As the recommendation indicated, the City Council has imposed similar conditions on other rezones to assure that the goals and policies of the existing Comprehensive Plan, and earlier versions, are satisfied. These goals and policies were intended, and do continue to provide, that the land in areas designated as appropriate for manufacturing park uses is not inappropriately used for retail operations. These policies were followed in past rezones, and the current request has not been singled out. Additionally, the conditions do not in any way prevent reasonable use of the subject site. Not unlike any zoning action, reasonable limitations are inherent when property is zoned. This permits a community to govern not only the location, but the types of businesses it wants in any particular area. The appeal date has been extended to May 2, 1985 in order to permit an appeal of this decision to the City Council, if you remain dissatisfied. Kaufman : We wish to request your reconsideration of the restrictive covenants recommended for the above referenced action . There are two basic reasons why we believe that restrictions beyond the existing zoning language represent a regulatory barrier to this property ' s development , a barrier which is not applied to like properties . First of all , it would appear to be premature to apply this particular clause of the proposed zoning language prior to City Council acceptance . As an attendee of many of the working committee meetings , as well as Planning Commission meetings , I have found 'the intent of the Comprehensive Plan , adopted in 1984 , is being interpretated more narrowly than your exclusion of all "B-1 "' uses" would imply. ' The language for the new zoning regulation may also be modified or not adopted by the Council as a whole . I understand this was done with the previous rewrite of the Manufacturing Park zoning language . Secondly , application of an unadopted ordinance , in part or in full , obstructs this parcel of land unfairly . Without a moratorium applied to all the similarly indicated properties in the Comprehensive Plan , other parcels are available for development under the existing zoning language . 7 Mr . Fred J . R-012-85 LOCATION: Southwest corner of East Valley Road and S.W. 19th Street SUMMARY OF REQUEST: Rezone approximately 11.8 acres of property from G-1 to M-P for future retail/warehouse use. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approve rezone and continue special permit Hearing Examiner Recommendation: Approval with restrictive covenants and conditions. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on March 19, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on March 26, 1985, at 9:05 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and other documentation pertinent to this request. Exhibit #2 - Assessors Map. Exhibit #3 - Vicinity Map. Exhibit #4 - Vicinity Map showing fill site. Exhibit #5 - Detailed plan for fill for subject site. Exhibit #6 - Memorandum dated March 25, 1985 from Captain D. R. Persson, Renton Police Department to Ron Nelson, Building and Zoning Director regarding proposed fill operations. Exhibit #7 - Letter to Hearing Examiner from Rainier Audubon Society. The hearing was opened and the Hearing Examiner inquired regarding City rights-of-way running through the center of the properties. He questioned whether these rights-of-way were made a part of the legal description of the property. He also questioned whether the City is aware of, and has it approved, the rezoning of its property. The reply from Roger Blaylock, Zoning Administrator was "no". Mr. Blaylock said the property is under the control of the City Council through the Public Works Department and there has not been a vacation request received. The Examiner questioned whether it was premature to take any action on the total request, and Mr. Blaylock stated based on their policy to zone to the center line of the street, staff's position would be a reply in the negative. Whether or not the site could be filled may be a separate issue, which stated in the staff report should not be filled until the vacation issue has been cleared up. He said the rezone does not create any physical action, only grants authority, so it was felt this portion of the request should be heard. l he Examiner stated his concern would be the applicant treating the dedicated right-of-way as part of the subject site, not necessarily whether the rezone would effect it. He asked the Zoning Administrator to proceed with the review of the staff report. i 1 VALLEY OFFICE AND INDUSTRIAL PARK R-012-85 and SP-013-85 April 1, 1985 Page 2 Mr. Blaylock noted this is a rezone for 11.8 acres which includes rights-of-way that will be vacated at some future time. There is a right-of-way for 21st Street, Maple Avenue S.W. and Taylor Avenue S.W. A special permit has been requested for fill and grade for 249,700 cu. yds. of material. Zoning in the area consists of H-1 to the north, G-1 to the west, M-P to the south and freeway to the east. 83,500 cubic yards of fill will be taken from the P-1 Channel to the site. The proposal complies with the intent of the Comprehensive Plan. The ERC expressed concern over the on-site wildlife, and feels the Hearing Examiner should set a specific time for removal of the fill. He continued on with a review of the four zoning criteria stating the M-P Zone is presently under consideration by the City Council and by the time the applicant applies for a building permit, the uses may have changed. It is felt the rezone request is timely. Discussing the Special Permit request, Mr. Blaylock advised this is a two-phased project with 250,000 cu. yds. imported to the site. 83,000 cu. yds. will be taken from the P-1 Channel location for compensating flood storage. Issues were discussed such as the requirement for a special permit for approval of activity in the P-1 Channel area. It was noted that the applicant has not provided a detailed plan setting out the design configuration for the location, but, the Public Works Department has not completed a program setting out where the P-1 Channel will be located and its final design. Public Works Department has suggested that the portion of the P-1 Channel located on the applicant's property be dedicated to the City. Mr. Blaylock stated the hours of operation are of concern to the Police Department, and read a memorandum from Captain Persson to the Director of Building and Zoning requesting hours for hauling be set between 7:00 A.M. and 3:00 P.M. on Monday through Friday, with no evening or weekend work allowed. Number of vehicle trips per day as well as noise are concerns for the surrounding areas. The hauling route would generally be on 19th Street or 27th and Lind Avenue. It was noted that to date the applicant has not set out the location they are taking the fill material from, the location of the haul routes, or anticipated methods for the clean-up of the haul routes. It is questioned if the permit should be granted without this information. The issue of the value of the wildlife habitat and nesting season was reviewed by the Zoning Administrator. The timing of the fill for this site will interfere with the nesting season, but the developer feels to delay the fill will make it more costly to them, and waiting until Fall would make the fill material'to be moved very heavy due to the rains. Again it was stated that the plans are incomplete by both the applicant and the Public Works deprtment as to the location of the P-1 Channel on the site and the location and of the material to be excavated for compensating flood storage. It is felt by the time these two issues are worked out, the issue of timing for the nesting season may be past. The last issue discussed was whether a permit should be issued for grade and fill on property that does not legally belong to the applicant. The City Council has not heard the issue of vacation, and the granting of a grade and fill permit may be premature. Mr. Blaylock stated staff would recommend the rezone to the Hearing Examiner but the issues discussed for the special permit would lead them to request that the consideration of a special permit be continued to May 14, 1985 to allow time for the applicant and the Public Works Department to submit detailed plans. The Hearing Examiner called for testimony from the applicant or their representative. Speaking in favor of the proposal was: William Fetterley Austin Company 800 S.W. 16th Renton, Wa. 98055 Mr. Fetterley spoke regarding the street vacation and stated petitions had been circulated to surrounding property owners in early February. They sent a petition to participate to the City, but to date they have had no reply. He stated at this time it is not possible for them to determine the actual location or route of the material that is to be placed on the site. The procedure to be used for the excavation of the material from the P-1 Channel would be to haul it across adjacent property, crossing Lind Avenue and crossing the City's undeveloped future fire station site to the property - thus eliminating the necessity for haul roads. When questioned, Mr. Fetterley admitted that he has no written agreement to cross these other various properties but said he did have written approval with an adjacent property owner, who also operates heavy machinery. Addressing the displacement of water fowl on existing ponds he said they have consistently looked at the P-1 Channel as a replacement of the habitat, as the design of the Channel provides for nesting areas and has a moving water flow which would be a desirable area for most species of water fowl. He also stated that to mitigate this year's nesting period they could drain the subject site VALLEY OFFICE AND INDUSTRIAL PARK R-012-85 and SP-013-85 April 1, 1985 Page 3 as soon as possible, as a determination by the ERC indicated that they would be within their rights to do so. He feels the drainage would be the best solution to the problem as it would cause less disruption to the environment. Discussing the location of the P-1 Channel, Mr. Fetterley said they have worked very cooperatively with the City regarding the rights-of-way and the exact location of the P-1 Channel. The Hearing Examiner inquired as to the location of the excavation of the forebay as to timeliness. Mr. Fetterley replied it was his understanding the linkage between I-405 and the Van Warden tract will have to be completed before completion of all of the measures of the P-1 Channel can be completed. It is his understanding that without a formal dedication of the property, they would still be operating on their own property, therefore, there would be no need for consideration from Soils Conservation Service with regard to their proceeding with excavation, but they would.not provide funds for the excavation. Calling for further testimony in support of the application, presenting comments from staff was: Bob Bergstrom Public Works Department City of Renton 200 Mill Avenue South Renton, Wa. 98055 Mr. Bergstrom reviewed the City process with regard to the issuance of right-of-way permits for streets which involves regulating filling operations across a fire station site. At this point it is the intention of the Public Works Department to issue the applicant a right-of-way permit to fill the streets adjacent to their site. If the applicant chooses to use the haul route across the fire station site, and receives permission from the Fire Marshall, they would also be eligible for a permit, with adequate bonding and restoration being considered as part of the permit approval. The Hearing Examiner questioned the legality of the applicant filling streets felt to belong to the City, without vacation of those streets. Mr. Bergstrom stated that at this point those streets are public streets and if the applicant wants to construct or do partial construction toward an end product that is consistent with street purposes, it is within the power of the Public Works Department to issue a permit to allow those streets to be filled. He will provide the Hearing Examiner with a copy of that portion of the City Code used as the authority on this matter. Discussing haul routes, Mr. Bergstrom stated it is his opinion that there is sufficient capacity on internal Valley streets to handle the material hauling across Lind Avenue. He feels there should be no traffic disruptions if the hours are limited from 8:00 A.M. to 3:30 P.M. If haul was from outside the Valley area then there would be concern regarding the haul routes. Continuing, Mr. Bergstrom stated the P-I Channel project is now in its 2nd phase. The 1st phase was completed approximately 1 year ago using Soil Conservation Service Funds. The 2nd phase was just approved by the City Council. The 2nd phase will extend the P-1 Channel from its present terminus in the old Earlington Golf Course property, south under Grady Way, and down I-405 to S.W. 16th Street. The work will possibly begin in May, 1985. Referring to the alignment he stated the City does have plarfis for full alignment of the project from the forebay into the City of Kent. The portion of the Channel crossing the applicant's property is fixed, and well defined in plans in the Public Works Department office. The Public Works Department will be looking to the applicant for plans for their excavation work in the ensuing fill work. The Hearing Examiner stated to the applicant it is felt the excavation plans should be presented as soon as possible to Public Works, and the dedication of property is a matter between Public Works and the applicant and should not be a condition of the fill permit. Calling for further testimony regarding the application, wishing to speak was: Diana Peffer 16901 - 31st Avenue So. Seattle, Washington 98288 Ms. Peffer read into the record a letter from the Rainier Audubon Society. The letter expressed concern regarding the plants and animals that would be affected if this fill permit is granted. The Audubon Society feels the City is not requiring sufficient mitigation for the loss of prime wetlands and wildlife habitat. It,was suggested that the City look at other ways to develop the site to reduce the loss of valuable habitat, and it is felt the City should adopt a wetlands survey and guidelines for protection of the wetlands. The letter was placed into the record as Exhibit #7. VALLEY OFFICE AND INDUSTRIAL PARK R-012-85 and SP-013-85 _ April 1, 1985 Page 4 Further testimony concerning the application was received from: Paul Chiado Austin Company 800 S.W. 16th Renton, Wa. 98055 Mr. Chiado wanted it noted that he is very impressed with the concern the City of Renton has shown for wetlands. The problem was studied prior to the enactment of LID #314, which caused a large investment by the community through the Public Works Department. It is supported by the taxes and payments of the landowners and he feels considerations of any permanent nature that would have an impact on the landowners who did support the Wetlands Study and LID #314, be supported by permission to develop the subject site. He stated Valley Office and Industrial Park is very interested in the environment, and their financial contribution made for the P-1 Channel and the initiative they are showing in moving ahead with the Channel, should be recognized. The Hearing Examiner asked Ms. Peffer if she had any information as to the nesting habits at the current time as there is concern regarding the loss of habitat at this time of year and curtailing fill operations. The applicant has indicated it was possible they would drain the property now, which would preclude the nesting. She responded that it is possible if the pond were drained at this time the wildlife may either leave the site and try to find suitable nesting habitat elsewhere, provided nests have not already been set or eggs already layed. If drained now, it could deter wildlife from nesting in that area as most are aquatic birds and require plants that are growing in the pond for food. Mr. Fetterley spoke again stating by draining the site now he feels there are still other species that would use the site. The Hearing Examiner indicated to Mr. Fetterly that without plans for the simultaneous excavation of the P-1 Channel, he feels it is difficult to move ahead on the application. The site can't be filled until there is compensating storage and there are no plans for excavation. Mr. Fetterley stated he hoped the decision would be forthcoming as soon as possible, both for their proposal for the property and the environmental concerns for the property. Mr. Blaylock suggested that the recommendation on the rezone request be moved along and the special permit could be held for detailed plans for review in a continued hearing. The Hearing Examiner stated he would allow the record to remain open so the plans could be submitted. The special permit will be held open as it is a separate application for a separate site and they will have to submit a site plan for the excavation: He stated he will make a recommendation to the City Council on the rezone application. There was a final call for testimony in favor of, or in opposition to this application. There was no one else wishing to speak, and no further comments from staff. The hearing was closed at 10:25 A.M. FINDINGS, CONCLUSIONS & RECOMMENDATION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS 1. The applicant, Valley Office and Industrial Park, has requested approval of a reclassification of approximately 11.8 acres of property from G-1 (General; Single Family Residential; Minimum lot size - 35,000 sq ft) to M-P (Manufacturing Park). 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject site is located at the southwest corner of East Valley Road and S.W. 19th Street. VALLEY OFFICE AND INDUSTRIAL PARK R-012-85 and SP-013-85 April 1, 1985 Page 5 6. The subject site was annexed into the City by Ordinance 1745 which was adopted by the City Council in April, 1959, as amended by Ordinances 1764 and 1928 adopted in May, 1959 and December, 1961, respectively. The site, upon annexation, was automatically zoned G-1, which remains its zoning category. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of manufacturing park/multiple option types of uses, but does not mandate such development without consideration of other policies of the plan. 8. A number of rezones (i.e. R-013-83; R-002-85) in areas covered by the Green River Valley Comprehensive Plan have included conditions limiting development to non-retail uses, while the City Council rejected one rezone which would have permitted solely retail uses (R-056-84). These actions were intended to provide compatibility with the goals of preserving for, manufacturing and warehousing uses, land particularly suited for those purposes, and further, to avoid the interaction and conflict between ordinary retail customers and their passenger cars and larger tractor and trailer truck rigs. 9. These restrictions on retail use were required even before the new Comprehensive Plan amendments, which specifically require that all uses serve the particular and special needs of the industrial area. The Plan emphasizes that general retail uses are inappropriate in this area. 10. The requested rezone would include within its boundaries the following platted and dedicated public streets: Taylor Avenue S.W., and portions of Maple Avenue S.W., and S.W. 21st Street. 11. The entire road system in the Valley has been improved within the last few years, and new water and sewer lines have been installed to accommodate new development pursuant to the directives of the Comprehensive Plan. 12. New development has occurred both north and south of the subject site; north of 16th Street and south of S.W. 41st Street. New development has occurred west of the site along Lind Avenue S.W. and further west along Oaksdale, Burlington Northern is developing substantial acreage. 13. Development of the subject site would require filling to bring the site above the 100 year flood level. An application for filling the site has been requested and is pending. Any filling of the subject site will require compensating equivalent storm water holding capacity to be excavated elsewhere in the basin. 14. No traffic analysis was done for the subject site, but any development will increase the average vehicle trip count over the existing amount for a vacant site. The URS Traffic Study indicated that the growing traffic impacts in the valley will adversely affect the existing Level of Service (LOS) for critical intersections. This office takes notice that retail uses generally generate greater vehicle trips than do manufacturing and general warehousing operations. CONCLUSIONS 1. The proponent of a rezone must demonstrate that the request is in the public interest, it will not impair the public health, safety and welfare and in addition, complies with at least one of the three criteria found in Section 4-3010, which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been a material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. The requested reclassification is justified and should be approved by the City Council subject to the conditions indicated below. 2. The Comprehensive Plan designates the site for manufacturing park uses which the M-P zoning would permit. Obviously the G-1 zoning which permits large lot single family uses is not inapproriate for the site in the heart of a growing industrial area.. • VALLEY OFFICE AND INDUSTRIAL PARK R-012-85 and SP-013-85 April 1, 1985 Page 6 3. The area is now served by improved roads and is serviced by storm drainage, sewer and water utilities, and should be able to support the potential development permitted in an M-P zone. The increased traffic appears to be a potential problem as indicated in the URS Traffic Study and therefore, to minimize traffic covenants restricting the uses on the site to manufacturing and warehousing in conformance with the Comprehensive Plan's policies and goals appears warranted. Similar restrictions have been placed on other rezones, and some rezones have been rejected for proposing retail use. Consistency would appear to indicate that such a restriction recommended by staff for a rezone within the last month similarly be applied to the subject site. 4. % Since the current Comprehensive Plan seeks to discourage retail uses, the implementation should begin at the rezone stage if possible. The covenants should therefore prohibit the development of those uses permitted in the B-1 zone, other than office uses, which are not predominately supportive of the industrial area. 5. With the imposition of those conditions and the mandatory site plan review required by the M-P zoning and separately required of sites which have been filled, the City Council should approve the reclassification of the subject site. RECOMMENDATION The City Council should reclassify the subject site from G-1 to M-P subject to the filing of restrictive covenants prohibiting B-1 uses, other than office use, which permit retail operations not supportive of the goals of the Comprehensive Plan. The ERC indicated that a sensitive situation exists on the site since water fowl, raptors and Great Blue Heron do use the ponds and marsh-like aquatic environment as a mating, nesting and foraging site. Since the issue has come before this office, inferences have been made that the applicant could eliminate or alter the existing environment without City approval. That would appear to be incorrect since City property, the various street rights-of-way, run through the subject site. One of the rights-of-way, Taylor Avenue S.W., approximately 38,480 sq ft in area, runs almost through the middle of the site, so it would appear that the City has a legitimate concern as expressed by the ERC. In addition, 32,000 cubic yards would , be placed on the wetlands north of S.E. 19th St. as part of a previous fill permit granted on that site. It is understood that to mitigate this action the City of Renton would require the developer to excavate 83,500 cubic yards of this site for the P-1 Channel to compensate for flood storage. However, at this time the final design configuration of the P-1 Channel is not finalize and the city has not aquired the right-of-entry for. excavation and construction of the actual channel . An environmental checklist of the site was submitted to the City of Renton on Feb. 1 , 1985. It is very brief and the level of information is incomplete , and incorrect in several sections. However, I will limit my discussion to the plants and animals sections. Plants- There is no discussion of the wetland plant communities. ' "Wetlands are vital areas that constitute a productive and valuable public resource, the unnecessary alteration of destruction of which should be discouraged as contary to the public interest" U.S. Army Corps of Engineers 33 CFR 320.4 (b) (1). Wetlands are among the most productive biological systems and support a wide variety of plants and animals. Wetlands function as important feeding, resting, and nesting habitats. Wetlands are important to maintaining high water quality. Animals- Hawks,, great blue herons, songbirds, waterfowl , and shorebirds are species found on this site year around. Five species of waterfowl are currently known to nest on this site. Many other species of ducks are present during the fall , winter, and spring. Significant wildlife resources are usually defined as having either institutional , public, and/or technical recognition. Waterfowl are considered institutionally important species because they are included in state management plans due -to their economic importance. Great blue herons are listed as *a proposed monitor species by the Washington Department of Game due to public recognition. These species are presently found on this site. Their presence should require at least an expanded environ- mental checklist or limited scope environmental impact statement be prepared to determine the level of impacts this project would have on these species. It is felt that the City of Renton is not requiring_ adaquate mitigation for the loss of prime wetlands and wildlife habitat. There are several very positive ways the site could be developed and also reduce the loss of valuable habitats. The construction of the P-i Channel could be sloped at 5:1 and wetland plant species planted along the banks. The storm runoff collected in the grass swales could be directed to a smaller size pond (which could be left unfilled). Islands could be created in the pond for waterfowl nesting. The proponent could provide funds to the City of Renton to create wildlife habitat in an area the city selects. These are just a few suggestions of possible alternatives to include in the proposed action. I hope you will consider these as options before giving approval of the special fill permit. One last note, it is suprising to me that the City of REnton does not recognise the value of wetlands. There are sensitive area ordinances (adopted or proposed) to protect these ecologically sensitive areas in Seattle, Bellevue, Kirkland, Kent, and King County, most of the surrounding lands. I strongly recommend that the City of Renton work towards protection of its remaining - valuable wetland resources.- This could be started by adopting the completed wetlands survey and proposing guidelines for protection of these wetlands. In addition, 83,500 cubic yards will be excavated from the right-of-way of the P-1 Channel to provide compensating flood storage. 2. The proposal complies with the intent of the Comprehensive Plan land use designation of Manufacturing Park/Multiple Option-Office. 3. The Environmental Review Committee has issued a Declaration of Non-significance for the subject proposal but, in addition, has issued a memorandum regarding the timing of the fill operation to minimize the impact upon nesting of waterfowl in the wildlife habitat. REZONE: 4. , The Hearing Examiner must review four specific criteria under Section 4-3014(C) to determine that the circumstances surrounding the request are adequate to recommend approval of the reclassification. The following evidence clearly demonstrates the rezone request is appropriate: a. That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis and area zoning. The subject site was annexed into the City in 1959 and has not been considered for a zoning reclassification since that time. b. That the property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the Comprehensive Plan, and conditions have been met which would indicate the change is appropriate. • PRELIMINARY REPORT TO Tr-t. HEARING EXAMINER VALLEY OFFICE AND INDUSTRIAL PARK: R-012-85, SP-013-85 MARCH 26, 1985 PAGE 3 The proposed rezone complies with the Comprehensive Plan map designation of Manufacturing Park/Multiple Option-Office. The ultimate use of the property has not been declared by the applicant at this point but could be limited by future changes in the Zoning Code. The Manufacturing Park zone is presently under consideration for modification to more strictly comply with the intent of the recently adopted Comprehensive Plan. Until a specific use is delineated, a precise statement of whether or not it complies with the intent is inappropriate. c. That since the last previous land use analysis of the area zoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone significant and material change. Since the original annexation of the property in 1959, the City has undertaken major public improvements to resolve both the access and • storm water drainage problem of the Green River Valley. Within the last two years, the City has spent in excess of $10,000,000 making major improvements to this immediate area. Development has increased substantially, especially since the resolving of the P-1 Channel drainage system north of I-405. It would therefore appear• that substantial changes have occurred in the general area which would support the rezone request. d. The final test to determine whether a rezone is appropriate is to address the question of timeliness. The proposal appears timely in that public facilities and services are now available to allow the development under the intended use of the Comprehensive Plan. SPECIAL PERMIT: 5. The special permit request submitted in conjunction with the rezone request includes the filling of 11.8 acres with approximately 249,700 cubic yards of material. Of this total volume, 83,500 cubic yards would be excavated from the P-1 Channel to provide compensating flood storage. In addition, 32,000 cubic yards, which will be utilized as preload for the building pad area, will be moved to the property north of S.E. 19th Street as part of a previous fill permit granted on that site. ISSUE: 6. Does the City need to grant special _permit approval .for activity in the proposed P-1 Channel area? The applicant proposes excavating approximately 83,500 cubic yards of material from the P-1 Channel south of S.W. 16th Street. However, the applicant has not provided detail plans showing the specific design configuration for location. At the same time the Public Works Department has not completed a thorough program of where the P-1 Channel will be located and its final design configuration. Valley Office and Industrial Park states clearly that they will be able to utilize their property to provide this compensating storage. Neither the applicant nor the Public Works Department have provided supporting documentation concerning this issue. The entire item should be presented before the Hearing Examiner at the scheduled public hearing to provide sufficient information for the Examiner to make a decision. ISSUE: 7. The applicant has not stated the hours of operation. The hours of operation combined with the estimated time to fill the site creates the traffic congestion function. Typically, hours of operation have been limited from 8:00 a.m. to 3:30 p.m. in the Valley so that it does not conflict with the p.m. peak hours. Based upon a total of 249,700 cubic yards to be moved, a total of slightly less than 25,000 vehicle trips utilizing 10-yard dump trucks could be anticipated. PRELIMINARY REPORT TO THE HEARING EXAMINER VALLEY OFFICE AND INDUSTRIAL PARK: R-012-85, SP-013-85 MARCH 26, 1985 PAGE 4 If this traffic volume were concentrated in a two-week period, approximately 5.5 trucks would have to dump material on the site per minute. Looking at another alternative, if Saturdays and Sundays were utilized from 8:00 a.m. to 5:00 p.m.during the same two-week period truck traffic would be reduced to 3.75 trips per minute. It is more probable that the fill activity will take approximately a month in time and result in the neighborhood of approximately 1.87 to 2.75 truck trips per minute. The applicant has not sought or argued the point that extended hours of operation may be appropriate because of the distance from any residential areas. Traffic and noise are primary concerns in the fill operation. It might be appropriate to utilize evening hours until 10:00 p.m. for filling operations. If the applicant were granted evening filling and also weekend filling, it is estimated that still over an eight-week period (two months), approximately .6 truck trips would enter the site per minute. The City should not assume that the fill activity will be equally divided over a nine-month period as stated in the environmental documents. A worst-case situation should be evaluated. ISSUE: ' 8. The applicant has not specifically stated the location that the fill material is coming from or the anticipated haul routes. Should the City issue a special permit without recognizing where the haul routes are? The City of Renton's primary concerns have been the traffic congestion associated with fill and the cleaning of public streets. The applicant has provided no information as to the direction or intensity of the truck traffic in relationship to time, nor have they suggested any methods of clean-up or their responsibility for the safe operation of the truck route. ISSUE: 9. Should the City of Renton consider the existing value of the wildlife habitat and the pending nesting season? The City of Renton recognized and made the decision that with the construction of L.I.D. 314 that both of the subject sites would be drained and filled. This only supported the previous decision of the City to implement the P-1 project by constructing and maintaining it in conjunction with the federal government. The specific environmental review conducted for the P-1 Channel included wildlife mitigation to satisfy the demands of the Eastside Watershed Project. Therefore, that should be the established norm. The Environmental Review Committee questioned the specific timing of the fill because it would appear to conflict with the nesting season. The Environmental Review Committee referred the specific timing issue to the Hearing Examiner to hear the merits of the experts before a public hearing. The primary issue is whether the nesting areas should be eliminated in 1985 or will be eliminated in 1986. The wildlife is not actually displaced but in fact eliminated with the removal of the site from the natural environment. The bird life that would frequent this location now must compete with other wildlife that is already established in other areas; therefore, the secondary issue is whether it matters if the nesting season is allowed to continue this year or eliminated. The nesting seasons varies based upon the individual species. Normally, it appears that the nesting season ,runs from mid-March through mid-August. However, the young waterfowl cannot fly to change their area of habitation until apparently the middle of September or early October. So the'situation exists that either the wildlife could be precluded from nesting at this point or the fill activities should not occur until October 1st. PRELIMINARY REPORT TO THE HEARING EXAMINER VALLEY OFFICE AND INDUSTRIAL PARK: R-012-85, SP-013-85 MARCH 26, 1985 PAGE 5 The applicant has argued that the delay until fall creates an undue cost upon the developer. In the fall, the fill material becomes heavier with the introduction of rainwater. 10. The Public Works Department has commented that the area designated for the P-1 Channel and owned by the applicant should be dedicated at this time so the City can acquire the right of entry for excavation and construction of the actual channel. The appliant has argued that the City needs to provide • detailed plans to show them where the Channel will be. At the same time, the Building and Zoning Department believes that the special permit request may be premature without tying down the specifics on both the location and design of the 83,500 cubic yards of material to be excavated for compensating flood storage. In any case, a detailed program needs to be submitted by both the Public Works Department and the applicant to address the specific issues of location. L ' 11. By the time both the Public Works Department and the applicant provide the detailed information, the issue of whether the nesting season should be eliminated or allowed to continue may be a moot issue. ISSUE: 12. Should the City of Renton issue a special permit for fill and grade on property that is not legally owned by the appliant? The applicant proposes filling 11.8 acres of which a portion is owned by the City of Renton in the form of a legal rights-of-way for public streets. The applicant has not applied for a right of entry through the Public Works Department nor for a vacation of that right-of-way. In addition, the applicant has not sought the City's joint endorsement for filling the subject right-of-way. Therefore, it would appear that the application may be ' premature in that there has not been an understanding reached with the City of Renton concerning filling of those public roadways. 13. In conclusion, the evidence does not support the granting of the special permit for fill and grade. Too many issues remain unresolved. RECOMMENDATION: Based upon the above analysis, it is recommended that the Hearing Examiner recommend approval of the rezone request, file R-012-85, to the City Council. I have noticed and recorded the following: Nesting activity is very apparent for many specied of waterfowl that frequent our area. Mallards are predominiate speices that I have found clutched and nestlings. Canade Geese have been observed with young, as have Northern Shovelers, Common Goldeneyes, Buffl:eheads, American Coots are very common and nest i'n, the area. I have also observed Long and Short -billed Dowitchers, Killdeer ( four nesting pairs last year) and nesting Red-winged Blackbirds. On a few occasions I have observed Ruddy Ducks with young, but not determined whether they were nesting in the area. Recently observed-Ring-billed Ducks and One pair of Hooded Mergansers display coursthip behavour. On various times I have observed mature Great Blue Herons along the shoreline of the ponds. They were seen feeding in these areas where they had not been seen in the general area before. One raptor that frequents the area is the Northern Harrier. There is• a distinct pair seen hunting over the open fields surrounding the pond. Without my field journal available, I am unable to continue with my findings. For a matter of record and general information I am a member of the Seattle chapter , of the Audubon Society, and Black Hills Audubon in Olympia. I am a member of the National Wildlife Federation and recently graduated from a Bird Biology Course from Cornell University in New York. I am currently enrolled in the science department programs at Green River Community College, and lastly, a concerned citizen about losing wetlands of this nature. The general nesting of the species listed is approximately mid March through August.
