Upon my arrival, I confirmed there were no complaints of injury requiring immediate medical response at the time of report. There, I was able to collect each involved party's information and independent summary of the events leading up to the collision. The driver of Unit#1, identified as Edelma Lopez-Leveron, stated she was traveling westbound on NE 4th St and approaching the 3800 block when she attempted to make a left turn. Edelma was intending to enter the parking lot of the Maplewood Apartments. While yielding for eastbound traffic, a vehicle in lane 2 of 2 stopped and created a gap in traffic to allow her access to the parking lot. As she proceeded through the traffic opening, Edelma failed to see Unit#2 traveling eastbound in lane 1 of 2. Both vehicles collided in the roadway causing severe damage Unit 1's passenger front fender and wheel. I then spoke with the driver of Unit 2, identified as Liana Schehr, and she explained she was traveling eastbound on NE 4th St and approaching the Maplewood Apartments when the collision occurred. Liana intended to continue east, when Unit#1 turned in front of her near the 3800 block of NE 4th St. Liana stated she was unable to avoid the collision and subsequently struck the passenger side of Unit #1. Unit #2 sustained moderate damage to the front bumper. Both vehicles sustained moderate damage and needed to be towed away. Edelma stated she privately contact her own tow, but Liana's vehicle was removed by Bankers Towing. Based on the above statements, I determined that the Driver of Unit#1, Edelma, is the proximate cause for the collision due to not granting the right of way during a left turn causing a collision. The driver of Unit#1 violated RCW 46.61.185(1) by being the driver of a vehicle intending to turn to the left within an intersection and not yielding the right-of-way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate hazard. The driver of Unit#1 did not grant the right of way to Unit#2 traveling in the roadway which had the right of way and was already underway. Due to Unit#1 having to traverse across oncoming traffic, the driver of Unit#1 must wait until the intersection is clear of hazard prior to proceeding. Edelma stated she her vehicle was uninsured.
