TO LIGHT INDUSTRIAL DISTRICT (L-1.) NEW BUSINESS Councilman Stredicke advised receipt of a letter from Thomas Honey Creek Malmoe regarding the Honey Creek Annexation/Rezone hearings. Annexation/ City Attorney Kellogg suggested that the letter be presented Rezone/PPUD during the Planning and Development Committee of 4/25/85 when R-014-84 this matter is scheduled to be discussed. The Committee can PPUD-015-84 then determine whether the record can be expanded to include Mr. Malmoe's letter. He cautioned against including the - letter in the record at this time because all parties to the annexation/rezone record are not aware of its contents. Mr. Sheridan cited problems with showroom congestion, vandalism, pollution by bus fumes, and requested this matter be discussed at the scheduled meeting between Council and Metro. Mayor Shinpoch noted that teachers Joyce Hollis and Betty Swanson are to be congratulated. Minority and Mayor Shinpoch reported her meeting scheduled for April 9 Women-Owned with Ernest Walker, President of the Minority and Small Business Business Council, to discuss his concerns voiced at the last Council meeting regarding the City's purchases from and contract placement to businesses owned by women and minorities had been postponed, rescheduled for this • date. Mr. Walker had been unavailable for that meeting and the matter was still pending. Playtime Theaters Mayor Shinpoch announced acceptance by the U.S. Supreme' Supreme Court Court of the City's petition for appeal 'of the Playtime Appeal Theaters court case and introduced City Attorney Larry Warren. Continued City Attorney Warren verified the Supreme Court "had noted probable jurisdiction", and the City (coordinating with the Washington, DC, law firm of Hogan and Hartson) will submit briefs and argue the case before the Court. Mr. Warren indicated this case has the potential to be of national significance and may be a legal landmark in years to come. The City Attorney praised Assistant City Attorney Dan Kellogg for his tremendous effort and energy expended in this case. Continued Mayor Shinpoch commended Attorney, Assistant City Attorney Kellogg, and their staff for a job well done. She said further action will be taken if that statement is not withdrawn. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on February 26, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on March 5, 1985, at 9:10 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and other information pertinent to this proposal. Exhibit #2 - Site Plan of subject proposal. The hearing opened with the Zoning Administrator, Roger Blaylock, introducing the above exhibits into the record and reviewing the staff report. He advised the property is located between two single family residences; one used as a residence and the other used as a day care center. Access to the site is off S.W. 13th Street. Utilities are available in the general area, and sewers are located approximately 400 ft. to the N.W. of the property. Mr. Blaylock continued stating there is a storm drainage line down Maple Avenue; and reviewed the four specific criteria attached to a rezone request. It was noted the applicant is requesting a rezone as well as four specific covenants covering setbacks and the permanent deletion of side yard requirements should this property be developed in combination with property on either side of it. The property is approximately 60 ft. by 100 ft.. He stated the major transition in the area is occurring west of Maple. The area is classified under the Comprehensive Plan as Manufacturing Park-Multiple Option, but over the last year the Plan has become more definitive and the proposal now does not meet with the requirements in the strictest intent. The L-1 classification now would allow retail commercial uses which should be evaluated to be sure they are within the strictest intent of the Plan. Mr. Blaylock continued stating the M-P zone has been used to implement the Manufacturing Park intent, however because of lot sizes in this area the City Council has permitted rezones to L-1 to modify the setback requirements on the odd-sized lots.`. He said there is a concern regarding the provision of storm water drainage. The most costly improvement to the developer will be the extension of sewer lines to the site. At present they are located approximately 400 ft. away. The timing of the request seems appropriate, and it was questioned whether persons should have to participate in a benefit area to improve S.W. Grady Way. Other rezones have been required to participate at the time of their development, but staff has not seen the benefit area established by the • FRANCES E. CARLSON R-002-85 March 8, 1985 Page 2 Public Works Department and therefore did not take a position on participation by this applicant. With that information it was recommended that the rezone is appropriate, and combined with the suggested restrictive covenants to include site plan approval and modified setbacks, this proposal is recommended for approval. It was also suggested that the uses on this site be limited to light industrial office uses with no retail commercial uses permitted on the site. The Hearing Examiner called for testimony in support of the application from the applicant or his representative. Responding was: Larry Brown 13975 Interurban South Seattle, Washington, 98166 Mr. Brown stated for the record that the applicant intends to extend a line to meet the. storm water line on Maple Avenue, and emphasized the request for the front yard setback to allow parking in 50% of the front yard area. In conformance with residential side yard setbacks he requested 5 ft. to be landscaped within the 10 ft. setback area. Mr. Brown also advised the applicant would be supportive of the Grady Way benefit district and stated the rate determined for that area has been set at 43¢ a square foot. They are willing to participate at the time the building permit is issued. The Hearing Examiner called for further testimony in support of, in opposition to, or further comments regarding the application. There being no one else wishing to speak, the hearing was closed at 9:25 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Frances E. Carlson, has requested approval of a reclassification of 5,750 square feet of property from R-1 (Single Family Residential; Minimum lot size - 7,200 sq ft) to L-1 (Light Industry). 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. There was no opposition to the subject proposal from any member of the public. 6. The subject site is located at 211 S.W. 13th Street, just northwest of the I-405/Rainier-SR-167 interchange. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of manufacturing park/multiple option type uses, but does not mandate such development without consideration of other policies of the plan. 8. The subject site was annexed into the City in April, 1959 by Ordinance 1745, as amended by Ordinances 1764 and 1928, adopted in May, 1959 and December, 1961, respectively. A change in titles changed the site's G-6000 zoning to R-1 in 1982. 9. A new storm water drainage system is located along Maple. Water lines are also located along Maple. Sewer service is approximately 400 feet from the subject site. 10. Single family uses are located east and west of the subject site. An occupied single family home is located immediately west of the site. A day care facility is located east of the subject site. Vacant property is located south of the subject site, while single family uses are located north of the subject site. The proposed Elisa Thomas rezone is located north of the subject site. • FRANCES E. CARLSON R-002-85 March 8, 1985 Page 3 11. The applicant has suggested that the rezone be conditioned to provide setbacks from adjacent property and the street in order to buffer these adjacent properties and provide some accommodation to the Comprehensive Plan. The applicant proposes a. A front yard setback of twenty (20) feet of which the first ten (10) feet would be landscaped. b. Side yard setbacks of ten (10) feet of which the first 5 or 6 feet would be landscaped. c. A rear yard setback of ten (10) feet of which five (5) feet would be landscaped. The applicant further suggested that the side yard setbacks be dissolved if the adjoining properties are joined with the subject site in one development. 12. The property is not quite rectangular in shape, with sixty (60) feet of frontage along S.W. 13th Street. The lot is approximately one hundred (100) feet in depth. The subject site is vacant and not utilized. 13. Rezones for smaller lots in the area between Grady Way and I-405 on both sides of Lind Avenue S.W. have generally been for L-1 districts, and in a few instances B-1 (Business/Commercial). These rezones have generally been conditioned upon providing setbacks as proposed by the applicant which proivde some fidelity to the Comprehensive Plan's designation of M-P for the area. M-P requires spacious setbacks which could not be accommodated on lots such as the subject site. CONCLUSIONS 1. The proponent of a rezone must demonstrate that the request is in the public interest, it will not impair the public health, safety and welfare and in addition, complies with at least one of the three criteria found in Section 4-3010, which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been a material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. The requested reclassification is justified. 2. The area has not been rezoned since its initial annexation in 1959. Since that time I-405 was constructed which makes the area less suitable for single family residential purposes, although the area does still contain a reasonable number of inhabited single family homes, including the home immediately west of the subject site. 3. The location next to I-405, combined with the site's designation as potential manufacturing park in the Comprehensive Plan, indicates that reclassification to something other than residential appears reasonable. The size of the lot, approximately 5,750 sq ft, would appear to dictate against an M-P classification, as the setbacks required in an M-P zone would leave almost no buildable lot area. 4. The L-1 zoning proposed by the applicant, subject to the conditions favored by the applicant, appears appropriate. With the setbacks the area can be suitably landscaped, and the adjacent dissimilar uses can be buffered from the potential adverse affects of the more intense uses permitted in an L-1 zone. 5. The site does not appear to be located in an area either conducive to retail uses or suitable for ordinary foot traffic. At the current time an ordinary L-1 designation which would permit such uses therefore, should be modified to prohibit such uses. New L-1 regulations are being studied and the applicant indicated that such a limitation would be acceptable. FRANCES E. CARLSON R-002-85 March 8, 1985 Page 4 6. The City Council should approve the reclassification of the subject site from R-1 to L-1 subject to the conditions submitted by the applicant, and limiting the uses to non-retail ventures. RECOMMENDATION The City Council should approve the reclassification of the subject site from R-1 to L-1 subject to the following conditions: The execution of restrictive covenants requiring: a. A front yard setback of twenty (20) feet of which the first ten (10) feet would be landscaped; b. Side yard setbacks of ten.(10) feet of which 6 feet would be landscaped; c. A rear yard setback of ten (10) feet of which five (5) feet would be landscaped; and further, subject to the dissolution of the sideyard requirements if the subject site is developed in an integrated proposal with its adjoining neighboring properties to the east or west. The covenants should further reflect that the site cannot be used for any uses permitted in the B-1 zone other than office uses, and that site plan review is required. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The applicant, Frances E. Carlson, is requesting a rezone of 5,750 square feet from R-1 (Single Family Residential) to L-1 (Light Industrial) for future development. The rezone request specifically includes the following four provisions in the form of suggested restrictive covenants: a. A front yard setback of twenty (20) feet for the first ten (10) feet only to be landscaped. b. The side yard setback of ten (10) feet with the first six (6) feet or possibly five (5) feet to be landscaped. c. The rear yard setback of ten (10) feet with only a five (5) foot landscaped strip. d. If the property be developed in combination with the property on either side, than the side yard requirements would not be required and should be automatically be dropped from the record. 2. The property is approximately rectangular in shape with sixty (60) feet of frontage along S.W. 13th Street and approximately one hundred (100) feet in depth. The subject site is vacant and is presently not utilized. 3. Land uses in the immediate area include a single family dwelling approximately fifteen (15) west of the subject property. A day care facility appoximately sixty (60) feet east of the subject site (Arlene Roberts, file TP-044-83). To the north of the subject site are single family residences and the recent Elisa Thomas rezone (R-094-84). To the south of the subject site is vacant land. 4. A Declaration of Non-significance was issued by the Environmental Review Committee on January 23, 1985 with an appeal period of February 11, 1985. An appeal was not submitted during that time. 5. The Hearing Examiner must review four specific criteria under Section 4-3014(C) to determine that the circumstances surrounding the rezone request are adequate to recommend approval of the reclassification to the City Council. The following evidence demonstrates the rezone request is appropriate: a. That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis and area zoning. • PRELIMINARY REPORT TO THE HEARING EXAMINER FRANCES E. CARLSON: R-002-85 March 5, 1985 PAGE 3 The subject zoning was applied initially at the time of annexation in 1959. In 1982, Ordinance #3634 changed the G-6000 classification to R-1 (Single Family Residential). The Valley Comprehensive Plan was recently adopted in October 1984, and this specific site has not been considered since that time. • • c. That since the last previous land use analysis of the area zoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone significant and material change. The proposed rezone is not in the strictest compliance with the land use designation of Manufacturing Park - Multiple Option (Non-retail). Under an L-1, Light Industrial Use zoning, all retail activities could be conducted on-site. The property is so limited by its size that the imposition of the present Manufacturing Park standards for setbacks would make the lot unusable. Therefore, the applicant has specifically requested the rezone to L-1 (Light Industrial Use) with the specific conditions on setbacks and landscaping. This appears to be consistent with previous land use decisions in the general area. Those policies were established primarily because of the limited lot size and the applicability of the strict Manufacturing Park standards upon those lots. c. That since the last previous land use analysis of the area zoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone significant and material change. During the last two years, development in the general area has trended towards industrial and office type activities. The transition that appears to be taking place is more gradual east of Lind Avenue S.W. than to the west. The transition, in any case, from residential and vacant uses to industrial and office uses is very gradual and many single family residential uses appear to be maintaining themselves. The City, approximately seven (7) years ago, approved improvement to S.W. Grady Way which prompted the beginning of this redevelopment. The resolving of the storm water drainage issue, along with other traffic improvements in the area, have created a new situation which has affected the rate of the land use transition. It would appear that, even though the property could be rezoned at this point, the actual development of the property would probably not occur immediately. d. The final test to determine whether a rezone is appropriate is to address the question of timeliness. Is it the appropriate time to rezone the property? The action to rezone does not signify the development of the property. Rezoning generally occurs when development pressure suggests the initial stage of land use reconsideration of a property. Unfortunately in the past, development pressure has often created false starts and there has been an eratic development of property throughout the City. This proposal appears to be generally consistent with the underlying development pattern of this specific transitional area. It appears that small parcels are rezoned; and then gradually accummulated for development at a later date. Rezoning of the property does not guarantee actual development, but the City should be careful and require development plan review as part of the final design consideration. Utilities can be provided to the subject site at the time of development. Therefore, it would appear that the rezone request is timely and appropriate. .. • PRELIMINARY REPORT 1 u (HE HEARING EXAMINER FRANCES E. CARLSON: R-002-85 ' March 5, 1985 PAGE 4 ISSUE 6. The primary issue is, should the City of Renton only approve the rezone request if the applicant agrees to contribute to the benefit area charge previously imposed upon for traffic improvements on other rezones in the area? The Public Works Department has identified a benefit area to make certain improvements to S.W. Grady Way. Both the Anderson-Minietta rezone and the Swales rezone were required to participate in those improvements at the time of development. The Building and Zoning Department has not seen the formal benefit area established by the Public Works Department and, therefore, cannot take a positive position concerning whether the fee should be assessed. The Public Works Department should argue their position before the Hearing Examiner and it is recommended that the Hearing Examiner request a representive from the Public Works Department to be present at the public hearing. 7. In conclusion, it would appear that the rezone request meets the necessary criteria for recommendation of approval. The specific request to include variations in setback are consistent with those requirements of the Hearing Examiner in the case of Mamie Swales, file R-062-83. Site plan approval is definitely necessary based upon the fact that the area is still in transition and the complication of utilizing small lots. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the Hearing Examiner recommend approval of the subject request, file R-002-85, to the City Council subject to the filing of restrictive covenants to include site plan approval and the modified setbacks as requested. { . - | j ! Grady Way, the Public Works Department had proposed that a special benefit area be established so that improvements could be made to Grady Way: In your memorandum, going back to October 4, 1983 on the Swales Rezone, the Environmental Review Committee took your recommendation and made a specific condition to that proposal. Today, the Environmental Review Committee can not place , conditions upon their environmental review. This means that stronger justification must be presented to the Hearing Examiner to make this a condition of the pending Carlson Rezone. However, the Hearing Examiner has taken the position in the case of the Mystic Company, file SA-112-84, .that benefit areas that are not specifically established by the City Council cannot be considered during the public hearing process even though they may merit specific concern. It is up to the Public Works Department to specifically recommend to the City Council establishment of benefit areas for traffic improvements. Until that is accomplished, we would expect the Hearing Examiner to continually deny requests by either the Building and Zoning Department or the Public Works Department to pay into a cummulative reserve fund based upon the pro.rata share for any development. I would appeciate receiving a breakdown similar to your October 4, 1983 memorandum for the pending Carlson Rezone. 1 will introduce that into the record and I would advise you that you should be available during the Carlson Rezone public hearing to specifically argue the point before the Hearing Examiner.
