CITY OF RENTON PLANNING/BUILDING/PUBLIC WORKS MEMORANDUM DATE: January 9, 1997 TO: Gregg Zinunerma FROM: Jim Hanson SUBJECT: Request for Reconsideration of Decision Conditions 1 and 3 B &T Warehouse LUA-96-145, SHPL BACKGROUND: Decision 1 The building code has very specific requirements in terms of allowable area for buildings relative to lot size and proximity to property lines. Specifically, exterior walls adjacent to property lines must be fire walls and openings are not permitted in such walls. If the owners of two adjacent buildings have an agreement, such as a covenant running with the land,the buildings could be viewed as one larger building and openings maintained between the two. However,the covenant must also ensure that in the event the agreement is terminated the building separation must be restored such that both buildings meet the code with the property line running between. Decision 3 The applicant has submitted a Joint Use Agreement whereby the current owners agree to maintain unrestricted ingress/egress, and vehicular maneuvering space, share the parking and agree to no physical barriers between the properties. This agreement was notarized, but not recorded. Because the site is already developed and hooked up to utilities, there needs to be an agreement to jointly maintain these utilities as well as landscaping, drainage facilities and any other improvements on the site. The agreement(or whatever vehicle is chosen) should include future property owners and,to be enforceable as well as visible in the title, should be recorded. The site plan condition can be amended to eliminate the requirement to create a business owners' association as long as the current and future owners are held responsible. STAFF RECOMMENDATION: Decision 1 Development Services staff recommends the applicant be required to submit plans to show how the buildings will meet the building code as separate buildings. In addition, any proposed covenants which would allow openings between buildings per owners agreement should also be submitted for review and approval and recorded prior to recording of the short plat. Decision 3 Development Services staff recommends the applicant be required to record a covenant which states that the owners, both current and future, be responsible for the maintenance of all common facilities and structures. Project Description/Background The applicant seeks approval to subdivide a 2.2 acre site into two lots. Lot A would include an area of 58,731.106 sf and Lot B would include an area of 37,791.623 sf. This lot was previously developed for an office/warehouse building that was divide into two sections by a fire wall. The building has been occupied by two separate tenants. The applicant now requests an approval of a short plat to subdivide the property in a manner that will locate one property line through the building. The property line will correspond to the existing fire wall in the building. The existing fire wall is now considered to be a "use separation fire wall", if the property line divides the building into two separate lots the wall becomes an "area separation fire wall". The' difference in the requirements is that a area separation fire wall can not have the openings in the wall that can be allowed in a use separation wall. City staff is concerned that there might be openings in the fire wall that may not be acceptable if the fire wall is also a property line.and.is.then.considered to be-an.area separation wall. The applicant will need to submit plans:for the'building.to:the Development.Services Division so that"the mall.can.be..evaluated for compliance with the Building Code. 2. Environmental Review Pursuant to the City of Renton Environmental Review Ordinance and SEPA, the short plat is exempt from environmental review. 3. Compliance with ERC Conditions Not applicable. 4. Staff Review Comments Representatives from various city departments have reviewed the application materials to identify and address issues raised by the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. Consistency Short Plat Criteria Approval of a plat is based upon several factors. The following short plat criteria have been established to assist decision makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation The Comprehensive Plan Land Use Element map designates this area as Employment Area - Valley. The Lind Ave. SW area has been developed for a variety of commercial/industrial uses in the vicinity of the subject property. As noted above;this site was previously developed as an office/warehouse land use and the building and land use will be retained after the short plat is effective. The short plat will not change the use of the property, it will • allow the two tenants of the building to purchase the portion of.the site that they use and allow for the continued use of the joint parking area. Policy LU-212.21: Vehicular connections .'between adjacent parking areas are encouraged. Incentives' should 'be offered to encourage shared parking. The applicant has submitted an . agreement between the two existing-tenants of the building to continue the joint use of the parking lot . after the short plat.is effective. The applicant will need to record covenants on each of the properties to ensure that future owners continue the use of the, parking 'area as a joint use facilities. The covenant will also'help to ensure that a dispute between land owners'does not end up with a fence -along the common property line that would block driveways or prevent one'owner from accessing the parking spaces on the other lot. The applicant will need to create a business owners association for the maintenance of all common features including, but not limited to, the parking area and landscape areas. b) Compliance with the Underlying Zoning Designation The.project'site is zoned Medium Industrial (IM). The present land use is compatible with this zone. The proposed short plat is consistent with the zoning standards for development. The minimum lot size.in.the:IM zone is 35,000 sf. Lot A-is proposed to include.58,731,sf of area and Lot-B would.include-377,791.sf.of area. Therefore,:.both lots exceed the'minimum requirement. There is no requirement for a side yard setback in the IM:zone. Therefore, the property line may be extended through the building as long as the structure.complies with.Building Code requirements. c) Compliance with Subdivision Regulations Streets:The project is accessed from Lind Ave. SW.All streets exist at this time and no further improvements are necessary. Blocks: No new blocks will be created as part of the proposed short plat. The existing block is consistent with City requirements. Lots: The proposed lots are consistent with the requirements for this area. As noted above, both of the lots exceed the minimum requirements for lot area. d) Reasonableness of Proposed Boundaries Access: The subject property gains access from Lind Ave. SW. Lind Ave. intersects with SW 7th Street and Grady Way. Lind Ave. also is a major connection with the valley industrial/commercial area of Renton. Topography: The project site is fairly level. The parking areas have been designed to drain into existing catch basins. Relationship to Existing Uses: The area surrounding the subject property has been developed for a variety of commercial office and industrial buildings. The existing building is typical for this area. Recreation: Community Services staff note that the proposed short plat will not affect their provision of services to the City. Schools: The proposed short plat will not impact area schools. Storm,Water: Storm water facilities already exist-on-site and in SW 7th Street. The proposed short plat will not generate the need for additional storm water features. Water and Sanitary Sewer Utilities: Water and sanitary sewer main facilities are available to the subject property. The existing building is already connected into these systems. The applicant will need to develop a business owners association for the maintenance of all common facilities. It appears from the plans submitted that the existing utility lines cross over the proposed property line. The applicant will need to establish easements for the utility lines and a maintenance program. The maintenance of the common utility lines should be included in the business owner's association covering the maintenance of common facilities. H. DECISION: • .The Short Plat, File No. LUA-96-145,,SHPL, is approved subject to the following conditions: 1. The applicant shall submit plans of the building demonstrating that the existing building complies with the Building Code requirements for area separation.. These plans shall be submitted to the satisfaction of the Development Services Division prior to the recording of the short plat. Any improvements required to bring the existing fire wall separating the structures into compliance with the Building Code shall be completed prior to the recording of the short plat. 2. The applicant shall record a covenant on each of the lots declaring that the parking area is a joint use facility agd • that no fence or other structure may be erected on the property line that would prevent the free movement of vehicles across the property line within the parking lot. Are there any requirements that need to be met to adhere to current City of Renton codes (fire, etc.)for the two buildings? What sort of wall(s) or.partition(s)exists between the two buildings? Note the lot line adjustment and parcel number of the property to the East of the subject property. Also note that the properties to the North and South are unplatted. The following issues are addressed as required by the City of Renton Short Plat/Short Subdivision Procedures containing four lots or less. • Zoning designation of the property to be subdivided and of adjacent land. The City of Renton Zoning of this parcel number 192305-9064-01, located at 846 Lind Ave. Southwest, Renton, WA 98055 is IM (Industrial). Zoning of surrounding property is also IM. • Special site features(Wetlands, water bodies, steep slopes). This parcel has no existing special site features. The site is developed with two buildings and paved parking and storage areas. • Current use and acreage of site and type of any existing on site improvements. Differentiate between structures to remain and those to be removed. Current use of the site is wholesale distribution using two buildings with paved parking and outside storage areas. Acreage of the total site is 2.17 acres. There are existing water and sanitary sewer mains in Lind.Ave SW which should provide adequate service for the two lots. No water or sewer main extensions will be required for this proposal. Final water main improvement determination will be based on fire flow requirements for the site, and may require a loop around the building if fire flow requirements exceed 2500 gpm. 2. You are required to have a fire hydrant within 150' and 300' of each proposed structure. A fire hydrant withing 300' is required for each 1000 gpm of required fire flow. This may require the installation of an additional fire hydrant(s) on Lind Ave SW . A civil drawing prepared per City of Renton standards would be required for this installation. 3. Street improvements do not appear to be required along Lind Ave SW adjacent to the short plat. New street lighting improvements may be required to comply with City of Renton lighting standards. For more information on these standards, please refer to the handout for lighting requirements available at the 4th floor permit counter. 4. A Drainage Control Plan will be required for the new building construction, including a Level 1 analysis. Detention will be required, and biofiltration may also be required if the new pavement area exceeds 5000 square feet: A conceptual drainage report will be I required for the short plat approval (see attached list for content requirements of conceptual • plan.) 5. There will be a variety a fees required for this short plat. These fees will include, but.not be limited to the following fees: Water SUCC charges of $0.126 per square foot of the lot, Sewer SUCC charges of $0.063 per square foot of the lot, and Drainage SUCC charges of$0.146 of new impervious surface. Construction permit fees will be 5% of the construction costs for the water, street and drainage improvements, plus $100 for side sewer fee and $100 for drainage connection fees. In addition, there typically are land use application fees, fire mitigation fees, and park mitigation fees. These are preliminary comments only, based on limited review of the material submitted.
