Correspondence
CORRESPONDENCE Letter was read from Richard Grant, Chairman of Board of
Water District Commissioners for Water District No. 90, requesting opening
No. 90 Request of discussion with the City of Renton regarding possible
purchase of water service; construction of emergency interties
that would be of benefit to the City and District; and
establishing a mutually beneficial water service area. MOVED
BY MATHEWS, SECONDED BY HUGHES, COUNCIL REFER THIS MATTER TO
UTILITIES COMMITTEE. CARRIED.
OLD BUSINESS Council President Reed presented a report regarding pending
Committee referrals: Utility tax break for senior citizens and history
of the of the matter (referred 10/6/80) ; Metro rates (referred
Whole 4/19/82) ; and Voter's Pamphlet (referred 9/17/84) . The
Referrals Committee has determined that no further action is required
on these items and recommends that they be removed from the
referral list. MOVED BY REED, SECONDED BY MATHEWS, COUNCIL
CONCUR IN THE COMMITTEE REPORT. CARRIED.
Proposed MOVED BY KEOLKER, SECONDED BY STREDICKE, COUNCIL REJECT THE
R-1-5 Zone RECOMMENDATION OF THE PLANNING COMMISSION AND NOT APPROVE THE
Tabled R-1-5 ZONE. Council President Reed spoke against the motion
since he felt that the proposed R-1-5 zone provides an
appropriate buffer to protect single family residential use
of lesser density than any other existing zone. Councilwoman
Keolker felt that the City's existing Planned Unit Development
(PUD) process allows similar development, but provides a
better opportunity to homeowners to monitor surrounding
proposed development. SUBSTITUTE MOTION BY MATHEWS, SECONDED
BY REED, COUNCIL TABLE THE MATTER OF THE PROPOSED R-1-5 ZONE.
CARRIED.
Utilities Utilities. Committee Chairman Hughes presented a report
Committee recommending that the City Council accept sponsorship of
Phase II - Phase II of the Soil Conservation Service's P-1 Channel
SCS P-1 Channel and authorize the Mayor and City Clerk to sign the agreement
for construction and operation of the proposed flood control
channel . The Committee further recommended that the Public
Works Department administer the filling and grading permit
for this phase. MOVED BY HUGHES, SECONDED BY CLYMER, COUNCIL
CONCUR IN THE RECOMMENDATION OF THE COMMITTEE.- CARRIED.
Installation Utilities Committee Chairman Hughes presented a report
of Conduit concurring in the recommendation of the Public Works
Between City Department to accept the low bid of Potelco, Inc. in the
Shops and amount of $189,576.08, including tax, to install the conduit
Municipal between the Municipal Building and the City Shops. The
Building Committee also recommended that the Mayor and City Clerk
be authorized to sign the contract documents. MOVED BY
HUGHES, SECONDED BY KEOLKER, COUNCIL CONCUR IN THE
RECOMMENDATON OF THE COMMITTEE. CARRIED. Engineer' s estimate
for the project was $199,215.00.

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM
BUSINESS USE DISTRICT (B-1) TO LIGHT INDUSTRIAL
DISTRICT (L-1) (CULLEN R-114-84)
WHEREAS under Chapter 7, Title IV (Building Regulations) of
Ordinance No. 1628 known as the "Code of General Ordinances of the
City of Renton" , as amended, and the maps and reports adopted in
conjunction therewith, the property hereinbelow described has heretofore
been zoned as Business Use District (B-1) ; and
WHEREAS a proper petition for change of zone classification
of said property has been filed with the Building & Zoning Department
on or about December 12, 1984 , which petition was duly referred to the
Hearing Examiner for investigation, study and public hearing, and
a public hearing having been held thereon on or about January 29 ,
1985, and said matter having been duly considered by the Hearing Examiner
and said zoning request being in conformity with the City' s Comprehensive
Plan, as amended, and the City Council having duly considered all matters

Ways and Means Ways and Means Committee Chairman Clymer presented a report
Committee recommending the following ordinance for second & final reading:
Ordinance #3896 An ordinance was read providing for the issuance of $2,600,000
Water & Sewer par value of Water and Sewer Revenue Bonds, 1985, of the City
Revenue Bonds for the purpose of obtaining a part of the funds with which to
1985 pay the cost of carrying out the system or plan of additions
to and betterments and extensions of the waterworks utility
of the City, including the sewerage system as a part thereof,
and providing a required amount for the arts; fixing the date,
form, denomination, maturities, maximum interest rate, terms
and covenants of such bonds; creating a special bond redemption
fund to provide for the payment of the bonds; and providing for
the sale of such bonds. MOVED BY CLYMER, SECONDED BY TRIMM,

NEW BUSINESS Councilman Stredicke requested a report on location of a
Liquor Store liquor store sign in the City right-of-way on NE Sunset
Sign Boulevard in the Highlands Shopping Center. Mayor Shinpoch
agreed to investigate the matter.
ADMINISTRATIVE Mayor Shinpoch responded to Council inquiry of 3/4/85 regarding
REPORT selection of Mother' s Park building for energy conservation
Washington project aimed at gas and oil heated buildings, sponsored by
State Energy the State Energy Office. Several City buildings were considered
Office Project for the program, but due to several factors, were disqualified:
City Hall - electric heat; energy study commissioned in 1982
and currently being implemented; Library - 1982 conservation
study; renovation scheduled for 1986 as budgeted; Highlands
Administration Building - renovation scheduled for 1985 with
Housing & Community Development funds and appropriation approved
by City Council (electric heat pump proposed) . Mother' s Park
building was determined the best candidate since it meets
WSEO required qualifications (gas fired boiler) in a cost
effective manner.
Golf Course Regarding autonomy of the Park Board and authority to issue
Passes Maplewood Golf Course passes to senior citizens, Mayor Shinpoch
reported that by ordinance, the Park Board has authority under
its autonomy to set fees. The Board has decided to leave golf
course fees at current rate since those figures were built into
financial considerations when Council made the decision to approve

BUILDING & ZONING The Building & Zoning Department Report was
DEPARTMENT REPORT: received by the Examiner on January 22, 1985.
PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with
the application, and field checking the property and
surrounding area, the Examiner conducted a public
hearing on the subject as follows:
The hearing was opened on January 29, 1985, at 10:00 A.M. in the Council Chambers of
the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
The following exhibits were entered into the record:
Exhibit #1. Yellow file containing application, proof
of posting and various other documents pertinent to
this proposal.
Exhibit #2 - Assessors Map.
Exhibit #3 - Site Plan.
The hearing opened with the Zoning Administrator presenting the staff report. Mr.
Blaylock began by placing the above exhibits into the record. He continued by stating this
proposal is to allow the operation of a water treatment bottling plant for Crystal Springs
Drinking Water. The site will be accessed off S.W. 43rd Street, and is located on the west
side of the Burlington Northern railroad tracks between the tracks and West Valley Road.
All major services are available. It was pointed out that there is an existing structure
abutting the western property line, thereby negating the setback standards for side yards.
The area is comprised of very small lots. The existing structure is to be remodeled and
used by the applicant. The building is approximately 1125 sq. ft.
Mr. Blaylock continued with a review of the four rezone criteria covering the
reclassification of the area, and noted the L-1,( Light Industrial) use zone does riot require
setbacks from side, rear or front property lines. The 43rd Street corridor was discussed as
it is a critical link for traffic (the only east-west corridor south of I-405). Mr. Blaylock
said the issue of traffic is going to receive critical review for all future proposals in this
area. 'The Comprehensive Plan acknowledges there will be certain periods when traffic
will be 150% over capacity on 43rd Street. Because of the continued high volume of
traffic on 43rd Street the City has had to contemplate Phase II of the improvements to
that area. Within 3 to 5 years there will be a condemnation of property for a major street
undercrossing for the railroad tracks. This subject parcel will more than likely be a
portion of the property that may be condemned. This brought up the question of whether
or not the City should approve a rezone request when it is aware of possible future

condemnation of subject property. It was felt adjacent property owners should not be
penalized now for a decision that may be pending from the City in the future. Mr.
Blaylock stated it was staff's contention that the applicant should have the right to
receive consideration on this request as long as the applicant is cognizant of the City's
plans for the future for that piece of property. It is felt the request is timely and should
be given consideration. Upon questioning from the Examiner it was determined the
existing building conforms with the current zoning in B-1 and L-1. Parking will be placed
in the front of the existing building with an addition to be added on to the north side of
the building. Mr. Blaylock said staff has recommended site plan approval because in the
Manufacturing Park classification of the Comprehensive Plan where there has been an L-1
request because of the size and constraints of the property, there has'been concern over
interFacing with adjacent uses. Mr. Blaylock advised Mr. Cullen that site plan approval
through the Hearing Examiner process will take approximately 2-1/2 months after the
plan has been prepared and presented, and no building permits could be issued until that
time. Mr. Blaylock stated staff would recommend approval with a required 20 ft.
landscaped front yard setback and site plan approval.
'The Hearing Examiner called for testimony' in support of this application from the
applicant or their representative. Responding was:

Mr. Cullen expressed his concern regarding the site plan approval taking another 2-1/2
months. He said he was aware of the underground railroad crossing plans, and was told by
the Engineering Department that the City will probably riot be putting Phase II into effect
for approximately 3 to 5 years. With this in mind he proceeded with his plans to purchase
the property. Mr. Cullen said he will be remodeling and adding on to the existing building
by putting outside storage behind a fence in back of the building, within a 27 ft. setback
already provided. He does not want to put up a new building knowing at some date in the
future it may have to be demolished when the City is ready to condemn property for
Phase II of improvements to 43rd Street. With this information in mind the Hearing
Examiner advised it may not be necessary to require site plan approval if the building is
not remodeled beyond just some exterior landscaping and parking stalls. Mr. Cullen asked
that consideration be given for him to use the upper portion of the roof line on the front
of the building to add a small office and restroom space. In this way he can utilize all of
the downstairs as warehouse space. The Examiner said he would consider this information
in making his decision. Mr. Cullen concluded his testimony noting there will be only 2
employees at this location thereby creating no traffic impact on the area.
The Examiner called for further testimony in support of this application. There being no
one else in the audience wishing to speak for, or in opposition to this proposal, the hearing
was closed at 10:20 A.M.
FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the record in this matter, the Examiner now makes and enters the
following:
FINDINGS:
1. The applicant, Allen Cullen, filed a request for approval of reclassification of
approximately 6,480 sq ft of property from B- 1 (Business/Commercial) to L-1
(Light Industrial).
2. The application file containing the application, the State Environmental Policy Act
(SEPA) documentation, the Building and Zoning Department Report, and other
pertinent documents was entered into the record as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C,
1971, as amended), a Declaration of Non-Significance has been issued for the
subject proposal by the Environmental Review Committee (ERC), responsible
official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the subject proposal from any member of the public.

6. The subject site is located at 1900 S.W. 43rd Street, just east of the West Valley
Road (SR 181), in the Orillia area.
7. The subject site was annexed into the City by Ordinance 1745 adopted in April,
1959, as amended by Ordinances 1764 and 1928, adopted in May of 1959 and
December of 1961, respectively. The site was reclassified in June, 1959 from a
residential designation to its current B-1 zoning by Ordinance 1768.
8. The applicant proposes' establishing a water treatment and bottling plant for the
subject site. The use is not permitted in a B-1 zone.
9. An existing building will be utilized for the proposed plant. Remodeling will be
required, but the full extent of such remodeling remains unknown without
additional information.
10. The subject site is one of a series of small lots in the old Orillia town center.
There are a number of smaller businesses operating in the area, as well as a number
of empty lots or vacant properties.
11. The subject site appears to be located within a proposed right-of-way for an
eventual undercrossing of the railroad immediately east of the subject site.
Development of such a crossing, while currently envisioned, is not proposed for at
least 3 to 5 years.
12. The undercrossing will require the acquisition of the subject site and any
development on the property. A certain amount of waste would result from the
proposed redevelopment of the subject site.
13. The proposed use will employ approximately 2 people. No estimates of traffic
were provided. Speculation provided that a retail business use would generate
more traffic than the applicant's current proposal.
14. The map element of the Comprehensive Plan designates the area in which the
subject site is located as suitable for the development of manufacturing
park/multiple option uses, but does not mandate such development without
consideration of other policies of the plan.
15. The areas north of the subject site are predominantly zoned M-P (Manufacturing
Park), while L-1 zoning, the category requested by the applicant, can be found east
of the subject site along the north side of S.W. 43rd. Street.

16. The subject site's size is not unlike the recently rezoned properties north of I-405
in the Grady Way area. These small parcels could not comply with the large
setbacks required in the M- P zone, therefore, covenants requiring relaxed but
comparable setbacks were imposed for most of those rezones. Also, site plan
review has been required as it is in the M-P zone.
CONCLUSIONS
1. The proponent of a rezone must demonstrate that the request is in the public
interest, will not impair the public health, safety and welfare and in addition, is in
compliance with at least one of the three criteria found in Section 4-3010, which
provides in part that:
a. The subject site has not been considered in a previous area-wide rezone or
land use analysis; or
b. The subject site is potentially designated for the new classification per the
Comprehensive Plan; or
c. There has been a material and substantial change in the circumstances in
the area in which the subject site is located since the last rezoning of the
property or area.
The requested reclassification is justified and should be approved by the City
Council.
2. While there should be some concern raised regarding the eventual demolition.of any
improvements inspired and facilitated by the reclassification of the subject site,
the request is compatible with the Comprehensive Plan for the area and will permit
the location of a viable business in a now vacant building.

3. The zoning, if comparable setbacks are maintained, is compatible with the
Comprehensive Plan. The proposed use is light industrial and would be permitted in
the M-P zone. It would also be compatible with the, multiple options now
permitted in the Green River Valley area of the city.
4. The issue of right-of-way acquisition should not necessarily determine the
disposition of the request. While substantial improvements may be wasted, the
City should not base a decision solely on eventual acquisition. At the same time a
reclassification which permits expansion raises some issues. Primarily, the current
zoning would allow the property owner reasonable use of the subject site while it
also remains compatible with the multiple option designation of the Comprehensive
Plan.
5. In summary, the current plans for further roadway improvements appear to be at
least 3 to 5 years away, the applicant is aware of the potential loss of the site, and
the request is faithful to the new Comprehensive Plan. Therefore, the City
Council should approve the reclassification.
6. The execution of restrictive covenants requiring a landscaped 20 foot setback along
the front property line should be required. Similarly, as in the rezones in the Grady
Way vicinity, the site should be subject to site plan review, but only if the building
is enlarged beyond its current floor plan.
RECOMMENDATION
The City Council should approve the reclassification of the subject site from B-1 to L-1
subject to the execution of restrictive covenants which require:
1. A 20 foot landscaped setback from S.W. 43rd St. subject to review of the City's
Landscape Architect.
2. Site plan review if the applicant enlarges the current building beyond the current
floor plan.

An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection or
purchase in the Finance Department, first floor of City Hall.
The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one)
communications may occur concerning land use decisions. This means that parties to a
land use decision may not communicate in private with any decision-maker concerning the
proposal. Decision-makers in the land use process include both the Hearing Examiner and
members of the City Council.
' All communications concerning the proposal must be made in public. This permits all
interested parties to know the contents of the communication and would allow them to
openly rebut the evidence. Any violation of this doctrine would result in the invalidation
of the request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.

G. DEPARTMENT ANALYSIS:
1. The applicant, Allen Cullen, is requesting rezone approval of approximately
6,480 square feet of property from B-1, Business Use, to L-1, Light Industrial ''
Use, to allow construction of a water treatment/bottling plant for the firm of
Crystal Springs Drinking Water.
2. The parcel is 120 feet deep' by 54 feet wide with an existing concrete block
building containing approximately 1,125 square feet. The applicant would
remodel and add on to the existing structure for the industrial operation.
3. The Environmental Review Committee ' has issued a Declaration of
Non-significance with the appeal date expiring on January 14, 1985.
4. The Hearing Examiner must review four specific criteria under Section
4-3014(C) to determine that the circumstances surrounding the rezone
request are adequate to recommend approval of the reclassification. The
following evidence clearly demonstrates the rezone request is appropriate:
a. That substantial evidence was presented demonstrating the subject
reclassification appears not to have been specifically considered at the
time of the last area land use analysis and area zoning.
The subject site was rezoned under 'Ordinance *1768 on June 9, 1959
from Single Family Residential (R-7200) to B-1, Business Use. The
property was subsequently used for business activities over the years.
In fact, the site had been utilized for many years before annexation in
1959 and recently an old structure burned on the site. The. Valley
Comprehensive Plan was recently adopted in October, 1984, and this
specific site has not been considered since that time.
b. ' That the property is potentially classified for the proposed zone being
requested pursuant to the policies set forth in the Comprehensive Plan
and conditions have been met which would indicate the change is
appropriate.
The proposed rezone is not in the strictest compliance with the Land
Use Designation of Manufacturing Park - Multiple Option. The site has
been utilized for commercial and industrial activities in the past.
However, the property is so limited by size that the imposition of
present Manufacturing Park standards for setbacks would make the lot
unusable. Therefore, the applicant has applied for a rezone to L-1.
The L-1, Light Industrial Use Zone, does not require setbacks from side,
rear, 'or front property lines. However, there is a 10 foot setback
because the site is adjacent to an arterial.

The lots along the north side of S.W. 43rd Street between West Valley
Highway and the Burlington Northern railroad tracks are comparable to
the area lying between S.W. 16th Street and S.W. Grady Way. In that
area, the City Council allowed rezones to Light Industrial with specific
covenants trying to protect and encourage more of a modern industrial
park concept.
In this specific case, the property is limited because a building is
located along the western property line. Therefore, setback standards
for side yards could not be applied.
c. That since the last previous land use analysis of the area zoning of the
subject property, authorized public improvements, permitted private
development or other circumstances affecting the subject property
have undergone significant and material change.
In 1984, the City of Renton completed Phase I of the S.W. 43rd Street
major arterial street improvements. This included all services
associated with major arterials including the roadway, curbs, gutters,
sidewalks, and street lighting. The 43rd Street traffic corridor is one of
the critical links for traffic flow in the Green River Valley between the
cities of Tukwila acid Renton. As traffic demand increases on this
arterial, the problem of an adequate railroad crossing becomes more
critical. It is envisioned that somewhere between three and ten years
the subject project will be condemned and a major street undercrossing
of the,railroad tracks will be constructed.
ISSUE
Should the City of Renton approve a rezone request or other land use
decisions when it knowns that within a reasonable period of time (3 to
10 years), public improvements will require condemnation and
elimination of the proposed uses?
The City of Renton, like any other local governmental unit, must
respond to impacts from a reactionary point of view. Serious planning
where future acquisitions are made are not fundable under present
systems. The adjacent property owner should not suffer pending a
decision by the governmental body. In this specific case, the property
owner should be considered in any other case, but with the
understanding that the City, at some time, will be using its authority
for the public benefit and welfare. This may prompt the applicant to
design and develop the facility at different standards than would
necessarily be envisioned by him.
d. The final test to determine whether a rezone is appropriate is to
address the question of timeliness.
The final issue to consider is timing. Is it the appropriate time to
rezone the property?
Based upon our knowledge concerning the. necessary widening of the
street, there is no appropriate time to rezone the property. At best,
the rezone will provide an interim use of the subject site. The
questions is, what is interim? Public pressure often has to be extended
to a very high level before public improvements are completed. The
Building and Zoning Department believes that this is the case and that
actual improvements to this corridor will not occur within a five year
period. Since all of the physical improvements are available to the site
and the intended operation does not appear to be a major traffic
generator, it would be appropriate to rezone the site to the L-1, Light
Industrial Use, as requested. In fact, the retail uses that would
presently be allowed would create more traffic impacts than the
anticipated use.

5. The Policy Development Department has recommended site plan approval.
Consistency would dictate that this be a requirement.
6. In conclusion, the request is appropriate to recommend approval based upon
the fact that it has not been considered since the last area-wide land use
analysis and it is potentially classified under the Comprehensive Plan.
H. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that rezone request by Allen
Cullen, file R-114-84, be recommended to the City Council for approval subject to:
1. The filing of a restrictive covenant to require a landscaped front yard
setback of 20 feet.
2. Site plan approval.

governmental agencies to consider the environmental impacts of a proposal before making

Subject : Rezone of property located at 1900 S.W. 43rd,
Renton, Washington.
Dear Zoning Administrator, or whom it may "concern;
Enclosed you will find my application for rezone of the
above property along with materials requested for such
rezone.
Listed below are the points of justification for rezone:
a) The current zone (B-1) to L-1 is appropriate and timely
with the current Comprehensive Plan which is classified
M-P, as all industrial enterprises similar in operation
to those permitted in the L-1 district are permitted in
the M-P, manufacturing park district .
b) In addition to the above, I understand that the Compre-
hensive Plan is being updated currently, and that the pur-
posed land use would be a H-1, which also permits all uses
permitted in L-1 zones .

c) The current and/or proposed land use of adjacent
property is consistent with the requested L-1 zone.
Property on the south side of S.W. 43rd street is lo-
cated within the boundaries of the City of Kent, and
is zoned: Heavy Industrial, Light Industrial and Man-
ufacturing Park, with no consistency between properties,
but all are consistent with an L-1 zone.
d) The widening of S .W. 43rd street and location of the
railroad tracks to the east, make the old zone of B-1,
nearly obsolete, as access to this property has changed
considerably from the days of a slow paced, two lane
rural road.
