We met with the city's project manager, Dave Chistianse Christensen, for the lift station upgrade project at
Debra's house. HOA members present included Steve Winn, Debra Rogers, Happy Longfellow, and John
Todderud.
Dave discussed the need driving the upgrade of the sewer lift station.
• The pumps -Lift Station needs to be replaced in the next 2 to 3 years
• Combining the Summerwind and Stonegate pump stations reduces maintenance costs and increases
efficiencies. This requires upgrading Stonegates lift station (ty'hich requires upgrade for fixture capacity
needs anyway) and eliminating the Summerwinds lift station.
• Current pump capacity is 125 gallons per minute (gpm)
• Forecasted need is 32-5-42 gpm to 375 ii with future demand at 600 to 700 gpm to serve approximately
1200 homes
Dave presented his pipe conveyance alternative development and analysis
■ Dave presented 3 options for upgrading the pipe network.
■ Option 1 installed new forced main pipe up 26th st and up the first culdesac to Summerwind
■ Option 2 installed new forced main pipe up 26th and up the 3rd culdesac to Summerwind
■ Option 3 installed new forced main pipe up 148th and then `behind' Stonegate to Summerwind (about
145th PI SE.
■ All options require the upgrading of the pipe from about the center of the I st cul de sac up in to
Summerwind between lots 10 and I 1 within an existing utility easement. The existing 4" forced main will
he replaced with an 8" .rg avi1y line, utilizing a trenchless technology know as "directional drilling" to
minimize impact to the two properties. All options also requires an up •made to additional pipes outside the
limits of Stonegate. within Summerwind and along Sunset Blvd.
■ Dave decided not to go with option ' ^r ''to move forward with option 3 due to the eos-t-impact of tearing
up the public roads within Stonegate including construction-eestsimpacts gists, traffic on
Stonegate roads, and the number of children in Stonegate.
--Dave selected option 3 as his preferred option, although more expensive than options 1 or 2, in order to
minimize impacts on local neigbbprhoods. Opt;ion_3 44 s will require easements across a couple of parcels,

grassy area that the kids play in at the entrance. This option will require wetland/stream buffer
enhancements within Stonegate common tracts. This mitigation w4l-ma likely •kely include removal of
invasive plant species and replanting of appropriate native vegetation within the wetland/stream buffer.
■ Option 2 installs a garage size bldg and lift station on a condensed footprint on the existing easement and
installing some underground vaults in road at the entrance. This option will take out most of the entrance
landscaping that would need to be reconfigured and replaced. This location is very near the bus stop.
■ Option 3 constructs the lift station within anasoanded easement on the Homeowner tract and eliminates tl-

■ Dave prefers option 1 if Stonegate is willing to support it.
The HOA members present discussed the details of the city's proposal and options
■ Tthe schedule for doing the upgrade. Currently in predesign. Design 12/2007 thru 8/2008. eenstfuetie
_Construction 8/2008 thru 8/2009.
■ Will Stonegate allow surveyors and sensitive area delineation? Timing is mid -November
■ The members thanked Dave for his time and appreciated the effort he's put in to these options and it looks
like there is a way to work together to achieve the city and Stonegate Communities goals.
■ We promised to take the information back to the full board and let him know if we support his best option
and what considerations/details we'll need. Dave left.
The members discussed the details of the alternatives
■ We liked that trenching and piping along 26th and up the culdesacs were greatly reduced with the preferred
conveyance layout.
■ The Stonegate Community property (53 homes) would be used to serve 1200 homes for sewer.
■ We preferred the lift station option that accesses from 148th rather than 26th.
■ We liked that the grassy area and the landscaping would not be fully impacted.
■ We talked about the details of the things we would like to insure are a part of the city's proposal
o The above ground building will be sided, roofed, and painted to match the character of the
neighborhood - Yes
o The lift station area will be screened with landscaping from the grassy area - Yes
o The city will be responsible for maintaining their landscaping - Yes
o The city will be responsible for all changes to our landscaping and irrigation system to our
satisfaction — Yes(Reasonable Satisfaction).
o The city will abandon `unused' portions of their old easement. — All facilities except wet well.,
which will be converted to a manhole.
o The city will pay for the easement fair market value — Yes, or provide onsite mitigation equivalent
in value.
o The city will pay our costs of legal counsel to execute said easement — Yes, reasonable costs
associated with the review and approval of an easement agreement. However, any legal cliallenges
brought against the City would not be_ppid for by the City.
o The city will be responsible for their operation and maintenance costs of their facilities - Yes

o Will their driveway be paved or gravel off of 148th? — We will pave the access road with either
asphalt or concrete. or possibly use grass blocks if we need to reduce our impervious footprint, but
not navel..

install, establish and maintain. — Yes, for the first 6-years. at such time vegetation will be
established.
o We will grant a formal right of entry to our common parcels under formal agreement.— City will
prepare document.

Stonegate II Project
Homeowners Association discussion of Revised Easement on Tract H
Conditions of Easement
1. Place new facility in easement area as roughly indicated on plans provided
(Outside existing grass area, within wetland buffer)
2. Obtain temporary easement to northwest of station for wetland buffer mitigation
area.
3. Remove existing lift station, control cabinet, and appurtenances from existing site.
Except, leave existing wet well and convert into manhole with standard access
cover.
4. Add landscaping in area of previous station, but maintain access to new manhole.
5. New control building shall be:
• Constructed of material and style to blend with existing Stonegate homes.
• Be sound proofed to below minimum standards for residential
neighborhood.
• Not be larger than 20 ft by 40 ft in footprint area.
6. Provide landscape screening along westerly and southerly edges of lift station
area, to be maintained by City.
7. Appraise easement area and provide compensation at current market value for the
property we are obtaining an easement upon. �r
provide onsite mitigation as acceptable to Stonegate Homeowners in equivalent
value to the compensation.
Process Steps
1. Obtain conceptual approval from Homeowners Association for Easement areas.
2. Obtain Right of Entry for survey and wetlands delineation on Stonegate Tracts.
3. Perform survey and wetlands delineation work.
4. Layout easement areas (force main and lift station) and identify permit issues.
5. Obtain permits for lift station and force main.
6. Negotiate and obtain easements for force main.
7. Negotiate terms and conditions and obtain easement for lift station.
8. Complete design
9. Bid project
10. Construct project

Thereby amending the legal description of the sanitary sewer utility easement recorded under King
County Recording Number 20090310000737 which by a scrivener's error identified the incorrect
Section in the legal description.

For the purpose of constructing, reconstructing, installing, repairing, replacing, enlarging, operating and
maintaining a sanitary sewer pipeline, together with the right of ingress and egress thereto without prior
institution of any suit or proceedings of law and without incurring any legal obligation or liability therefor.
Following the initial construction of its facilities, Grantee may from time to time construct such additional
facilities as it may require. This easement is granted subject to the following terms and conditions:
The Grantee shall, upon completion of any work within the property covered by the easement, restore the surface of
the easement, and any private improvements disturbed or destroyed during execution of the work, as nearly as
practicable to the condition they were in immediately before commencement of the work or entry by the Grantee.
Grantor shall retain the right to use the surface of the easement as long as such use does not interfere with the easement
rights granted to the Grantee.
Grantor shall not, however, have the right to:
a. Erect or maintain any buildings or structures within the easement; or
b. Plant trees, shrubs or vegetation having deep root patterns which may cause damage to or interfere with the
utilities to be placed within the easement by the Grantee; or
C. Dig, tunnel or perform other forms of constriction activities on the property which would disturb the
compaction or unearth Grantee's facilities on the right-of-way, or endanger the lateral support facilities.
d. Blast within fifteen (15) feet of the right-of-way.
This easement shall run with the land described herein, and shall be binding upon the parties, their heirs,
successors in interest and assigns. Grantors covenant that they are the lawful owners of the above properties and
that they have a good and lawful right to execute this agreement.
This conveyance shall bind the heirs, executors, administrators and assigns forever.

prior institution of any suit or proceedings of law and without incurring any legal obligation or
liability therefor. Following the initial construction of its facilities, Grantee may from time to time
construct such additional facilities as it may require.
This easement shall run with the land described herein, and shall be binding upon the parries, their heirs,
successors in interest and assigns. Grantors covenant that they are the lawful owners of the above properties and
that they have a good and lawful right to execute this agreement.

maintaining a sanitary sewer pipeline, together with the right of ingress and egress thereto without prior
institution of any suit or proceedings of law and without incurring any legal obligation or liability therefor.
Following the initial construction of its facilities, Grantee may from time to time construct such additional
facilities as it may require. This easement is granted subject to the following terms and conditions:
1. The Grantee shall, upon completion of any work within the property covered by the easement, restore the surface of
the easement, and any private improvements disturbed or destroyed during execution of the work, as nearly as
practicable to the condition they were in immediately before commencement of the work or entry by the Grantee.
2. Grantor shall retain the right to use the surface of the easement as long as such use does not interfere with the easement
rights granted to the Grantee.
Grantor shall not, however, have the right to:
a. Erect or maintain any buildings or structures within the easement; or
b. Plant trees, shrubs or vegetation having deep root patterns which may cause damage to or interfere with the
utilities to be placed within the easement by the Grantee; or
C. Dig, tunnel or perform other forms of construction activities on the property which would disturb the
compaction or unearth Grantee's facilities on the right-of-way, or endanger the lateral support facilities.
d. Blast within fifteen (15) feet of the right-of-way.
This easement shall run with the land described herein, and shall be binding upon the parties, their heirs,

The City of Renton, in exchange for two utility easements over a portion of Tract H (Lift
Station Easement and Pipeline Easement), agree to include the following improvements
to the construction project as compensation for the two easements:
1. Install Curb, Gutter, and Sidewalk and adjacent asphalt paving from the existing
curb return on the north side of NE 261h Street, along 148th Ave SE, to the
Northerly edge of our proposed entrance driveway for the new lift station. From
this point, the sidewalk will have an asphalt taper to match the new asphalt
roadway, which will also taper to meet the existing pavement in 1481h Ave SE.
2. Provide a complete 2-inch grind and 2-inch asphalt overlay to all existing public
roadways within the plat of Stonegate. (The City's standard restoration would
have covered a 5-ft from curb grind and 2-inch asphalt overlay for only those
portions of the existing full -width roadway disturbed by the project work).
Roadways Sections include: NE 26th St from Lyons Av NE to 1481h Av SE,
Lyons Av SE from south end of plat to NE 26th Street, NE 24th Ct from cul de sac
to Lyons Av NE, NE 23rd Ct from cul de sac to Lyons Av NE, NE 22"d Ct from
cul de sac to Lyons Av NE and NE 2 1 " Ct from Lyons Av NE to cul de sac.
Existing emergency access road from NE 22"d Ct to NE 20th Street will also be
fully restored as part of the construction work.
3. The City will require the Contractor to restore all trench work with hot -mix
asphalt in accordance with City Standards as they progress and will not be
allowed to exceed one thousand linear feet of temporary trench patch at any one
time.
4. The City will install landscaping that blends with the existing landscaping on
Tract H around its new lift station to act as a buffer from the Stonegate
neighborhood. The landscaping will have a full time automated irrigation system
to help ensure survival of the landscaping.
5. The lift station emergency power generator will not exceed 45 dba at the property
line between Tract H and Lot 1 of Stonegate.
6. Replace both Fire Acces4 Gates in Tract G with current Fire Department standard,

neighborhood while you are completing this project. We are still very interested in those items and ask
that you keep us involved and informed on the following:

SUBJECT: EASEMENT ACQUISITION ON TRACT H
STONEGATE LIFT STATION REPLACEMENT
Dear Stonegate HOA:
The City of Renton is interested in obtaining two easements from the Stonegate HOA within
Tract H that allows us to reconstruct a new sewage lift station. Attached please find the easement
documents along with the City's agreed upon conditions for the easements. If this is acceptable
to the HOA, please execute and return the easement documents for recording by the City.
Per our recent meeting on this subject, we are aware that the HOA is working on potential
amendments and/or slight alterations to these documents. Since the City needs to move forward
with our project, we can only allow 30 days from the date of this letter to finalize any such
changes. If we cannot come to an agreement by that time, the City will be required to proceed
with a revised design for the new station that is constructed within the existing right-of-way and
easements currently owned by the City. While certainly not our preferred option, we are at a
point where we need to move forward to assure that we have a facility in place to handle the
anticipated flows coming to this facility.
We have greatly appreciated the efforts of the Stonegate HOA as we have worked through issues
the neighborhood will have as we move forward with this project. It is my sincere hope that we
are able to come to a satisfactory agreement related to those issues in time to allow for the City to
continue to proceed with our preferred option within the new easement area. As such, please
provide me with any potential amendments as soon as possible so that we can finalize this

STONEGATE II LIFT STATION PROJECT
Dear Mr. and Mrs. Daly:
The City of Renton Wastewater Utility is in the process of designing a new lift station that will be
constructed near our existing station located in the northeast portion of the plat of Stonegate. As
part of this work, the Wastewater Utility is also looking to eliminate the existing Summerwind
Lift Station located due west of your property in the drainage pond tract for the Plat of
Summerwind. The route to construct the new gravity line to eliminate the lift station would run
through the existing easement that the City has through the northerly 15-feet of your property.
In order to perform the design work, we will need to access our existing 15-foot easement for the
purpose of performing surface survey work. The City will have its consultant surveyor, Roth Hill
Engineering, take elevations and check property boundaries within the easement area. No
disruption to your existing landscaping should occur as part of this work.
The City is anticipating the use of a construction technique known as directional drilling to install
the new 8-inch gravity line. This methodology would eliminate the need for us to perform any
excavation on the City's existing easement on your property. The City would construct a "pit" in
the cul-de-sac and in the pond tract to allow for the drilling to occur between the two points, thus
eliminating the need to disturb your yard area.

permanent removal of any private improvements from within or upon the surface of the easement area shall be subject to
specific written mutual agreement.
2. Grantor shall retain the right to use the surface of the easement as long as such use does not interfere with the easement
rights granted to the Grantee.
Grantor shall not, however, have the right to:
a. Erect or maintain any permanent building or structures within the easement, except that in -ground irrigation devices
and in -ground cable runs pertaining to architectural lighting and security/surveillance systems shall not be restricted;
or
b. Plant trees orshrubs having known mature root patterns no deeper than eight feet or which have been known to
cause damage to or interfere with the utilities to be placed within the easement by the Grantee. The Grantor shall
have no responsibility to prevent, maintain or remove naturally occurring or naturally sown vegetation of any type
that might damage or interfere with the easement; or
c. Dig, tunnel or perform other forms of construction activities on the property which would disturb the compaction or
unearth Grantee's facilities on the right-of-way, or endanger the lateral support facilities without notifying the
Grantee of the proposed activity at least seven days in advance if routine, or as soon as practicable, if the activity is
urgent or related to an emergency; or
d. Blast within fifteen (15) feet of any easement boundary, except that this limitation shall not apply to firearms,
fireworks (novelty, 1.3G and 1 AG devices), air or powder actuated tools, or pest control devices.
3. Grantee is notified that certain dedications, grants, easements and designations have been recorded against the subject

c. Noxious Noise Control: The Grantee agrees that noise generated by the activities, when measured adjacent to any
easement boundary; or, b t related activity when measured from any sidewalk within the Stonegate
plat; shall, at no ,exceed 110 dBA; s 11 not exceed 90 dBA for more than 5 minutes without an intervening
interval of at le 5 minutes below 85 dBA; nd for continuing operations, shall not exceed 45 dBA at any time
during nonrol operations.
i. a Grantee shall prove, by a test me od acceptable to the Grantor, that the conditions of this section
pertaining to continued normal operati ns are met prior to the final completion of construction, installation
or significant repair, upgrade or conve ion of the utilities.
ii. Unless the activity constitutes an emer ncy repair, if the Grantee violates the restrictions of this section
and the Grantor complains to the Grant
,its agents, employees or representatives, while the offending
activity is ongoing; or upon the demand
f any public safety official at any/time; in addition to the other
remedies available to the Grantor througA
this easement, the Grantee shal immediately cease all activities
until such time as an effective mitigation
agreed between the Grantee d Grantor and any public safety
agency that may choose to concern itself.
iii. Measurement of noise and duration may be de by anyone operatin any measurement equipment
calibrated and operated in accordance with manufacturer's ins tions found, by any Washington State
registered Professional Engineer, to be reliable or the purposes o his section. Offending sound levels
measurements and durations shall be logged and ' ed b easurement equipment operator and shall
include date/time, duration, indicated level, vicinity of measurement and a description of the most likely or
predominate source.

Traffic and Access Control: Grantor and Grantee agree that, except during normal continuing operations, the traffic

ii. Sidewalk Obstruction — No otherwise passable sidewalk shall be obstructed by the placement of equipment

ediately removed on complaint to the Grantee, its agents, employees or representatives.
iii. in assable Sidewalks: Sidewalks damaged or destroyed during the activities shall be limited to a single
side of the road at any one time A dedicated crossing guard shall be apportioned from the Grantee's on -
site personnel to assist the safe crossg.of the road or through -the active construction area(s) anytime
unaccompanied young children are transiting.
f. Scheduled activities: - Excluding normal operations and emergency repair, Grantee shall provide the Grantor with
an estimated timeline of d a easement an ment related major activities [e.g.. trenching, grinding,
paving, landscapin stallation, check-out, commissio ' ] at least 30 calendar days in advance of -the
commenceme f any work. The Grantor shall provide an -to-date progress report every two weeks during the
activities i ntifying work.completed since pre repo work contemplated for the next two weeks and
estimated completion dates)br�maining unfinished maI a Grantee shall make themselves
availabl�to the Grantor at a mutually agreed location on a monthl asis during easement and e ment related
activities to provide an opportunity to review, ask questions and co ent on the schedul ctivities or other issues
arising from or related to the activities.
Amenities: In consideration of the granting of this easement, the Grantee shall accomplish the following to the benefit of
the Grantor:

Lance,
Attached is a PDF of the draft Stone Gate Landscape plan.
Some background:
On my trip out to the Highlands, I noticed that most
residential landscapes were fairly informal, i.e. plants were loosely
arranged, as opposed to being symmetrical -sort of an English garden
style. And the plantings were eclectic - lots of variety in species,
color, texture, etc. In the planting plan, the planting facing 148th
reflects those patterns.
I chose plant species that should be fairly easy to find, both
for the contractor, and also for maintenance workers who'll be replacing
plants that die for one reason or another.
In the pump station interior, the planting are much more
straightforward than the one facing 148th (easier to install &
maintain.) I think that people driving or walking by will focus on the 6
flowering dwarf crabapple trees in the foreground, and the viburnums and
ferns will be an effective backdrop.
The conifer screen is emerald arborvitae. East to get, and
won't outgrow the space set aside for it in the site layout.
Not much space left over in front of the conifers facing the
lawn, but I've tried adding daylilies (surprisingly tough, drought
tolerant, easy to find, and relatively inexpensive) to make the planting
look a little less institutional. These could be left out if cost
becomes a factor.
With both the rhododendrons and the flowering crabapple, I
given the contractor a list of species to select from (in the notes) to
ensure that size (especially) and colors of these plants aren't changed
during contractor substitutions.
I've added a 2 ft-wide gravel strip around the back side of
the control building, to allow for access without trampling the
plantings. This could be left out.

Tract A and Tract H of the Plat of Stonegate, portion of Gov't Lot 1 and the SE '/4 of the NE '/a of
Section 3, Township 23N, Range 5E, WM, City of Renton, County of King, State of Washington.
That said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary,
to enter upon said property for the purpose of collecting survey, geotechnical, wetlands and related data without incurring
any legal obligation or liability therefore; provided that such work shall be accomplished using ordinary care to avoid
unnecessary disturbance or damage to the property. In the event that there is disturbance or damage, the property will be
restored to the same condition as it was before the property was entered upon by the Grantee
The term of this agreement shall be 12-months from the date of execution of the agreement.

SUBJECT: REQUEST FOR PERMISSION TO SURVEY — SECOND NOTICE
STONEGATE II LIFT STATION PROJECT
Dear Ms. Scherer:
On February 6, 2008, we sent a letter asking permission to enter the northerly 30-feet of your property in
order to perform survey activities. Unfortunately, we have not heard from you so we are sending this
reminder.
The City would like permission to allow surveyors to enter the property to get topographical survey
information. In addition, we would like to have Geotechnical and Environmental firms to walk your
property. All this work can be performed without disturbing your property.
We have attached another copy of the right -of -entry agreement, if you agree to give the City permission
to perform this work. As stated in the previous letter, granting permission for the survey work in no way
commits you to granting an easement in the future. At this time, we need to perform the survey to
determine the ability to potentially use this alignment for a new force main.
If your concern is related to disturbance of your property during a potential installation of the force main,
we will evaluate options, which allows us to install our facility without actually excavating on your
property with such techniques as directional drilling. Once we have the area surveyed and determine this
alignment to be a viable route, we will meet with each property owner to discuss the potential of
obtaining easement for the work.
If you still do not wish to provide permission to the City for the survey work, please send back this letter
with your signature indicating that decision. We have provided a self-addressed envelope for you to
return either this letter or a signed copy of the right -of -entry agreement.

The City of Renton is in the initial design phase for a new lift station to be constructed north of
your existing property. As part of this new lift station, the City has determined that its preferred
route for the new pipeline, called a force main, would potentially cross your property located at
10415 148th Ave SE, along its northerly boundary. Prior to determining the full feasibility of this
route, the City would like your permission to enter upon the northerly 30-feet to perform survey
work, geotechnical investigation, and environmental analysis.
We can perform all of our needed tasks without directly impacting the property. We only need
access to allow the consultants hired by the City to take elevations on the property, and determine
property lines within the 30-foot corridor. Other consultants will simply access the property for
observation purposes only.
Attached is a flyer that includes a general description of the project and a picture of the route. In
addition, a map showing the properties that we need permission from in order to perform the
survey and related work is attached. Finally, a right -of -entry document that would give the City
the permission to enter your property for the work described above is attached. Please sign and
return the right -of -entry document to the City in the provided stamped, self-addressed envelope.
At this time, the City is only asking permission to perform the survey and related work. Signing
the right -of -entry document in no way compels you to grant the City an easement. If upon

Sewer Improvements in Your Neighborhood
The City. of Renton is pleased to announce the alternatives analysis for the
upcoming sewer line improvements to the Summerwind/Stonegate
neighborhoods is complete, The report, completed in November, analyzed
four alternatives and recommended a prefered route. The next phase of
the project will include surveying wetland delination, design and
Permitting.

SITUATE IN THE CITY OF RENTON, COUNTY OF KING, STATE OF WASHINGTON.
Except as may be otherwise set forth herein Grantee's rights shall be exercised upon that portion of the Property
("Easement Area" herein) described as follows:
An Easement Area ten (10) feet in width having five (5) feet of such width on each side of a centerline described as
follows:
THE CENTERLINE OF GRANTEE'S FACILITIES AS NOW CONSTRUCTED,
TO BE CONSTRUCTED, EXTENDED OR RELOCATED LYING WITHIN THE
ABOVE DESCRIBED PARCEL.
1. Purpose. Grantee shall have the right to use the Easement Area to construct, operate, maintain, repair,
replace, improve, remove, and enlarge one or more utility systems for purposes of transmission, distribution and sale
of electricity. Such systems may include, but are not limited to:
Underground facilities. Conduits, lines, cables, vaults, switches and transformers for electricity;
fiber optic cable and other lines, cables and facilities for communications; semi -buried or ground -
mounted facilities and pads, manholes, meters, fixtures, attachments and any and all other facilities
or appurtenances necessary or convenient to any or all of the foregoing.
Following the initial construction of all or a portion of its systems, Grantee may, from time to time, construct
such additional facilities as it may require for such systems. Grantee shall have the right of access to the Easement
Area over and across the Property to enable Grantee to exercise its rights hereunder. Grantee shall compensate
Grantor for any damage to the Property caused by the exercise of such right of access by Grantee.
2. Easement Area Clearing and Maintenance. Grantee shall have the right to cut, remove and dispose of
any and all brush, trees or other vegetation in the Easement Area. Grantee shall also have the right to control, on a
continuing basis and by any prudent and reasonable means, the establishment and growth of brush, trees or other
vegetation in the Easement Area.
3. Grantor's Use of Easement Area. Grantor reserves the right to use the Easement Area for any purpose
not inconsistent with the rights herein granted, provided, however, Grantor shall not construct or maintain any
buildings, structures or other objects on the Easement Area and Grantor shall do no blasting within 300 feet of
Grantee's facilities without Grantee's prior written consent.
4. Indemnity. Grantee agrees to indemnify Grantor from and against liability incurred by Grantor as a result
of Grantee's negligence in the exercise of the rights herein granted to Grantee, but nothing herein shall require
Grantee to indemnify Grantor for that portion of any such liability attributable to the negligence of Grantor or the
negligence of others.

5. Abandonment. The rights herein granted shall continue until such time as Grantee ceases to use the
Easement Area for a period of five (5) successive years, in which event, this easement shall terminate and all rights
hereunder, and any improvements remaining in the Easement Area, shall revert to or otherwise become the property
of Grantor; provided, however, that no abandonment shall be deemed to have occurred by reason of Grantee's
failure to initially install its systems on the Easement Area within any period of time from the date hereof.
6. Successors and Assigns. Grantee shall have the right to assign, apportion or otherwise transfer any or
all of its rights, benefits, privileges and interests arising in and under this easement. Without limiting the generality of
the foregoing, the rights and obligations of the parties shall inure to the benefit of and be binding upon their
respective successors and assigns.
