Plaintiff and Defendant were present; Defendant appeared through its authorized representative Robin
Robertson, Risk Management. Service of process was proper. Defendant acknowledged Plaintiff's filing
of tort claim pursuant to RCW 4.96. This is a property damage claim. Plaintiff has a pool on her property.
The pool's pumphouse was on Defendant's utility easement. The pumphouse had to be moved to allow
the City to correct a local drainage problem (NE 22nd Street Storm System Project). The City moved the
pumphouse and its equipment. Plaintiff claims that when the pumphouse was moved, the City installed a
damaged replacement heater, and an inferior pumping system. After hearing testimony from Plaintiff, her
husband, John, Ms. Robertson, and Daniel Carey (Surface Water Utility Engineer), and after reviewing
Plaintiff's Exhibits 1-7 and 15-16, and Defendant's Exhibits 8-14, the court concludes that Plaintiff failed to
establish her claims against the City by a preponderance of the evidence.
NOTE: If the judgment is not paid within thirty(30) days from today, the Defendant(s) can notify the
clerk. For a fee, a Judgment Transcript shall be available from the Clerk's Office. Thereafter, reasonable
costs and attorney fees are allowed in enforcing the judgment.
Note to Defendant: Payment should/needs to be made directly to the Petitione `�
