of the project (600 square feet total surface area) allows the project to easily integrate into the existing property, as well as the surrounding commercial and industrial uses. The property is designated as Employment Area- Industrial in the City of Renton Comprehensive Plan. The proposal provides infrastructure that is necessary for commercial enterprises to compete in the business marketplace. The antenna arrays will be painted a neutral color to blend with the surrounding environment. 9. HOUSING a) Approximately how many units, if any, would be eliminated? None. b) Proposed measures to reduce or control housing impacts, if any: None are anticipated to be necessary. 10. AESTHETICS a) What is the tallest height of any proposed structure(s), not including antennas; what is the principal exterior building material(s) proposed. The steel antenna monopole is 72 feet . The antennas, to be mounted on the steel mounting platform, are fiberglass. The exterior materials of the self- contained equipment cabinets are steel. The facility will be surrounded by a chain-link fence. b) What views in the immediate vicinity would be altered or obstructed? No views in the immediate vicinity would be altered or obstructed. c) Proposed measures to reduce or control aesthetic impacts, if any: None are anticipated to be necessary. 11./ LIGHT AND GLARE a) What type of light or glare will the proposal produce?
