Project Description/Background: GTE proposes to construct a telecommunication Personal Communication System (PCS)facility. A steel monopole would be erected to support a triangular platform with 12 panel antennas (approximately 53 inches by 6 inches) organized in three sectors. The maximum height of the antennas would be 50 feet. Two radio equipment cabinets (measuring approximately 8 feet long by 6 feet high by 2.5 feet wide)would be located on the ground and the facilities enclosed with security fencing, 6 foot high chain link with 3 strands of bar wire. The radio equipment cabinets contain radio transmission and receiving equipment as well as electrical backup batteries. The telecommunication facility would be located on a site that is presently used for storage and parking by The Plumbing Joint. The Plumbing Joint store is located on an adjacent parcel just southeast of the subject site. The monopole and equipment cabinets would be located behind an existing storage building (approximately 15 feet in height), adjacent to the west property boundary and setback approximately 68 feet from NE 4th Street. The applicant selected this location to shield the facility from public view while minimizing its impact on the business operations of the Plumbing Joint. There is an existing 40 foot tall billboard located just north of the proposed facility. The entire lot is presently surrounded with chain link fencing. The proposal would add security fencing only around the PCS facility. The fencing on the east lot line facing the Chevron Oil and Lube facility is slatted to provide screening. There is a landscape frontage along NE 4th Street and a large landscape/rockery exists between the street and the proposed facility. Wireless communications services can be utilized by emergency service providers, public utilities and maintenance companies, as well as many other mobile users. The proposed PCS station facility would be part of an area-wide system, part of an effort to provide customers with uninterrupted service as they move throughout the area. Personal Communication Systems (PCS) differ from cellular telephone antennas in that they operate off a higher frequency band with less power and are intended to serve small compact wireless phones, pagers, caller ID, • wireless modems and fax machines. They operate with 100% digital technology rather than the older analog/digital hybrid systems currently used by cellular companies. The FCC has opened up new licensing for PCS systems, approving 6 companies versus the 2 that were licensed for cellular telephone antennas. There has been an influx of applications for PCS antennas that may be attributed to introduction of a new technology, an increased demand from an expanding customer base, and the opening of the licensing to more carriers. Medium utilities require approval of an Administrative Conditional Use Permit in the Suburban Center(CS) zone. FINDINGS, CONCLUSIONS & DECISION Having reviewed the written record in the matter, the City now makes and enters the following: G. . Findings 1) CONSISTENCY WITH CONDITIONAL USE CRITERIA Section 4-31-36 lists 11 criteria that the Hearing Examiner is asked-to.'consider, along-with all other relevant information, in making a decision on a Conditional Use application. These include the following: A. CONSISTENCY WITH THE COMPREHENSIVE PLAN,ZONING CODE& OTHER ORDINANCES: The proposed use shall be compatible with the general purpose, goals, objectives and standard of the Comprehensive Plan, the Zoning Ordinance and any other plan, program, map or ordinance of the City of Renton. (1) COMPREHENSIVE PLAN, ITS ELEMENTS AND POLICIES The proposed project is consistent with the elements and policies contained within the Comprehensive Plan. Policy U-1: Utility facilities and services.should.be consistent with the_growth and development • • .concepts directed by the Comprehensive Plan. The proposed Personal Communication System (PCS) system will provide wireless communication services to all present and future uses in the City of Renton and the region. Residential, commercial, and industrial users will all benefit from the provision of a quality mobile communication system. Policy U-4: Strive to protect the health and safety of Renton citizens from recognized harmful effects of utility generated environmental hazards. There is some public concern about the potential health impacts of low level radio signals. However, at this point the evidence of potential.risk is inconclusive and the City has not established policies or regulations regarding these facilities. The applicant contends that the radio signals emitted from the PCS antennas do not contain any known health risk to the public, and the facility would operate at extremely low power levels, only a small fraction of the power used by television and radio broadcasters. The FCC is responsible for regulating PCS facilities based on health hazards and has ruled that local jurisdictions may only regulate facilities with criteria adopted by the FCC. The proposed equipment meets adopted State and Federal standards regarding radiation emissions. Policy U-5: Encourage the appropriate siting, construction, operation, and decommission of all utility systems in a manner that reasonably minimizes impacts on adjacent uses. The PCS facility, the monopole and equipment cabinets, is proposed to be located behind the storage building in order to shield the facility from public view. The monopole would have a 50 foot maximum height and there is an existing 40 foot billboard and a landscape rockery located just north of the proposed facility, which effectively screens the proposal. The proposal is adjacent to the west property line and would be approximately 8 feet from the Eastway Shopping Center building. 'Faros" restaurant has windows which presently view into the parking/storage yard and would view the proposed facilities. Telecommunication facilities are considered "medium utilities" which require approval of an Administrative Conditional Use Permit. The proposal includes a lightening rod attached to the monopole, which would extends above the top of the antennas and therefore exceeds the 50 foot height limit of the CS zone. Heights which exceed the maximum height limit of 50 feet by less than 25 feet requires an Administrative Conditional Use permit for consideration of the excess height. B. COMMUNITY NEED: There. shall.be.:a :community need for the proposed'use at: the proposed location. In. the = determination of community.:need, the.Hearing.Examiner:shall•consider-;the'following-factors, among all other relevant information: (1) The proposed location shall not result in either the'detrimental over concentration of a particular use within the City or within the immediate area of the proposed use. The proposed facility would not cause an over concentration of PCS antennas in the area of the site. There are not other communication facilities located in the immediate vicinity of the site. The applicant contends that the location of the proposed PCS facility is necessary to provide coverage for uninterrupted service for customers.. The applicant searched for other locations, including co-location sites; before determining the subject site-wasp most appropriate for the proposed facility. (2) That the proposed location is suited for the proposed use. The applicant contends that this-site is most suited for the.proposed,PCS facility. The need for a new base;station site:is_dictated•by-:capacity and.coverage.:requirements. Once.a target area is identified as needing an additional facility to provide-.continual- coverage, a specific site is selected based upon the local topographic features, mitigation of the facility's visual characteristics, compatibility with existing land use and the ability to negotiate a contract with a landowner. The proposed site is well suited for the proposed use in that the facility would be largely screened by the existing storage shed, landscaping and the billboard. C. EFFECT ON ADJACENT PROPERTIES: The proposed use at the proposed location shall not result in,substantial or undue adverse effects on adjacent property. The following site requirements shall be required: (1) LOT COVERAGE Lot coverage shall conform to the requirements of zone in which the proposed use is to be located. The entire project area including the GTE antenna facility, support pole, foundation and radio equipment cabinets would cover approximately 522 square feet of the site. With consideration of the existing structure on the site, this would still conform to lot coverage requirements. (2) Yards: Yards shall conform to the requirements of the zone in which the proposed use is to be located. Additions to the structure shall not be allowed in any required yard. The proposal complies with the yard requirements of the CS zone. As noted previously, the facility would be located adjacent to the west property line. There are no side yard setback requirements in the CS zone. The facility would be setback approximately 68 feet from the front property boundary. 3) Height: Building and structure heights shall conform to the requirements of the zone in which the proposed use is to be located. Spires, belltowers, public utility antennas or similar structure may exceed the height requirement upon approval of a variance. Building heights should be related to surrounding used in order to allow optimal sunlight and ventilation, and minimal obstruction of views from adjacent structures. According to submitted building elevations, a lightening rod would extend above the height of the antennas. This exceeds the 50 foot height limit of the CS zone and thereby requires consideration of a Conditional Use Permit for excess height. 4-31-10.2.E. Conditional Use Permit For Excess Height: In consideration of a request for conditional use permit for a building in excess of fifty five feet (559, the Hearing Examiner or .Zoning Administrator shall consider the following factors in addition to the criteria in Section 4-31- 36 of this Chapter, among all other relevant information. -- 1.-Location Criteria:. Proximity of arterial streets that have sufficient capacity to accommodate .traffic generated by the development. Developments.are-encouraged to locate in•areas served by transit. The proposed site is located along NE 4th.Street:which is designated as.a principal arterial on the City Street.Classification Map: The proposed development would generate very little traffic, only once a month maintenance visits are anticipated. 2. Comprehensive Plan: The proposed use shall be compatible with the general purpose, goals, objectives and standards of the Comprehensive Plan, the Zoning Ordinance and any other plan, program, map or ordinance of the City. The proposed use has been analyzed in detail throughout this report for its compliance with objectives and standards of the City Comprehensive Plan, 'Zoning-Ordinance, and any other plan, program, map, or ordinance. It has been found that the proposal is compatible and ..- consistent with applicable objectives and standards found.in the above stated documents. 3. Effect on Adjacent Properties: Buildings in excess of fifty-five feet (55') in height at the :.:proposed.location shall:nofresult-in.-substantial-or:.undue:adverse_:effects on adjacent.property. When-a building:in=excess of fifty five.feet•(559'in height is.adjacent.:to a multiple family lot zone MF or MR on the City.Zoning Map and Multi-family.on the City Comprehensive-Plan, then setbacks shall be equivalent to the requirements of the-adjacent residential zone. The monopole and the lightening rod on top of the monopole which exceeds the height limit of the zone, would not result in substantial or undue adverse effects on adjacent properties. The site is not adjacent to a multiple-family lot zone. D. COMPATIBILITY: The proposed use shall be compatible with the residential scale and character of the neighborhood. (Ord 3599, 1-11-82) The area surrounding the site is zoned and developed with commercial uses so there is not an issue of compatibility with residential development. The facility would be located behind an existing storage building and approximately 8 feet from the shopping center adjacent to the west. Windows of the "Paros" restaurant presently look out to the storage yard and would view the proposed facility. The ground equipment facility would be largely screened from all views except the restaurant by the existing storage building and landscape rockery. The antennas would have a maximum height of 50 feet. An existing billboard located just north of the antennas is approximately 40 feet in height. Therefore, the height of the proposal is compatible with existing heights and uses in the immediate vicinity of the site. The monopole would be, approximately 4 feet wide at the base, tapering to about 2 feet at the top. It should be noted that the existing billboard pole is also a 3 to 4 foot diameter pole. The monopole would be constructed of galvanized steel resulting in a gray color which would blend in well with the surroundings. The department has received a letter signed by 9 business owners surrounding the site. The objections in the letter concern the visual distraction and aesthetic impacts of the proposed facility, negative impacts on property values, and potential health hazards of the radio waves. Lot coverage may be increased to as much as seventy-five percent(75%) of the lot coverage requirement of the zone,in which the proposed use is located, if all parking is provided underground or within the structure. (Ord.3903,4-22-85) The applicant will need to access the antennas about once a month in order to service/maintain the facility. There is parking available on the site, presently used by employees of the Plumbers Joint. F. TRAFFIC: - Traffic and circulation patterns of vehicles and pedestrians relating to the proposed use and surrounding area shall be reviewed for potential effects on, and to ensure safe movement in the surrounding area. The PCS.facility would not generate a significant amount.offtraffic. After construction approximately one vehicle a month will need to access this site in order to service the antennas and base station. This volume of traffic will not impact the roads in the area of this'site. G. NOISE, GLARE: Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the location of on-site parking areas, outdoor recreational areas and refuse storage areas. It is not anticipated that the proposed antennas would result in noise, light, or glare impacts. The FAA may require lighting on the antennas if it is determined to be a navigational hazard to aircraft. The -height of the lighting and the intensity would not pose a significant impact. H. LANDSCAPING: Landscaping shall be provided in all areas not occupied by building or paving. The Hearing Examiner may require additional landscaping to.buffer adjacent properties from potentially adverse effects of the proposed use. There is an existing landscape/rockery north of the proposed facility. This area has mature plantings that would effectively screen the proposed ground-related uses from NE 4th Street. No further landscaping would be required on the site for the installation of the PCS antennas. I. ACCESSORY USES: Accessory uses to conditional uses such as day schools, auditoriums used for social and sport activities, health centers, convents, preschool facilities, convalescent homes and others of a similar nature shall be considered to be separate uses and shall be subject to the provisions of the use district in which they are located. CONVERSION: No existing building or structure shall be converted to a conditional use unless such building or structure complies, or is brought into compliance, with the provisions of this Chapter. Not applicable. K. PUBLIC IMPROVEMENTS: The proposed use and location shall be adequately served by and not impose an undue burden on any public improvements, facilities, utilities, and services. Approval of a conditional use permit may be conditional upon the provision and/or guarantee by the applicant of necessary public improvements, facilities, utilities, and/or services. The Conical Surface slopes upwards at a 20:1 slope from the Horizontal Surfaces elevation of 179' above sea level (at the green line) to an elevation of 379' abiove sea level at its outer edge (at the yellow line). The site is positioned approximately 2,700 feet from the Horizontal Surface. The altitude of the Conical Surface at this approximate location is 314' above sea level. The diagrams of the proposed tower show an elevation at the base of 403.3', and at the top of 453.3' above sea level. The elevation of the tower is 89 feet above the altitude of the conical surface. The project sponsor, GTE, must submit FAA Form 7460-1, Notice of Proposed Construction or Alteration, to the address indicated on the attached sheet. This notice is required because the proposed antenna exceeds the allowable height of the Conical Surface and the construction exceeds a 100:1 slope from the airport's runway. In the event that the FAA determines that the tower should be painted and/or lighted, GTE must be responsible for the maintenance of the paint and lighting equipment and the operation and changing of bulbs of any required lighting. The City does not have personnel or suitable equipment for such maintenance. To: Peter Rosen, City of Renton Associate Planner _ - From: Concerned property owners and tenants Re: Project # LUA 96-138, ACU Date: 9/22196 Dear Mr. Rosen, This letter concerns the proposed cellular phone tower to be located at 3929 N E 4th Street. The project description indicates that the tower will be a four foot wide, 50' tall pole'with an array of twelve panel antennas at the top. At the base, there will be a 575 SF project area for transmitter equipment that will be enclosed in security fencing. There are several objections and concerns with this project. The first involves the compatibility of such a structure with the existing character of the area. The City of Renton has numerous ordinances and restrictions along N E 4th designed to keep this area visually appealing for a healthy business community. Any new business locating in this area knows well of the sign, landscape, and building restrictions designed to keep a clean, well groomed and attractive business area along this busy Renton corridor. We believe that a 4' wide, 50' tall metal post with a huge array of antennas would most definitely be a visual distraction and incompatible with the aesthetic goals for this area. The project description notes that trees, an existing shed, and an existing • billboard would help hide the tower. In actuality, there are no trees of significant height close to the proposed site and the tower would dwarf the existing shed. The idea of a 50' tower and a billboard side by side could only be viewed as an eyesore. There must be other sites in the East Renton area that would have the advantage of trees that would help hide such a structure. The second concern involves the impact the tower would have on property and business values. Locating a tower so close to a busy business area would likely have a negative impact on values. Many prospective buyers or business owners would view such a tower as a liability. Property is very expensive in this area and the City of Renton has an obligation to protect present and future property and business values in. this area. Again, locating a cellular tower at this particular site is not a necessity and other sites more compatible and less economically damaging should be sought. Finally there is the concern of safety regarding the chronic exposure of radio frequency and microwave radiation. The proposed tower would be located in a busy business area with uncertain health effects, Much study is currently being done regarding the long term effects of such exposure to these cellular towers. Although the radio frequency and radiation would fall within accepted levels based on current federal • guidelines, this does not ease the concerns regarding such a complicated and confusing health issue. It would simply make sense to locate these towers away from people as much as possible until more research has been completed. Several cities, counties, and utility commissions have cited the concerns noted in this letter as basis for restricting or denying cellular tower construction in certain areas. The City of Renton needs to address the issue of cellular tower sites. These towers are necessary; however, the benefits should not be considered before the rights of current property and business owners. We the undersigned urge the City of Renton to deny the construction of the cellular tower at this particular site and work with and encourage GTE Mobilnet to find a more appropriate placement for their tower. GMCG), requests approval of.a Conditional Use Permit for the construction of a Personal Communication System (PCS)-facility to be located at The Plumbing Joint, at 3929 NE 4th Street, in Renton. The proposed facility is an effort ley GTE to provide complete coverage throughout their wireless communications network. The proposal,calls for the construction of two radio equipment cabinets and a fifty foot antenna support pole with an array of twelve panel antennas. The site is zoned Center Suburban and is part of the commercial neighborhood along 4tli" Street: The site is used for storage, parking and layout for The Plumbing Joint which is located on ari"adjacent parcel. The subject parcel is paved with a mixture of asphalt and compacted gravel. A storage building, a metal shed and an advertising billboard are currently on site. The site is relatively flat, is not near a body of water or wetlands, and contains minimal vegetation. The entire parcel is approximately 16,815 SF. The site is bordered on the east by a lube/oil change facility and a plumbing repair store; across Union Avenue is a gas station and tire store. To the northeast is another gas station. Directly north of the site, across NE Fourth Street is a convenience store, pizza delivery outlet and sandwich shop: A pizza restaurant, video store and other small commercial services are located on the adjacent parcel to the west. The storage area for the Plumbing Shop lies to the south of the site. The specific location of the proposed facility is next to and behind an existing storage building that is approximately 15 feet in height. This location was chosen to shield the facility from public-view while minimizing its impact on the current business operations of the Plumbing Joint. An advertising billboard, approximately 40 feet in height; and power lines, approximately 35 to 50 feet in\height, lie directly in front of the proposed location. Landscaping up to 10 feet inheight also lies directly in front of the proposed location. An inaccessible side wall of a commercial building and a landscaping strip are on the adjacent parcel to the west. The facility will be located approximately 61 feet from the front property line (minimum setback by Code is 15 feet). Each of the two radio equipment cabinets, containing radio transmission and receiving equipment as well as electrical backup batteries, measures approximately 8 feet long by 6 feet high by 2.5 feet wide. The antenna support pole will be a galvanized steel pole, 50 feet in total height, with a triangular platform at the top. The antennas will be organized in three sectors (four antennas per sector); each antenna is approximately 53 inches by 6 inches. Each sector is approxima13 feet wide. REM 1996 • cos. p�N WG ort0Fa r , •vVA0057 GTE PCS Site at"3929 NE 4th Street Page 2 The facility will include a 353 SF concrete foundation to support the equipment cabinets and the antenna support pole. -The facility will be located in an area that is currently compacted gravel and used for storing plumbing,pipe; it,is already an. impervious surface area, so no new impervious surface will be added to the site. Several tall structures exist either on site or in the immediate vicinity, including: an advertising_billboard (approximately 40 feet in height), local utility poles and ' wires (approximately 35 to 50 feet in height), regional power line lattice structures (approximately 90 feet in height) and several evergreen trees ranging in height from 60 to 90 feet. The height of the monopole was specifically chosen to be the lowest height possible while providing signal coverage over the majority of existing structures in the area. A six foot chain link fence will surround the radio equipment cabinets.and the antenna support pole, restricting unauthorized access to the support pole. There generally will be one-maintenance visit per.month. The PCS facility will operate • and be monitored twenty-four hours a day, seven days a week. Approximate square footage of individual uses: storage building 1350 - parking/surface storage 14,715 total building/paved area 16,065 landscaping , 750 total lot area 16,815 SF J JUSTIFICATION FOR THE CONDITIONAL USE PERMIT REQUEST Comprehensive Plan Sections of the Renton Comprehensive Plan have been addressed per the direction of Renton Planning Staff: ' Policy U-100 The proposed facility has been sited on commercial property in the Center Suburban zone so as to not impact residential neighborhoods. Adjacent properties,are also zoned commercial and contain commercial used. The facility will not impact streams or wet lands, cause erosion or otherwise be a determent to the natural environment. c Policy U-101 The specific location was chosen behind and to the side of • existing structures and landscaping to minimize visual impact while also minimizing impact on existing commercial operations. A forty foot tall billboard and landscaping exist between the site and the street frontage. The site is set back more than sixty feet from the street front. The facility is not set back further so as to not detrimentally impact the existing commercial operations. • The height of the facility is limited to fifty feet to provide just enough height to allow coverage of the area while minimizing visual impact. The only existing structures of enough height in the area are power line supports, which cannot accommodate antennas. No other antenna support structures exist in the immediate area. Policy U-102 The addition of this facility will allow GTE to provide wireless telecommunications services in theimmediate area, increasing the competition among wireless providers and creating greater options for Renton consumers. Community Need • JMCG knows of no other communication facilities in the immediate vicinity of the proposed facility. Allowance of the proposed facility will not result in a concentration of a particular use. The proposed location is part of a commercial area, with commercial zoning. The specific siting of the facility is behind existing commercial structures and landscaping so as to shield the facility from public view. Immediately adjacent,to the site is the back side of a commercial 'strip mall' that has few windows and no access points. A landscape buffer runs between the commercial building and the property line. REVIEW CRITERIA Lot Coverage The proposal does not include any new buildings, only equipment and the support pole. Therefore, it will not change the amount of lot coverage from the existing. Yards Zoning requires a fifteen foot front yard setback. The facility will be set back`more than sixty feet from the street. Height Zoning allows a maximum height of fifty feet. Additional height may be approved through a conditional use permit. The maximum height of the proposed facility is fifty feet. Compatibility The facility is proposed for a commercial area so as to not impact residential neighborhoods. Further, the facility is positioned behind • existing structures and landscaping to avoid impacts the commercial area. Parking The proposed facility will not displace parking or require additional parking. It will typically require one maintenance visit per month.
