And the Court being otherwise fully advised in this matter, now, therefore, having
2 considered the foregoing, this Court finds that plaintiff is entitled to summary judgment
3 against defendant;
4 IT IS HEREBY ORDERED, ADJUDGED AND DECREED, as follows:
5 1. That plaintiff's Motion for Summary Judgment to Quiet Title is GRANTED;
6 2. Thai title to the real property commonly located at 3447 Lincoln Dr. N.E.,
7 Renton, King County, Washington 98056, and legally described as shown in EXHIBIT A
s attached hereto and incorporated herein by this reference, is quieted and vested in the
9 plaintiff, CITY.OF RENTON, a municipal corporation, subject to the following restrictive
ib covenants that shall run with the land:
11. a. that the property shall only be used as a public park to be called
12 "Kenyon-Dobson Park;" •
13 " • b. that the trees upon the park property shall be left standing;
14 c. that the park property shall be minimally developed as set forth in the
15 restrictive covenants;
d. that the City. of Renton, or its successors, shall receive no..economic
16
17 gain or benefit from the operation of the park property and that no admission fee shall
is be charged to the public for access to or use of the park property, nor shall any
•
19 commercial activity for profit be permitted on the premises;_
20 e. that no additional installations or easements shall be permitted by the
21 City of Renton, or its successors, in or on the park property other than those that existed
22 on December 11, 2008, the date of Arthur R. Kenyon's death, or which previously
23 existed of public record in the chain of title for the property;

f. that signage identifying the name of the park property as Kenyon- ,

Dobson Park" and the City of Renton's rules and regulations for use of the park by the

3 public, including a vehicle parking lot and a portable toilet, shall be permitted on the
4 park property; -
5 g. that the park property shall only be used as a natural woodland, open
6 green-space area park in perpetuity for the benefit of the public;
7
h. that no roads or utility/cell tower and wireless network installations,
e outdoor area lights or other intrusions that might facilitate degradation of the park
9 property shall be permitted;
io
i. that no vehicular access shall be permitted through the park property
11
(Kenyon-Dobson Park)to May Creek Park from any road; and
12
k. that public access through the park property shall be limited to hiking
13 trails.

3. That taxable costs as provided by statute are awarded to plaintiff, City of
15
Renton, against defendant, Estate of Arthur R. Kenyon.
