SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval with conditions Hearing Examiner Decision: Site Approval request is approved. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on January 28, 1986. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public • hearing on the subject as follows: The hearing was opened on February 4, 1986, at 9:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication, and other documents pertinent to this request. Exhibit #2 - Map showing parking lot in Phase II. Exhibit #3 - Vicinity Map. A review of the staff report was presented by the Zoning Administrator, Roger Blaylock. Mr. Blaylock stated the requested 61 parking stalls are not required parking for Phase II, (but were requested by their leaseholder), and are not a part of Phase II as they will ultimately become a part of the development of the adjacent building to the west. The site is west of Phase II, with access being through Phase I to the north as well as through Phase II via access roads provided by the applicant for access through the entire site. This proposal meets the goals and objectives of the Comprehensive Plan, services, are available to the area, and the Environmental Review Committee said that any structures built in Tract B would necessitate the construction of Oaksdale Avenue. Mr. Blaylock continued with a review of the comments received by staff noting all departments except the Utility Engineering Division approved the proposal with certain requested conditions. Reviewing the criteria to be considered for site plans it was noted that the parking lot is compatible with the Comprehensive Plan and Zoning Code, meets landscaping and maneuvering requirements, access is through the property to the east which also provide an extension to the next facility that will be built to the west, and public access to Tract B will be on Oaksdale when it is constructed. Continuing, Mr. Blaylock stated Phase I, due to the configuration of the buildings, the alignment of the parking aisles does not run in a north/south pattern. From a design point of view, in a parking lot where aisles running through the lot are off-set, it tends to create more confusion for the user and a potential for traffic hazards. It was recommended that the emergency access be chained or gated so the parking lot is not used for general circulation. Mr. Blaylock discussed this portion of the site and how it interrelates to the rest of the site, and the functional intertie with the entire property. He stated Phase II is at a building stage where the parking stalls and aisles could be realigned, and recommended this proposal with modifications to its design to align the western boundary with the north lot which will create a large landscaped area which can be utilized by the office users on Phase II. First City Equities SA-105-85 February 14, 1986 Page 2 Calling for testimony from the applicant or their representative, responding was: Barbara Moss 800 Fifth Avenue. Suite 4170 Seattle, Wa. 98104 Ms. Moss responded addressing certain design criteria contained in the staff report stating the purpose of adding the parking lot is to address the market demand for increased parking above that required by City code. Referring to the functionality of the parking lot she stated it is the applicant's feeling that the parking lot should not function as a drive-thru between Phase I and Phase II but have the two phases interrelate with the use of sidewalks; changing the parking lot behind Phase II, she said infrastructure is already installed, paving will begin next week on the parking lot, and if there is a need to redesign it will make a major impact on the building program for the Phase II parking lot. Also responding for the applicant was: Royce Berg, Architect 114 Vine Street Seattle, Wa. 98121 Mr. Berg referred to some of the staff comments regarding utilities and landscaping which he stated will be no problem to change to meet the suggestions of staff. Alignment of parking north and south, he said initially the parking did not align but when the parking extension was added to Phase. II it still did not align so they eliminated the access lane in Phase I behind the westerly most building and replaced it with landscaping thereby forcing traffic to turn, creating a major east/west access point from Powell Avenue to Oaksdale Avenue. This move also aids in circulation through the property for emergency vehicles. Mr. Berg briefly reviewed the 'master plan' for the entire site with regard to projected traffic, access points to be utilized, pedestrian traffic and landscaping. There was no one else, in the audience and no one wishing to testify in opposition to this proposal. A comment was offered by the Hearing Examiner suggesting applicants work with the Building and Zoning department on requests for additional parking (above what is required by City code) in the future. There has been a concern expressed by Metro on previous applications 'in this area with regard to the use of carpools, ridesharing and transit to and from these Valley sites, and the suggestion of future applicants being required to set up some type of Transportation Management Plan to try to alleviate further traffic impacts in the area and encourage use of the transit system. There being no further testimony or comments, the hearing was closed at 9:45 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, First City Equities, has requested approval of a Site Plan for a parking area containing 61 parking stalls. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject site is located in the southeast corner of Tract B of the Washington Technical Center Plat. The site is just west of Phase II of the Valley 405 Office Park, west of Powell Avenue S.W. and north of S.W. Grady Way. :,. First City Equities SA-105-85 February 14, 1986 Page 3 6. The subject site was annexed into the City by the adoption of Ordinance 1745 in April, 1959, as amended by Ordinances 1764 and 1928 adopted in May, 1959 and December, 1961 respectively. The site was automatically zoned G-1 (General: Single Family Residential; Minimum lot size - 35,000 sq ft) upon annexation. The site was rezoned to M-P (Manufacturing Park) in August, 1979 by the enactment of Ordinance 3344. The final plat was approved in July, 1982. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of Manufacturing Park/Multiple Option uses, but does not mandate such development without consideration of other policies of the Plan. 8. The applicant is proposing developing a parking lot to serve an already approved 3 story office building which would be located immediately east of the suject site. A 242 stall parking lot has. already been provided to service the building, but the applicant has a tenant who requires additional parking. 9. Staff has recommended that landscaping be added and that the alignment of the parking aisles be adjusted to coincide with adjacent parking aisles. 10. Metro Transit has provided comments which are applicable to development of the proposed parking area. Those comments concern the affects expanded parking has upon alternative .transportation modes. Additional parking stalls serve as a disincentive for employees to use mass transit, van pools or car pools. The extra parking is an invitation to use more single occupant vehicles (SOV). CONCLUSIONS 1. The proposed parking lot appears to serve the public use and interest although the issue of parking supply in relation to traffic generation cannot be lightly ignored. Particularly when traffic impacts have been a continuing concern for the various parcels of the Washington Technical Center Plat, providing parking which invites additional vehicle trips probably deserves more analysis than is provided. Total traffic generation was an issue during preparation of the original EIS for the development of the subject site and has been explored for each new development. 3. Staff has not analyzed the impacts of parking supply on traffic generation but should do so for future development. While City standards provide a minimum level for parking for a 'particular use, it may just be that a ceiling may also be required, especially in light of the anticipated traffic impacts in and around the Green River Valley. 4. The general review criteria for site plans does not appear completely relevant since only a parking lot is being developed and no building is involved. While staff was concerned about the interrelation of the various parking lots proposed for the subject site and also the intertie with surrounding parking, the applicant indicated that they do not want to create a defacto street, but rather a parking lot with limited speeds.. Through aisles would provide an invitation to speed, while the proposed alignment, or lack thereof, would avoid this situation. 5. The parking lot'will be landscaped to blend with the principal or original parking area. Aisle width will permit emergency access and otherwise meets code requirements. 6. The ultimate plans for the remainder of Tract B are not under review and remain speculative at this point. A circulation pattern which incorporates the subject parking area, and the adjacent eastern and northern parking areas to connect to development west of the subject site may need additional exploration. There are a great many cars and aisle intersections at other than 90 degree angles which complicate manuevering. The use of parking areas to provide through circulation between arterial and feeder/collector streets may therefore, be inappropriate and should be subject to additional analysis. 7. Staff and the applicant are on notice that the issue of providing excess parking capacity and utilizing parking areas to provide cross circulation routes should be more thoroughly reviewed in future requests. 1 , r • First City Equities SA-105-85 February 14, 1986 Page 4 DECISION The proposed parking lot is approved. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing, Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. For purposes of these decisions and recommendations the terms "Should" and "Shall" are to be considered mandatory. The term "May" will be considered discretionary. The proposal generally complies with the Comprehensive Plan designation of, Office Park for the subject site and provides supporting parking facilities for the development of an office park. It also complies with the minimum, dimensional requirements of both the parking and loading ordinance and the zoning code designation.of M-P, Manufacturing Park. 3. The Environmental Review Committee has issued a declaration of non-significance for the subject proposal. The appeal period will expire on Monday, February 3, 1986, at 5 p.m. 4. Various City departments have reviewed the proposed construction of the parking lot. The Building Division, Engineering Division, Parks and Recreation Department and Police Department have all recommeneded approval without comment. The following departments have recommended approval, approval with conditions, or denial with the following conditions: • Zoning Division: Approved. Suggest incorporating evergreen shrubery and evergreen trees into the landscape design of parking lot. January 8, 1986 • Policy Development Department: Approved. In the review of site plan, the staff and the Hearing Examiner should normally consider the following criteria: • Compatibility of Adjacent Structures • Compliance with the Comprehensive Plan and Zoning Code • Access (Both General and Emergency) • Functionality of Parking Lot • Traffic Circulation (Both Onsite and Offsite) • Pedestrian Circulation • Usable Public Open Space • Onsite Recreation It appears that only five of the eight criteria are actually appropriate. The criteria dealing with compatibility of adjacent structures, usable public open space and onsite recreation are not appropriate in the discussion. Compliance with the Comprehensive Plan and Zoning Code: The subject site is located in an area that is rapidly undergoing a transition from undeveloped property to high intensity office park uses. The client, the Boeing Company, believes that the availability of parking is critical to their operation. In fact, in this application they are oversupplying parking above that required by City code. Therefore, the parking lot presently stands on its own but must be functionally tied to the adjacent use and at the same time allowed to be separated when other future functions demand parking for code requirements. The proposal does comply with the intent of the Comprehensive Plan and the specificity of the zoning code. Access: The access to the parking area will be initially through the adjacent development site of Phase II. It will initially support Phase II but in the future may support the new development to the west. Emergency access is also provided through the same east-west access routes that will be continued across the development site of First City Equities Valley 405 Office Park. SA-105-85 FEBRUARY 4, 1986 PAGE 4 Functionality of the Parking Lot: The parking lot has a critical design problem in that it does not blend with the development to the north and creates some serious jogs in circulation that might intimidate the individual motorist. Not only will Boeing occupy, Phase II development but it is presently occupying the three buildings to the north. The most logical solution to align the parking aisles is to provide more landscaping and open space adjacent to_the Phase II building. However, we are not discussing the site plan for Phase II which does comply with the code. The proposal as submitted for the parking lot also complies with the code, but from a design standpoint it creates complications in function and maneuvering of automobiles on the site. One interesting side issue arises in that more parking is provided than originally estimated by City code and staff. We would envision that the building itself will have more employees, thus, a greater need for onsite recreation and public open space. Traffic Circulation: Offsite traffic circulation has been addressed in the updated traffic study provided. Some modification will have to occur as incremental increases in employment population is established. Onsite traffic circulation is difficult at the interface between the building lot to the north and the subject site. Pedestrian Circulation: The site plan continues the pedestrian circulation to the projects to the west. There does not appear to be any major problem associated with pedestrian circulation in the project as presented. ISSUE: WHAT IS SITE PLAN APPROVAL? 6. Site plan, approval is a land use review process that analyzes site layouts in more depth than just the compliance with the City code. City departments: can administer the City code as is specifically prescribed. How the individual' pieces of property interrelate with one another becomes critical in the site! plan process. Therefore, the site plan as presented should not be considered, acceptable and should be rejected by the Hearing Examiner. 7. In conclusion, the proposal meets the specifics of the zoning code and the parking and loading ordinance. It complies with the intent of the Comprehensive Plan. However, from a design standpoint the proposal lacks the fine tuning necessary to make it function at its optimum level. The site is functional and meets minimum functional standards. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis the site plan request, file number SA-105-85, by First City Equities, should be approved subject to the condition that 25 feet of landscaping be placed adjacent to the building in Phase II and that the parking aisles align with the development established to the north of Phase II and the subject site. The Building and Zoning Department realizes that this modifies the Hearing Examiner's approval on Phase II, but the applicant is seeking approval of a parking area that would support the tenant proposed for occupancy in Phase II. Therefore, we believe it warrants reconsideration in the context of the adjacent developments. Development of the parcels adjacent to Tract 'B' by First City Equities and Holvick, deRegt and Koering (HDK) have been short of parking spaces on existing lots. In order to accommodate proposed parking, lot line adjustments have been approved in which a portion of Tract 'B' is added to the adjacent lots. These lot line adjustments for parking lot areas raised the question of whether Oakesdale needed to be constructed. On October 30, 1985, the ERC upon review of a new traffic analysis determined that "... parking lots can be constructed on Parcel B without the implementation of the condition to construct Oakesdale Avenue.
