SUMMARY OF REQUEST: Approval to allow the construction of a building having approximately 3000 square feet of space. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval. Hearing Examiner Decision: Approved with conditions. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on June 11, 1986. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on June 17, 1986, at 9:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit #2 - Site Plan. Exhibit #3 Elevation/Floor Plan. The above exhibits were entered and Roger Blaylock, Zoning Administator, presented the proposal. The applicants request Site Plan approval to permit the construction of a retail sales building on a 9900 sq. ft. lot in a B-1 zone. The mezzanine area will be a storage area and will not be occupied for retail space. The site was rezoned in 1985: utilities are available to the site; and the site will be located at what will soon be one of the busiest intersections in the City. In the original rezone the ERC required a dedication of 10 ft. as shown on the Site Plan in red, and the landscaping will be complete when the street is widened and then will be landscaped to the curb line. Mr. Blaylock advised the application was accepted on April 11, 1986 previous to the new Site Plan procedures placed in effect on April 17, 1986. The previous rezone of the site required site plan approval so this application is being processed under the old Site Plan Ordinance (although this proposal would comply with both the old and new Site Plan Ordinance). He said the building will be in the northeast corner with parking on the west and south sides: access is provided off adjacent properties by way of easements coming into the site, and exiting will be onto a public alley: there will be 14 parking spaces provided: and a sidewalk in front of the building may be adjusted to permit sufficient turning radius for the cars. Continuing, Mr. ,Blaylock stated the City has not required the applicant to participate in the widening of the street as they believe the dedication of the street is sufficient at this time. He said the proposal is appropriate, complies with the Comprehensive Plan and zoning, and meets the design criteria. It was noted that the proposal will be a maximum development of the site based upon the necessary parking and building limitations. The use for the site has not been definitely determined but it is thought may be either a retail store or a delicatessen. In closing, the Zoning Administrator recommended approval of the request subject to conditions submitted in the staff report. - Woody and Rose Woodall SA-031-86 June 30, 1986 Page 2 Calling for testimony in support of the proposal from the applicant or their representative, responding was: Larry Brown 13975 Interurban Avenue Seattle, Washington, 98168 Mr. Brown agreed with the staff report and recommendations as presented and clarified that the parking overhang problem has already been corrected with the expansion of the width of the parking spaces along N.E. 6th Street by 2 ft.. He feels the intent is to provide grass in the 10 ft. dedicated right-of-way area on an interim basis, until such time as the City or Boeing decides to widen Park Avenue. Referring to access on Park Avenue it was stated the easement in place now between the two parcels indicates a 47 ft. wide easement area of which about 30 ft. is for driveway purposes. The reason was to provide utilization of a small site and provide an access point as far away from the intersection as possible. Mr. Brown said at the present time there are no plans to share access with the northern property owner in order to provide a barrier between the two driveways to separate the two different uses. Continuing, Mr. Brown referred to the vacation of the alley which was a part of the rezone in 1985. He said according to City staff, by granting a building permit the use of the alley will always be protected for this particular development. This is important because the adjacent property owner has a discretionary right, by title, to the alley should they ever wish to vacate the alley and take possession from the City subject to the granting back of easements for utilities. That would close off the alley and the subject building would be locked in without any access available. This could happen due to the procedure used when the alley was initially dedicated. He noted this should be addressed at the time of the Site Approval process. This information was discovered when the applicant tried to vacate the alley and went through a title search. The adjacent property owner (Pac Car) was unwilling to relinquish those rights so the idea of vacating the alley was terminated. There was no one else in attendance to testify for or against this proposal. There were no other comments from staff. The hearing was closed at 9:40 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicants, Woody and Rose Woodall, have requested approval of a Site Plan for an approximately 3,000 sq ft building on an approximately 9.900 sq ft lot. 2. The application file containing the application. the State Environmental Policy Act (SEPA) documentation. the Building and Zoning Department Report. and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. There was no opposition to the subject proposal from any member of the public. 6. The subject site is located at the northeast corner of the intersection of Park Avenue North and North Sixth Street, just southeast of Mothers Park. 7. The building will actually contain approximately 4,200 sq ft of finished floor space within a structure with a 3,000 sq ft footprint. 8. The building will be a two story affair with a setback on the second floor. - Woody and Rose Woodall ' SA-031-86 June 30, 1986 Page 3 9. A one-way circulation pattern through the site will be established. Entry will be via Park Avenue. and the exit would be via the alley immediately abutting the site on the east. The alley deadends north of the site so access would be provided south to North 6th Street. 10. The site will contain fourteen parking spaces, the number required for the proposed use. As designed, the parking stalls along N. 6th will overhang the landscaping which is not permitted. Staff has recommended the relocation of parking appropriately. 11. The site is part of the original townsite of Renton. The site was zoned H-1 (Heavy Industry) when zoning was first adopted in 1953. The site was reclassified in early 1986 to its current B-1 zoning by the adoption of Ordinance 3987. 12. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of heavy industrial uses, but does not mandate such development without consideration of other policies of the plan. 13. Perimeter landscaping has been provided along the street frontages of Park and N. 6th. Corner plantings will also be provided. CONCLUSIONS 1. While relatively uninspired, the proposed use of the small lot probably accomplishes the applicants' aims. Development of the site will increase the tax base of the City and will offer additional employment opportunities. 2. . The parking will have to be adjusted in order to avoid conflicts with the landscaping. 3. Since the applicant intends to utilize the alley for primary egress from the site, the applicant will have to pave the alley to City standards. 4. The use of the alley by the applicants will probably preclude any future vacation attempt by the adjoining property owner, which previous action demonstrates would be entitled to sole possession. DECISION The Site Plan is approved subject to modification of the parking configuration. subject to approval of the Building and Zoning Department and subject to the paving of the alley to City standards. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and .the_.Examiner may. after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made- in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. For purposes of these decisions and recommendations the terms "Should" and "Shall" are to be considered mandatory. The term "May" will be considered discretionary. Water: A .6-inch water main is located along North Sixth Street adjacent to the subject site. b. The applicants, Woody and Rose Woodall, are seeking site plan approval to allow the construction of a retail sales building having approximately 4,200 square feet of space on a 9,900 square foot lot in the B-1, Business Use, zone. 2. The Environmental Review Committee has issued a memorandum of concurrence. This restates their position that the proposal has a negative impact upon the environment. 3. The application was received on April 11, 1986. It was being processed as a requirement of the original rezone reconsideration under file R-088-$5. On April 17. 1986, the new site plan ordinance went into effect. This included new criteria for review of any site plan request. There is some argument that the proposal, since it was received before the ordinance went into effect, should be judged under the old criteria. However. review of the application shows that the proposal would meet the intent of • either set of criteria that was utilized. 4. Specifically looking at the criteria in Ordinance No. 3981, the proposal complies with the general criteria. It does not create major impacts on surrounding properties and uses. It can be considered a maximum utilization . of the site. In addition, the circulation and access is a joint effort uitilizing the adjacent property to the north and the public alley to the east for • access. In fact, by not having access on the subject site, it provides la safer sight distance as it relates to the intersection of Park Avenue North and North Sixth Street. Signage on the site will be limited.by the sign code, but the one freestanding sign might be supplemented by wall-mounted signs on the building. Various City departments have reviewed the site plan and pointed to technical issues that can be resolved as part of the building plans review. These generally fall in the area of drainage, street lighting and the filing of required deeds for public right-of-ways. 5. Design issues of the proposal focus on access and parking. The applicant has calculated the parking based upon portions of spaces. In actuality, 14 spaces are required with 14 spaces being provided. The applicant has also obtained an access easement over the adjacent property to the north which is included in the record file to provide a shared access for PRELIMINARY REPORT THE HEARL.. SA-031-86 JUNE 17, 1986 PAGE 3 both the proposed commercial building and Kenney's Auto Rebuild to the north. _ The parking that faces North Sixth Street overhangs two feet into the required landscaping. Either the landscaping will have to be increased by two feet or curb stops provided so that the landscaping required is clear. This will not substantially impact the driving aisle since it is 30 feet wide. 6. The landscaping plans adequately address the subject site except for the right-of-way that will be deeded to the City along Park Avenue North. The applicant is responsible for landscaping all areas behind the curb on their site. The landscape plans will have to be modified to specifically address that area prior to the issuance of a building permit. 7. In conclusion. the proposal appears appropriate. It complies with the Comprehensive Plan and specific zoning for the subject site and meets the design requirements of all of the ordinances of the City of Renton. It should be noted that the proposal is the maximum potential of the subject site based upon the necessary parking and building location. The Policy Development Department states that they believe that the proposal is an underutilization of the site because of the scale of the adjacent uses. In fact. if we were looking at scale, the Building and Zoning Department would agree'that it is in comparison to scale its neighbors. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the site plan approval request by Woody and Rose Woodall. file SA-031-86. be approved subject to the following conditions: 1. Paving of the adjacent alley to City standards. 2.
