You should be receiving a letter from the City Clerk with the official bid award. For execution of the contract, please submit the following information as soon as possible so we can prepare the contract documents for review and signature by the Mayor: 1. A list of names, addresses, phone numbers, and emergency phone numbers for: Responsible Officer, Job Foreman, and Bonding Agent. 2. Corporation letter or Resolution giving names of those authorized to sign the contract and samples of their signatures. 3. Photocopy of your current State Contractor's License (not master license). 4. Photocopy of your current City of Renton Business License. (To activate your City Business license, please contact Linda Weldon at 425-430-6851). 5. Two signed contract bonds on City of Renton forms (enclosed), UNDATED. The date will be filled in when signed by the Mayor. 6. One City of Renton Fair Practices Affidavit of Compliance (enclosed). 7. Two signed contracts, also UNDATED (enclosed). 8. One Insurance Information form and one Endorsement form (enclosed). 9. One Certificate of Insurance for 2010. Please add the City of Renton as additional insured. The insurance policy declaration pages of all required insurance policies obtained from the insurance carrier. After the contract information is submitted, we will need the following information to review and approve before construction can start. We would like to have most of it before we schedule a pre -construction conference. If you intend to use private property for material storage or staging you will need the approval of our Development Services Department. In some instances this may include the need for a Temporary Use Permit. This does not apply to storage and staging areas within City Rights -of -Way. Provide material submittals as required for the work involved with this job. This will include, but not be limited to, information on the proposed source and specifications of all materials that will be used in the project (e.g.; pipe, manholes, crushed surfacing rock, bank run gravel, gravel borrow, asphalt, etc.), showing that the proposed material meets the project specifications, per Standard Specifications and Special Provisions Section 1-06.1. Provide any shop drawings and submittals needed for the project per Standard Specifications and Special Provisions Section 1-06. 2. Work Plan. Include the following items: Proposed construction sequencing and schedule for the project. 2. Mobilization Plan. 3. Temporary Erosion and Sediment Control Plan. 4. Traffic Control Plan. Street Cleaning and Sweeping Plan. 6. Trench Excavation Safety Systems Plan. 7. Disposal Site. 3. Construction Surveying. Identify the surveying firm/surveyor and a letter showing that the surveyor is licensed in the State of Washington. 4. Traffic Control Plan. The form is included with this letter. Zimmerman; Bonnie Walton Subject: Stonegate Lift Station Conveyance Improvements Bid Protest Mark, I received a phone call at approximately 11:40 AM today by the second low bidder (Titan Earthwork) on the City's Stonegate Lift Station Conveyance Improvements project. He has informed me that he will be mailing a letter protesting the awarding of the bid to the low bidder Shoreline Construction Co. (bids were opened on Tuesday, April 13, 2010). He is basing his protest on the fact that they only bid $0.10 per ton on items 17 and 18 (see attached bid tab sheet) and therefore have off-loaded cost onto other bid items that they think may run over the estimated quantities. I have checked the low bidder's unit prices on all of the other items and they appear to be comparable to the prices that the other contractors used (including Titan Earthwork) for their bids. Given the comparisons, I believe that there is no merit to his protest. I'd like to know your opinion on this so that the bid award is not delayed by the protest. We are requesting that an agenda bill for "Council Concur" be prepared for the April 19, 2010, Council Meeting. The bid opening was on Tuesday, April 13, 2010. There were 10 bids received. There was one irregularity in the third low bid from Titan Earthwork that moved them to the second low bid. The low bidder is Shoreline Construction Co. with a bid of $875,888.86 for Schedule A (Schedule A was the basis of award as specified in the contract documents). The engineer's estimate was $1,436,996.00 for Schedule A. The project budget amount is $1,450,000. The low bid is within the amount budgeted. The project will install approximately 710 linear feet of new 15"and 12" diameter gravity sanitary sewer main and 4,720 linear feet of 8" diameter sanitary sewer force main. After reviewing the bid tabulations (attached exhibit A) it is vividly apparent that Shorelines bid is excessively unbalanced and should be considered irregular and non -responsive per WASHDOT Standard Specifications (Attached Exhibit B) 1-02.13. Making Titan Earthworks the lowest responsive responsible bidder for the project. www.TITANEarthworks.com Core Principles: Integrity/ Safety/ Quality/ Production Unbalanced bids as Defined. Contain lump sum or unit bid items that DO NOT reasonably reflect the ACTUAL COST To construct the items. Unbalancing of bid items has an expected potential detrimental effect upon the competitive process and has proven to cause contract administration/construction conflict after the award. Acceptance of unbalanced bids productively results in the real potential for disputes and claims with extra costly resolution for the OWNERS. Again, for this reason, WASHDOT has a Specific Standard. 1-02 BID PROCEDURES AND CONDITIONS 1-02.13 Irregular Proposals 2. A proposal may be considered irregular and may be rejected if; b. Any of the unit prices are excessively unbalanced(either above or below the amount of a reasonable bid) to the potential detriment of the Contracting Agency. In conclusion, the fact is that Shoreline Construction submitted a bid that is Irregular and Unbalanced per the Standard Specifications. The City of Renton has sufficient reason to question Items #17 and #18 Schedule A of Shoreline's bid and conclude that they should be disqualified due to an UNBALANCED BID proposal.
