A mix of offices, light industrial warehousing and manufacturing should be encouraged as the secondary uses in the Employment Area-Industrial classification with conditions as appropriate. Project Description/Background The applicant is proposing to divide an existing 21.9,369.9 square foot (5.05 acres) parcel into 2 parcels. Lot 1, the west parcel, would consist of 135,718.8 square feet; and Lot 2, the east parcel, would consist of 83,651.1 square feet. There is an existing two story office/research and development building located on Lot 2. The building footprint is 15,000 square feet with a total net floor area of 26,000 square feet. The remainder of the site is presently paved for surface parking. The perimeter of the site is landscaped along the street frontages and the parking lot includes interior landscaping. The applicant does not propose to make improvements to either parcel with this short plat application. The site is accessed via 2 curb cuts off SW 39th Street. There would be a 25 foot wide shared access easement at the boundary of the 2 parcels. The site is presently served by sanitary sewer, gas, electrical, telephone, water, and storm sewer lines located in Lind Avenue SW and SW 39th Street. There would be a covenant for Lot 1 requiring the Owner to accommodate surface water drainage and retention requirements for Lot 2, as currently occurs on this parcel. There would be a utility easement across Lot 2 to provide access for Lot 1 to the sewer main in Lind Avenue SW. There are no plans to construct a sanitary sewer line at this time; the easement is granted for potential future use. • Lot 2 has an existing 26,000 square foot office/research building and contains 105 parking stalls. The Parking and Loading Code requires a minimum of 3 and a maximum of 4.5 parking spaces per each 1,000 square feet of gross floor area. Lot 2 satisfies the parking code requirement for the existing building, providing a ratio of 4.0 parking spaces per 1,000 square feet. The site is currently zoned Light Industrial (IL). Consistency Short Plat Criteria Approval of.a plat is based upon several factors. The following short plat criteria have been established to assist decision makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation The proposal is consistent with the Comprehensive Plan Land Use Element designation of Employment Area- Industrial (EAI). Comprehensive Plan policies do not specifically address subdivisions of property. However, the policies generally call for efficient use of infrastructure, consolidating site design, and intensification of development. b) Compliance with the Underlying Zoning Designation The subject property is zoned Light Industrial (IL). The proposed short plat application complies with all the applicable development standards of the IL zone. The proposed lot sizes, Lot 1 - 135,718.8 and Lot 2 - 83,651.1 square feet, meet the minimum lot size of 35,000 square feet required in the IL zone. The lot coverage of the existing building on Lot 2 would be approximately 18%, well within the maximum 65% allowed in the IL zone. As discussed previously, there would be sufficient parking included on Lot 2 to meet the requirements for the existing building. Lot 2 would contain 105 parking spaces for the 26,000 square foot building, for a parking ratio of 4 spaces per 1,000 square feet of floor area. The code requires a minimum of 3 and a maximum of 4.5 parking spaces per 1,000 square feet of gross floor area. c) Compliance with Subdivision Regulations Lot Arrangement: Side lot lines are to be at right angles to street lines, and each lot must have access to a public street or road. Access may be by private access easement street per the requirements of the Street Improvement Ordinance(Code Section 4-34). The proposal complies with this criteria. The side lot lines would be oriented at right angles to the street line of SW 39th Street. Access to the lots is available off SW 39th Street, a public street. Lots: The size, shape and orientation of lots shall meet the minimum area and width requirements of the applicable zoning classification and shall be appropriate for the type of development and use contemplated. The proposal would result in lot sizes of 135,718.8 square feet (Lot 1,) and 83,651.1 square feet (Lot 2), meeting the minimum lot size requirement of 35,000 square feet in the IL zone. The IL zone does not specify minimum lot width and depth requirements. The size, shape and orientation of the proposed lots is appropriate for accommodating the light industrial uses anticipated in the zone. The proposal would devote more area to the vacant parcel, Lot 1, which increases its viability for development. d) Reasonableness of Proposed Boundaries Access: Access to both of the lots would be off SW 39th Street. The lots have sufficient frontage along SW 39th Street to allow an adequate separation between access drives serving the lots. A 25 foot wide shared access easement is proposed along the common property boundary between the lots. Topography: The site is relatively flat with no special features. Note the King County Recording Numbers for the railroad trackage easement and the 25' utility easement shown along the southerly boundary line of the subject parcel.'Who is served by the 25' wide utility easement across the south side of Lot 2? this is a new easement to serve Lot 1, it will need to be granted and conveyed when either of the two subject lots is sold. Where is the 25'wide utility easement shown,as noted in the legal description for Lot 1? The legal description for the proposed lots includes a"Together with and Subject to"statement about the 25' wide private access easement(12.5'wide on each proposed lot). It should not be included in the legal description at this time, since it appears that this easement is not recorded. Information needed for final short plat approval includes the following: The City of Renton land use action number(LUA-96-146-SHPL)and the city's land record number (LND-20-0202)should be noted on the drawing,preferably in the upper right-hand corner. CURRENT CONDITIONS: The project site is located at the southwest corner of Lind Avenue and SW 39th Street. The site consists of 5.05 acres. (a)Any law,ordinance or governmental regulation(including but not limited to building and zoning laws,ordinances,or regulations)restricting,regulating,prohibiting or relating to(i)the occupancy,use,or enjoyment of the land;(ii)the character,dimensions or location of any improvement now or hereafter erected on the land;(iii)a separation in ownership or a change in the dimensions or area of the land or any parcel of which the land is or was a part;or(iv)environmental protection,or the affect of any violation of these laws,ordinances or governmental regulations,except to the extent that a notice of the enforcement thereof or a notice of a defect,lien or encumbrance resulting from a violation or alleged violation affecting the land has been recorded in the public records at Date of Policy.(b)Any governmental police power not excluded by(a)above,except to the extent that a notice of the exercise thereof or a notice of a defect, lien or encumbrance resulting from a violation or alleged violation affecting the land has,been recorded in the public records at Date of Policy. 2. Rights of eminent domain unless notice of the exercise thereof has been recorded in the public records at Date of Policy,but not excluding from coverage any taking which has occurred prior to Date of Policy which would be binding on the rights of a purchaser for value without knowledge. 3. Defects,liens,encumbrances,adverse claims or other matters: (a)created,suffered,assumed or agreed to by the insured claimant; (b)not known to the Company,not recorded in the public records at Date of Policy,but known to the insured claimant and not disclosed in writing to the Company by the insured claimant prior to the date the insured claimant became an insured under this policy; (c)resulting in no loss or damage to the insured claimant; (d)attaching or created subsequent to Date of Policy;or (e)resulting in loss or damage which would not have been sustained if the,insured claimant had paid value for the estate or interest insured by this policy. 4. Any claim,which arises out of the transaction vesting in the Insured the estate or interest insured by this policy,by reason of the operation of federal bankruptcy,state insolvency,or Similar creditors'rights laws,that is based on: (a)the transaction creating the estate or interest insured by this policy being deemed a fraudulent conveyance or fraudulent transfer,or (b)the transaction creating the estate or interest insured by this policy being deemed a preferential transfer except where the preferential transfer results from the failure: (i)to timely record the instrument of transfer,or (ii)of such recordation to impart notice to a purchaser for value or a judgment or lien creditor.
