Washington 98119 RE: BUILDING 11/SA-106-85/HEARING EXAMINER CONDITIONS Dear Mr. Gardner: The Hearing Examiner in his approval of site plan. file SA-106-85, included four provisions; The implementation of those four provisions is under the authority of the Building and Zoning Department. It is our position that the following circumstances affect our department's implementation of those four conditions. 1. The Hearing Examiner required that "parking and aisle width shall be modified as generally demonstrated on exhibit #2. including the modification of turning radii. elimination of parking immediately north of building #11, and the provision of a "plaza" emergency drive across the rail line in the center of the site." The site plans as presently submitted by your firm complies with the intent of the first three provisions. However, the fourth issue of a "plaza" emergency drive across the rail line in the center of the site has not been addressed. This may be a result of the fact that you have provided adequate circulation and turning radii to the north by relocating the primary east-west drive through the site to connect into future building site #12. The plaza is still a requirement that the Hearing Examiner imposed. The site plan for building #11 should be made by your firm at this time to include the plaza. There is the possibility that you could increase the pedestrian corridors along the south side of the east-west access drive to create a "plaza" effect. 2. The Hearing Examiner also required that "the provision of a pedestrian easement from the cul-de-sac to the springbrook public right-of-way." - Douglas Gardner March 4, 1986 Page 2 The easement is already provided on the underlying plat. However, improvement of that easement was contemplated during the public hearing, and the Building and Zoning Department would interpret the provision to mean the actual construction of interconnection with the Springbrook public right-of-way. 3. The third provision the Hearing Examiner required was "the provision of one acre of recreational facilities near the southwest corner of the subject site." Your firm has shown the set aside area of one acre to meet the intent of this provision. However, setting aside does not specifically 'comply with the intent to provide "recreational facilities." Therefore, the Building and Zoning Department will require that a recreational plan showing the actual facilities to be installed be approved at the time of building permit issuance. Please be aware that these plans may be modified if you decide to redesign building #12. 4. The Hearing Examiner also required that "landscaping shall be provided in accordance with the language and conclusions 8 and 9 above." The Hearing Examiner was specifically pointing to the fact that the development should create a campus-like setting and heavy landscaping should be required around the perimeter that blends all of the facets from an aesthetic point of view. This item will be carefully evaluated by the City's landscape architect at the time of building plan approval. February 26, 1986, and determined that the conditions that were originally implied on the Orillia Properties project for the BECO Company can be clarified as follows: 1. Environmental conditions concerning the payment of fees for traffic mitigation shall be in the form of a letter of credit issued to the City of Renton. 2. The traffic signal at S.W. 39th Street and Lind Avenue S.W. had previously been determined to be installed by September 1, 1986 under a previous negotiated agreement. A total of $100,000 can be credited for the construction of this signal. This amount does have to be included in the letter of credit, if construction plans are not approved for the traffic signal prior to issuance of a building permit. (Plans should be approved in the next 90 days to assure installation of the traffic signal by September 1, 1986. 3. Payment of traffic mitigation fees will be at the time of issuance of the building permit in the form of a letter of credit specifically applied to the trip generation for that building. The letter of credit will be open ended without a date of expiration. However, all off--site traffic mitigation shall be completed no later than March 1, 1987. 4. The Environmental Review Committee since it is waiting upon additional information to prioritize the necessary traffic improvements in the entire Green River Valley Planning Area as determined cannot prioritize at this time specific improvements the developer can accomplish in lieu of actual payment of fees. The Environmental Review Committee by September 1, 1986 will provide the developer with a prioritization schedule and a time schedule. Douglas N. Gardner March 3, 1986 Page 2 5. The Environmental Review Committee cannot commit to a position on whether refunds will be appropriate under the methodology established for the implementation of the necessary traffic improvements. It can only be assumed at this time that if the final calculations are less than $175 per vehicle trip then apOlication may be made for credit consideration. The Environmental Review Committee has taken the above positions based upon the methodology for implementing the necessary traffic improvements. This was the primary reason to require letters of credit instead of actual posting of cash deposits to the City treasury for the traffic impacts associated with the development. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on January 28, 1986, at 10:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of publication and posting and other documents pertinent to this request. Exhibit #6 - by reference, yellow file for SA-100-85. • The hearing opened with a review of this request by the Zoning Administrator, Roger Blaylock. The applicant wishes to construct 2 buildings totalling 153,300 sq. ft. of office space on 10.48 acres. The property is designated as Manufacturing Park/Multiple Option on the Comprehensive Plan, and is unique in that the angle created along the northwestern boundary of the property is the alignment of Springbrook Creek and part of the storm water drainage facility for the area. This property is triangular in shape and provides access onto a public street on one side. Continuing, Mr. Blaylock advised there are adequate services provided to the area, with a major parking lot and landscaping currently being completed. The ERC review prompted the requirement of a traffic signal, on-site recreation to be provided along the east side of Springbrook Creek, and a 12 ft. wide asphalt trail capable of supporting emergency vehicles, which means an extension through the property along 34th Street on the north and 41st Street on the south. The site south of 39th Street is not in question at this time. Mr. Blaylock stated there is an estimate of approximately 1840 vehicle trips per day to be generated by these buildings, with the applicant contributing to area-wide improvements due to increased traffic. • Orillia Property Associate; SA-106-86 February 5, 1986 Page 2 • Staff feels this application is compatible with adjacent buildings, meets the goals and intent of the Comprehensive Plan with minor modifications for internal functions, and complies with the zoning ordinance of the City. Located in the middle of this site is a rail line which divides buildings 11 and 12. Access will be from S.W. 39th Street. Both' buildings have separate access. The rail line provides a design problem with regard to turning movements far emergency vehicles. It was proposed by staff that approximately 28 parking spaces be eliminated to provide for pedestrian access between the two buildings. As it is now, the east/west access, to be located on the north side of building #11, will have vehicles backing out directly into the aisleway along the south side of the building, and staff suggests that parking along the north side of the building be eliminated, with the applicant creating a separated internal traffic corridor to link through the adjacent site on the 'east to Lind Avenue S.W.. Mr. Blaylock stated the pedestrian circulation needs to be tied to the site plan to the west and pedestrian walkways that will tie into the trail system along Springbrook Creek. The public pedestrian walkway to be provided will probably always remain open which leads to the desire to have other outdoor recreation located adjacent to the walkway, with the entire area remaining unfenced. In conclusion, Mr. Blaylock stated staff recommends approval of this site plan, subject to the four conditions set out in the report to the Hearing Examiner. Calling for testimony in support of this proposal from the applicant or their representative, responding was: Edward Heavey 201 Elliott Avenue West, Suite 400 Seattle, Washington, 98119 Mr. Heavey addressed the parking as it relates to building 12 stating the north easterly 305 ft. of the lot containing building 12 is necessary for parking for the occupants of building 11. A lot line adjustment is to be processed which will include parking on both sides of the aisle closest to building 12. Mr. Heavey stated if the lot line adjustment creates a setback problem for building 12, that building will be moved slightly to the south. The railroad line is to be moved and the right-of-way is to be vacated, with that portion of the property becoming a part of the site plan. Mr. Heavey requested when that is accomplished that they be permitted to revise the site plan so the space can be utilized._ Mr. Heavey said Boeing Company will be utilizing Building 11 on June 1st and will be moving their facility from Kent to Renton. With this in mind, due to their building schedule, and previous delays, it was requested that the Hearing Examiner give consideration to rendering a Decision within a period less than the 14 day period provided by City Code. The Examiner stated he would take that request into consideration, and called for further testimony in support of, in opposition to,' or comments from staff. There was no one else wishing to speak. In the previous hearing this date for Orillia Property, SA-100-85, Bill Roach representing METRO made a plea for the coordination of effort between the developer, the tenant, the City of Renton and METRO to consider alternatives to traffic impacts, with consideration being given to transit and ridesharing to and" from the site. He requested that his comments be noted for this application also. There being no further testimony, the hearing was closed at 10:30 A.M. FINDINGS, CONCLUSIONS & DECISION:. For purposes of these Decisions and Recommendations the terms "Should" and "Shall" are to be considered mandatory. The term "May' will be considered discretionary. When the report is a recommendation to the City Council the terms "Should" and "Shall" are intended to inform the City Council that if they approve the recommendation the, items should be mandatory to preserve the,intent of the Decision. Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Orillia Property Associates, Limited Partnership, for the Boeing Company, has requested approval of a site plan for 2 two-story buildings containing approximately 153,300 sq feet of office space. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal.' 5. The subject site is located on the north side of the S.W. 39th Street cul-de-sac, just west of Lind Avenue S.W. The site abuts Springbrook Creek. 6. The site was annexed into the City by the adoption of Ordinances 1745 and 1764 which were enacted by the Council in April and May of 1959, respectively. These were amended by the adoption of Ordinance 1928 in December, 1961. The subject site was rezoned to its current classification, M-P (Manufacturing Park) in December, 1969 by the adoption of Ordinance 2533. The site was filled under a special permit issued in November, 1975. 7. The map element of the Comprehensive Plan designates the site for the development of Manufacturing Park/Multiple Option uses, but does not mandate such development without exploring the goals and policies elements of the plan. 8. The applicant proposes developing on the 10.48 acre subject site 2 two- story buildings and parking for 921 autmobiles. 9. The buildings will be concrete tilt-up construction and will contain approximately 153,300 square feet of office space. 10. A railroad right-of-way which runs through the site parallels Springbrook Creek. The rail line and the creek both were utilized when the plat was prepared and therefore, the subject site, which is composed of two separate legal lots, is triangular in shape. Both the rail line and the creek cut a diagonal through this area of the Valley. 11. A number of conditions were placed upon the subject proposal by the ERC as part of the declaration of non-significance. Those conditions require participation in a variety of traffic related improvements including the installation of a traffic signal at Lind and 39th and the payment of a fee of not more than $175.00 per trip for an estimated 1,840 trips. The conditions also required the installation of an asphalt trail and other amenities along the Springbrook Creek, a dedicated public right-of-way immediately west of the subject site. 12. The subject site has been reviewed by staff in conjunction with other proposals to house various operations of the Boeing Company in the immediate area, including a proposal for the site immediately east, as well as those south of the subject site. These adjacent sites, particularly the easterly site, are integrally related to one another and staff reviewed them in that light. 13. The parking lots will function as extensions of one another with links between the two sites. A common dining facility will also be incorporated within one of the two sites. 14. The Boeing Company use of the site is expected to generate a substantial daily vehicle trip count, one in excess of that ordinarily generated by a comparable facility. Boeing typically utilizes floor space to provide a maximum return per employee. As a result, Boeing generally increases its parking requirement by about 20 percent and would generate almost as much additional traffic. • 15. As a result, the Transit arm of the Municipality of Metropolitan Seattle (METRO) has objected to the parking specifications of Boeing, and has requested that Boeing participate in constructive arrangements to reduce what is expected to be large traffic volumes confined to the Valley floor and to mitigate the Levels of Service (LOS) of E and F. "stop and go" and almost stalled traffic flow. • • ' Orillia Property Associate.. SA-106-86 February 5, 1986 Page 4 16. The proposal is expected to house approximately 1,110 to 1,300 employees. The adjoining complex is anticipated to employ a similar number of people. Based upon these numbers, staff has recommended, or imposed, the traffic related conditions already enumerated. Staff has also recommended measures to provide for the recreational needs of at least a segment of these employees. The recommendations include the pavement of the public right-of-way along Springbrook Creek, enhanced seating areas for lunchtime diversion and the incorporation of a 1 acre recreational area at the southwest corner of the site adjacent to the 39th Street cul-de-sac. Staff also recommended the connection through the site of a walkway from the public cul-de-sac to the Springbrook right-of-way. 17. While there will be two driveways with access to 39th from the site, the interior aisleways will continue more or less east/west across the eastern property line providing access through the easterly adjacent site. These links will provide additional access to 39th from the eastern site (SA-100-85), but in addition, will provide access through to Lind Avenue S.W. Staff therefore, recommended, and the applicant agreed, that parking north of proposed building 11 should be eliminated to avoid backing manuevers onto a major interior collector aisle. 18. The triangular shape of the combined parcels results in some of the parking aisles meeting at severely constrained (acute) angles which might interfere with emergency vehicle movements. The railroad alignment through the site also hampers emergency flow. Staff recommended a major crossing at right angles to the track, more or less centered over its length, along with the realignment of aisle intersections. 19. Staff also recommended carrying the interior pedestrian sidewalks through to the public sidewalks. 20. Depending upon security needs, staff was concerned that the site not take on the appearance of a fortification, and that any fencing be interior'to the peripheral landscaping, and thereby softened so the area appears like an office park. CONCLUSIONS 1. The proposed Site Plan, when viewed together with the adjacent site, appears to serve the public use and interest. 2. While the site is being developed as though it were one legal lot, and actually is being developed very much in conjunction with the easterly lot, the subject site is in fact 2 separate legal lots. The current commitment does not necessarily provide assurances for future modifications. The properties could be separated in future sales or leases. Therefore, parking and or lot lines should be modified to provide each building its requisite allotment of parking. 3. Along similar lines, which unfortunately have not been explored but should be a matter for future consideration, the compartmentalization of services or amenities, such as the 1 acre recreational complex proposed on the subject site, a cafeteria for the adjacent site, etc., does not address the potential severance of the linkage between sites in the future. These issues though would have to be explored, if such division occurred, and therefore, while the site plan is approved, it is approved based upon the current proposed linkage. 4. Modifications, generally as shown on Exhibit #2, to the parking stalls shall be required to assure access around the buildings and through the site for emergency vehicles. These modifications will also provide for safe access across the site by vehicles circulating through the parking lot and from this site across to the companion parcel east of this site. 5. While the applicant has' agreed to provide the traffic improvements required by the ERC, the site will still generate a substantial amount of cars. The additional parking, over standard requirements, will serve as an invitation for employees to utilize individual vehicles, rather than explore alternative transporation, including car pools and public mass transit. Even with the extensive improvments envisioned, amounting to expenditures of up to 20 to 40 Million Dollars ($20 - $40,000,000), the Level of Service is anticipated to be LOS E/F, that is, the roads will be very congested. Therefore, the applicant shall have to provide a tranporation coordinator who shall have to have the positive responsibility of working with Metro Transit and its Car Pool/Van Pool agency and the City of Renton to coordinate programs to minimize the number of separate automobile trips (known as single occupancy vehicles. SOV) generated by this and its associated adioin ng proposai. • Orillia Property Associate. SA-106-86 February 5, 1986 Page 5 6. Frankly, while this office has dabbled in requiring an applicant to provide van pool vehicles, the efforts were cumbersome and difficult to police. Therefore, without more this office will refrain from imposing such requirements:- This office will forward the response of Metro in this matter to the City Council and to the Mayor's Office for their considered review. 7. The actual building design, although details are limited, appears compatible with surrouding development in scale. While it might be reasonable to provide a focal point such as a plaza, fountain, or rotary as others have provided in recent plans proposed for properties in the vicinity, the 1 acre recreational area and the provision of a public access easement between 39th and the Springbrook Creek public right-of-way shall serve as a reasonable amenity. It might have been nice to orient Building 12 with a landscaped connection to the Creek amenity so near the site. 8. This Office cannot be expected to ignore the existing Boeing complex immediately north of the Central Business District and its general appearance. It is not an office park type of development like that envisioned by the Comprehensive Plan for the Green River Valley. This office will also not ignore such a complex's needs for security. As staff indicated, the Valley is supposed to be developed with an eye toward achieving aesthetic, appealing office park type development - campus-type development around a spacious plaza, with buildings relating to each other and taking advantage of natural site amenities. _ Lind Ave is one of the major north/south connectors and is the premier entry point to the Valley from the north. This site and its companion site lie just north of the Valley's major interchange with SR-167, and provide an entry point into Renton's proposed area for campus-type office park development. The site lies immediately adjacent to Springbrook Creek which can be developed into a serious, well designed public amenity. Therefore, to assure the development presents the office park appearance which the Comprehensive Plan requires, and which other development along Lind has been required to provide, if security fencing is installed, it shall be required to be adjacent to the perimeter parking and interior to the required landscaping. The landscaping shall be of such a nature as to hide and fully soften the appearance of any security fencing and shall be subject to the approval of the City's landscape architect. The landscaping shall.consist of a conbination of lawn, scrubs, and both flowering deciduous and conifer trees. This theme shall be consistent along the entire perimeter of the site, including along the Springbrook Creek frontage, and shall be carried through the adjoining site. Site Plan SA-100-85. 9. In the event fencing is not required, landscaping, subject to the approval of the City's Landscape,Architect shall consist of a combination of lawn, trees and shrubs. 10. The Environmental Review Committee (ERC), under their substantive authority [Section 4-2822(D)] recommends to the decision maker, the Hearing Examiner, that the application for site plan approval to allow the construction of two buildings totaling 153,300 square feet of office space on 10.48 acres located on the north side of S.W. 39th Street at the 800 block is subject to the following conditions: 1. Installation of intersection improvements at Lind Ave. S.W. and S.W. 39th Street including a traffic signal and lane widening per Public Works Department approval. 2. In addition to the outside eating/recreational area provided, the developer shall provide on-site recreation to either include an exercise room, gym area, or similar function inside of one of the buildings or outside a tennis court, basketball, or sports court or similar area. 3. Installation of off-site recreational improvements along the east side of Springbrook Creek from S.W. 34th Street to S.W. 41st Street to include (1) 12-foot wide asphalt trail capable of supporting emergency vehicles built to both Park's and Public Works' Department standards, (2) two benches, and (3) twelve trees to be located by the Parks Department. The Public Works Department shall submit to the ERC by January 27, 1986, an area-wide traffic and circulation study bounded by South 180th on the south, SR-167 on the east, SR-181 on the west, and I-405 on the north, along with the extension of Oakesdale Avenue S.W. to SR-900. The study shall identify (1) a circulation system adequate to accommodate motor vehicle traffic locally generated in the study area at build-out office park intensity, (2) the total estimated cost of that system; (3) the total trip generation associated with said office park development, (4) an estimate of the per trip cost of constructing the system, (5) a list of those elements of the system which have already been constructed or committed to by pending developers and who receives credit (on a trip basis) for the cost of that construction; and (6) a prioritization of the construction projects needed in the immediate future to minimize the impact of developments currently being proposed in the study area. 5. Participation in area-wide traffic improvements identified by the above traffic study to the project's proportionate share based upon estimated daily traffic generation as calculated by standards established in the Institute of Traffic Engineers Trip Generation Manual. The ultimate costs per vehicle trip shall not exceed $175 per trip. (Estimated 1,840 vehicle trips). 6. Credit for adjacent signalization at S.W. 39th Street and Lind Avenue S.W. will be credited against the project's projected proportionate impact and for other scheduled area-wide improvements if the applicant proceeds to complete instead of the City constructing those improvements. The Environmental Review Committee finds that the following facts are true of the proposed project: 1. The addition of 1,840 vehicle trips to the anticipated 2,144 vehicle trips associated with Phase I construction and a 980-space parking lot that provides 70% of the parking for the adjacent 266,000 square feet of office to the south is significant and requires mitigation. The project represents approximately 30% of all anticipated traffic on S.W. 39th Street. 2. The addition of approximately 1,000 employees to the planned 2,500 employees in the adjacent 7 other office buildings creates a dramatic need for year-round on-site recreation. The outdoor eating area attempts to address some of the recreational needs of the on-site employees, but it focuses only on one aspect -- lunch. Other recreational activities must be introduced to serve the anticipated recreational needs of the employees. 3. The adjacent pedestrian corridor to the west along Springbrook Creek has been designated for public pedestrian use. Since it is an adjacent public right-of-way, it should be developed at the time of any development of any of the adjacent properties. Fred J. The City of Renton must identify area-wide traffic circulation and improvement needs to provide continued public accessibility to individual privately owned properties. Without this formal identification by the City, the general level of service will continue to decline as a result of incremental adverse impacts resulting from private development. 5. The previous traffic evaluation conducted late in 1984 was based on a land use assumption of a much greater percentage of warehouse use and a lower intensity of office park uses. Actual and proposed development is office park in nature and this use generates significantly more traffic in addition to the general shift in type of vehicle trips. As a result a revised traffic study is necessary to reflect changing circumstances. 6. The total anticipated development by Boeing Electronics Company, Boeing Computer Services, and Boeing Commercial Airplane Company within the general traffic study area represents a known impact of 1.1 million square feet of office space and possibly 6,500 employees. This represents a doubling of 1984 employment in the study area. Therefore, the Boeing Corporation is a major contributor to present impacts and the ultimate impacts of full industrial development of the study area. The Boeing Corporation must therefore be a significant contributor to the solution. Therefore, the above conditions are necessary as a minimum for the preservation of the welfare and safety of the general public and a minimum to mitigate the adverse environmental impacts of the proposal. Under Section 4-2822(D), the decision maker must accept these conditions as binding upon his ultimate decision unless he identifies in writing a substantial error in fact or conclusion by the Environmental Review Committee. The decision maker then has the option of asking the ERC for reconsideration or revising the conditions. The applicant also has the ability to request reconsideration of these conditions from the ERC or appeal these conditions directly to the Hearing Examiner under authority granted in Section 4-2823(A)(1)(a) within 14 days of the date that the DNS is final. The City of Renton must identify area-wide traffic circulation and. improvement needs to provide continued public accessibility to individual privately owned properties. Without this formal identification by the City. the general level of service will continue to decline as a result of incremental adverse impacts resulting from private development. 5. The previous traffic evaluation conducted late in 1984 was based on a land use assumption of a much greater percentage of warehouse use and a lower intensity of office park uses. Actual and proposed development is office park in nature and this use generates significantly more traffic in addition to the general shift in type of vehicle trips. As a result a.revised traffic study is necessary to reflect changing circumstances. 6. The total anticipated development by Boeing Electronics Company, Boeing Computer Services, and Boeing Commercial Airplane Company within the general traffic study area represents a known impact of 1.1 million square feet of office space and possibly 6,500 employees. This represents a doubling of 1984 employment in the study area. Therefore, the Boeing Corporation is a major contributor to present impacts and the ultimate impacts of full industrial development of the study area. The Boeing Corporation must therefore be a significant contributor to the solution. Therefore, the above conditions are necessary as a minimum for the preservation of the wolfare and safety of the general public and a minimum to mitigate the adverse environmental impacts of the proposal. Under Section 4-2822(D). the decision maker must accept these conditions as binding upon his ultimate decision unless he identifies in writing a substantial error in fact or conclusion by the Environmental Review Committee. The decision maker then"has the option of asking the ERC for reconsideration or revising the conditions. This expansion of 153,000 square feet is the second phase of development of the BECO relocation into the City of Renton. The initial phase was the remodeling of approximately 266,000 square feet of the Benaroya Business Park located to the south along with the construction of a 1,000 stall parking lot to service the new complex. 2. The development will introduce between 1,100 and 1,300 employees into the area and represent approximately 30 percent of the anticipated traffic! generated on S.W. 39th Street. 3. The Environmental Review Committee has issued a declaration of non-significance. The appeal period for their declaration will expire on I Monday. January 27, 1986, at 5 p.m. In addition, the Environmental Review l Committee imposed the following conditions under the substitive authority [Section 4-2822(D)]: 1. In the review of a site plan, the staff and the Hearing Examiner should normally consider the following criteria: • Compatibility of Adjacent Structures • Compliance with the Comprehensive Plan and Zoning Code • Access • Functionality of Parking Lot • Traffic Circulation • Usable Public Open Space • On-site Recreation Compatibility of Adjacent Structures The area between S.W. 43rd Street and S.W. 34th Street lying between Oakesdale Avenue S.W. and Lind Avenue S.W. has basically been acquired by BECO through Orillia .Property Associates to create one large industrial/office facility. The only intrusion into that area is Reliable Distributors located on the southwest corner of Lind Avenue S.W. and S.W. 34th Street. The intent is to create an industrial park for one corporate entity. Presently, BECO has remodeled the four buildings to the south of the site into office structures and constructed a major parking lot. The approximately 11.7 acres to the east of the subject site will be developed into another three office buildings (SA-100-85). The proposed structures will, therefore, blend with most of the adjacent office type structures presently proposed for the east and possibly in the future proposed for the north. PRELIMINARY REPORT ." THE HEARING EXAMINER • ORILLIA PROPERTY ASSOCIATES, FILE NO. SA-106-86 JANUARY 28, 1986 PAGE 4 Compliance with the Comprehensive Plan and Zoning Code: The proposed office/industrial development follows the basic intent of the Comprehensive Plan and its land use designation of Manufacturing/Multiple Option. This is not,in the area envisioned for heavy office concentration, btit the general development of Boeing is introducing some new higher intensity uses into the region than anticipated. The proposed site design as projected complies with the specifics 'of the Comprehensive Plan and the Manufacturing Park zone classification. Access Access is provided for the general public from two directions. The first is from the south from S.W. 39th Street and the other is from the adjacent lot to the east. Since the entire project will function under one corporate operation, the access interties appear appropriate. Emergency access will also be provided from the east and south. Functionality of the Parking Lot The parking lot has severe design problems as a result of the lot configuration, of the original plat. The original plat suggested individual development, but now combining the lots together the shapes create major design complications. The major problem is the triangular shape of building lot #11. The turning radii inside the lot do not comply with the Fire Department standards and create the public safety problem. Probably the best way to improve the access situation is to create a plaza that can be utilized for emergency vehicles between proposed buildings #11 and #12. This would not only provide emergency access but eliminate some of the more severe turning radii problems on the site. In total, it is estimated that the site plan revision would eliminate ten (10) parking spaces to allow proper turning radii. One additional design problem can be seen in that the major east-west access proposed on the north side of building #11. Motor vehicles will be backing out directly onto the aisleway along the south side. It would be more appropriate to eliminate all parking along the north side (south side.of the, access aisle) of the building and create a separated internal traffic corridor, that links through the adjacent side,on the east to Lind Avenue S.W. The applicant has provided more than the required parking for the anticipated building space. This appears to be a requirement of the Boeing Corporation to overpark their site as a result of general corporate policy. Traffic Circulation On-site traffic circulation with' some modifications will allow access to adjacent public streets. Off-site traffic circulation is becoming critical and thus the Environmental Review Committee has required participation in the general traffic circulation and transportation upgrading necessary for the{ valley subregion. BECO will be introducing in less than one year almost twice the number of workers presently employed'in 'the Valley. Pedestrian Circulation The site does not generally provide adequate pedestrian circulation. It is noted that the site plan does not locate sidewalks in the most convenient locations for access. It does not address either the necessary pedestrian interconnection with the office buildings to the east or the required pedestrian link to the Springbrook Pedestrian Corridor in the southwest corner of the subject site from S.W. 39th Street. This is a public easement that must be built to City standards and allow public access. { PRELIMINARY REPORT 1 u 1HE HEARING EXAMINER ORILLIA PROPERTY ASSOCIATES, FILE NO. SA-106-86 JANUARY 28, 1986 PAGE 5 Usable Public Open Space: The site plan provides a very small amount of outdoor open space. It appears that the applicant considers the outdoor eating/sitting area on the parcel adjacent to the east as servicing both complexes. On-Site Recreation: In the review of site plans in the Valley, the staff in the past has not focused on the intent of the Recreational Element of the Valley Comprehensive Plan. This is the first instance where the Parks and Recreation Department has projected a formal position of private enterprise providing on-site recreation. The Valley Plan includes the following policies that are applicable to private developments: 1. Provision of recreational opportunities should be an integral part of the development of the Valley. 2. Recreational opportunities in the Valley that serve both the employees and the community should be encouraged. 3. Firms with large numbers of employees should develop outdoor recreation facilities. 4. Whenever feasible, greenbelt/openspace and wildlife habitats should be managed to include recreational opportunities as a secondary objective. The ERC has required that the developer do substantial improvements along the Springbrook Pedestrian Walkway along with some form of on-site recreation. The Walkway is a "public" pedestrian access and could probably never be closed; therefore, it seems reasonable to locate most outdoor recreation adjacent to the walkway to meet the intent of the first recreational policy. It would also seem reasonable since the walkway will eventually be in the center of the BECO industrial plant an adjoining recreational area could serve both the employees and the general public. 5. In conclusion, the proposal appears to met the public interest by implementing the Comprehensive Plan and Zoning Code. Both major and minor revisions are warranted to improve both pedestrian and traffic circulation; manuevering in the parking lot; and on-site open space and recreational areas. H. DEPARTMENT RECOMMENDATION: Based upon the above analysis, it is recommended that the Hearing Examiner approve the site plan request, File Number SA-106-85, by Orillia Property Associates, Limited Partnership subject to the following conditions: 1. Creation of a plaza inbetween the buildings straddling the railroad tracks to provide an emergency access turn-around and a pedestrian link between the two proposed buildings. 2. Remove and relocate the parking on the south side of the primary east-west access aisle so there are no parking spaces backing onto this access corridor. • 3. Introduction of a one (1) acre recreational area adjacent to the pedestrian walkway. This will provide recreational opportunities for the office workers on the south side of Springbrook Creek. The area shall include both passive and active recreational areas in the plan. The design shall be approved by the Parks and Recreation Department and it must be open to the public. 4. Redesign the site plan to include a separate pedestrian circulation system that links the site with the sidewalk along S.W. 39th-Street, the office complexes to the east, and the public pedestrian walkway along Springbrook Creek. First of all, this department is concerned that the great amount of construction' in the Green River Valley is not only impacting our present park system but will eventually result in , the need for construction of a major park in the area as well as a system of trails for jogging and walking. The City's Comprehensive Park and Recreation Plan (1984) states as a major need for the Green River Valley, "The City should monitor • development of the area for potential joint recreation efforts with the private sector". We feel that because of the large number of employees to be housed in the noted two buildings as well as adjacent office buildings to be constructed, and because of the site's proximity to the Springbrook Creek Greenbelt and Pedestrian Easement, the Orillia application offers an excellent chance to begin to meet the obvious need for recreational opportunities. We, therefore, recommend the following: 1. The applicant should install some type PP of on-site recreation to serve the entire Boeing complex. This can be either located inside one of the buildings (exercise room, gym area) or outside (tennis courts, basketball court, etc.) as well as an outdoor picnic • area. w MEMORANDUM Environmental Review Committee January 8, 1986 Page Two 2. Additionally, the applicant should install an eight foot wide asphalt trail (per Park Depart- ment standards) along the east side of Spring- brook Creek from Oaksdale Avenue to S.W. 34th Street. Additionally, two benches should be installed along the trail (per Park Department standards) and twelve trees at locations chosen by this department. The trail will accommodate jogging and walking for employees and will eventually be extended in both directions and can potentially hook up to the P-1 Channel system of trails. EH:ms cc: John E. First of all, this department is concerned that the great amount of construction in the Green River Valley is not only impacting our present park system but will eventually result in the need for construction of a major park in the area as well as a system of trails for jogging and walking. The City's Comprehensive Park and Recreation Plan (1984) states ,as a major need for the Green River Valley, "The City should monitor development of the area for potential joint recreation efforts with the private sector". We feel that because of the large number of employees to be housed in the noted two buildings as well as adjacent office buildings to be constructed, and because of the site's proximity to the Springbrook Creek Greenbelt and Pedestrian Easement, the Orillia application offers an excellent chance to begin to meet the obvious need for recreational opportunities. We, therefore, recommend the following: 1. The applicant should install some type of on-site recreation to serve the entire Boeing complex. This can be either located inside one of the buildings (exercise room, gym area) or outside (tennis courts, basketball court, etc.) as well as an outdoor picnic area. • p r A MEMORANDUM Environmental Review Committee January 8, 1986 Page Two 2. Additionally, the applicant should install an eight foot wide asphalt trail (per Park Depart- ment standards) along the east side of Spring- brook Creek from Oaksdale Avenue to S.W. 34th Street. The Public Works Department shall submit to the ERC by January 27, 1986, an area-wide traffic and circulation study bounded by South 180th on the south, SR-167 on the east, SR-181 on the west, and I-405 on the north, along with the extension of Oakesdale Avenue S.W. to SR-900. The study shall identify (1) a circulation system adequate to accommodate motor vehicle traffic locally generated in the study area at build-out office park intensity, (2) the total estimated cost of that system; (3) the total trip generation associated with said office park development, (4) an estimate of the per trip cost of constructing the system, (5) a list of those elements of the system which have already been constructed or committed to by pending developers and who receives credit (on a trip basis) for the cost of that construction; and (6) a prioritization of the construction projects needed in the immediate future to minimize the impact of developments currently being proposed in the study area. 5. Participation in area-wide traffic improvements identified by the above traffic study to the project's proportionate share based upon estimated daily traffic generation as calculated by standards established in the Institute of Traffic Engineers Trip Generation Manual. The ultimate costs per vehicle trip shall not exceed $175 per trip. (Estimated 1,840 vehicle trips). 6. Credit for adjacent signalization at S.W. 39th Street and Lind Avenue S.W. will be credited against the project's projected proportionate impact and for other scheduled area-wide improvements if the applicant proceeds to complete instead of the City constructing those improvements. The Environmental Review Committee finds that the following facts are true of the proposed project: 1. The addition of 1,840 vehicle trips to the anticipated 2,144 vehicle trips associated with Phase I construction and a 980-space parking lot that provides 70% of the parking for the adjacent 266,000 square feet of office to the south is significant and requires mitigation. The project represents approximately 30% of all anticipated traffic on S.W. 39th Street. 2. The addition of approximately 1,000 employees to the planned 2,500 employees in the adjacent 7 other office buildings creates a dramatic need for year-round on-site recreation. The outdoor eating area attempts to address some of the recreational needs of the on-site employees, but it focuses only on one aspect -- lunch. Other recreational activities must be introduced to serve the anticipated recreational needs of the employees. 3. The adjacent pedestrian corridor to the west along Springbrook Creek has been designated for public pedestrian use. Since it is an adjacent public right-of-way, it should be developed at the time of any development of any of the adjacent properties. Fred J. Actual and proposed development is office park in nature and this use generates significantly more traffic in addition to the general shift in type of vehicle trips. As a result a revised traffic study is necessary to reflect changing circumstances. 6. The total anticipated development by Boeing Electronics Company, Boeing Computer Services, and Boeing Commercial Airplane Company within the general traffic study area represents a known impact of 1.1 million square feet of office space and possibly 6,500 employees. This represents a doubling of 1984 employment in the study area. Therefore, the Boeing Corporation is a major contributor to present impacts and the ultimate impacts of full industrial development of the study area. The Boeing Corporation must therefore be a significant contributor to the solution. Therefore, the above conditions are necessary as a minimum for the preservation of the welfare and safety of the general public and a minimum to mitigate the adverse environmental impacts of the proposal. Under Section 4-2822(D), the decision maker must accept these conditions as binding upon his ultimate decision unless he identifies in writing a substantial error in facto or conclusion by the Environmental Review Committee. The study shall identify (1) a circulation system adequate to accommodate motor vehicle traffic locally generated in the study area at build-out office park intensity, (2) the total estimated cost of that system; (3) the total trip generation associated with said office park development, (4) an estimate of the per trip cost of constructing the system, (5) a list of those elements of the system which have already been constructed or committed to.by pending developers and who receives credit (on a trip basis) for the cost of that construction; and (6) a prioritization of the construction projects needed in the immediate future to minimize the impact of developments currently being proposed in the study area. 5. Participation in area-wide traffic improvements identified by the above traffic study to the project's proportionate share based upon estimated daily traffic generation as calculated by standards established in the Institute of Traffic Engineers Trip Generation Manual. The ultimate costs per vehicle trip shall not exceed $175 per trip. (Estimated 1,840 vehicle trips). 6. Credit for adjacent signalization at S.W. 39th Street and Lind Avenue S.W. will be credited against the project's projected proportionate impact and for other scheduled area-wide improvements if the applicant proceeds to complete instead of the City constructing those improvements. The Environmental Review Committee finds that the following facts are true of the proposed project: 1. The addition of 1,840 vehicle trips to the anticipated 2,144 vehicle trips associated with Phase I construction and a 980-space parking lot that provides 70% of the parking for the adjacent 266,000 square feet of office to the south is significant and requires mitigation. The project represents approximately 30% of all anticipated traffic on S.W. 39th Street. 2. The addition of approximately 1,000 employees to the planned 2,500 employees in the adjacent 7 other office buildings creates a dramatic need for year-round on-site recreation. The outdoor eating area attempts to address some of the recreational needs of the on-site employees, but it focuses only on one aspect -- lunch. Other recreational activities must be introduced to serve the anticipated recreational needs of the employees. 3. The adjacent pedestrian corridor to the west along Springbrook Creek has been designated for public pedestrian use. Since it is an adjacent public right-of-way, it should be developed at the time of any development of any of the adjacent properties. Fred J.
